[Excerpt] "Liberty. Security. Both are essential to a good life. But of course, neither is absolute, and at times circumstances demand that a society trade some measure of liberty for security. The tricky part is deciding when and how to draw the line."

Mining Pm2.5 And Traffic Conditions For Air Quality, Xu Du, Aparna S. Varde
Mining Pm2.5 And Traffic Conditions For Air Quality, Xu Du, Aparna S. Varde
Department of Computer Science Faculty Scholarship and Creative Works
Fine particle pollution is related to road traffic conditions. In this work, we analyze Particulate Matter with a diameter less than 2.5 micrometers, calledPM2.5, along with traffic conditions. This is done for multicity data to study the relationships in the context of environmental modeling. The goal behind this modeling is to support prediction of PM2.5 concentration and resulting air quality. We deploy data mining algorithms in association rules, clustering and classification to discover knowledge from the concerned data sets. The results are used to develop a prototype tool for the prediction of PM2.5 and hence air quality for public health …
From Culture Shock To Cultural Adaptation: A Workbook For International Students, Gregory R. Sugajski
From Culture Shock To Cultural Adaptation: A Workbook For International Students, Gregory R. Sugajski
Master's Projects and Capstones
San Francisco’s complex communal tapestry can lead to cultural disorientation, dislocation, and unfamiliarity for recently arrived F-1 and M-1 international students, a series of events that when related to problematic adaptation issues and negative adjustment implementations is known as culture shock. Easing the adaptation process for this population is considered to be of academic importance from a progressive, economic, sociocultural, and intercultural perspective. Thus, the organizing purpose and principle of the project is to enable cultural adaptation for students who reside in San Francisco by instilling in them proximal, behavioral, and situational safety awareness. The project takes the form of …
Regulating Aesthetics Of Coastal Maine: Kroeger V. Department Of Environmental Protection, Nancy Walworth
Regulating Aesthetics Of Coastal Maine: Kroeger V. Department Of Environmental Protection, Nancy Walworth
Ocean and Coastal Law Journal
In Kroeger v. Department of Environmental Protection, the Maine Supreme Judicial Court, sitting as the Law Court, held that the Department of Environmental Protection (DEP) had appropriately denied a private landowner a permit to build a dock. Out of nine permitting criteria enforced by the DEP, the court held that the structure would violate one criterion: the unreasonable interference with the scenic uses of Somes Sound. The majority cited the enjoyment of the Sound by boaters and recreationalists, as well as the nearby tourist attraction of Acadia National Park as factors supporting the area’s scenic use. The majority found that …
Beyone Conservation: Excessive Legislative Regulation Of Commercial Fishing In Cherenzia V. Lynch, Hillary Bouchard
Beyone Conservation: Excessive Legislative Regulation Of Commercial Fishing In Cherenzia V. Lynch, Hillary Bouchard
Ocean and Coastal Law Journal
In Cherenzia v. Lynch, several commercial fishermen filed suit to challenge the constitutionality of a Rhode Island statute that prohibits the use of a self-contained underwater breathing apparatus (SCUBA) to harvest shellfish at four coastal ponds in the state. On cross motions for summary judgment, the trial court granted the plaintiffs' motion and the State filed a timely appeal to the Supreme Court of Rhode Island. The supreme court was asked to address whether the fishermen's equal protection and due process rights were infringed upon by the statute; it found in the negative and reversed the decision of the trial …
Kaneohe Bay Cruises V. Hirata: Are Commercial Jet Skiers In Hawaii And Endangered Species?, Daniel W. Walker
Kaneohe Bay Cruises V. Hirata: Are Commercial Jet Skiers In Hawaii And Endangered Species?, Daniel W. Walker
Ocean and Coastal Law Journal
The beautiful coastal waters of Hawaii teem with boaters much of the year. Adding to the congestion is the increasing use of thrill craft, more commonly known as the "Jet Ski" or personal water craft. The thrillcraft market has grown enormously since these items were first introduced in 1970. Over 300,000 thrill craft are in operation today throughout the United States. Heavy thrill-craft use has also given rise to an increase in boating-related accidents and fatalities. Due to the increase in injuries and harm to the environment, many states and communities are passing legislation strictly regulating or banning the use …

Strahan V. Linnon: A Missed Opportunity For Testing The Use Of Section 7(A)(1) As An Action-Forcing Provision, Amber Shell Ward
Ocean and Coastal Law Journal
In its 1997 decision, Strahan v. Linnon, the United States District Court for the District of Massachusetts summarily rejected the claims of Max Strahan, a whale enthusiast and citizen activist. Following two occasions upon which a United States Coast Guard vessel struck and killed an endangered Northern Right whale' Strahan brought numerous claims, alleging various violations under the Endangered Species Act (ESA) and other relevant environmental statutes. The defendants, namely the United States Coast Guard and the National Marine Fisheries Service (NMFS), were granted summary judgment on every count. Although the court's decision was reasonable in light of applicable case …

At Point Blank Range: The Genesis And Implementation Of Lethal Removal Provisions Under The Marine Mammal Protection Act, Nina M. Young, Stephanie Mairs, Suzanne Iudicello Martley
Ocean and Coastal Law Journal
In 1994, Congress reauthorized the Marine Mammal Protection Act (MMPA). As part of the reauthorization, a coalition of environmental organizations, animal welfare groups, commercial fishing industry representatives, and Alaska Natives, assisted by a professional facilitator, developed a negotiated proposal to govern the incidental take of marine mammals during commercial fishing operations. A subgroup of the negotiating parties also met to address the issue of pinniped predation on declining salmon stocks. This subgroup proposed to Congress a multiphased process to evaluate whether all feasible methods of nonlethal deterrence had been tried, and whether the target marine mammals were responsible for the …
State Oil Spill Prevention Laws And Intertanko: When Is State Law Preempted?, Paul H. Avery
State Oil Spill Prevention Laws And Intertanko: When Is State Law Preempted?, Paul H. Avery
Ocean and Coastal Law Journal
Seeking declaratory and injunctive relief, the International Association of Independent Tanker Owners (INTERTANKO), a trade association of tanker operators, brought suit in 1996 against Washington State and local enforcement officials who enforced Washington's Best Achievable Protection (BAP) Regulations. INTERTANKO challenged the constitutionality of the BAP Regulations by asserting that federal regulations and maritime law preempted its provisions: "Article VI of the Constitution provides that the laws of the United States shall be the supreme law of the land;... State laws notwithstanding." RITERTANKO founded its preemption theory upon: (1) conflict preemption, whereby a State law is invalid if it stands as …

The three companies are: (1) Downeast LNG, which seeks to develop a terminal at Robbinston, Maine; (2) Quoddy Bay LLC, which seeks to develop an LNG terminal on Indian tribal land at Sipayik, Maine; and (3) North East Energy Development Company LLC, which seeks to develop a terminal on the Saint Croix River (a tributary to Passamaquoddy Bay) at Red Beach in Calais, Maine. To deliver the LNG to any one of these terminals, a 300-meter-long …
Spills Of National Significance And State Nullification, Russell V. Randle
Spills Of National Significance And State Nullification, Russell V. Randle
Ocean and Coastal Law Journal
In May 2010, at President Obama’s request, outgoing Coast Guard Commandant Thad Allen delayed his retirement and became National Incident Commander for the response to the Deepwater Horizon oil spill, serving until the conclusion of the emergency at the end of September 2010. From that experience, Admiral Allen observed what he called “social and political nullification” of the National Contingency Plan (NCP) arising from public hostility to the responsible party and demands of state and local political officials for more active roles in the response. The NCP is the federal regulation governing oil and hazardous substance response under the Oil …

The Value Of A Pelican: An Overview Of The Natural Resource Damage Assessment Under Federal And Louisiana Law, Melissa Trosclair Daigle
Ocean and Coastal Law Journal
On April 20, 2010, the drilling rig Deepwater Horizon exploded while finishing an oil well located approximately fifty miles off the coast of Louisiana. When the rig sank two days later, oil began pouring into the Gulf of Mexico. The well was capped with a temporary device on July 15, 2010, and declared “effectively dead” on September 19, 2010, but states and local governments along the Gulf of Mexico will continue to see untold amounts of damage to property and natural resources as oil that is suspended in the water column or lying on the seafloor washes up on land. …

Deepwater Liquefied Natural Gas Ports And The Shifting U.S. Liquefied Natural Gas Market, Sean T. Dixon
Deepwater Liquefied Natural Gas Ports And The Shifting U.S. Liquefied Natural Gas Market, Sean T. Dixon
Ocean and Coastal Law Journal
The United States has been historically at the “end of the pipeline” for liquefied natural gas (LNG) and regular imports are needed in some regions to augment seasonal shortages in supply. Because the United States has become a more significant producer of natural gas (highest in the world), regional markets here tend to no longer rely on LNG cargoes for gas supply. According to the Energy Information Administration (EIA), “LNG imports to the United States were generally not viewed as competitive with domestic supplies of natural gas and pipeline imports from Canada through the 1980s and 1990s.” In the early …

Is Registering As An Animal Abuser In Illinois Abusive To The Offender? An Examination Of The Proposed Illinois Animal Abuse Registry, Alisha L. Biesinger
Southern Illinois University Law Journal
This Comment explains why the proposed animal abuse registry in Illinois should not be passed because it pushes constitutional limitations, is impractical, and would be ineffective in meeting its goals. It first discusses background information on animal abuse registries, including Illinois’ proposed registry, and other relevant Illinois registries. The Comment then discusses the constitutional limits any registry in Illinois faces and focuses on how the proposed animal abuse registry pushes the constitutional bounds of due process. Lastly, the Comment analyzes the problems associated with an animal abuse registry in Illinois, most notably the lack of financial resources in Illinois and …
