Neuroscience And Criminal Law: Have We Been Getting It Wrong For Centuries And Where Do We Go From Here?, Elizabeth Bennett
Neuroscience And Criminal Law: Have We Been Getting It Wrong For Centuries And Where Do We Go From Here?, Elizabeth Bennett
Fordham Law Review
Moral responsibility is the foundation of criminal law. Will the rapid developments in neuroscience and brain imaging crack that foundation—or, perhaps, shatter it completely? Although many scholars have opined on the subject, as far as I have discovered, few come from a front-line perspective.

When Empathy Bites Back: Cautionary Tales From Neuroscience For Capital Sentencing, Sheri Lynn Johnson, Amelia Courtney Hritz, Caisa Elizabeth Royer, John H. Blume
Fordham Law Review
This Article examines the implications of emerging neuroscientific findings regarding empathy for capital trials. We have approached this task with caution because neuroscientists’ understanding of the human brain is still evolving. As with any new field, if neuroscience is completely trusted before it is thoroughly tested, there is a risk of embracing the new phrenology. Given the state of the research, our advice to defense lawyers is quite modest, but we believe that there are some important lessons for lawyers, judges, legislators, and other stakeholders in the capital punishment system.

People who are more avoidant of pathogens are more politically conservative, as are nations with greater parasite stress. In the current research, we test two prominent hypotheses that have been proposed as explanations for these relationships. The first, which is an intragroup account, holds that these relationships between pathogens and politics are based on motivations to adhere to local norms, which are sometimes shaped by cultural evolution to have pathogenneutralizing properties. The second, which is an intergroup account, holds that these same relationships are based on motivations to avoid contact with outgroups, who might pose greater infectious disease threats than …
Assessing Diversity Among Corporations In Brazil: An Exploratory Study, Helga Sheyla Pereira
Assessing Diversity Among Corporations In Brazil: An Exploratory Study, Helga Sheyla Pereira
Theses and Dissertations
The purpose of this thesis is to explore what corporations in Brazil, whether with Brazilian headquarters or not, are doing in regards to communicating their diversity practices and initiatives to the public. Understanding these companies' positions on diversity can paint a better picture of how much Brazil has advanced on diversity in the workplace matters, since the topic started coming about in discussions in the 1990s (Fleury, 2000). A sample of 15 companies was selected from Exame magazine "Melhores e Maiores Ranking 2014" (2015), and a content analysis of each company's website was performed during the summer of 2016, based …
Creativity & Religion: A Self-Study Of Mormon Mindset In The Art Classroom, Shon Scot Feller
Creativity & Religion: A Self-Study Of Mormon Mindset In The Art Classroom, Shon Scot Feller
Theses and Dissertations
A high school art teacher investigates the relationship of his religious beliefs with his notions of what it means to be creative. This Mormon teacher examines his religious and experiential life through self-study, by drawing from autoethnographic and hermeneutic phenomenological strategies. He believes that everyone, including himself and his students, has a creative potential. He also analyzes how his Mormon religion affects his view of creativity and how creativity has affected his behavior as a Mormon. The conclusions he reaches uncover the need for balance between his creative self and his Mormon self and outlines several ways to merge these …

Don't End Or Audit The Fed: Central Bank Independence In An Age Of Austerity, Neil H. Buchanan, Michael C. Dorf
Don't End Or Audit The Fed: Central Bank Independence In An Age Of Austerity, Neil H. Buchanan, Michael C. Dorf
Cornell Law Faculty Publications
The Federal Reserve (the Fed) is the central bank of the United States. Because of its power and importance in guiding the economy, the Fed's independence from direct political influence has made it a target of ideologically motivated attacks throughout its history, with an especially aggressive round of attacks coming in the wake of the 2008 financial crisis and ongoing today. We defend Fed independence. We point to the Fed's exemplary performance during and after the 2008 crisis, and we offer the example of a potential future crisis in which Congress falls to increase the debt ceiling to show how …
Einsiedeln On The Ohio Overseas Migrations Of Einsiedeln People To The United States In The 19th And Early 20th Centuries, Heinz Nauer
Swiss American Historical Society Review
Between 1850 and 1950, more than 3,000 men and women from Einsiedeln went overseas, most of them to the United States. It was not unique since many people also migrated from other regions of Switzerland, and the total migrations of Swiss overseas during that time represented only a very small fraction of the global movement of people in three main directions: from Europe to the Western Hemisphere, from India and southern China to Southeast Asia, and from Russia to the Far East. 1 Despite not being out of the ordinary, it seems useful to explore the history of overseas migrations …

Country Roads, Take Me Home ... To My Friends: How Intelligence, Population Density, And Friendship Affect Modern Happiness, Norman P. Li, Satoshi Kanazawa
Research Collection School of Social Sciences
We propose the savanna theory of happiness, which suggests that it is not only the current consequences of a given situation but also its ancestral consequences that affect individuals’ life satisfaction and explains why such influences of ancestral consequences might interact with intelligence. We choose two varied factors that characterize basic differences between ancestral and modern life – population density and frequency of socialization with friends – as empirical test cases. As predicted by the theory, population density is negatively, and frequency of socialization with friends is positively, associated with life satisfaction. More importantly, the main associations of life satisfaction …

Exploring Connections Between Advanced And Secondary Mathematics, Erin E. Baldinger, Eileen Murray, Diana White, Shawn Broderick, Nicholas Wasserman
Department of Mathematics Faculty Scholarship and Creative Works
The second meeting of this Working Group continues to explore questions about the connections between abstract algebra and school mathematics. Our goal is to focus in on questions around the way in which teachers’ practice might be influenced based on their understanding of such connections. In particular, we will gather interested individuals in an effort to deepen our understanding of existing connections between abstract algebra and secondary mathematics and which of these connections are important for secondary teachers to know and understand. Moreover, we aim to further research in this area by first considering connections between abstract algebra and school …

Discipleship Counseling: Developing Healthy, Growing, Multiplying Followers Of Jesus, James Albritton
Doctoral Dissertations and Projects
This project will look at how professional or lay counseling can increase the effectiveness of making and maturing followers of Jesus. An effective strategy for disciple-making that targets the whole person will be established to help followers of Jesus overcome the emotional pain due to past sin and hurts which have left them ineffective and stagnant in their growth as disciples. Research will be conducted through articles, websites, and books dealing with the subject as well as a survey of at least 50 pastors to determine whether a clear process of disciple-making exists in their church and if any form …

Judging Knowledge In The Digital Age: The Role Of External-Memory Organization, Kristy A. Hamilton, Kevin Mcintyre, Paula T. Hertel
Psychology Faculty Research
Two studies examined relations between features of external-memory repositories (personal computers) and confidence in knowing. Participants judged their confidence in knowledge related to their work or studies and then answered questions about the way they store and use information. Participants who maintained more organized repositories were more confident in their knowledge. Furthermore, moderation analyses showed that the participants who navigated through their files by manually clicking through folders to find documents, but not those who use an automated search feature, felt more knowledge confident if they maintained a well-organized electronic repository. These results provide evidence for relation between assessments of …

Alcohol Use Variability In A Community-Based Sample Of Nonstudent Emerging Adult Heavy Drinkers, Cathy Lau-Barraco, Abbly L. Braitman, Amy L. Stamates, Ashley N. Linden-Carmichael
Psychology Faculty Publications
BACKGROUND: While nonstudent emerging adults are at elevated risk for experiencing alcohol-related problems, there remains a paucity of research devoted specifically to addressing drinking in this group.
OBJECTIVES: The present study sought to offer unique insights into nonstudent drinking by examining drinking variability across 30 days using a retrospective diary method. Specific aims were to: (1) compare within- and between-person variability in alcohol use across 30 days, and (2) determine the extent to which central social-cognitive between-person factors (i.e., social expectancies, perceived drinking norms, social drinking motivations) predict between-person alcohol use as well as within-person variability in drinking.
METHODS: Participants …
The Mapmaker’S Dilemma In Evaluating High-End Inequality, Daniel Shaviro
The Mapmaker’S Dilemma In Evaluating High-End Inequality, Daniel Shaviro
University of Miami Law Review
The last thirty years have witnessed rising income and wealth concentration among the top 0.1% of the population, leading to intense political debate regarding how, if at all, policymakers should respond. Often, this debate emphasizes the tools of public economics, and in particular optimal income taxation. However, while these tools can help us in evaluating the issues raised by high-end inequality, their extreme reductionism—which, in other settings, often offers significant analytic payoffs—here proves to have serious drawbacks. This Article addresses what we do and don’t learn from the optimal income tax literature regarding high-end inequality, and what other inputs might …
Legal Paternalism And The Eclipse Of Principle, R. George Wright
Legal Paternalism And The Eclipse Of Principle, R. George Wright
University of Miami Law Review
Legal paternalism involves, very roughly, requiring persons to do something for their own good. We often think of debates between legal paternalists and non-paternalists as taking place largely at the level of broad, basic principle. This Article argues, however, that in our culture, disputes over the proper scope of legal paternalism will increasingly focus not on issues of basic principle, but on much more detailed, concrete, particular, contextualized matters. The four major reasons for this eclipse of basic principles bearing upon legal paternalism are herein identified, explored, and illustrated.

Team science research has indicated that trust is a critical variable of teamwork, contributing greatly to a team’s performance. Trust has long been examined in health care with research focusing on the development of trust by patients with their health care practitioners. Studies have indicated that trust is linked to patient satisfaction, adherence to treatment, continuity of care, and improved outcomes. We explore the construct of trust using a case example of a patient who received a surgical procedure for a precancerous polyp. We apply the principle of trust to the case as well as present the literature on trust …
Innocent Suffering: The Unavailability Of Post-Conviction Relief In Virginia Courts, Kaitlyn Potter
Innocent Suffering: The Unavailability Of Post-Conviction Relief In Virginia Courts, Kaitlyn Potter
Law Student Publications
This comment examines actual innocence in Virginia: the progress it has made, the problems it still faces, and the possibilities for reform. Part I addresses past reform to the system, spurred by the shocking tales of Thomas Haynesworth and others. Part II identifies three of the most prevalent systemic challenges marring Virginia‘s justice system: (1) flawed scientific evidence; (2) the premature destruction of evidence; and (3) false confessions and guilty pleas. Part III suggests ways in which Virginia can, and should, address these challenges to ensure that the justice system is actually serving justice.

Cultural Threats In Culturally Mixed Encounters Hamper Creative Performance For Individuals With Lower Openness To Experience, Xia Chen, Angela K. Y. Leung, Daniel Y. J. Yang, Chi-Yue Chiu, Zhong-Quan Li, Shirley Y. Y. Cheng
Research Collection School of Social Sciences
Past research has examined independently how openness to experience, as a personality trait, and the situational threat triggered by a foreign cultural encounter affect the emergence of creative benefits from a culture-mixing experience. The present research provides the first evidence for the interactive effect of openness to experience and cultural threat following culturally mixed encounters on creative performance. In Study 1, under heightened perceptions of cultural threat, exposing to the mixing of Chinese and American cultures (vs. a non-mixed situation) made close-minded Chinese participants to perform more poorly in a creative generation task. In Study 2, inducing cultural threat by …
