Criminal Law, Bernadette C. Crucilla Dec 2016

Criminal Law, Bernadette C. Crucilla

Mercer Law Review

As in prior periods, this year's survey of criminal law will include only a few of the most significant cases and statutory amendments. Due to the constant evolution of criminal laws in our society, it is simply not practical to attempt to make note of every legal development. Therefore, the discussion is limited to those changes that will have the widest application and interest to criminal law practitioners for the period from June 1, 2015 through May 31, 2016.

Race And Criminal Justice In Canada, Charles E. Reasons, Shereen Hassan, Melinda Bige, Christianne Paras, Simranjit Arora Dec 2016

Race And Criminal Justice In Canada, Charles E. Reasons, Shereen Hassan, Melinda Bige, Christianne Paras, Simranjit Arora

All Faculty Scholarship for the College of the Sciences

The relationship between race and crime has long been a subject of study in the United States; however, such analysis is more recent in Canada. A major factor impeding such study is the fact that racial/ethnic data are not routinely collected and available in Canada, unlike the United States. The collection of such data would arguably undermine the multi-cultural mosaic of Canada as a place of acceptance and tolerance. However, the lack of such data bellies research suggesting that race plays a role in the Canadian criminal justice system. Using available, albeit, limited research studies and their data, the role …

Avoiding Linguistic Neglect Of Deaf Children, T. Humphries, P. Kushalnagar, G. Mathur, Donna Jo Napoli, C. Padden, C. Rathmann, S. Smith Dec 2016

Avoiding Linguistic Neglect Of Deaf Children, T. Humphries, P. Kushalnagar, G. Mathur, Donna Jo Napoli, C. Padden, C. Rathmann, S. Smith

Linguistics Faculty Works

Deaf children who are not provided with a sign language early in their development are at risk of linguistic deprivation; they may never be fluent in any language, and they may have deficits in cognitive activities that rely on a firm foundation in a first language. These children are socially and emotionally isolated. Deafness makes a child vulnerable to abuse, and linguistic deprivation compounds the abuse because the child is less able to report it. Parents rely on professionals as guides in making responsible choices in raising and educating their deaf children. But lack of expertise on language acquisition and …

Evaluating The Likelihood Of Use Of Bispectral Index Guided Anesthesia As A Strategy To Reduce Postoperative Delirium In Surgical Patients 65 Years Of Age Or Older, Simon Jack Gibson Dec 2016

Evaluating The Likelihood Of Use Of Bispectral Index Guided Anesthesia As A Strategy To Reduce Postoperative Delirium In Surgical Patients 65 Years Of Age Or Older, Simon Jack Gibson

Doctoral Projects

Postoperative delirium (POD) is the most common postoperative complication in the elderly, accounting for approximately $164 billion in costs per year in the United States (Inouye, Westendorp, & Saczynski, 2014, p. 911). This complication occurs in as many as 50% of elderly patients, but can be prevented as much as 40% of the time (Inouye et al., 2014). The use of processed encephalographic monitoring, such as Bispectral Index (BIS) monitoring, to guide anesthetic dosage is the single intraoperative intervention with enough evidence to support it as a recommendation for use to reduce POD (American Geriatrics Society, 2015). There were two …

Efficacy Of Intravenous Ondansetron In Relieving Nausea/Vomiting And Pruritus Post Epidural Administered Opioids In The Obstetric Patient, Benjamin Stephen Butler Dec 2016

Efficacy Of Intravenous Ondansetron In Relieving Nausea/Vomiting And Pruritus Post Epidural Administered Opioids In The Obstetric Patient, Benjamin Stephen Butler

Doctoral Projects

One prominent side effect in the use of a neuraxial anesthesia is pruritus, with an incidence in the obstetric patient of 60-100% (Kumar & Singh, 2013). Another side effect of an epidural placement is nausea and vomiting. Nausea and vomiting occurs frequently during the progress of labor and is difficult to determine an incidence that is related to epidural opioid administration (Chestnut, Wong, Tsen, Ngan Kee, Beilin, & Mhyre, 2014). A review of literature was performed and established evidence that ondansetron is effective in reducing incidence of pruritus in intrathecal administered opioids for cesarean sections in the obstetric patient. The Last 100 Years At Beijing’S Tanzhe Buddhist Temple In Light Of Modern China’S Political And Religious Upheavals, Yuxi Yan Dec 2016

The Last 100 Years At Beijing’S Tanzhe Buddhist Temple In Light Of Modern China’S Political And Religious Upheavals, Yuxi Yan

Senior Theses

In the last hundred years China has undergone massive cultural upheavals. In politics, the old imperial system gave way to Nationalism, then to strict Communism, and recently to a more moderated Communism that is trying to find a balance between state-controlled and free-market economies.

The cry, “destroy temples to build schools,” was first heard in 1898 as various forms of traditional Chinese religion were opposed by new agendas of modernization. For the next hundred years China witnessed what many historians believe to be the severest attack on religion in history. Ian Johnson writes: “Even before the Communist takeover in 1949, …

Opioid Use In The Cesarean Section Patient With The Preoperative Administration Of Intravenous Acetaminophen, Dana Edwards Bernardo

Doctoral Projects

Cesarean sections are one of the most common surgical procedures and there are no current guidelines for the management of postoperative pain control (Darvish, Ardestani, Shali, & Tajik, 2013). Unresolved pain in this population can lead to long lasting problems, such as chronic pain and depression (Booth, Harris, Eisenach, & Pan, 2015). The goal of multimodal therapy with IV acetaminophen for CS mothers was to ensure a rapid and safe recovery process with reduced adverse complications and shortened hospital length of stay. The independent t-test was used to compare the mean time for length of stay, first request of pain …

This study seeks to develop a statistically valid and reliable scale to empirically measure the quality of the in-flight experience that a passenger would witness on a commercial airline flight within the United States. Actual consumers from the general public were used for each of the five stages of the process, along with input from aviation experts, to …

Spiritual Direction With Children The Next Natural Step In The Christian Historical Progression Of Children's Spiritual Formation, Lacy Finn Borgo Dec 2016

Spiritual Direction With Children The Next Natural Step In The Christian Historical Progression Of Children's Spiritual Formation, Lacy Finn Borgo

Doctor of Ministry

Children without a listening and guiding companion miss opportunities to build upon their connection with God and others. Historically, from a western Protestant viewpoint, Christians have struggled to understand or acknowledge, much less encourage, the reciprocal nature of a child’s life with God. Supporting the reciprocal nature of a child’s life with God includes acknowledging their full humanity by embracing childhood as a fully human state and therefore their need for a whole person spiritual formation. The institution of Sunday School, Godly Play, and the Children’s Spirituality Movement have each helped us to understand, acknowledge and encourage a child’s life …

The Effects Of Active Learning Technology On Instructors’ Practices And Students’ Engagement And Grades: A Mixed Methods Study, Jeremy C. Van Hof

Department of Teaching, Learning, and Teacher Education: Theses and Other Student Research

Partly in response to university teachers’ changing pedagogies marked by flipping instruction, lecture capture technologies are evolving into active learning systems. Little published research exists on the effects of active learning technology on either teachers or students. This two-phase sequential explanatory mixed methods study details the effects that active learning systems have on instructor practices and on student grades and engagement. Phase one combined quantitative data collection with instructor interviews. Phase one findings show higher student engagement levels correlate with the use of the active learning system only in the presence of very specific, flipped classroom practices. Phase two, a …

Teachers completed the TSES via SurveyMonkey. CLASS observations were conducted …

Perceptions Of Significance Regarding Prenatal Care Among Multiparous Maternal Patients, Susan E. Wurzer Gustafson Dec 2016

Perceptions Of Significance Regarding Prenatal Care Among Multiparous Maternal Patients, Susan E. Wurzer Gustafson

Education Doctoral

Pregnancy, with the inherent need for prenatal care, is a global condition. Research has demonstrated a positive relationship between maternal adherence to prenatal care with associated maternal, fetal, and delivery outcomes of pregnancy. Non-adherence has been shown to increase risks of maternal and fetal morbidity and mortality. Despite the importance of care, maternal adherence to prenatal care is problematic, pervasive, and persists without an identified etiology. Research to identify a causation for maternal nonadherence has focused upon groups of women with shared traits or circumstance as a predisposing risk. The aim of this study was to identify how adherent multiparous …

Job Applicants' Information Privacy Protection Responses: Using Socia Media For Candidate Screening, John R. Drake, Dianne Hall, J. Bret Becton, Clay Posey

Faculty Publications

For human resource (HR) departments, screening job applicants is an integral role in acquiring talent. Many HR departments have begun to turn to social networks to better understand job candidates’ character. Using social networks as a screening tool might provide insights not readily available from resumes or initial interviews. However, requiring access to an applicants’ social networks and the private activities occurring therein—a practice currently legal in 29 U.S. states (Deschenaux, 2015)—could induce strong moral reactions from the job candidates because of a perceived loss of information privacy. Subsequently, such disclosure requests could induce job candidates to respond in a …

Opportunities For Innovation: Game-Based Learning In An Engineering Senior Design Course, Erica B. Walker Dec 2016

Opportunities For Innovation: Game-Based Learning In An Engineering Senior Design Course, Erica B. Walker

All Dissertations

Game-based learning is a novel approach for teaching a studio design course, especially in engineering. As a field, engineering is innovative by nature but has a strong emphasis on thinking in a logical, analytical, organized, and structured way. This way of thinking serves graduates well, but professional engineers also need to be able to think creatively, problem solve, and work well with a team (ABET, 2014; Felder, 1996; Herrmann, 1995; Lumsdaine & Lumsdaine, 1995; Shuman, Besterfield-Sacre, & McGourty, 2005; Walesh, 2012).

This study compared two sections of a Bioengineering Senior Design course. The control section was taught primarily with seventy-five …

Hiv Testing Avoidance: A Comparison Of Psychosocial Factors Affecting Hiv Testing In Gay And Bisexual Men, Devon Michelle Price

Master's Theses

This paper explores the role three psychosocial factors influence an at-risk individual’s decision to get tested for HIV. Two of the psychosocial factors, HIV stigma and fatalistic beliefs regarding an HIV positive diagnosis, have been well documented in the literature on HIV testing and psychosocial barriers. However, the third psychosocial factor, the tendency to avoid threatening information, has not been studied in relation to HIV testing. The present paper seeks to explore how each of these factors impact both past and present HIV testing behaviors in gay and bisexual identified men. HIV stigma and fatalistic beliefs related to an …
