Adult Entertainment Film Contracts: To Enforce Or Not To Enforce?, Elizabeth Lin Jan 2016

Adult Entertainment Film Contracts: To Enforce Or Not To Enforce?, Elizabeth Lin

Cardozo Journal of Equal Rights & Social Justice

The note argues that adult entertainment film contracts should be enforceable, as the consideration—whether in the form of performance, waiver of privacy, or sexual intercourse—meets legal standards. It posits that evolving social norms and legal precedents, such as the legalization of adult entertainment and the enforceability of cohabitation agreements, support the validity of these contracts, despite historical opposition due to public policy concerns.

My Hair Is Not Like Yours: Workplace Hair Grooming Policies For African American Women As Racial Stereotyping In Violation Of Title Vii, Dawn D. Bennett-Alexander, Linda F. Harrison Jan 2016

My Hair Is Not Like Yours: Workplace Hair Grooming Policies For African American Women As Racial Stereotyping In Violation Of Title Vii, Dawn D. Bennett-Alexander, Linda F. Harrison

Cardozo Journal of Equal Rights & Social Justice

This article argues that workplace discrimination based on hair grooming policies disproportionately impacts African American women. The article seeks to establish that natural hair is an immutable characteristic, as is all hair, made mutable by social policies that impose an "acceptable" standard of beauty that was never meant to include or reflect black women. Often placed under workplace or other institutional grooming policies, the article posits that these policies are no more than a continuation of race-based policies that reflect unlawful stereotyping under Title VII and should be eliminated. Lastly, the article proposes a set of questions that test the …

Dirty Laws: A Critique Of The Audiovisual Media Services Regulations 2014 And Section 63 Of The Criminal Justice And Immigration Act 2008, Daniel Haley Jan 2016

Dirty Laws: A Critique Of The Audiovisual Media Services Regulations 2014 And Section 63 Of The Criminal Justice And Immigration Act 2008, Daniel Haley

Cardozo Journal of Equal Rights & Social Justice

The United Kingdom's recently enacted anti-pornography laws, the Audiovisual Media Services Regulations 2014 and section 63 of the Criminal Justice and Immigration Act 2008, are inconsistent with the European Convention on Human Rights, United Kingdom case law, and United Kingdom public policy. The Audiovisual Media Services Regulations 2014, which bans the sale of a wide array of domestically produced pornography, and the Criminal Justice and Immigration Act 2008, which criminalizes the possession of "extreme pornography, " are among the most restrictive anti-pornography laws in the democratic world. These laws were passed in response to the rise of the Internet, which …

Inequity In Private Child Custody Litigation, Dale Margolin Cecka Jan 2016

Inequity In Private Child Custody Litigation, Dale Margolin Cecka

Law Faculty Publications

This article explores the history and implications of a two-tiered system for adjudicating matrimonial-as opposed to nonmatrimonial- custody matters. As the author uncovered by calling every clerk's office in every major city in the country, matrimonial matters are under a different jurisdiction or part of court in nine states.' This differential treatment has implications for the outcome of private custody cases. It also reflects a bias in the administration of justice, based on race and socioeconomic class. Perhaps most importantly, it causes the government and other outside parties (such as court appointed guardians ad litem) to be more involved …

Medical Papers and Journal Articles

Background: Based on our laboratory work and clinical trials we hypothesised that radiotherapy after lumpectomy for breast cancer could be restricted to the tumour bed. In collaboration with the industry we developed a new radiotherapy device and a new surgical operation for delivering single-dose radiation to the tumour bed – the tissues at highest risk of local recurrence. We named it TARGeted Intraoperative radioTherapy (TARGIT). From 1998 we confirmed its feasibility and safety in pilot studies.

Objective: To compare TARGIT within a risk-adapted approach with whole-breast external beam radiotherapy (EBRT) over several weeks.

Design: The TARGeted Intraoperative radioTherapy Alone (TARGIT-A) …

All Care, But Whose Responsibility? Community Juries Reason About Expert And Patient Responsibilities In Prostate-Specific Antigen Screening For Prostate Cancer, C Degeling, S Carter, L Rychetnik

Medical Papers and Journal Articles

General practitioners have implicitly been given responsibility for guiding men’s decisions about prostate-specific antigen–based screening for prostate cancer, but patients’ expectations of the bounds of this responsibility remain unclear. We sought to explore how well-informed members of the public allocate responsibilities in prostate-specific antigen screening decision-making. In 2014, we convened two Community juries in Sydney, Australia, to address questions related to the content and timing of information provision and respective roles of patients and general practitioners in screening decisions. Participants in the first jury were of mixed gender and of all ages (n = 15); the participants in the second …

Van Driel, Simon Morgan, Amanda Tapley, Lawrie Mcarthur, Patrick Mcelduff, Lucy Yardley, Anthea Dallas, Laura Deckx, Katie Mulquiney, Joshua S. Davis, Andrew Davey, Kim Henderson, Paul Little, Parker J. Magin

Medical Papers and Journal Articles

Background: Australian General Practitioners (GPs) are generous prescribers of antibiotics, prompting concerns including increasing antimicrobial resistance in the community. Recent data show that GPs in vocational training have prescribing patterns comparable with the high prescribing rate of their established GP supervisors. Evidence-based guidelines consistently advise that antibiotics are not indicated for uncomplicated upper respiratory tract infections (URTI) and are rarely indicated for acute bronchitis. A number of interventions have been trialled to promote rational antibiotic prescribing by established GPs (with variable effectiveness), but the impact of such interventions in a training setting is unclear. We hypothesise that intervening while early-career …

Impact Of Technology On Learning And Scholarship, And The New Learning Paradigm, Arnoud Cyriel Leo De Meyer

Research Collection Lee Kong Chian School Of Business

Recently I took on the challenge of teaching a course to Undergraduate students at Singapore Management University. It had been more than 20 years since I had taught any Undergraduates, having spent most of my career at Graduate Business Schools. I did it partially because many of my younger colleagues had told me that teaching had changed tremendously. Deep down I may have felt that I was perhaps a little out of touch with what happened inside and, as I would soon discover, outside our classrooms. I was indeed intrigued by the experience. When I entered the classroom for my …

The Prevalent And Persistent Virtues Of Autocratic Leadership In The Corporate Sector: An Analysis, Nadya Chishty-Mujahid Jan 2016

The Prevalent And Persistent Virtues Of Autocratic Leadership In The Corporate Sector: An Analysis, Nadya Chishty-Mujahid

Business Review

Nineteenth-century critics ascertained that there were three major modes of leadership: autocratic, democratic, and laissez-faire. These had their origins in the background of leaders and the structures of power within which they were compelled to operate. Although autocratic leadership was a mode normally associated with the military, many corporate leaders of the early twentieth century (tycoons and company heads alike) were seen to employ this form of governance to varying degrees of effect. According to Simon Restubog, “historical observation suggests that as countries moved from nomadic hunting and gathering to settling in towns and producing food, environmental complexity was reduced …

Maize Landraces Are Less Affected By Striga Hermonthica Relative To Hybrids In Western Kenya, Charles A.O. Midega, John Pickett, Antony Hooper, Jimmy Pittchar, Zeyaur R. Khan Jan 2016

Maize Landraces Are Less Affected By Striga Hermonthica Relative To Hybrids In Western Kenya, Charles A.O. Midega, John Pickett, Antony Hooper, Jimmy Pittchar, Zeyaur R. Khan

All Peer-Reviewed Publications

Production of maize in western Kenya is severely constrained by the parasitic weed striga. Although productivity of maize can be improved through adoption of improved varieties, adoption of such varieties remains low in the region, as the majority of smallholder farmers still grow unimproved open-pollinated varieties (landraces). The performance of two improved hybrid varieties was evaluated against six landraces in striga-infested soils in western Kenya. The varieties were planted in plots under natural striga infestation and were supplemented with pot experiments under artificial infestation. Striga emergence was lower in landraces than in the hybrid varieties in both field and pot …

Rage And Social Media: The Effect Of Social Media On Perceptions Of Racism, Stress Appraisal, And Anger Expression Among Young African American Adults, Morgan Maxwell

Theses and Dissertations

Recently, social media has become a sociopolitical hotbed for discussions of racism. However, no extant studies have questioned if social media use increases how often African Americans vicariously and/or personally experience discrimination in America. The current study sought to answer this question. By examining the relationships between social media use, general stress, race-related stress, and anger expression, and the mediating role of perceived racism, this study explored if frequent social media use influences young African American adults’: a) perceptions of racism, b) experiences with general and race-related stress, and/or c) expressions of anger. The current study conducted an online survey …

A Hint And The Incapacity, Jake Reller Jan 2016

A Hint And The Incapacity, Jake Reller

Theses and Dissertations

My paintings are a mediated autobiography focusing on fragmented, cropped or collaged elements derived from photographic sources. Banal scenes based on my experience growing up in rural Washington state are charged with multivalent interpretations via close ups, veiling and intentional obfuscation. Through these means, altered color and expressionistic paint handling, they subtly point outside of their beginnings as the photographic and personal and into a dialogue with historical and social sites such as punk music, abstract expressionism and existential literature.
