Policing In The Era Of Permissiveness: Mitigating Misconduct Through Third-Party Standing, Julian A. Cook Jan 2016

Policing In The Era Of Permissiveness: Mitigating Misconduct Through Third-Party Standing, Julian A. Cook

Scholarly Works

On April 4, 2015, Walter L. Scott was driving his vehicle when he was stopped by Officer Michael T. Slager of the North Charleston, South Carolina, police department for a broken taillight. A dash cam video from the officer’s vehicle showed the two men engaged in what appeared to be a rather routine verbal exchange. Sometime after Slager returned to his vehicle, Scott exited his car and ran away from Slager, prompting the officer to pursue him on foot. After he caught up with Scott in a grassy field near a muffler establishment, a scuffle between the men ensued, purportedly …

The Problem With Free Press Absolutism, Sonja R. West Jan 2016

The Problem With Free Press Absolutism, Sonja R. West

Scholarly Works

In her important new book, The First Amendment Bubble, Professor Amy Gajda exposes the many dangers of this all-encompassing attitude about constitutional rights for the press. Sure, there may have been a time when the news media could demand- and the courts and public would grant near immunity for their work, making free press absolutism relatively costless. Yet Gajda provides example after example demonstrating that the courts no longer give the media a free pass. And as the public and the courts' opinions about the press change, Gajda warns, the news media's thinking about their legal protections must change as …

The 'Uberization' Of Healthcare: The Forthcoming Legal Storm Over Mobile Health Technology's Impact On The Medical Profession, Fazal Khan Jan 2016

The 'Uberization' Of Healthcare: The Forthcoming Legal Storm Over Mobile Health Technology's Impact On The Medical Profession, Fazal Khan

Scholarly Works

The nascent field of mobile health technology is still very small but is predicted to grow exponentially as major technology companies such as Apple, Google, Samsung, and even Facebook have announced mobile health initiatives alongside influential healthcare provider networks. Given the highly regulated nature of healthcare, significant legal barriers stand in the way of mobile health’s potential ascension. I contend that the most difficult legal challenges facing this industry will be restrictive professional licensing and scope of practice laws. The primary reason is that mobile health threatens to disrupt historical power dynamics within the healthcare profession that have legally enshrined …

Securing Child Rights In Time Of Conflict, Diane Marie Amann Jan 2016

Securing Child Rights In Time Of Conflict, Diane Marie Amann

Scholarly Works

Each term in the title of this essay seems simple, yet provides much food for analytical thought. The essay thus explores: what is “conflict,” and whether there is a “time” when it is not present; who is a “child”; whether and to what extent children enjoy “rights”; and, finally, how local, national, and international regimes go about “securing” those rights. The essay – based on a talk given at the 2015 International Law Weekend in New York – concludes with a glance at a new potential avenue for child security: the Sustainable Development Goals which the U.N. General Assembly adopted …

Black Contemporary Social Movements, Resource Mobilization, And Black Musical Activism, Andrea L. Dennis Jan 2016

Black Contemporary Social Movements, Resource Mobilization, And Black Musical Activism, Andrea L. Dennis

Scholarly Works

In the last few years a grassroots social movement has emerged from the Black community. This movement aims to eliminate police and vigilante violence against Blacks nationwide. Blacks in America have long been subjected to this violence, and the issue has recently captured the country’s attention. Multiple groups are pressing for change, including Ferguson Action, Black Lives Matter, Say Her Name, and the leaderless social media effort organized by DeRay McKesson and Johnetta Elzie, to name a few. These fledgling activist groups have already experienced some success, garnering public attention and government response. As it currently stands, this nascent civil-rights …

In Defense Of The Devil’S Advocate, Lonnie T. Brown

mong the many controversial positions for which Monroe Freedman advocated during his illustrious career, the one that I find most surprising and uncharacteristic is his contention that lawyers who undertake morally questionable representations have a duty to explain or justify their choice of client. Specifically, in 1993 Professor Freedman penned a well-known column in the Legal Times — titled “Must You Be the Devil’s Advocate?” — in which he took Professor Michael Tigar to task for his representation of reputed Nazi war criminal John Demjanjuk. Professor Freedman tacitly criticized Professor Tigar for his client choice and expressly called upon him …

The Media Exemption Puzzle Of Campaign Finance Laws, Sonja R. West Jan 2016

The Media Exemption Puzzle Of Campaign Finance Laws, Sonja R. West

Scholarly Works

In the 2010 case of Citizens United v. Federal Election Commission, the United States Supreme Court solidified the media exemption dilemma in campaign finance law. When attempting to address concerns about corporate campaign expenditures (i.e., corporate political speech), legislatures are now stuck between a rock and a hard place. Regulate media corporations, and they violate press freedoms. Exempt media corporations from the regulations, however, and they are accused of speaker discrimination.

Thus the question of how to treat the press in campaign finance law can no longer be ignored. Can legislatures, without running afoul of the First Amendment, ever regulate …

Police Culture In The Twenty-First Century: A Critique Of The President's Task Force's Final Report, Julian A. Cook

Scholarly Works

In response to a series of events involving police-citizen encounters, including those in Ferguson, Missouri, and Staten Island, New York, that have strained relations between law enforcement and the communities (primarily minority) that they serve, President Barack Obama established a task force charged with developing a set of recommendations designed to improve police practices and enhance public trust. Headed by Charles Ramsey, Commissioner of the Philadelphia Police Department, and Laurie Robinson, former Assistant Attorney General for the U.S. Department of Justice Office of Justice Programs, and currently a Professor of Criminology, Law, and Society at George Mason University, the eleven-member …

History And Social Action: A Study Of Landscpae In The Former Sultanate Of Wolio, Tony Rudyansjah

Antropologi Indonesia

This article addresses the relationship between history and social action in the region of the former Sultanate of Wolio. To put it in a more precise way, the author seeks to demonstrate the multiple ways in which people in the region represent their past and to show how an understanding of history can be seen as a source of moral choices which guides social action. Landscape occupies a central place to examine how people represent their history. People visit certain historical sites not just for pleasure, but because past events and personalities related to these sites continue to exist in …

Ang Filipino Bilang Disiplina: Sakop, Lawak, At Potensiya Ng Pagtuturo Ng Panitikan Kaugnay Ng Bagong Kurikulum Bunsod Ng K To 12, Rebecca T. Añonuevo

Katipunan

Taming The Wild West: Online Excesses, Reactions And Overreactions, Catherine J. Ross Jan 2016

Taming The Wild West: Online Excesses, Reactions And Overreactions, Catherine J. Ross

GW Law Faculty Publications & Other Works

A review essay discussing Danielle Keats Citron’s Hate Crimes in Cyberspace (Harvard University Press 2014) and Amy Adele Hasinoff’s, Sexting Panic: Rethinking Criminalization, Privacy and Consent (University of Illinois Press 2015). Both books consider the risks and harms in cyberspace, blaming of victims, and the interaction between law and online expression. Citron documents widespread hate speech, cyberstalking, revenge porn, and other speech that especially targets women online. Hasinoff, grounded in feminist and cultural studies, emphasizes the positive aspects of the agency girls who sext voluntarily display in exploring and displaying their sexuality, arguing that advising girls that control of their …

Fluorescent Nanocomposite Of Embedded Ceria Nanoparticles In Crosslinked Pva Electrospun Nanofibers, Nader Shehata, Soha Gaballah, Effat Samir, Aya Hamed, Marwa Saad

Biology Faculty Publications

This paper introduces a new fluorescent nanocomposite of electrospun biodegradable nanofibers embedded with optical nanoparticles. In detail, this work introduces the fluorescence properties of PVA nanofibers generated by the electrospinning technique with embedded cerium oxide (ceria) nanoparticles. Under near-ultra violet excitation, the synthesized nanocomposite generates a visible fluorescent emission at 520 nm, varying its intensity peak according to the concentration of in situ embedded ceria nanoparticles. This is due to the fact that the embedded ceria nanoparticles have optical tri-valiant cerium ions, associated with formed oxygen vacancies, with a direct allowed bandgap around 3.5 eV. In addition, the impact of …

Learning Benefits Of A Translation Corpus For Novice Asl-English Interpreters, Daniel R. Roush Jan 2016

Learning Benefits Of A Translation Corpus For Novice Asl-English Interpreters, Daniel R. Roush

EKU Faculty and Staff Scholarship

A preliminary review of the literature reveals that Corpus-Based Translation Studies (CTS) is an established area of research/methodology (Kruger, et al, 2011). Corpus-Based Interpreting Studies (CIS) is still emerging (Setton, 2011). Studies within CTS point to positive benefits of using translation corpora in translator education (Beeby, 2009, among others). In CIS, there are few studies that examine the use of corpora in spoken language interpreter education (Tohyama, et al., 2006). The use of corpora in signed language interpreter education appears to be unexplored.

Novel Spoxazomicins Derived From Streptomyces Sp. Rm-14−6 Attenuate Ethanol Induced Cytotoxicity In Vitro, Meredith A. Saunders

Theses and Dissertations--Psychology

An estimated 13.9% of Americans currently meet criteria for an alcohol use disorder. Ultimately, chronic alcohol use may result in neurological deficits, with up to 85% of alcoholics exhibiting signs of cognitive decline. However, biochemical and behavioral factors contributing to this decline have remained elusive. Our ongoing research program encompasses a multi-tiered screening of a natural product library and validation process to provide novel information about mechanisms underlying these deficits and to identify novel chemical scaffolds to be exploited in the development of pharmacological treatments for alcohol use disorders in a rodent organotypic hippocampal slice culture mode. Experiment 1 sought …

Understanding Alcohol Use Trajectories From Adolescence To Young Adulthood: A Bioecological Approach, Jacqueline A. Bonsu Jan 2016

Understanding Alcohol Use Trajectories From Adolescence To Young Adulthood: A Bioecological Approach, Jacqueline A. Bonsu

Theses and Dissertations--Psychology

The current study sought to better understand how alcohol use patterns develop over the transition to young adulthood by taking a bioecological approach in examining the joint influence of contextual and individual factors on drinking behaviors. Using a longitudinal design to include many factors that likely play key roles in this highly sensitive developmental period (e.g., peer norms, social activities, personality traits, access and exposure to substances), both mean levels of these variables and their change over time were considered in relation to alcohol use trajectories (AUTs). Participants were 525 students ages 18 to 25 recruited from the introductory psychology …

Imc: Its Rhetorical And Philosophical Foundation And Impact, Allison Raemore Peiritsch Jan 2016

Imc: Its Rhetorical And Philosophical Foundation And Impact, Allison Raemore Peiritsch

Electronic Theses and Dissertations

A review of current integrated marketing communication (IMC) literature indicates that IMC has swept the globe. IMC has become the normative marketing practice for organizations to promote their goods and services, as well as an increasingly popular area of academic study. At the same time, literature shows inconsistency in IMC's professional practice and academic instruction. An increasing number of IMC theorists suggest that "true" IMC involves reorienting an organization to become consumer-focused and responsive at every level. This broader vision for IMC points to the discipline's communicative underpinnings. It is dialogic, other-oriented and interpretive in nature, yet most organizations and …
