Desecularization Of The State As A Resistance To The Globalization: A Case Study Of The Criminalization Of Blasphemy In Russia., Artem Profis Jan 2016

Desecularization Of The State As A Resistance To The Globalization: A Case Study Of The Criminalization Of Blasphemy In Russia., Artem Profis

Dissertations and Theses

A cultural aspect of westernization remains in the shadow of widely discussed economic and political ones. While many states are conforming to the Western rules of the global market game, the cultural characteristics and differences are less mutable and thus less easily compromised and resolved than political and economic ones. The dissolution of the U.S.S.R. has left behind a void in the Russian identity. After unsuccessful attempts to assume a Western liberal identity during the first half of the 90s, Russia has opted for tried and tested Orthodox Christianity to fill that void and to form a new post-Soviet Russian …

"Language Preference And Cognitive Availability Of Sexual Identity In Gay Japanese Bilinguals: An Analysis Of Habitual Use Of Linguistic Categories", Sebastian Cordoba Jan 2016

"Language Preference And Cognitive Availability Of Sexual Identity In Gay Japanese Bilinguals: An Analysis Of Habitual Use Of Linguistic Categories", Sebastian Cordoba

Dissertations and Theses

Sexuality is a very private matter in Japan. Japan’s cultural mores and concepts of family unity have led to very conservative attitudes toward homosexuality. For instance, gay people generally fear disgracing their families, and this fear might prevent them from revealing their sexual identity to others, and so keeping it secret. Thus, homosexuality in Japan is a highly controversial topic. Being gay in Japan is not as tolerated as it is in some Western cultures (McLelland, 2000). Homosexuality is an issue that is not acknowledged by mainstream Japanese society – it is taboo and not spoken about publicly. The present …

Evaluating Distributed Word Representations For Predicting Missing Words In Sentences, Saniya Saifee Jan 2016

Evaluating Distributed Word Representations For Predicting Missing Words In Sentences, Saniya Saifee

Dissertations and Theses

In recent years, the distributed representation of words in vector space or word embeddings have become very popular as they have shown significant improvements in many statistical natural language processing (NLP) tasks as compared to traditional language models like Ngram. In this thesis, we explored various state-of-the-art methods like Latent Semantic Analysis, word2vec, and GloVe to learn the distributed representation of words. Their performance was compared based on the accuracy achieved when tasked with selecting the right missing word in the sentence, given five possible options. For this NLP task we trained each of these methods using a training corpus …

The Influence Exposure Has On Consumer Behavior, Ryan M. Farney Jan 2016

The Influence Exposure Has On Consumer Behavior, Ryan M. Farney

CMC Senior Theses

Advertising has been around for thousands of years and has proven to be a valuable asset to company revenue. The methods used in advertising have been examined closely more recently, specifically from a psychological standpoint. The human brain reacts to advertisements in different ways. Low and high involvement advertisements stimulate the brain in the subconscious and conscious state effectively. While each of these advertising methods are useful, complex messaging techniques seem to stimulate recall more effectively than simple messaging. In the age of digital advertising, sponsors look to put new resources to use to ensure paid advertisements are doing their …

Is It Time To Adopt A No-Fault Scheme To Compensate Injured Patients?, Elaine Gibson Jan 2016

Is It Time To Adopt A No-Fault Scheme To Compensate Injured Patients?, Elaine Gibson

Articles, Book Chapters, & Popular Press

The tort system is roundly indicted for its inadequacies in providing compensation in response to injury. More egregious is its response to injuries incurred due to negligence in the provision of healthcare services specifically. Despite numerous calls for reform, tort-based compensation has persisted as the norm to date. However, recent developments regarding physician malpractice lead to consideration of the possibility of a move to “no-fault” compensation for healthcare-related injuries. In this paper, I explore these developments, examine programs in various foreign jurisdictions which have adopted no-fault compensation for medical injury, and discuss the wisdom and feasibility of adopting an administratively-based …

Militarización Y Violencia En Tamaulipas, Guadalupe Correa-Cabrera Jan 2016

Militarización Y Violencia En Tamaulipas, Guadalupe Correa-Cabrera

Public Affairs and Security Studies Faculty Publications

Sovereignty’S Gray Area: The Delimitation Of Air And Space In The Context Of Aerospace Vehicles And The Use Of Force, Matthew T. King Jan 2016

Sovereignty’S Gray Area: The Delimitation Of Air And Space In The Context Of Aerospace Vehicles And The Use Of Force, Matthew T. King

Journal of Air Law and Commerce

Debate over the delimitation of airspace and outer space has persisted since the dawn of the space age, without resolution. With the development of hybrid aerospace vehicles that can operate in and transition between the two zones, the line between their disparate legal regimes will be tested. And this test may not come with an after-the-fact courtroom debate over applicable liability regimes, but rather it may come with a real-time decision made in a military operations center as to whether an aerospace vehicle has violated sovereign airspace and should be shot down. The recent shoot-down of a Russian bomber by …

Re-Designing Law And Lawyering For The Information Age, Thomas D. Barton Jan 2016

Re-Designing Law And Lawyering For The Information Age, Thomas D. Barton

Notre Dame Journal of Law, Ethics & Public Policy

This Article analyzes the intersection of three aspects of law, lawyering, and Information Age technology and culture, describing how they disrupt and inhibit one another even as they supply possible opportunities for each to grow and innovate. The Article urges that Information Age challenges to traditional legal institutions and thinking become the foundation for reforms to legal systems and individual lawyering. In embracing changes made possible by emerging technology, the Rule of Law may be strengthened globally and the Preventive/Proactive style of lawyering can be re-invigorated. The Article begins by describing the Preventive/Proactive lawyering ("PPL") style, and offers an example …

"I Still Live In Guantánamo!" Human Rights Abuses Continue After Detainees Leave Guantánamo, Peter Jan Honigsberg Jan 2016

"I Still Live In Guantánamo!" Human Rights Abuses Continue After Detainees Leave Guantánamo, Peter Jan Honigsberg

Notre Dame Journal of Law, Ethics & Public Policy

This essay will describe the experiences of detainees who have resettled in third or host countries, as well as detainees who have been resettled in their home countries. The essay is based on interviews W2G has filmed with the detainees, in addition to other sources. The overarching message from the interviews and research is that when the U.S. transfers detainees to third countries, the U.S. has not been mindful in finding the best fit or even a suitable environment for the men as they re-enter society. In addition, in transferring detainees out of Guantánamo-whether to third countries or to the …

Note, The Unconstitutionality Of The Computer Fraud And Abuse Act, Michael C. Mikulic Jan 2016

Note, The Unconstitutionality Of The Computer Fraud And Abuse Act, Michael C. Mikulic

Notre Dame Journal of Law, Ethics & Public Policy

This Note deals with 18 U.S. C. 1030, otherwise known as the Computer Fraud and Abuse Act ("CFAA "). The CFAA is the federal computer hacking statute. This Note discusses the statute's history, purpose, and the recent circuit split regarding its interpretation. There are two ways to interpret the statute: one is broad and the other narrow. The broad interpretation, which many, if not a majority of circuit courts adopt, extends criminal liability to potentially millions of unsuspecting Americans. The approach is wholly unfair and unreasonable. But more than that, this Note argues that the broad interpretation is unconstitutional. There …

Note, American, Isis, And Social Media: How The Material Support Statute Can Help Combat Against Their Collision, Morgan Stacey Jan 2016

Note, American, Isis, And Social Media: How The Material Support Statute Can Help Combat Against Their Collision, Morgan Stacey

Notre Dame Journal of Law, Ethics & Public Policy

In this Note, I argue that individuals who support ISIS through encouragement and participation in the recruitment process through social media fall into criminal prosecution under the statute, as they have attempted to provide material support, namely personnel, to the foreign terrorist organization. This support of ISIS through social media is not protected First Amendment speech, as the support turns into an attempt to provide personnel or finances to the group. Part I will focus on ISIS as an organization, its history, and its recruitment strategies. It will discuss ISIS's innovative use of social media for recruitment and its dangerously …

Note, Physician-Owned Distributorships, Jennifer Brougham

Notre Dame Journal of Law, Ethics & Public Policy

The physician-owned distributor ("POD") is one example of the various business entities that have materialized. In recent years, a hot debate has ensued over whether PODs are legitimate business arrangements that offer solutions, or instead exacerbate industry challenges and implicate improper conduct. This Note will assess both sides of the debate and take the position that the harms created by the existence of PODs dwarf any potential benefits. PODs create conflicts of interest and are susceptible to abuse, working against the goals of health care reform-improving quality, affordability, and accessibility. Part I of this Note will provide an overview of …

Granting Exemptions From Legal Duties: When Are They Warranted And What Is The Place Of Religion?, Kent Greenawalt Jan 2016

Granting Exemptions From Legal Duties: When Are They Warranted And What Is The Place Of Religion?, Kent Greenawalt

Faculty Scholarship

In what follows, I focus on when exemptions from legal duties are called for and whether religion should be a crucial ingredient. I concentrate especially on the present controversy over same-sex marriage, and how far people and organizations should be required to afford those couples equal status. But other kinds of exemptions can help us understand various general questions and provide key insights about this intense concern of our time.

My basic conclusions are these: religious convictions and practices do matter but only sometimes should they be legally distinguished from other bases. Considering all that is at stake, certain exemptions …

Promote Interculturalism, Leadership Communication, And Professionalism In Your Students: Success With A Corporate Communication Certificate, Lana W. Carnes, M. M. Robles, F. Awang Jan 2016

Promote Interculturalism, Leadership Communication, And Professionalism In Your Students: Success With A Corporate Communication Certificate, Lana W. Carnes, M. M. Robles, F. Awang

EKU Faculty and Staff Scholarship

Business educators share a common interest in encouraging their students to improve intercultural, leadership communication, and professionalism skills to enable and promote increased fulfillment, character development, and advancement toward graduation, in addition to improving student employability after graduation. While career success depends on the standards and knowledge of character and behavioral traits, much more than on technical knowledge, these attributes define the qualities desired across various professions (Barnhart, 2013) in these three areas. For example, Holmes (2015) found that the values and communication rules of discourse systems may be different from that which is expected in the international workplace.

Provision Of Hospital-Based Palliative Care And The Impact On Organizational And Patient Outcomes, Marisa L. Roczen Jan 2016

Provision Of Hospital-Based Palliative Care And The Impact On Organizational And Patient Outcomes, Marisa L. Roczen

Theses and Dissertations

Hospital-based palliative care services aim to streamline medical care for patients with chronic and potentially life-limiting illnesses by focusing on individual patient needs, efficient use of hospital resources, and providing guidance for patients, patients’ families and clinical providers toward making optimal decisions concerning a patient’s care. This study examined the nature of palliative care provision in U.S. hospitals and its impact on selected organizational and patient outcomes, including hospital costs, length of stay, in-hospital mortality, and transfer to hospice. Hospital costs and length of stay are viewed as important economic indicators. Specifically, lower hospital costs may increase a hospital’s profit …

High Affinity Block Of Icl,Swell By Thiol-Reactive Small Molecules, Sung H. Park Jan 2016

High Affinity Block Of Icl,Swell By Thiol-Reactive Small Molecules, Sung H. Park

Theses and Dissertations

Ebselen (Ebs) is considered as a glutathione peroxidase (GPx) mimetic and primarily thought to function by scavenging intracellular reactive oxygen species (ROS). Previous to our work, Deng et al. (2010a) demonstrated complete block of ICl,swell with 15 microM Ebs following endothelin-1 (ET-1) induced activation of the current in cardiomyocytes. This block was presumed to take effect mainly via the quenching of ROS. Nonetheless, our work with DI TNC1 astrocytes strongly emphasizes that Ebs might function by an alternative mechanism based on its kinetic profile in blocking ICl,swell. Our experiments showed that 45 nM Ebs can fully block …

Involvement Of Signal Peptidase I In Streptococcus Sanguinis Biofilm Formation, Jessica Aynapudi Jan 2016

Involvement Of Signal Peptidase I In Streptococcus Sanguinis Biofilm Formation, Jessica Aynapudi

Theses and Dissertations

Biofilm accounts for 65%-80% of microbial infections in humans. Considerable evidence links biofilm formation to oral disease and consequently systemic infections. Eradication of biofilm-associated infections is important. Streptococcus sanguinis, a Gram-positive bacterium, is one of the most abundant species in oral biofilm. It contributes to biofilm development in oral cavities and is one of the recognized causes of infective endocarditis. To study and identify biofilm genes in S. sanguinis, biofilm formation of 51 mutants was compared with the wild type SK36 strain using crystal violet (CV) staining in a microtiter plate. Confocal laser scanning microscopy (CLSM) and image analysis was …

Filter Performance Under Simulated Real-World Conditions, Qiang Wang Jan 2016

Filter Performance Under Simulated Real-World Conditions, Qiang Wang

Theses and Dissertations

Evaluating the performance of filter media for filtration applications is essential to assure design engineers and users that filter device will deliver promised performance for specific applications under the environmental stress. The study of particle loading characteristics of filter media in the laboratory setting is typically performed under the steady flow conditions, i.e., at the constant particle concentration and flow rate. In reality, filtration products are operated under the situations that the flow rate and mass concentration of particles are varied in time. The success of translating the laboratory data to estimate the performance of filter media in the fields …

Development And Characterization Of Lung Derived Extracellular Matrix Hydrogels, Robert A. Pouliot Jan 2016

Development And Characterization Of Lung Derived Extracellular Matrix Hydrogels, Robert A. Pouliot

Theses and Dissertations

Chronic obstructive pulmonary disease (COPD) including emphysema is a devastating condition, increasing in prevalence in the US and worldwide. There remains no cure for COPD, rather only symptomatic treatments. Due to unique challenges of the lung, translation of therapies for acute lung injury to target chronic lung diseases like COPD has not been successful. We have been investigating lung derived extracellular matrix (ECM) hydrogels as a novel approach for delivery of cellular therapies to the pulmonary system.

During the course of this work we have developed and characterized a lug derived ECM hydrogel that exhibits “injectability,” allowing cells or dugs …

Gender Nonconforming, Transgender, And Transsexual Patient Navigation Of The American Health Care System: Locating A Primary Care Provider, Justin M. Vinneau Jan 2016

Gender Nonconforming, Transgender, And Transsexual Patient Navigation Of The American Health Care System: Locating A Primary Care Provider, Justin M. Vinneau

Theses and Dissertations

This study explores the experiences of gender nonconforming (GNC), transgender, and transsexual (trans) people in the search for a primary care provider in the United States. The current body of literature on transgender health often discusses HIV rates, substance use, mental health/suicide, and few studies have studies primary care seeking behaviors; this study seeks to provide new insight into the primary care (pcp) seeking behaviors of GNC and trans people. The primary theoretical perspectives utilized in this study were West and Zimmerman’s (1987) “Doing Gender” and the Health Beliefs Mode (Ayers et al., 2007; Connor and Norman, 2005; Green and …

An Injectable Stem Cell Delivery System For Treatment Of Musculoskeletal Defects, Shirae Leslie Jan 2016

An Injectable Stem Cell Delivery System For Treatment Of Musculoskeletal Defects, Shirae Leslie

Theses and Dissertations

The goal of this research was to develop a system of injectable hydrogels to deliver stem cells to musculoskeletal defects, thereby allowing cells to remain at the treatment site and secrete soluble factors that will facilitate tissue regeneration. First, production parameters for encapsulating cells in microbeads were determined. This involved investigating the effects of osmolytes on alginate microbead properties, and the effects of alginate microbead cell density, alginate microbead density, and effects of osteogenic media on microencapsulated cells. Although cells remained viable in the microbeads, alginate does not readily degrade in vivo for six months. Therefore, a method to incorporate …

Stains Induce Apoptosis And Autophagy In Primary And Transformed Mast Cells, Patrick A. Paez Jan 2016

Stains Induce Apoptosis And Autophagy In Primary And Transformed Mast Cells, Patrick A. Paez

Theses and Dissertations

Statin drugs are widely employed in the clinic to reduce serum low density lipoproteins (LDLs) in patients with hypocholesteremia. In addition to their cholesterol-lowering effects through HMG CoA reductase antagonism, isoprenyl lipids necessary for membrane anchorage and signaling of small G-proteins are abrogated. We previously found that statins suppress mast cell activation in murine and human cells, suggesting these drugs might be useful in treating allergic disease. While mast cell function is critical to allergic inflammation, mast cell hyperplasia and survival also impact these diseases, and were not studied in our previous work. In this study, we describe Fluvastatin-mediated apoptosis …

The Molecular And Mechanical Mechanisms Of The Age-Associated Increase In The Severity Of Experimental Ventilator Induced Lung Injury, Joseph Ames Herbert Jan 2016

The Molecular And Mechanical Mechanisms Of The Age-Associated Increase In The Severity Of Experimental Ventilator Induced Lung Injury, Joseph Ames Herbert

Theses and Dissertations

Abstract

Background

The majority of patients requiring mechanical ventilation are over the age of 65 and advanced age is known to increase the severity of ventilator-induced lung injury (VILI) and mortality. However, the mechanisms which predispose aging ventilator patients to increased mortality rates are not fully understood.

Pulmonary edema is a hallmark of VILI and the severity of edema increases with age. Ventilation with conservative fluid management decreases mortality rates in acute respiratory distress (ARDS) patients, but has not been investigated in VILI. We hypothesized that age-associated increases in pulmonary edema promote age-related increases in ventilator-associated mortality. Endoplasmic reticulum (ER) …

One Of Us, Farrah T. Al Sulaiman Jan 2016

One Of Us, Farrah T. Al Sulaiman

Theses and Dissertations

With this thesis, I reflect on my identity as a Saudi American. I look at how nonverbal communication through gesture and artifact presents the potential for both communication breakdowns, as well as shared understanding. From the lens of Saudi culture, I consider how gender relations and intra-national tribal factions play a role in the division of society, which my work seeks to overcome, at both the national and global levels. My exhibit, One of Us, interrogates one of the most controversial gestures in contemporary society: veiling. As I discuss the notion of camouflage, I review the types of veils available …
