Copyright Piracy And The Indian Film Industry: A "Realist" Assessment, Arpan Banerjee Jan 2016

Copyright Piracy And The Indian Film Industry: A "Realist" Assessment, Arpan Banerjee

Cardozo Arts & Entertainment Law Journal

In India, the academic discourse surrounding intellectual property (IP) has been marked by great skepticism. Global IP laws have been viewed as a Western imposition detrimental to national interests. In this paper, I will make the case for a "realist" approach to film piracy in India, i.e., an approach that is rooted in legal pragmatism and draws from the New Legal Realism (NLR) movement. I will suggest a rough template for such an approach, referring to seven broad elements: a) international relations realism; b) contextualization of IP; c) contextualization of copyright; d) the views and interests of the film industry …

Tweeting #Justice: Audio-Visual Coverage Of Court Proceedings In A World Of Shifting Technology, Itay Ravid

Cardozo Arts & Entertainment Law Journal

The debate over whether to allow cameras into courtrooms refuses to fade away. In 2015 alone, U.S. federal courts completed a five-year experiment with cameras in courts, New Zealand published new guidelines for audio-visual coverage, and Scotland completely revised its former broadcast policy. These jurisdictions, and others around the globe, constantly struggle to design model practices that successfully balance freedom of the press, transparency, and public access to information, with rights to a fair trial and privacy. The constant need to rethink coverage policies can be attributed in large part to the advancement of technology, providing the media innovative tools …

Massey, Christie Kodama, Kelsey Jarrell, Leah Jacobs, Alexandra Moses, Rebecca Follman, Rosemary Hall

STEMPS Faculty Publications

The school district library supervisor occupies a pivotal position in library and information services programs that support and enhance the instructional efforts of a school district: providing leadership; advocating for the programs; supporting, advising, and providing professional development to building-level librarians; and representing school library programs to stakeholders in the school system and the community at large. With funding from the Institute of Museum and Library Services, the Lilead Project was founded at the University of Maryland in 2011 to "study, support, and build community among school district library supervisors" (Lilead Project n.d.). To gain a better understanding of supervisors--who …

Currency, Elisha M. Emerson Mfa Jan 2016

Currency, Elisha M. Emerson Mfa

All Student Scholarship

The privileged Watters family, David, Winnie, and their 14-year-old daughter, Faye, struggle to adjust their suburban Charlotte lifestyle to fit a much-reduced income. Their fast failure leads them down separate paths: David after enlightenment through Transcendental Meditation, Faye after the power she feels in the company of her handsome Earth Science teacher, and Winnie in a romantic foray to Alaska after buried gold. Currency probes that moment when everything changes size, when initial annoyances shrink and reality resumes a new and disturbing sense of proportion.

Chasing "Plan A": Identity Development Of First-Generation College Student-Athletes, Alexandra Warner Jan 2016

Chasing "Plan A": Identity Development Of First-Generation College Student-Athletes, Alexandra Warner

Electronic Theses and Dissertations

Student-athletes competing at the university level face a unique set of stressors, pressures, and experiences. While all students will inevitably face difficulties transitioning from high school to post-secondary education, collegiate athletes bear the burden of balancing at least two demanding public roles, student and athlete, along with other interpersonal relationships, such as friendships, familial ties, and connections with teammates and coaches. The current study examines the identity development of college student-athletes and the challenges they face as they transition into and through their involvement in higher education and intercollegiate sports. This project in particular focuses on how the gendered experiences …

Rethinking Drinking: A Paradigm Shift For Estimating Social And Behavioral Harm, Thomas Hall Jan 2016

Rethinking Drinking: A Paradigm Shift For Estimating Social And Behavioral Harm, Thomas Hall

Electronic Theses and Dissertations

This study challenges old saws about negative consequences attributed to alcohol use. Previous research findings associate negative social and behavioral consequences with alcohol consumption, as if college students only do regrettable things when they are drunk. Typical research related to negative consequences and alcohol use relies on retrospective self-reporting. Investigators often frame negative consequences as outcomes of problematic drinking or, as more commonly labeled, "binge drinking." In the nomenclature of prevention, binge drinking is not a direct measure of alcohol use resulting in intoxication; it is a hypothetical tipping point, predicting an increased likelihood of the incidence of negative consequences …

Preparing For The Inevitable: Sensemaking In Parent-Child Discussions Of Death, Carrie Ann Wartmann Jan 2016

Preparing For The Inevitable: Sensemaking In Parent-Child Discussions Of Death, Carrie Ann Wartmann

Electronic Theses and Dissertations

Death is something everyone will eventually encounter, yet American society has a tendency to avoid or deny death in everyday life and language. Death makes people uncomfortable, and many view it as a topic too complex for children to understand. Children, however, witness big and little deaths in their lives: of pets, relatives, plants, and favorite fairy tale characters. When a child experiences a death, he or she may have questions for parents or other trusted adults which our current avoidance-geared society does not prepare adults for. Children exist in a specific cultural context, and learn rules and expectations of …

A Patriot For Men: The Politics Of Masculinity In John Osborne's "A Patriot For Me", Joshua Kelly Jan 2016

A Patriot For Men: The Politics Of Masculinity In John Osborne's "A Patriot For Me", Joshua Kelly

All Master's Theses

By applying David Savran’s scholarship on the politics of masculinity to John Osborne’s play A Patriot for Me (1965), I demonstrate that Osborne exemplified contradictory sexual politics in the play, and was criticized as homophobic and praised as revolutionary in similarly contradictory original reviews. I argue that play very much typifies the heteronormative politics of masculinity by placing a dominant homosexual (Redl) as protagonist, and inverts the positions of the period woman and the staged effeminate man. Redl is historically represented as a heroic homosexual, but is actually a heteronormative object. I provide evidence for this interpretation by employing Savran …

Burnt Offerings: How The City Of Angels Engulfed Any And All Involved In The Rodney King Affair And Los Angeles Riots, Michael P. Mcnamara Jan 2016

Burnt Offerings: How The City Of Angels Engulfed Any And All Involved In The Rodney King Affair And Los Angeles Riots, Michael P. Mcnamara

Pell Scholars and Senior Theses

This thesis analyses the first modern case of police brutality and race relations - the beating of Rodney King and the 1992 Riots that followed. The roots of the gravity of this situation can be found in the the leadership of the city during that time. The thesis tells the story of the juxtaposition of the black, Democratic Mayor of Los Angeles (Tom Bradley) and the white, Republican Los Angeles Police Chief (Daryl Gates). Though both have a very mixed legacy, both men were highly effective in their respective fields and goals. It is their inability to work together and …

This Master of Arts by Research investigates the role of new media in influencing familyarchive materiality and what effect this has on the performance of memory. The aim is to examine through creative arts praxis how installation art illuminates the participatory engagement of family archive materiality to mediate our mnemonic processes. The source materials for this project stem from my family archives dating from the early 1900s to 2013, and include photographs, 35mm slides, VHS tapes, audiotapes and personal items. The significance of this research lies in the creative outcomes that have occurred through the investigative and critical dialogues between …

Celestial Sources For Random Number Generation, Erin Chapman, Jerina Grewar, Tim Natusch Jan 2016

Celestial Sources For Random Number Generation, Erin Chapman, Jerina Grewar, Tim Natusch

Australian Information Security Management Conference

In this paper, we present an alternative method of gathering seed data for random number generation (RNG) in cryptographic applications. Our proposed method utilises the inherent randomness of signal data from celestial sources in radio astronomy to provide seeds for RNG. The data sets were collected from two separate celestial sources, and run through the SHA-256 algorithm to deskew the data and produce random numbers with a uniform distribution. The resulting data sets pass all tests in the NIST Statistical Test Suite for random data, with a mean of 98.9% of the 512 total bitstreams from the two sources passing …

Understanding And Combatting Terrorist Networks: Coupling Social Media Mining With Social Network Analysis, Benn Van Den Ende Jan 2016

Understanding And Combatting Terrorist Networks: Coupling Social Media Mining With Social Network Analysis, Benn Van Den Ende

Australian Information Security Management Conference

Throughout the past decade the methods employed by terrorist organisations have changed drastically. One of these key changes has been associated with the rise of social media such as Facebook, Twitter, YouTube and blogging in general. Terrorist organisations appear to be using the wide reach and vast network capabilities created by social media to disseminate propaganda, radicalise susceptible individuals, recruit potential fighters and communicate strategic and operational objectives. However, this growing terrorist presence on Social Media can also offer invaluable insights into the social networks of terrorist organisations through the use of Social Media Mining and Social Network Analysis. By …

The Consumer-Based Brand Equity Development In The Australian Luxury And Upscale Hotel Sector, Sharon Shan Jan 2016

The Consumer-Based Brand Equity Development In The Australian Luxury And Upscale Hotel Sector, Sharon Shan

ECU Posters

A main strategy for a luxury or upscale hotel to succeed in a competitive market is to develop a strong brand which is recognised, trusted and preferred by the consumers. This strength of a brand is defined as the consumer-based brand equity. There is limited research identifying factors that drive consumer-based brand equity in the specific sectors of luxury and upscale hotels. This limits managers in this sector in being able to efficiently manage their brands. Therefore, the current research investigated antecedents and measurements of consumer-based brand equity, based on the specific hotel consumers’ expectations and perceptions of a strong …

Broadly Neutralizing Human Antibodies Inhibit Dengue Virus Infection In Aedes Mosquitoes, Colette Jolynn Matysiak Jan 2016

Broadly Neutralizing Human Antibodies Inhibit Dengue Virus Infection In Aedes Mosquitoes, Colette Jolynn Matysiak

Public Health Theses

Introduction

Dengue virus is the leading cause of morbidity and mortality among mosquito-borne viruses globally. There are four Dengue serotypes; immunity to one serotype provides protective immunity to that serotype but increases the risk of severe disease upon infection with a second serotype. Dengue virus, like all Flaviviruses, utilizes class II fusion proteins to gain entry into the host cytoplasm. The fusion loop, which is responsible for viral-host fusion, lies within the envelope (E) glycoprotein and has nearly 100% amino acid identity among all Flaviviruses. Two anti-Dengue virus human monoclonal antibodies (hMAbs), 1.6D and D11C, were isolated from Dengue infected …

Development And Psychometric Evaluation Of A Questionnaire To Assess Attitudes Towards Tobacco Policies, Margaret Elizabeth Mayer Jan 2016

Development And Psychometric Evaluation Of A Questionnaire To Assess Attitudes Towards Tobacco Policies, Margaret Elizabeth Mayer

Public Health Theses

Introduction: Over the past two decades, the landscape of tobacco control has rapidly changed. Currently there exists no widely-used measure to assess attitudes towards smoking and tobacco policies in the United States. The primary goal of this research project was to develop and validate a timely questionnaire to measure these attitudes, with a particular focus on e-cigarettes and flavorings/additives.

Methods: Building upon the previously validated Smoking Policy Inventory (SPI; 1994), items were developed to assess attitudes toward current and/or controversial issues in tobacco policy. Items querying issues that are generally considered settled (e.g., smoking in restaurants) were removed from the …

Barriers, Motivators, Facilitators Related To Engagement In Hiv Care Among Ghanaian Men Who Have Sex With Men (Msm) Living With Hiv: A Qualitative Study, Adedotun Ogunbajo

Public Health Theses

In Ghana, men who have sex with men (MSM) bear a high burden of the HIV epidemic. To identify factors related to engagement in HIV care, we conducted an explorative qualitative research study with 30 HIV-positive Ghanaian MSM between May 2015 and July 2015. We sought to explore barriers, motivators, and facilitators to engagement in HIV care. Common barriers were fear of being seen in HIV-related health facility, financial difficulties, and other logistical issues. Major sources of motivators for engagement in care included social support, fear of mortality from HIV, and knowledge of effectiveness of HIV treatment. Care facilitators were …

Evaluating Substance Use In A Network Of Emerging Adult Males Via Analysis Of Text Messages Sent And Received, Lia Pizzicato Jan 2016

Evaluating Substance Use In A Network Of Emerging Adult Males Via Analysis Of Text Messages Sent And Received, Lia Pizzicato

Public Health Theses

Introduction: With the ubiquity of mobile phones, mobile health (mHealth) has the ability to transform healthcare specifically in regard to substance use interventions. Current mHealth interventions targeting substance use are limited as they require self-monitoring and user input.

Objectives: The objective of this study was to determine if text message content can predict substance use attitudes and behaviors. The aims were three-fold: (1) To assess the prevalence of discussion of substance use in text messages (2) To evaluate the relationship between text message content and substance use attitudes and behaviors; and (3) To examine social network structure using texting interactions …

Determinants Of Perceived Insufficient Milk And The Infant Feeding Practices Of New Mothers In León, Nicaragua, Cara Safon Jan 2016

Determinants Of Perceived Insufficient Milk And The Infant Feeding Practices Of New Mothers In León, Nicaragua, Cara Safon

Public Health Theses

Breastfeeding has been shown to improve maternal and child health. In Nicaragua, the primary risk of death and disability-adjusted life years among children under 5 years of age is suboptimal breastfeeding. Although the Nicaraguan Ministry of Health promotes exclusive breastfeeding from within the first half hour through the first 6 months of life, less than a third of children in the country under 6 months are exclusively breastfed. As part of a larger, mixed-methods study, 21 semi-structured, in-depth interviews were conducted with new mothers recruited from 3 primary health centers between June and August 2015 in order to identify the …

Perspectives For Adolescent Engagement: The Bright Bodies Program, Athena Theodora Samaras Jan 2016

Perspectives For Adolescent Engagement: The Bright Bodies Program, Athena Theodora Samaras

Public Health Theses

While responses to the obesity epidemic have largely encompassed top-down approaches with a focus on health-related outcome evaluation, for successes to be sustained, a greater emphasis is needed on local initiatives and intervention process evaluation. Pediatric weight management programs in the healthcare and community settings represent local initiatives that have had considerable health-related impacts, yet are often limited by high attrition rates. Because adolescence is marked by substantial weight shifts and the formation of long-lasting health habits, it represents a critical point for implementing obesity prevention and treatment. Accordingly, this study sought to assess factors that promote adolescent participant engagement …

Pirnas Variants And Lung Cancer Risk: A Post-Gwas Study, Rui Ye Jan 2016

Pirnas Variants And Lung Cancer Risk: A Post-Gwas Study, Rui Ye

Public Health Theses

Background: Lung cancer is the most frequently diagnosed cancer and one of the top cause of cancer death worldwide. The recent discovery of PIWI-interacting RNAs (piRNAs), one type of non-coding RNAs, has been shown to be involved in tumorgenesis pathways of various types of cancer types by accumulating evidences. However, the role of piRNAs in lung cancer development is underexplored.

Methods: Genotype and phenotype data were obtained from a genome-wide association study of lung cancer risk (3,702 cases and 3,739 controls) and 1,173 imputed piRNAs variants were analyzed by association analysis for lung cancer risk. A secondary expression analysis is …
