Interpretations Of Revolution In Partitioned Poland, Jonathan Dean Nov 2016

Interpretations Of Revolution In Partitioned Poland, Jonathan Dean

Research Papers

The nineteenth century was a time of chaotic politics in Europe, a time that saw Poland broken into pieces and partitioned out to its neighbors. This article examines three different works on Polish history, using their authors' contexts to illustrate how the partitioning of Poland has been interpreted by historians throughout time, and how the status of Poland at the time these histories were written affects that interpretation.

Scalable Equals Asynchronous And Asynchronous Equals Boring. Or Does It?, Liz Thompson, Howard Carrier

Libraries

This paper reports on recent work to introduce a model of scalable, asynchronous library instruction into the First Year Writing program at James Madison University, inspired by the premise: Scalable equals asynchronous. And asynchronous equals boring. Or does it? The authors describe how a small team from Libraries & Educational Technologies at James Madison University planned and built an asynchronous, modular tutorial series, primarily designed to motivate students to engage with the library instruction contained within it. Information literacy instruction was provided using a tool called “Guide on the Side” and employed short scenario videos and additional content, followed by …

Gif Gaffe: How Big Sports Ignored Lenz And Used The Dmca To Chill Free Speech On Twitter, Andrew T. Warren

Fordham Intellectual Property, Media and Entertainment Law Journal

Many major sports leagues including the National Football League, Major League Baseball, and Ultimate Fighting Championship have consistently used the Digital Millennium Copyright Act (“DMCA”) to remove user-created GIFs, Vines, and related content that make use of the leagues’ copyrighted broadcast material on Twitter. This Article analyzes Twitter users’ right of fair use in the leagues’ copyrighted material, while suggesting that sports leagues and their agents may not be following the Ninth Circuit’s Lenz v. Universal Music Corp.decision, which requires copyright owners to consider fair use before submitting DMCA takedown notices. Sports leagues’ protocol and actions towards GIFs and Vines …

Who’S Afraid Of Forever 21?: Combating Copycatting Through Extralegal Enforcement Of Moral Rights In Fashion Designs, Irina Oberman Khagi

Fordham Intellectual Property, Media and Entertainment Law Journal

This Article examines the often underexplored theory of personality rights, or moral rights, as a justification for protection of intellectual property in the context of protection of fashion designs. Traditional forms of intellectual property protection have thus far proven inadequate to protect the overall design of an article of clothing or accessory; rather, most are only sufficient to protect portions of the design. Advocates for strengthened intellectual property rights regimes traditionally invoke utilitarian rights, or the need to provide an incentive for continued generation of new ideas. But these utilitarian theories appear to be less relevant in the fashion world, …

The Non-Contractual Nature Of Privacy Policies And A New Critique Of The Notice And Choice Privacy Protection Model, Thomas B. Norton Nov 2016

The Non-Contractual Nature Of Privacy Policies And A New Critique Of The Notice And Choice Privacy Protection Model, Thomas B. Norton

Fordham Intellectual Property, Media and Entertainment Law Journal

Notice and Choice is the model for protecting privacy online in the United States. Under the model, users of online services are given notice about services information and privacy practices in the form of privacy policies. Based on this information, users can choose whether to use particular online services and whether to exercise any options for protecting their privacy that the services might offer. In theory, Notice and Choice seems like a sound regulatory mechanism. Indeed, state and federal regulatory agencies prefer the model as a basis for privacy enforcement action. But Notice and Choice faces harsh criticism from privacy …

Theses and Dissertations

This paper was produced by an artificial neural network. An algorithm iteratively taught itself how to write by studying the text of thesis papers from the Fall 2015 and Spring 2016 MFA semesters. After hundreds of generations of self-education, the program can produce endless thesis papers, writing letter-by-letter. The images were created through an identical process, using 8000 installation photographs from the website Contemporary Art Daily as a dataset.

Rethinking Article 422: A Retrospective On Ecuador's 2008 Constitutional Isds Recalibration, Alexander B. Avtgis Nov 2016

Rethinking Article 422: A Retrospective On Ecuador's 2008 Constitutional Isds Recalibration, Alexander B. Avtgis

Indiana Journal of Constitutional Design

Is Ecuador’s adoption of Article 422 in the 2008 Constitution properly viewed as a “re-statification”1 of Investor State Dispute Settlement (ISDS)? And, since its implementation, has the constitutional article been effective in institutionally insulating Ecuador from the jurisdictional reach of international ISDS? This paper answers both questions in the negative—but qualifies such an outlook by balancing the drawbacks of Article 422 against its successes. Article 422’s provisions, strident in its attempt to create an alternative development vision, did not achieve all that the Constitution’s drafters had hoped. Nevertheless, in its limited effect of detaching Ecuador from certain ISDS fora, it …

Back To The Future: Prospects For Education Faculty And Librarian Collaboration Thirty Years Later, Lindy Scripps-Hoekstra, Erica R. Hamilton Nov 2016

Back To The Future: Prospects For Education Faculty And Librarian Collaboration Thirty Years Later, Lindy Scripps-Hoekstra, Erica R. Hamilton

Scholarly Papers and Articles

Thirty years ago, education conference panelists shared concerns regarding collaboration between education faculty and librarians and they presented ideas for expanding these partnerships. A review of their ideas raises an important question: In what ways have their ideas for collaboration and partnership been realized? To answer this question, the authors conducted a review of the literature regarding education faculty-librarian collaboration. Findings indicate that when collaborating with education faculty, there are three roles librarians have embodied: librarian-as-reference, librarian-as-consultant, and librarian-as-instructor. These roles contribute to the realization of the panelists’ proposed ideas and offer suggestions for future collaboration and research possibilities.

time to recognize the biggest problem of all – anti-intellectualism.

Anti-intellectualism is defined as a negative attitude

toward intellectual pursuits, whether in the

form of education or scholarly activities and toward

their practitioners, such as college professors and

intellectuals in general.

Sms Derived Vs. Public Perceived Risk In Aviation Technology Acceptance (Literature Review), Paul L. Myers Iii Nov 2016

Sms Derived Vs. Public Perceived Risk In Aviation Technology Acceptance (Literature Review), Paul L. Myers Iii

International Journal of Aviation, Aeronautics, and Aerospace

Aviation technology progressed from the first airplane flight to landing on the moon in just 63 years with continued progress today. Thus, organizations like commercial airlines and the National Aeronautics and Space Agency (NASA) that use a Safety Management System (SMS) are periodically implementing technology changes. Typically, two different processes are used to derive SMS and public perceived risk. Disparity between the two processes coupled with dissimilar influencing factors has, at times, frequently slowed or halted technology implementation. Understanding both processes and influencing factors using a literature review allows for a more proactive approach in implementing technology, aids in gauging …

Puzzles Of The Zero-Rate Royalty, Eli Greenbaum Nov 2016

Puzzles Of The Zero-Rate Royalty, Eli Greenbaum

Fordham Intellectual Property, Media and Entertainment Law Journal

Patentees increasingly exploit their intellectual property rights through royalty-free licensing arrangements. Even though patentees using such frameworks forfeit their right to trade patents for monetary gain, royalty-free arrangements can be used to pursue other significant commercial and collaborative interests. This Article argues that modern royalty-free structures generate tension between various otherwise well-accepted doctrines of patent remedies law that were designed for more traditional licensing models. As such, current doctrines provide conflicting frameworks for evaluating the royalty-free arrangement, and offer inconsistent approaches for determining the appropriate remedy for their breach. This discord grows out of courts’ inadequate attention to non-monetary consideration …

Transitioning From High School To College: Examining The Sources And Influences Of Social Capital For A First-Generation Latina Student, Randall F. Clemens

The Qualitative Report

This paper uses the life history method to narrate the experiences of Camilla, a 19-year-old, first-year student at a four-year university. Camilla emigrated with her mother from El Salvador to the United States during her freshman year of high school. Based on two years of data collection, the author presents Camilla’s experiences at different stages, including her childhood in El Salvador, first and last year in high school, and her first year in college. The paper explores the sources and influences of social capital for a low-income, first-generation student and highlights its dynamic and contextual nature. The author argues that …
