The first road to be built into Humla, Nepal has connected this once-remote Himalayan region to a market in China. This dissertation research assesses the impacts of this road on villagers’ food security, diet and nutrition, and subjective well-being, and investigates the link between objective and subjective health outcomes. The primary aim of this study is to decipher whether villagers’ ‘proximity to road’ is the strongest predictor of the aforementioned health outcomes, or whether other sociocultural and economic variables play a more significant role. A mixedmethods approach and a case-control ethnographic research design were implemented in order to investigate this …

A Qualitative Pilot Study Of Aging Women’S Physical Activity Experiences In One University Fitness And Wellness Center, Alexis Hobbs

Online Theses and Dissertations

Physical inactivity is one of the driving risk factors for developing health problems such as obesity, diabetes, and cardiovascular diseases (World Health Organization, 2003). The prevalence of these diseases increases with the aging process, which renders participation in physical activity crucial among the aging population. There is strong evidence that physical activity reduces the risk of these health disparities and disabilities (Young & Dinan, 2005), however despite these well-documented benefits, aging women still remain sedentary. This study examined the phenomenon of women 55 years of age or older and their lived experiences of participating in physical activity within a university …

A Comparison Of School Suspension Rates And Number Of Days Suspended Between African-American And Caucasian Males, Jeffrey D. Herron-Rodgers Jan 2016

A Comparison Of School Suspension Rates And Number Of Days Suspended Between African-American And Caucasian Males, Jeffrey D. Herron-Rodgers

Online Theses and Dissertations

Racial discrimination plays a major role in out-of-school suspensions. Research shows that when students are suspended, they are removed from their learning environment, which can lead to poor academic achievement, lower graduation rates, and higher delinquency. The distribution of racial and ethnic minorities that are being suspended or expelled reveal disparities between the groups. Within the United States public school system, racial disparities have been documented over time to show African-American students are suspended from school at higher rates than any other race (Arcia, 2007; Bulter et al, 2012; Rocque, 2010; Skiba et al, 2002; Townsend, 2000).

School systems should …

Intercultural Learning Perspectives Of World Language Educators In Kentucky, Ernest Luke Mcclees Jan 2016

Intercultural Learning Perspectives Of World Language Educators In Kentucky, Ernest Luke Mcclees

Online Theses and Dissertations

A line has become blurred between intercultural interactions and daily personal interactions. The once long distance for trade, travel and communication is at its’ smallest gap. However, “American graduates have been cited as being culturally deprived and linguistically illiterate, compared to students from other countries” (2013 Kentucky Standard for World Language Proficiency). For educational leaders to improve this current educational inadequacy, it is important to understand teachers’ intercultural beliefs and how they impact their classroom practices. What is not known is the present state of world language teachers’ global competence understanding and what they perceive to be best practices to …

What Do You Think I Am?: On Perceiving Unintelligibility In The Nonbinary Gender Experience, James Warwood Jan 2016

What Do You Think I Am?: On Perceiving Unintelligibility In The Nonbinary Gender Experience, James Warwood

Graduate Student Theses, Dissertations, & Professional Papers

What does it mean to be “retired from gender,” and what role does such an identity play in daily life? Engaging with the work of Maurice Merleau-Ponty and Judith Butler, this project attempts to elucidate the experience of nonbinary – that is, external to the male/female gender binary – gendered individuals, and the ultimate unintelligibility of that experience. Merleau-Ponty’s phenomenological approach to perception allows for an exploration of the social norms and regulations that determine how gender is defined in Western culture; combined with Butler’s significant work on gender and its performativity, phenomenology proves a useful tool for revealing the …

Enduring Originalism, Jeffrey A. Pojanowski, Kevin C. Walsh Jan 2016

Enduring Originalism, Jeffrey A. Pojanowski, Kevin C. Walsh

Journal Articles

If our law requires originalism in constitutional interpretation, then that would be a good reason to be an originalist. This insight animates what many have begun to call the “positive turn” in originalism. Defenses of originalism in this vein are “positive” in that they are based on the status of the Constitution, and constitutional law, as positive law. This approach shifts focus away from abstract conceptual or normative arguments about interpretation and focuses instead on how we actually understand and apply the Constitution as law. On these grounds, originalism rests on a factual claim about the content of our law: …

Compact Is Back: The Supreme Court Of Canada’S Revival Of The Compact Theory Of Confederation, Sébastien Grammond Jan 2016

Compact Is Back: The Supreme Court Of Canada’S Revival Of The Compact Theory Of Confederation, Sébastien Grammond

Osgoode Hall Law Journal

The compact theory of Canadian Confederation is the idea that the Constitution is the product of a political agreement (or “compact”) among the country’s constitutive parts. Although the theory has been widely criticized, this article shows how the theory has recently been used by the Supreme Court of Canada to explain the origins of certain parts of the Constitution and to guide its interpretation, in particular in cases involving constitutional amendment and indigenous rights. It then discusses how the Court dealt with instances where one party’s consent to a foundational compact was vitiated or altogether lacking, and whether the Court’s …

Absence Of “Joseph Smith” In The Book Of Mormon: Lack Of The Name Letter Effect In Nephite, Lamanite, And Jaredite Names, Bruce L. Brown, Sharon Black, Brad Wilcox, Wendy Baker Smemoe

Faculty Publications

Although some authors of fiction attempt to hide their real names by publishing their work under pseudonyms, the letters and sounds they consciously or subconsciously select for the names of their characters often reveal the author’s true identity. Since 1985, research has explored the name letter effect—the preference people show for the letters and sounds (especially initial sounds) in their own names. This tendency is evident in the highly personal and introspective literature produced in the United States during Joseph Smith’s lifetime by authors such as Nathaniel Hawthorne, Washington Irving, and Edgar Allan Poe. The purpose of this study was …

The Communicability Of Nature, Meg E. Smith Jan 2016

The Communicability Of Nature, Meg E. Smith

Undergraduate Theses, Professional Papers, and Capstone Artifacts

How do we experience nature? In what way can we find ourselves at one with nature, immersed in the experience of nature, and still allow nature a level of healthy “otherness,” of individual separation? Writers, scientists, and lost people have long gone to the wilderness, to nature, in search of answers to life’s mysteries. In effect it has become a destination, a place apart from humans, where it exists only as a haven and place of meditation. Nature has lost its own individuality, its sense of presence as an entity in and of itself. When we seek nature in order …

The study conducted implemented an internet-based treatment for depression in which users were provided an opportunity to watch slam poetry videos related to mental health issues and write free responses regarding the content of the videos and their subjective experience of depression. Numerous studies provide support for the effectiveness of expressive writing, online mental health interventions, and slam poetry in particular for reducing symptoms …

The Combatant's Stance: Autonomous Weapons On The Battlefield, Jens David Ohlin Jan 2016

The Combatant's Stance: Autonomous Weapons On The Battlefield, Jens David Ohlin

Cornell Law Faculty Publications

Do Autonomous Weapon Systems (AWS) qualify as moral or rational agents? This paper argues that combatants on the battlefield are required by the demands of behavior interpretation to approach a sophisticated AWS with the “Combatant’s Stance” — the ascription of mental states required to understand the system’s strategic behavior on the battlefield. However, the fact that an AWS must be engaged with the combatant’s stance does not entail that other persons are relieved of criminal or moral responsibility for war crimes committed by autonomous weapons. This article argues that military commanders can and should be held responsible for perpetrating war …

Immigrant Passing, Andrew Tae-Hyun Kim Jan 2016

Immigrant Passing, Andrew Tae-Hyun Kim

Kentucky Law Journal

The metaphor of America as a "melting-pot" is as old as this country's founding. In its aspirational reach and inclusive vision, this storied narrative is alluring. This assimilationist norm is deeply woven into our culture and laws. But the demand to assimilate can easily cross the ine into unlawful discrimination and exact untold harms on an individual's identity For over eleven million undocumented immgrants in the United States, many of whom have lived here for generations, the story of inclusion smacks of fiction. To remedy their daily fear of deportation and obviate the need to hide, the Obama Administration enacted, …
