Berlin Opera Wars : Institutional And The Quest For German Identity, Rebecca Robinson Jan 2016

Berlin Opera Wars : Institutional And The Quest For German Identity, Rebecca Robinson

Honors Theses

In October 2000, Berlin’s Minister of Culture Christoph Stölzl proposed a merger of the city’s opera houses. In the midst of German reunification, Berlin was struggling financially and the cost of three separate opera houses was too much for the city to bear. This proposal to combine the former East-German Staatsoper Berlin and Komishe Oper with the former West-German Deutsche Oper under the administration of “The Opera Stages of Berlin” was met with public backlash. Newspapers all over the world reported daily as the directors of both the Staatsoper and Deutsche Oper—Daniel Barenboim and Christian Thielemans— fought bitterly for their …

Leaked Memo To West Point Superintendent Lt. Gen. Robert Caslen From Major Consuelo Antoinette Martinez Regarding The "Raised Black Female Fist" Old Corps Photograph Incident, Yxta Maya Murray Jan 2016

Leaked Memo To West Point Superintendent Lt. Gen. Robert Caslen From Major Consuelo Antoinette Martinez Regarding The "Raised Black Female Fist" Old Corps Photograph Incident, Yxta Maya Murray

Cardozo Journal of Equal Rights & Social Justice

This satire responds to the recent United States Military Academy ("USMA" or "West Point') Investigation sixteen African American female cadets who took a photograph of themselves holding up their fists. This work of legal analysis and of the imagination takes the form of an investigatory memo written by afictional Latina West Point official to the (very real) West Point Superintendent Lieutenant General Robert Caslen. In it, I study the legal underpinnings for the investigation, which center on certain Department ofDefense regulations forbidding political activity on the part of military service members. I reveal the race and gender absurdity that cuts …

Finding Customary International Law, Ryan M. Scoville Jan 2016

Finding Customary International Law, Ryan M. Scoville

Faculty Publications

Established doctrine holds that customary international law (“CIL”) arises from general and consistent state practice that is backed by a sense of legal obligation. Contemporary litigation requires federal courts to apply this doctrine to identify the contours of CIL in a diverse collection of cases ranging from civil actions under the Alien Tort Statute to criminal prosecutions under the Maritime Drug Law Enforcement Act. This Article provides an in-depth look at how federal judges carry out this task. Conducting a citation analysis of opinions published since the U.S. Supreme Court’s 2004 decision in Sosa v. Alvarez-Machain, this Article analyzes …

The Mapmaker’S Dilemma In Evaluating High-End Inequality, Daniel N. Shaviro Jan 2016

The Mapmaker’S Dilemma In Evaluating High-End Inequality, Daniel N. Shaviro

Faculty Articles

The last thirty years have witnessed rising income and wealth concentration among the top 0.1% of the population, leading to intense political debate regarding how, if at all, policymakers should respond. Often, this debate emphasizes the tools of public economics, and in particular optimal in-come taxation. However, while these tools can help us in evaluating the issues raised by high-end inequality, their ex-treme reductionism—which, in other settings, often offers significant analytic payoffs—here proves to have serious drawbacks. This Article addresses what we do and don’t learn from the optimal income tax literature regarding high-end inequality, and what other inputs might …

Molecular Cytogenetic Identification Of A Novel Hexaploid Wheat-Thinopyrum Intermedium Partial Amphiploid With High Protein Content, Mariyana Georgieva, Klaudia Kruppa, Nedyalka Tyankova, Marta Molnar Lang

Turkish Journal of Biology

Genomic in situ hybridization and fluorescence in situ hybridization were used to define the cytogenetic constitution of the intergeneric introgression line 29(1-57) obtained from the wheat × Thinopyrum intermedium (wheatgrass) cross. This line is a high-protein line resistant to leaf rust, yellow rust, and powdery mildew under field conditions and has 42 chromosomes. GISH analysis using a total genomic DNA probe from Thinopyrum intermedium resulted in the identification of 14 chromosomes of wheatgrass origin. The sequential GISH patterns obtained using St-genomic and J-genomic DNA as probes and ABD-genomic DNA from wheat as a blocker led to a better determination of …

A Wavelet Transform Module For A Speech Recognition Virtual Machine, Euisung Kim Jan 2016

A Wavelet Transform Module For A Speech Recognition Virtual Machine, Euisung Kim

All Graduate Theses, Dissertations, and Other Capstone Projects

This work explores the trade-offs between time and frequency information during the feature extraction process of an automatic speech recognition (ASR) system using wavelet transform (WT) features instead of Mel-frequency cepstral coefficients (MFCCs) and the benefits of combining the WTs and the MFCCs as inputs to an ASR system. A virtual machine from the Speech Recognition Virtual Kitchen resource (www.speechkitchen.org) is used as the context for implementing a wavelet signal processing module in a speech recognition system. Contributions include a comparison of MFCCs and WT features on small and large vocabulary tasks, application of combined MFCC and WT features on …

Teacher Governance Factors And Social Cohesion: Insights From Pakistan, Anjum Halai, Naureen Durrani

Institute for Educational Development, East Africa

This paper explores teacher governance factors, particularly recruitment and deployment of teachers, in relation to inequalities and social cohesion. Pakistan introduced major reforms in education in the post 9/11 context of escalating conflict. These include a merit and needs-based policy on teacher recruitment to eliminate corruption in recruitment and improve equity on the basis of gender, language, ethnicity, religion, and special needs. A 4Rs framework of redistribution, recognition, representation and reconciliation was employed to analyse data gathered from: interviews with teacher educators, policy makers and development partners, and focus group discussions with and questionnaires completed by pre- and in-service teachers. …

Combating Misdiagnoses In The Field Of Speech Language Pathology, Jezzica E.. Zimmermann Jan 2016

Combating Misdiagnoses In The Field Of Speech Language Pathology, Jezzica E.. Zimmermann

Honors Capstones

Introduction: The problem of misdiagnosis between language disorder and language difference is something that has been increasingly brought to light in the past few decades. There is a plethora of information showing research to prove licensed speech language pathologists (SLPs) and students do not have accurate judgement in conducting evaluations or deciphering the correct diagnosis as they do in other areas of the field (Levey, 2013; ASHA Cultural Competence; Verdon, McLeod, & Wong, 2016; Horton-Ikard & Muñoz, 2010 ). The factors that contribute to this problem include the lack of a required multicultural course which leads to insufficient cultural competence, …

The article is a reflective narrative regarding the work I do as an ally for change and social justice as a white woman. In my class on Human Diversity and Social Justice, I often discuss how I can use my white privilege to advance social justice to address racism. Several students who have taken the class offer their own reflections on taking the class. Relevant information from the literature is provided to ground the discussion and includes cultural competence, racism, white privilege, and racial identity development. Strategies for deconstructing racism are discussed.

Does Centralized Private Power Corrode The Rule Of Law?, James G. Wilson Jan 2016

Does Centralized Private Power Corrode The Rule Of Law?, James G. Wilson

Cleveland State Law Review

Wilson argues that profound wealth inequality invariably creates an unstable, dual legal system. The rich become largely immune from criminal sanctions, civil regulations, and taxation; the middle class carries the tax burden while the criminal justice system hammers the poor. This perpetuates the fear of the Framers that America would decline if it ever adopted a class system similar to the European class structure, which was far more drastic. The infamous revolving door between the corridors of public and private power guarantees regulatory capture; high-level bureaucrats, members of Congress, and military leaders flock to the private sector, where they are …

Beyond Babel: Achieving The Promise Of Our American Constitution, André Leduc Jan 2016

Beyond Babel: Achieving The Promise Of Our American Constitution, André Leduc

Cleveland State Law Review

This Article completes a therapeutic treatment of the originalism debate. The long-running debate over constitutional originalism is pathological, more confused than insightful or important. This Article completes the course of therapy by sketching the constitutional discourse and practice we may hope for after the debate over originalism is transcended and left behind. In so doing, it disarms the final defense of the participants in that debate in that they have no alternative. Only by sketching what that alternative is can its existence be proved, and the ideopolises of the protagonists finally be reconstructed. This Article shows the constitutional theory and …

Tempo Perception Across Cultures: The Beat Is All It Takes, Kendall L. Lyons, Jessica E. Nave-Blodgett, Erin E. Hannon Jan 2016

Tempo Perception Across Cultures: The Beat Is All It Takes, Kendall L. Lyons, Jessica E. Nave-Blodgett, Erin E. Hannon

AANAPISI Poster Presentations

  • Dancing to music is a human universal that relies on beat perception.
  • Listeners may infer the “tempo” or speed of music from:
    • the time interval between beats;
    • the density of events;
    • higher-level features of musical temporal organization (the meter).
  • The “Gabbling Foreigner Illusion” is the observation that listeners perceive unfamiliar languages as being faster than familiar ones.
  • Even when music is the same speed, listeners tap faster to unfamiliar music.
  • Does culture background impact how we perceive musical tempo?

Robust Fuzzy-Sliding Mode Based Upfc Controller For Transient Stability Analysis In Autonomous Wind-Diesel-Pv Hybrid System, Asit Mohanty, Sandipan Patra, Prakash K. Ray Jan 2016

Robust Fuzzy-Sliding Mode Based Upfc Controller For Transient Stability Analysis In Autonomous Wind-Diesel-Pv Hybrid System, Asit Mohanty, Sandipan Patra, Prakash K. Ray

Articles

This study presents a comparative study of transient stability and reactive power compensation issues in an autonomous wind–diesel-photovoltaic based hybrid system (HS) using robust fuzzy-sliding mode based unified power flow controller (UPFC). A linearised small-signal model of the different elements of the HS is considered for the transient stability analysis in the HS under varying loading conditions. An IEEE type 1 excitation system is considered for the synchronous generator in the HS, with negligible saturation characteristic, for detailed voltage stability analysis. It is noted from the simulation results that the performance of UPFC is superior to static VAR compensator and …

Reconciling Patent Law And Traditional Knowledge: Strategies For Countries With Traditional Knowledge To Successfully Protect Their Knowledge From Abuse, Ameera Haider Jan 2016

Reconciling Patent Law And Traditional Knowledge: Strategies For Countries With Traditional Knowledge To Successfully Protect Their Knowledge From Abuse, Ameera Haider

Case Western Reserve Journal of International Law

Traditional knowledge is a form of innovation that does not fit neatly into Western notions of property. Underdeveloped countries with significant traditional knowledge lack property protection for their traditional knowledge and are often not compensated for the technology arising from this form of knowledge. This Note outlines the tension arising from the differing incentives that underlie patent and traditional knowledge systems, and recommends methods of reconciling those tensions. First, this Note advocates that countries develop national libraries of the knowledge embodied in their staple agricultural products. Next, countries should create statutes to establish a method by which outside parties can …

Synthesis, Reaction, And Evaluation Of The Anticancer Activity Of 6,7,8,9-Tetrahydro-5$H$-Cyclohepta[4,5]Selenopheno[2,3-$D$]Pyrimidine Derivatives, Kadi̇r Doğanay, Ünzi̇le Keleştemur, Sevgi̇ Balcioğlu, Burhan Ateş, Ali̇ye Altundaş

Turkish Journal of Chemistry

The cyclocondensation of 2-amino-5,6,7,8-tetrahydro-4$H$-cyclohepta[$b$] selenophene-3-carbonitrile (1) with formic acid and formamide gave the selenophenopyrimidine 15 and selenophenopyrimidone 6 derivatives. The reaction of 6 with phosphorus oxychloride produced 4-chloro-6,7,8,9-tetrahydro-5$H$-cyclohepta[4,5] seleno[2,3-$d$]pyrimidine (12), the key compound for our nucleophilic substitution reactions. The hydrazinoselenophenopyrimidine 19 obtained from the reaction of 12 with hydrazine hydrate was converted to its tetrazoloselenophenopyrimidine 21 and triazoloselenophenopyrimidine 26 derivatives. Moreover, the chloropyrimidine derivative was reacted with pyrrolidine and morpholine to afford 4-(1-pyrrolidinyl)-6,7,8,9-tetrahydro-5$H$-cylohepta[4,5]selenopheno[2,3-$d$]pyrimidine (27) and 4-(6,7,8,9-tetrahydro-5$H$-cyclohepta[4,5]selenopheno[2,3-$d$]pirimidin-4-yl)morpholine (28). Anticancer activities of the synthesized compounds were investigated against the MCF-7 breast cancer cell line and the IC$_{50}$ values of these compounds were …

Causal Responsibility And Patent Infringement, Dmitry Karshtedt Jan 2016

Causal Responsibility And Patent Infringement, Dmitry Karshtedt

GW Law Faculty Publications & Other Works

It is not uncommon for multiple parties in the stream of commerce — manufacturers, distributors, end users — to be involved in the infringement of a single patent. Yet courts continue to struggle with such scenarios. Attempts to deal with them — particularly when plaintiffs asserted so-called method patents, which cover specific “steps,” or actions — have produced results that defy commonsense notions of legal responsibility. In method patent cases, the patentee must clear much higher legal hurdles to prevail against a manufacturer who designed and supplied an infringing device than against an end user who simply bought that device …

Double Deference In Administrative Law, Emily Hammond Jan 2016

Double Deference In Administrative Law, Emily Hammond

GW Law Faculty Publications & Other Works

Administrative law presumes a neat system of agency rulemaking and adjudication followed by judicial review. But the reality of the administrative state departs starkly from this model. One such departure is the use of audited self-regulatory organizations (SROs) -- private organizations comprised of specific industries that formulate binding law to regulate themselves. Although SROs operate subject to the oversight of federal agencies, their power is vast, reaching significant swaths of the national and international economies. There is little to constitutionally constrain such arrangements, and whereas the administrative law model values the norms of participation, deliberation, and transparency, the procedures used …

Local Health Departments’ Activities To Address Health Disparities And Inequities: Are We Moving In The Right Direction?, Gulzar H. Shah, John P. Sheahan

Health Policy & Management: Faculty Publications (2006-2018)

Context: Health disparities are among the critical public health challenges.

Objectives: To analyze the extent to which local health departments (LHDs) perform activities for addressing health disparities, changes in proportion of LHDs’ performing those activities since 2005, and factors associated with variation in such engagement.

Methods: We used the 2013 National Profile of LHDs Survey to perform Logistic Regression of activities LHDs performed to address health disparities.

Results: About 20 percent of LHDs did not perform any activity to address health disparities. Significant decreases occurred since 2005 in the proportion of LHDs that performed health disparity reduction/elimination activities for four …
