From Out To In: The Opportunity And Need For Clinical Law Programs To Effectively Serve Low-Income Lgbt Individuals, Sarah Steadman Jan 2016

From Out To In: The Opportunity And Need For Clinical Law Programs To Effectively Serve Low-Income Lgbt Individuals, Sarah Steadman

Faculty Scholarship

Although the recent legalization of same-sex marriage in the U.S. is heartening for lesbians and gays, the resulting discriminatory legislative backlash against the LGBT population shows that this community continues to be marginalized and at risk. Over two hundred anti-LGBT bills have been introduced in state legislatures since January 2016. North Carolina recently passed anti-LGBT legislation that eliminated and prohibits LGBT anti-discrimination protections, and bars transgender individuals from using gender congruent public bathrooms. One result of recent and historical discrimination is LGBT individual's newfound and pre-existing fears of encountering anti-LGBT bias when seeking legal services, even as recent developments have …

Worse Than Pirates Or Prussian Chancellors: A State's Authority To Opt-Out Of The Quid Pro Quo, Michael C. Duff

Marquette Benefits and Social Welfare Law Review

Privatization of public law dispute resolution in workplaces has been under intense scrutiny in the context of arbitration. Another kind of workplace dispute privatization is presently underway, or under serious consideration, in several states. In connection with state workers’ compensation statutes, one state has implemented, and others are considering, a dispute resolution model in which employers are explicitly authorized to “opt out” of coverage. “Alternative benefit plans,” created under such statutes, permit employers to, among other things, unilaterally and without limitation designate private fact-finders, whose conclusions are subject to highly deferential judicial review. This model is arbitration on steroids. While …

Statutory Review Of The Construction Contracts Act 2004 (Wa), Phillip Evans Jan 2016

Statutory Review Of The Construction Contracts Act 2004 (Wa), Phillip Evans

The University of Notre Dame Australia Law Review

The Construction Contracts Act 2004 provides for security of payment in the construction industry through the use of rapid adjudication processes to determine payment disputes. It further prohibits or modifies certain “unfair” provisions in construction contracts and implies provisions in construction contracts about certain matters if there are no written provisions about these matters in the contract. In 2015 the Minster for Commerce commissioned a review of the Act to determine whether iy is meeting the needs of industry and whether amendment was required. This paper provides a background to the construction industry in Western Australia and the essential provisions …

Assessing Climate Change And Health Vulnerability At The Local Level: Travis County, Texas, Natasha Prudent, Adele Houghton, George Luber Jan 2016

Assessing Climate Change And Health Vulnerability At The Local Level: Travis County, Texas, Natasha Prudent, Adele Houghton, George Luber

United States Public Health Resources

We created a measure to help comprehend population vulnerability to potential flooding and excessive heat events using health, built environment and social factors. Through principal component analysis (PCA), we created non-weighted sum index scores of literature-reviewed social and built environment characteristics. We created baseline poor health measures using 1999–2005 ageadjusted cardiovascular and combined diabetes and hypertension mortality rates to correspond with social–built environment indices. We mapped US Census block groups by linked ageadjusted mortality and a PCA-created social–built environment index. The goal was to measure flooding and excessive heat event vulnerability as proxies for population vulnerability to climate change for …

"Sense Of Access To Justice" As A Framework For Civil Procedure Justice Reform: An Empirical Assessment Of Judicial Settlement Conferences In Quebec (Canada), Jean-François Roberge Jan 2016

"Sense Of Access To Justice" As A Framework For Civil Procedure Justice Reform: An Empirical Assessment Of Judicial Settlement Conferences In Quebec (Canada), Jean-François Roberge

Cardozo Journal of Conflict Resolution

An emerging worldwide civil procedure justice reform trend takes the user's point of view into account in order to promote access-tojustice and support for the rule of law. In the Canadian context, the Quebec civil law province has taken the lead to renew its legal culture towards a participatory justice, rooted in fair-minded processes that encourage the persons involved to play an active role. In an effort to monitor such ambitions, carried by the civil procedure code reforms of 2003 and 2014, our paper offers an empirical evaluation through the lens of litigant's "Sense of Access to Justice" ("SA"). We …

The Pragmatic Limits Of Access To Justice, Hart Schwartz, Anthony Robert Sangiuliano

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

The Supreme Court of Canada’s Charter jurisprudence often resembles a seesaw. The Court will tilt toward a robust approach that favours individual rights and freedoms only to adjust a short time later when the broader social or economic costs of its expansive jurisprudence become evident. Expansion is followed by contraction. Whether this pattern is best described in terms of “trimming its sails”, taking corrective measures, or simply clarifying doctrinal scope, the Court has teetered to one side and tottered back again on a number of occasions.

The concept of “access to justice” is one example. In 2014 it had been …

Addressing Intimate Partner Violence And Power In Relationships In Hiv Testing Services: Results Of An Intervention Piloted In Nairobi, Kenya, Nicole Haberland, Charity Ndwiga, Katharine Mccarthy, Margaret Makanyengo, Rose Kosgei, Cecilia Choi, Julie Pulerwitz, Sam Kalibala Jan 2016

Addressing Intimate Partner Violence And Power In Relationships In Hiv Testing Services: Results Of An Intervention Piloted In Nairobi, Kenya, Nicole Haberland, Charity Ndwiga, Katharine Mccarthy, Margaret Makanyengo, Rose Kosgei, Cecilia Choi, Julie Pulerwitz, Sam Kalibala

HIV and AIDS

The overarching goal of this study was to pilot an approach to HIV testing services (HTS) that addresses intimate partner violence (IPV) and sexual relationship power (SRP) inequalities, and explores the intervention’s potential for improving uptake and retention of antiretroviral therapy and prevention of mother-to-child transmission services. The project was implemented in Kenyatta National Hospital’s (KNH) antenatal care (ANC) clinic, and examined intermediate indicators of effect, as well as operational issues around incorporating attention to IPV in hospital procedures, especially in high-volume, high-need settings like KNH’s. The findings from this study suggest that providing some minimal IPV/SRP counseling to all …

Lessons And Liabilities In Litigating Solitary Confinement Symposium Essays, Keramet Reiter Jan 2016

Lessons And Liabilities In Litigating Solitary Confinement Symposium Essays, Keramet Reiter

Connecticut Law Review

This Essay reviews the recent deluge of legal attention solitary confinement has received in the United States, focusing in particular on three legal cases: Davis v. Ayala (a U.S. Supreme Court case), Coleman v. Taylor (a case filed and recently dismissed in a federal district court in Illinois), and Ashker v. Brown (a settled case filed in a federal district court in California). A close analysis of the reasoning in each of these cases provides a framework for examining the changing landscape of prison reform litigation in what many are heralding as a new era of reform. Together, these cases …

A Solution In Search Of A Problem: Kelo Reform Over Ten Years Commentary Essays, Wendell E. Pritchett

Connecticut Law Review

Kelo is NOT Dred Scott. Kelo is not only NOT Dred Scott, it was, as this Essay will argue, the right decision given the facts of the cases and the current state of legal jurisprudence. As an academic who has detailed the historic exploitation of eminent domain to uproot persons of color in this country, I find it interesting, and somewhat troubling, that the case has received so much criticism, much more criticism, I would argue, than other Supreme Court decisions that deserve condemnation. Certainly, eminent domain, like any other government power, must be regulated carefully. But upending the principles …
