Some Early Thoughts On Liability Standards For Online Providers Of Legal Services, Benjamin H. Barton Jan 2016

Some Early Thoughts On Liability Standards For Online Providers Of Legal Services, Benjamin H. Barton

Scholarly Works

This Article discusses a classic intersection of law, science, and technology. Just like common law courts adjusted the "mailbox rule" to cover fax machines, courts will have to adjust their existing approach to liability for harmful legal services, given the existence of new providers of legal services online.' The result is a clash of cultures between one of America's most conservative2 institutions-its common law courts-and some of its most aggressively forward looking ones-internet entrepreneurs.

Watson Institute For Public Policy Of Thomas Edison State University, New Jersey Urban Mayors Association, The Anti-Poverty Network Of New Jersey, Fund For New Jersey

Urban Mayors Policy Center

This report examines the problem of concentrated poverty in the State of New Jersey. Both the individual and the long-term economic consequences of concentrated poverty are well- documented in social science research. The report adds to that knowledge by examining the practical, budgetary consequences faced by urban centers that are characterized by high poverty levels. The report focuses on four cities, which are represented in the New Jersey Urban Mayors Association (NJUMA) — Bridgeton, Passaic, Perth Amboy, and Trenton. While these regions vary considerably, they all share one important fact: their poverty rates are double or triple the New Jersey …

Modeling The Likely Effects Of Litigation Financing, Jeremy Kidd Ph.D Jan 2016

Modeling The Likely Effects Of Litigation Financing, Jeremy Kidd Ph.D

Loyola University Chicago Law Journal

The arguments for and against third-party litigation financing are based on incorrect assumptions regarding the impacts on total litigation. A formal model incorporating the choices of the plaintiff, the lawyer, and the financier shows only minimal impact on total litigation, largely positive. Yet, after addressing the potential for long-term, strategic behavior by financiers, it is obvious that some dangers remain. Divorced from the dramatic claims of proponents and opponents, litigation financing is merely a tool that can be used for good or bad, and differentiating by types of claims and the incentives of the parties allows that tool to be …

A Comparison Between The American Markets For Medical And Legal Services, Benjamin H. Barton Jan 2016

A Comparison Between The American Markets For Medical And Legal Services, Benjamin H. Barton

Scholarly Works

America’s access to justice woes are paradoxical in a number of ways. We have more lawyers than every country, except for India, and more lawyers per capita than every country, except for Israel. We spend more on law as an absolute amount or as a percentage of GDP than any other country. At the high end, our so-called “Big Law,” we provide the best and most lucrative services in the world. Yet, we barely provide any legal services to the very poor, and American lawyers cost too much for the working poor or even the middle class. We graduate so …

Developing Skills Of Leadership Through Service Learning: Alice's Adventures In Wonderland And A Path To Effective Leadership, R. Brad Morgan

Tennessee Law Review

"What could a children's book have to say about leadership?" you may be thinking, "much less leadership in the legal profession?" Well, to that question I defer to one of the book's primary antagonists, the Duchess, and her simple, reassuring words: "'Tut, tut, child!' said the Duchess. 'Everything's got a moral, if only you can find it."'" And with that introduction, dear friends, I invite you to join me as we go down the rabbit hole ...
