Continuing in the rich vein of prior Annual Surveys, this article examines developments in Virginia civil procedure and practice in the past year. The survey includes a discussion of the relevant decisions from the Supreme Court of Virginia, changes to applicable rules of practice or procedure, and new legislation, which will likely affect the practice of a civil practitioner in the Commonwealth of Virginia.

This study explores the adaptation of design thinking to administrative justice. Design thinking – or human centred design – approaches services and products from the perspective of the user. This perspective too often is missing in the design of administrative tribunals, most of which have been developed top-down to serve the needs of a particular policy interest of the Government of the day.

North Slope oil has paid for most of Alaska state government—and indirectly, a big share of local government—since the 1980s. It’s also been the backbone for much of Alaska’s economic growth over time. But today, a combination of declining oil production and sharply lower oil prices has left the state budget billions of dollars in the red and is reverberating throughout the economy. How has the big drop in oil prices affected the Alaska economy so far? This paper looks at that question, using changes in the number of jobs— statewide, and also by census area and sector—as a gauge. …

On a substantive and ethical level, I tell my students to take on faith that if you were to do all of this and take all this into account, if you were to apply the conflict of interest and the disqualifications rules, it could make it extremely difficult or many of the firms involved in these matters to avoid being conflicted out; especially, if the parties and the kind of firms involved were not dealing with these conflicts and issues until a problem arose. International Trade V. Intellectual Property Lawyers:Globalization And The Brazilian Legal Profession, Vitor Martins Dias
Journal of Civil Law Studies
In the context of globalization, this work analyzes a distinctive characteristic of the Brazilian legal profession. Namely, intellectual property (IP) lawyers, who played important roles in opening the Brazilian economy and who were key players in cross-border transactions, are now losing ground to their peers with respect to expertise in international trade. The thesis of this article is that the manner in which Brazilian lawyers are being educated is problematic. Generally, Brazilian legal education has become degraded and provincial. Yet, Brazilian international trade lawyers, unlike Brazilian IP lawyers, have overcome their deficient legal training by seeking legal education abroad. By …

Limited License Legal Technicians: Non-Lawyers Get Access To The Legal Profession, But Clients Won’T Get Access To Justice, Julian Aprile

Washington Limited License Legal Technicians (LLLTs) are non-lawyers who will supposedly help to close “the wide and ever-growing gap in necessary legal and law related services for low and moderate income persons.” However, LLLTs will not close the access to justice gap because “[t]here are no protections . . . to ensure that legal technicians will actually provide services to the poor, as opposed to selling their services to those who can most afford them,” and LLLTs are “not going to have the competency to actually do for the poor what needs to be done.”

In the November 2016 election, Cache County residents will vote on Proposition #11, Formation of the Cache Water District. The question before voters is: Should the Cache Water District be created? Voters can respond “yes” or “no.” The Cache County Water Master Plan was released in 2013. Discussion and analysis conducted through that planning effort suggested that a water conservancy district would be the best organizational structure for Cache County and its municipalities to collectively and cooperatively manage water. Cache County created the Bridgerland Water Conservancy Work Group (BWC Work Group) to draft a purpose statement and bylaws for the …

This qualitative study conducted by a community-research partnership used multiple types of data collection to examine variables relevant for LGBTQ older adults who wished to age in place in their urban Denver neighborhood. Focus groups, interviews, and a town hall meeting were used to identify barriers and supports to aging in place. Participants (N=73) primarily identified as lesbian or gay, aged 50–69, and lived with a partner. Ageism, heterosexism, and/or cisgenderism emerged as cross-cutting themes that negatively impact access to healthcare, housing, social support, home assistance and legal services.
