Thinking Positively: Optimism And Emotion Regulation Predict Interpretation Of Ambiguous Information, Nakia S. Gordon, Samantha A. Chesney, Katherine Reiter
Thinking Positively: Optimism And Emotion Regulation Predict Interpretation Of Ambiguous Information, Nakia S. Gordon, Samantha A. Chesney, Katherine Reiter
Psychology Faculty Research and Publications
The way individuals interpret their worlds is influenced by emotion and its regulation. Indeed, negative affect typically increases negative interpretations of ambiguous stimuli and may have a role in dysfunctional psychosocial function. Yet, it is not currently known whether explicit and implicit emotion regulation can counteract this effect. To address this question, undergraduates (N = 103) used cognitive reappraisal under angry and control mood states to disambiguate sentences by selecting either a neutral, positive, or negative word. While explicit cognitive reappraisal decreased negative affect, it had no effect on interpretation of ambiguity. Still, reported use of reappraisal predicted decreased …

Comprehensive Behavioral Intervention for Tics (CBIT) is an efficacious treatment with limited regional availability. As neurology and pediatric clinics are often the first point of therapeutic contact for individuals with tics, the present study assessed preliminary treatment response, acceptability, and feasibility of an abbreviated version, modified for child neurology and developmental pediatrics clinics. Fourteen youth (9-17) with Tourette disorder across 2 child neurology clinics and one developmental pediatrics clinic participated in a small case series. Clinician-rated tic severity (Yale Global Tic Severity Scale) decreased from pre- to posttreatment, z = –2.0, P < .05, r = –.48, as did tic-related impairment, z …

Despite its prevalence and a growing body of research, significant gaps remain in the knowledge of trichotillomania (TTM). The current study sought to address this issue by examining personality characteristics, impulsivity, and experiential avoidance of those with TTM compared to an age and gender matched sample. 56 Female participants (28 with TTM and 28 non-clinical age-matched controls) completed the Personality Assessment Inventory (PAI), Barratt's Impulsivity Scale (BIS), and the Acceptance and Action Questionnaire (AAQ). Paired-sample t-tests compared each of the 28 individuals who met criteria for TTM to an age and gender matched individual who did not meet criteria …

Psychology Faculty Research and Publications
Objective: The current study sought to establish psychometric properties of the ADHD-FX (a culturally sensitive measure designed to assess functional impairment related to ADHD) in a dual-site clinical sample. Method: We analyzed patient charts of 67 children (47 boys and 20 girls, ages 5 to 15 years) receiving comprehensive assessments from two university-based ADHD clinics. Results: The parent and teacher ADHD-FX rating scales demonstrated good psychometric properties via adequate reliability (Cronbach’s α > .70), convergent construct validity (significant correlations with majority of theoretically related measures), and divergent construct validity (insignificant correlations with majority of theoretically unrelated measures). Conclusion: Results extend upon …

What Difference Do Bystanders Make? The Association Of Bystander Involvement With Victim Outcomes In A Community Sample, Sherry L. Hamby, Marcela C. Weber, John H. Grych, Victoria Banyard
Psychology Faculty Research and Publications
Objective: To fill gaps in the bystander literature by describing patterns of bystander involvement and associations between bystander involvement and victim outcomes across different types of emotional, physical, and sexual victimizations and to expand these considerations to a rural rather than urban sample. Method: Adults and adolescents (n = 1,703) were surveyed about bystander actions, bystander safety, and victim outcomes (injury, disrupted routine, fear level, and current mental health) for 10 forms of victimization. Results: Bystanders were present for roughly 2 thirds of most victimization types (59% to 67%), except sexual victimization (17%). Relatives were the most common bystanders of …

Strengths, Narrative, And Resilience: Restorying Resilience Research, Sherry L. Hamby, Victoria Banyard, John H. Grych
Psychology Faculty Research and Publications
Objective: To envision a path toward a more strengths-based approach to violence research, prevention, and intervention—a path that focuses on thriving and resilience. Key Points: Both the content and the process of research need to change if we are to transform our efforts to understand and overcome adversity. Greater focus on strengths and the achievement of well-being despite adversity is 1 important avenue; focusing on the narrative and the power of story is another important path. However, merely shifting the focus of traditional research and scholarly efforts is not enough. At another level of analysis, the field needs communication across …

Objective: This commentary reviews current conceptualizations of well-being, examines explanations for the lack of attention to well-being research, and provides justification for investing research time and funding into well-being studies. Opportunities for integrating factors related to well-being into prevention and intervention programs are also outlined. Key Points: Well-being may motivate people toward success, improve health and longevity, strengthen relationships, and boost the economy. Well-being can be enhanced in easy and inexpensive ways by incorporating facets of well-being into already-existing individual and systems-level intervention or prevention programs. Implications: Future research into this important construct should focus on objective means to assess …

Background: Effective interventions are needed to improve brain function in mild cognitive impairment (MCI), an early stage of Alzheimer’s disease (AD). The posterior cingulate cortex (PCC)/precuneus is a hub of the default mode network (DMN) and is preferentially vulnerable to disruption of functional connectivity in MCI and AD. Objective: We investigated whether 12 weeks of aerobic exercise could enhance functional connectivity of the PCC/precuneus in MCI and healthy elders. Methods: Sixteen MCI and 16 healthy elders (age range = 60–88) engaged in a supervised 12-week walking exercise intervention. Functional MRI was acquired at rest; the PCC/precuneus was used as a …

Psychology Faculty Research and Publications
Objective
To validate a brief measure of vaccination confidence using a large, nationally representative sample of parents.
Methods
We analyzed weighted data from 9018 parents who completed the 2010 National Immunization Survey–Teen, an annual, population-based telephone survey. Parents reported on the immunization history of a 13- to 17-year-old child in their households for vaccines including tetanus, diphtheria, and acellular pertussis (Tdap), meningococcal, and human papillomavirus vaccines. For each vaccine, separate logistic regression models assessed associations between parents' mean scores on the 8-item Vaccination Confidence Scale and vaccine refusal, vaccine delay, and vaccination status. We repeated analyses for the scale's 4-item …

Objective
To support efforts to address parental hesitancy towards early childhood vaccination, we sought to validate the Vaccination Confidence Scale using data from a large, population-based sample of U.S. parents.
Methods
We used weighted data from 9,354 parents who completed the 2011 National Immunization Survey. Parents reported on the immunization history of a 19- to 35-month-old child in their households. Healthcare providers then verified children’s vaccination status for vaccines including measles, mumps, and rubella (MMR), varicella, and seasonal flu. We used separate multivariable logistic regression models to assess associations between parents’ mean scores on the 8-item Vaccination Confidence Scale and …
Revisiting Congresssional Delegation Of Interpretative Primacy As The Foundation For Chevron Defense, Mark Seidenfeld
Revisiting Congresssional Delegation Of Interpretative Primacy As The Foundation For Chevron Defense, Mark Seidenfeld
Scholarly Publications
Although congressional delegation is the rationale used most often to justify the Chevron doctrine, most scholars who have written about this justification have recognized that it is a fiction, albeit, they claim, a useful one. In “Chevron’s Foundation,” I proposed an alternative foundation for the Chevron doctrine—a judicial self-limitation justification for Chevron deference—based on an implicit understanding of Article III that courts should not resolve cases by making policy choices where alternative means for deciding these cases exists. In this essay, I first revisit my original critique of the delegation rationale and explicitly respond to the arguments …
Finding Safe Harbor: Eliminating The Gap In Colorado's Human Trafficking Laws, Jessica A. Pingleton
Finding Safe Harbor: Eliminating The Gap In Colorado's Human Trafficking Laws, Jessica A. Pingleton
University of Colorado Law Review
In March 2014, the Colorado Court of Appeals acquitted Dallas Cardenas of all human trafficking charges. The court determined that under the 2014 version of Colorado's human trafficking statute, a defendant who sold the sexual services of a minor, as opposed to selling a minor for sex, did not commit the crime of human trafficking. Following the Cardenas decision, the state legislature passed House Bill 1273, which broadened the language of the statute and eliminated all possible affirmative defenses, including minor consent. Under the new law, a defendant can no longer argue that a minor consented to commercial sex. However, …
Person, State, Or Not: The Place Of Business Corporations In Our Constitutional Order, Daniel J.H. Greenwood
Person, State, Or Not: The Place Of Business Corporations In Our Constitutional Order, Daniel J.H. Greenwood
University of Colorado Law Review
Business corporations are critical institutions in our democratic republican, market-based, economic order. The United States Constitution, however, is completely silent as to their status in our system. The Supreme Court has filled this silence by repeatedly granting corporations rights against the citizenry and its elected representatives.
Instead, we ought to view business corporations, like municipal corporations, as governance structures created by We the People to promote our general Welfare. On this social contract view, corporations should have the constitutional rights specified in the text: none. Instead, we should be debating which rights of citizens against governmental agencies should also apply …
Racial Emotions And The Feeling Of Equality, Janine Young Kim
Racial Emotions And The Feeling Of Equality, Janine Young Kim
University of Colorado Law Review
This Article examines two distinct but related questions regarding race and emotions. The first raises the possibility that there are certain emotions that are so closely tied to racial experiences that they can be said to demonstrate and typify an emotional dimension to the construct of race. The second asks how such quintessentially racial emotions can be analyzed and evaluated, employing three theories of emotion that have developed in various disciplines within the humanities and social sciences. These theories reveal that racial emotions are not idiosyncratic and elusive, but instead relate to reason and values, to social membership and hierarchy, …

Little Sisters Of The Poor Home For The Aged V. Sebelius: Ramifications For Church Plans And Religious Nonprofits, Samantha T. Ford
University of Colorado Law Review
The mandate for certain employers to provide contraceptive care as part of their employees' benefit plans established by the Patient Protection and Affordable Care Act (PPACA) and pertinent regulations has been controversial and highly litigated since its passage in 2010. One party to this litigation, the Little Sisters of the Poor, finds the contraceptive care mandate to be in conflict with their fundamental religious beliefs. The Little Sisters also find PPACA's exceptions to the contraceptive care mandate for religious nonprofits to be inadequate in preventing the government from requiring the Little Sisters to violate their beliefs. Currently, the Little Sisters …
All Your Data Are Belong To Us: Consumer Data Breach Rights And Remedies In An Electronic Exchange Economy, Michael D. Simpson
All Your Data Are Belong To Us: Consumer Data Breach Rights And Remedies In An Electronic Exchange Economy, Michael D. Simpson
University of Colorado Law Review
Consumers navigating the United States' modern electronic exchange economy are uniquely vulnerable to injury from data breaches. Hackers run data breach operations on an industrial scale, with a worldwide underground economy supporting the processing and exploitation of stolen information. Economic damages from data breaches exceed millions of dollars annually in direct and indirect costs for consumers and businesses alike. While existing common law, statutory law, and regulatory law offer consumers affected by a data breach some degree of protection, that protection is largely inadequate in the face of the threat posed by consumer data breaches. This Comment argues that consumers …

Legal Adaptive Capacity : How Program Goals And Processes Shape Federal Land Adaption To Climate Change, Alejandro E. Camacho, Robert L. Glicksman
University of Colorado Law Review
The degree to which statutory goals are pliable is likely to significantly affect the ability of an agency with regulatory or management responsibilities to achieve those objectives in the face of novel challenges or changing circumstances. This Article explores this dynamic by comparing the degree of 'ive" provided by the goals of the regimes governing management of the five types of federal public lands in responding to the challenges posed by climate change. A comparative analysis of federal land adaptation to climate change demonstrates that a management regime's legal adaptive capacity is influenced not only by procedural flexibility, but also …
To Have Our Water And Use It Too : Why Colorado Water Law Needs A Public Interest Standard, Larry Myers
To Have Our Water And Use It Too : Why Colorado Water Law Needs A Public Interest Standard, Larry Myers
University of Colorado Law Review
This Comment proposes constitutional and statutory amendments that would allow water courts to consider the public interest in water allocations. It offers a model public interest standard and argues that this public interest standard is an economic necessity given the shifting contributions of water-reliant industries and the nature of their water needs. Assuming the purpose of Colorado water law is to promote growth and the economic health of the state, then Colorado must adjust the guiding laws to reflect the current economic reality. Where facilitating economic growth formerly required consumptive diversions from streams to subsidize homesteads, ranches, and mines, now …

Us Libor Reaction To Us Monetary Surprises, Ellis Heath
Journal of Business, Industry, and Economics
The Federal Open Market Committee announcement of the Federal Fund Target Rate is one of the most important policy news items in the world. Additionally, the role of the US London Interbank Offered Rate (LIBOR) and LIBOR-Federal Fund Effective Rate spreads are important for financial markets. This relationship is well-documented. Here, the relationship between varying maturities of the US LIBOR to unexpected changes in Federal Fund Target Rate is examined. The spread between the Federal Fund Effective Rate and the US LIBOR as it relates to these US monetary shocks is looked at. An event study analysis is used. The …
Interaction Between The Legislative And Regulatory Process: The Case Of State Level Electricity Restructuring, Earl H. Davis
Interaction Between The Legislative And Regulatory Process: The Case Of State Level Electricity Restructuring, Earl H. Davis
Journal of Business, Industry, and Economics
For several years beginning in the early ‘90s, states attempted to bring competition and the resulting lower cost to the provision of electric power within the states through restructuring. This paper attempts to model the behavior of legislatures in reaction to the decisions of regulators as well as their own institutional incentives using a panel dataset of the 48 states across the 8 years in which restructuring was occurring.

Smartphone Microendoscopy For High Resolution Fluorescence Imaging, Xiangqian Hong, Vivek K. Nagarajan, Dale H. Mugler, Bing Yu
Biomedical Engineering Faculty Research and Publications
High resolution optical endoscopes arc increasingly used in diagnosis of various medical conditions of internal organs, such as the cervix and gastrointestinal (GI) tracts, but they are too expensive for use in resource-poor settings. On the other hand, smartphones with high resolution cameras and Internet access have become more affordable, enabling them to diffuse into most rural areas and developing countries in the past decade. In this paper, we describe a smartphone microendoscope that can take fluorescence images with a spatial resolution of 3.1 μm. Images collected from ex vivo, in vitro and in vivo samples using the device …

Conception Des Cordes D’Assurance Horizontales Pour La Protection Contre Les Chutes De Hauteur : Mise À Jour Du Guide Technique, Bertrand Galy, André Lan

The goal of this study was to investigate the role of MLC phosphatase (MLCP) in a LPS model of acute lung injury (ALI). We demonstrate that ectopic expression of a constitutively-active (C/A) MLCP regulatory subunit (MYPT1) attenuates the ability of LPS to increase endothelial (EC) permeability. Down-regulation of MYPT1 exacerbates LPS-induced expression of ICAM1 suggesting an anti-inflammatory role of MLCP. To determine whether MLCP contributes to LPS-induced ALI in vivo, we utilized a nanoparticle DNA delivery method to specifically target lung EC. Expression of a C/A MYPT1 reduced LPS-induced lung inflammation and vascular permeability. Further, increased expression of the …
