Despite a great deal of academic literature surrounding domestic abuse in general, it is fair to suggest that the majority of research focuses on male perpetrated domestic abuse and the female victim. This therefore neglects the complexity of domestic abuse as a crime, whilst also undermining and causing further implications for the unrecognised and under researched male victim. Contemporary English abortion law is now typically thought to be a development of the twentieth century, and little academic attention has been paid to its development before the 1938 case of R v Bourne or the Abortion Act 1967. Sir James Fitzjames Stephen's nineteenth century perspectives on pregnancy, abortion and the doctrine of necessity informing the basis of contemporary governance of abortion, child destruction, and infanticide as distinct from homicide, are often overlooked. A comprehensive debate on the interface between IP (Intellectual Property) and European competition law has emerged over the past 50 years. The initial section of this article examines the gradual development of this conflicting relationship between the two laws. The problematic construction of domestic abuse as a 'gendered, heterosexual phenomenon that is predominantly physical in nature' has served to marginalise male victims of domestic abuse (Donovan and Hester, 2010:279), and impeded them from reaching victim status (Josolyne, 2011). As such, in comparison to women, men receive less recognition as victims within society, and support services are tailored towards the needs of female victims. The release of the film Suffragette in October 2015, surprisingly the first major feature film on the women's suffrage movement, has raised public consciousness about the issue of women's rights and the role of the suffragettes in demanding votes for women with their call to arms of 'deeds, not words'. But decades before the Women's Social and Political Union was created in 1903 campaigners across the country had begun the struggle for emancipation for women. The UK government has struggled with controlling the legal high problem since the emergence of mephedrone in 2009. Academic research has provided detailed knowledge on how people perceive these substances, mainly focusing on mephedrone, but has yet to identify a viable solution to escalating usage and availability. This research aimed to determine young adults' (18-26) current perceptions of legal highs and to assess how this might help government shape current proposed policy and futurelegislation more successfully. The Petrockstowe and Bovey basins are two similar pull apart (strike slip) basins located on the Sticklepath – Lustleigh Fault Zone (SLFZ) in Devon, SW England. The SLFZ is one of the several faults on the Cornubian Peninsula and may be linked to Variscan structures rejuvenated in Palaeogene times. The bulk of the basins’ fill consists of clays, silts, lignites and sands of Palaeogene age, comparable to the Lough Neagh Basin (Northern Ireland), which is also thought to be part of the SLFZ. This article aims to explore the changing reality of domestic abuse service provision to victims of domestic abuse in the South West of England. By interviewing the professionals who work with the victims, it explores how cuts to funding is altering provisions for victims and multi-agency working and the realities of the move to tendering via the commissioning process. Results illustrate that austerity measures and government reforms have negatively affected domestic abuse service provision over recent years. Background: Pressure ulcers are a serious, common, lifelong, and costly secondary complication of spinal cord injury (SCI). Community-dwelling people with a SCI can prevent them with appropriate skin care (i.e. pressure relieving activities, skin checks). Background: Epstein-Barr virus (EBV) infection represents a major environmental risk factor for multiple sclerosis (MS), with evidence of selective expansion of Epstein-Barr Nuclear Antigen-1 (EBNA1)-specific CD4+ T cells that cross-recognize MS-associated myelin antigens in MS patients. HLA-DRB1*15-restricted antigen presentation also appears to determine susceptibility given its role as a dominant risk allele. In this study, we have utilised standard and next-generation sequencing techniques to investigate EBNA-1 sequence variation and its relationship to HLA-DR15 binding affinity, as well as examining potential cross-reactive immune targets within the central nervous system proteome.

As a result, a mentally ill person can be confined against his or her will, to remain in the hospital indefinitely. The mentally ill person’s freedom depends on the outcome of a single hearing. In a unique corner of immigration law, a significant reallocation of power over immigration has been occurring with little fanfare. States play a dramatic immigration gatekeeping role in the process for providing protection to immigrant youth, like many of the Central American children who sought entry to the United States in the 2014 border “surge.” This article closely examines the history of this Special Immigrant Juvenile Status provision, enacted in 1990, which authorized a vital state role in providing access to an immigration benefit. What are the legitimate types of argument in constitutional debate? This is a perennial question in American law and every generation of constitutional scholars has the right to ask it anew. For over thirty years, Phillip Bobbitt’s taxonomy of legitimate constitutional argument types has reigned as the most influential and enduring in the scholarly discourse. In a recent article, Jamal Greene has proposed a welcome but flawed rhetorical re-conception of Bobbitt’s venerable typology. By identifying and correcting the errors in Greene’s framework, this Article provides a rigorous theoretical grounding for the entire constitutional law and rhetoric project.

Several satellite-based methods have been used to detect and trace Karenia brevis red tide blooms in the eastern Gulf of Mexico. Some require data statistics and multiple data products while others use a single data product. Of these, the MODIS normalized fluorescence line height (nFLH) has shown its advantage of detecting blooms in waters rich in colored dissolved organic matter, thus having been used routinely to assess bloom conditions by the Florida Fish and Wildlife Conservation Commission (FWC), the official state agency of Florida responsible for red tide monitoring and mitigation. Introduction: Tendon dynamics influence movement performance and provide the stimulus for long-term tendon adaptation. As tendon strain increases with load magnitude and decreases with loading rate, changes in movement speed during exercise should influence tendon strain.

Methods: Ten resistance-trained men [squat one repetition maximum (1RM) to body mass ratio: 1.65 ± 0.12] performed parallel-depth back squat lifts with 60% of 1RM load at three different speeds: slow fixed-tempo (TS: 2-s eccentric, 1-s pause, 2-s concentric), volitional-speed without a pause (VS) and maximum-speed jump (JS). In fiscal year 2014, 43 percent of all cases filed in Maryland’s trial court of general jurisdiction (the circuit court) were family law cases (Court Operations Department, 2014: CC-5). Historically, Maryland courts, like many states’ family justice systems, lacked a uniform structure to consolidate family law issues for an individual family. As a result, families often faced multiple hearings before different judges in different courtrooms to address a variety of issues, such as divorce, domestic violence, delinquency, and child abuse/neglect. Luminaries ranging from the President to the Pope to economist Thomas Piketty in his bestselling book Capital in the Twenty- First Century have raised alarms about the disparity between the haves and the have-nots. Overlooked, however, in these important discussions is the reality that economic inequality is not a uniform experience; rather, its effects fall more harshly on women and minorities. The Obama Administration's "Clean Power Plan" for addressing industrial carbon emissions is controversial as a matter of environmental policy. It also has important constitutional implications. The rule was initially crafted not by officers or employees of the Environmental Protection Agency, but by two private lawyers and a scientist with industry ties. Private parties operate extra-constitutionally, and no existing legal doctrine tethers constitutional scrutiny to the nature of the power delegated to them. The nondelegation doctrine applies to delegations by Congress-not to agencies' subdelegations of legislative power to private parties. Currently, the estate tax does not accurately value the property and transactions that it is meant to cover. Additionally, the marital and charitable deductions do not reflect actual associated transfers, instead skewing their benefits away from their purported beneficiaries. This Article proposes reforming the estate tax by eliminating these sources of unreality and distortion, and to make the current estate tax a reality-based tax. Through six specific proposals, the Article identifies solutions to the problems associated with testamentary transfers, puts forth alternative methods of valuation to prevent gaming of transfer taxes, and offers significant modifications to two deduction provisions.

The movement to reduce over-prosecution and mass incarceration has focused almost exclusively on non-violent offenders despite data showing that over half of all prisoners incarcerated within the United States are sentenced for crimes of violence. As a consequence of the focus on nonviolent offenses, the majority of current and future defendants will not benefit from initiatives offering alternatives to criminal prosecution and incarceration.

Across all levels of sport—professional, Olympic, intercollegiate, interscholastic, and youth recreational—the prevailing view is that the government should not take an active role in regulating athletics. As a result, there are relatively few federal or state statutes directed at regulating sports, and those that are aimed at sports primarily serve to support the professional sports industry. Moreover, courts show great deference to sports leagues and administrators, most often applying law in a way that insulates and empowers them. Toric intraocular lenses (IOLs) are designed to reduce spectacle dependency by correcting corneal astigmatism at the time of surgery. However, these IOLs are reliant on the accurate prediction of post-operative corneal astigmatism through reliable ocular biometry and the accurate calculation of surgically induced astigmatism. In the thesis the repeatability of assessing corneal curvature was assessed using six commercially available keratometers. The results question the validity of corneal biometry and infer that much of the apparent change in corneal shape usually associated with surgically induced astigmatism may be due to measurement error. In current mammography practice, radiologists typically view mammograms in a symmetric, side-by-side, configuration in the belief that abnormalities will be made salient because they break the perceived symmetry. The literature on the use of symmetry as an aid to signal detection is limited and this thesis has taken a psychophysical approach to investigate the radiologist’s task of detecting a small mass (a blob) in paired mammogram backgrounds. Oxaliplatin is an anticancer drug widely used in cancer chemotherapy. This thesis evaluates whether a specific dose-banding scheme for oxaliplatin could replace the individual dosing method that is currently used in the oxaliplatin administration. Dose-banding was introduced into UK clinical practice in 2001, as it reduces delays in patients receiving their treatment and, through quality control and end-product testing, safeguards the infusion quality and patient safety. The role of natural environments, especially ‘green space’, in promoting human health and well-being is well-researched. However, less is known about the benefits of ‘blue space’ (e.g. the coast) or ‘managed’ nature (e.g. zoos). In this thesis, six studies investigated the restorative potential of sub-aquatic settings, specifically public aquariums and the biological diversity within them.
