Regulating Off-Label Promotion — A Critical Test, Christopher Robertson, Aaron S. Kesselheim Dec 2016

Regulating Off-Label Promotion — A Critical Test, Christopher Robertson, Aaron S. Kesselheim

Faculty Scholarship

In 2012, the U.S. Court of Appeals for the Second Circuit handed down a landmark decision in the case of pharmaceutical sales representative Alfred Caronia. The Food and Drug Administration (FDA) had approved sodium oxybate (Xyrem) for treating narcolepsy, but Caronia promoted it for a wide range of nonapproved (off-label) indications, including insomnia, Parkinson’s disease, and fibromyalgia. Off-label use is common, especially in specialties such as oncology, in which it may even be considered the standard of care. However, surveys have revealed that supporting evidence is lacking for a majority of off-label uses of medical products.1 The uses Caronia …

The Roberts Court And The New Textualism, Anton Metlitsky Dec 2016

The Roberts Court And The New Textualism, Anton Metlitsky

Cardozo Law Review

The article explores the Roberts Court's approach to statutory interpretation, focusing on its adherence to the "new textualism," a methodology emphasizing the plain meaning of statutory text. While recent cases like King v. Burwell, Bond v. United States, and Yates v. United States appear to prioritize statutory purpose over textual meaning, the Court's reasoning reinforces its commitment to textualism by framing decisions within textualist methodology, even when outcomes seem to depart from strict textual interpretation.

The Plain Language Court, David A. Strauss Dec 2016

The Plain Language Court, David A. Strauss

Cardozo Law Review

The Roberts Court, under Chief Justice John Roberts, has demonstrated a strong and consistent commitment to the plain language approach in statutory interpretation. This approach emphasizes interpreting statutes based on their literal text, often without considering legislative history or broader statutory purposes. The Court's decision in Milner v. Department of the Navy exemplifies this trend, where the Court adhered to the plain language of the Freedom of Information Act (FOIA) despite significant policy concerns. This approach has become more unanimous among the justices, reflecting a shift from earlier Courts that were more divided on this method.

Property Rights And International Trade: An Institutional Determinant Of Export Structure, Gregory Alan Bonadies Dec 2016

Property Rights And International Trade: An Institutional Determinant Of Export Structure, Gregory Alan Bonadies

Dissertations

This work investigates the connection, independent of other factors, between a country’s system of law and property rights and patterns of trade. Stronger property rights institutions are hypothesized to lead to greater diversity in exports and a greater proportion of higher value-added exports. Production and export possibilities depend on capital, labor, and technology. Technology is the way in which capital and labor resources can be organized for productive purposes. Property rights condition expressions of technology and thus production possibilities and export potential. Consequently, if property rights vary between countries, then technological expression, production possibilities, and export potential vary as well. …

Investigation Of Polymer–Plasticizer Blends As Sh-Saw Sensor Coatings For Detection Of Benzene In Water With High Sensitivity And Long-Term Stability, Pintu Adhikari, Laura Jeanne Alderson, Florian Bender, Antonio J. Ricco, Fabien Josse

Electrical and Computer Engineering Faculty Research and Publications

We report the first-ever direct detection of benzene in water at concentrations below 100 ppb (parts per billion) using acoustic wave (specifically, shear-horizontal surface acoustic wave, SH-SAW) sensors with plasticized polymer coatings. Two polymers and two plasticizers were studied as materials for sensor coatings. For each polymer–plasticizer combination, the influence of the mixing ratio of the blend on the sensitivity to benzene was measured and compared to commercially available polymers that were used for BTEX (benzene, toluene, ethylbenzene, and xylene) detection in previous work. After optimizing the coating parameters, the highest sensitivity and lowest detection limit for benzene were found …

Zero++: Harnessing The Power Of Zero Appearances To Detect Anomalies In Large-Scale Data Sets, Guansong Pang, Kai Ming Ting, David Albrecht, Huidong Jin

Research Collection School Of Computing and Information Systems

This paper introduces a new unsupervised anomaly detector called ZERO++ which employs the number of zero appearances in subspaces to detect anomalies in categorical data. It is unique in that it works in regions of subspaces that are not occupied by data; whereas existing methods work in regions occupied by data. ZERO++ examines only a small number of low dimensional subspaces to successfully identify anomalies. Unlike existing frequencybased algorithms, ZERO++ does not involve subspace pattern searching. We show that ZERO++ is better than or comparable with the state-of-the-art anomaly detection methods over a wide range of real-world categorical and numeric …

Cloud-Enhanced Robotic System For Smart City Crowd Control, Akhlaqur Rahman, Jiong Jin, Antonio Cricenti, Ashfaqur Rahman, Marimuthu Palaniswami, Tony Tie Luo

Computer Science Faculty Research & Creative Works

Cloud robotics in smart cities is an emerging paradigm that enables autonomous robotic agents to communicate and collaborate with a cloud computing infrastructure. It complements the Internet of Things (IoT) by creating an expanded network where robots offload data-intensive computation to the ubiquitous cloud to ensure quality of service (QoS). However, offloading for robots is significantly complex due to their unique characteristics of mobility, skill-learning, data collection, and decision-making capabilities. In this paper, a generic cloud robotics framework is proposed to realize smart city vision while taking into consideration its various complexities. Specifically, we present an integrated framework for a …
