The Judge Is The Key Component: The Importance Of Procedural Fairness In Drug-Treatment Courts, Brian Mackenzie Jan 2016

The Judge Is The Key Component: The Importance Of Procedural Fairness In Drug-Treatment Courts, Brian Mackenzie

Court Review: Journal of the American Judges Association

Beginning in the 1960s, the United States has suffered from waves of illicit drug epidemics, which have exerted immense stress on our system of criminal justice.2 For decades, the governmental response has been to wage a “War on Drugs” that has siphoned funding away from our nation’s schools and into the budgets of our correctional systems.3 In spite of the considerable amount of taxpayer dollars that has been dedicated to enforcement and incarceration initiatives, substance abuse remains a driving force in the criminal-justice system.4 After five decades of inefficient spending and ineffective imprisonment, governments at every level are realizing just …

Conjunctive Groundwater Management As A Response To Social Ecological Disturbances: A Comparison Of Four Western U.S. States, Sonya Ziaja, Zachary P. Sugg, Edella C. Schlager

All Faculty Scholarship

Recent severe droughts in U.S. western and Great Plains states have highlighted the challenges that socio-ecological disturbances can pose for governing groundwater resources, as well as the interconnections between groundwater and surface water and the need to manage the 2 in an integrated way. Conjunctive management recognizes these interconnections and can be used to mitigate disturbances and achieve a variety of water management goals. However, comparative studies of how and to what extent various states have implemented conjunctive management strategies are few. Here we compare and assess the use of conjunctive management practices in 4 western state —Arizona, California, Nebraska, …

Winter Distribution And Size Structure Of Antarctic Krill Euphausia Superba Populations In-Shore Along The West Antarctic Peninsula, Alison C. Cleary, Edward G. Durbin, Maria C. Casas, Meng Zhou Jan 2016

Winter Distribution And Size Structure Of Antarctic Krill Euphausia Superba Populations In-Shore Along The West Antarctic Peninsula, Alison C. Cleary, Edward G. Durbin, Maria C. Casas, Meng Zhou

Graduate School of Oceanography Faculty Publications

Antarctic krill Euphausia superba are a key component of food webs in the maritime West Antarctic Peninsula, and their life history is tied to the seasonal cycles of sea ice and primary production in the region. Previous work has shown a general in-shore migration of krill in winter in this region; however, the very near-shore has not often been sampled as part of these surveys. We investigated distribution, abundance, and size structure of krill in 3 fjordic bays along the peninsula, and in the adjacent Gerlache Strait area using vertically stratified MOCNESS net tows and ADCP acoustic biomass estimates. Krill …

The Use Of Song To Open An Educational Development Workshop: Exploratory Analysis And Reflections, Lawrence Lesser, Song An, Daniel Tillman Jan 2016

The Use Of Song To Open An Educational Development Workshop: Exploratory Analysis And Reflections, Lawrence Lesser, Song An, Daniel Tillman

To Improve the Academy: A Journal of Educational Development

Song has been used by faculty of many disciplines in their classrooms and, to a lesser extent, by educational developers in workshops. This paper shares and discusses a new song (about an instructor’s evolving openness to alternatives to lecture only teaching) and its novel use to open an educational development workshop. Self reported participant data from an exploratory survey suggest that the song was most effective in reducing stress as well as in increasing motivation, morale, engagement, and connection. Practical implications and implementation considerations are discussed regarding the song as well as related creative work.

The 2016 Election And The Future Of Constitutional Law: The Lessons Of 1968, Earl M. Maltz Jan 2016

The 2016 Election And The Future Of Constitutional Law: The Lessons Of 1968, Earl M. Maltz

UC Law Constitutional Quarterly

The upcoming presidential election of 2016 may very well become a pivotal moment in the evolution of American constitutional doctrine. Given Justice Scalia's untimely passing and the ages of a number of the sitting justices, the next President could easily have the opportunity to choose several new members of the Court. Moreover, because the Court is currently divided almost equally along ideological lines, even a single appointment could have the effect of turning the overall orientation of the Court's decisions sharply to either the right or the left.

To illustrate the effect that a single election can have on the …

The Rise Of White-Segregated Subsidized Housing, Institute On Metropolitan Opportunity Jan 2016

The Rise Of White-Segregated Subsidized Housing, Institute On Metropolitan Opportunity

Studies

Minneapolis and Saint Paul are currently operating what is, in effect, a dual subsidized housing system. In this system, the majority of units are available in lower-cost, utilitarian developments located in racially segregated or diverse neighborhoods. These units are mostly occupied by families of color. But an important subset of units are located in predominately white neighborhoods, in attractive, expensive buildings. These units, which frequently are subject to special screening requirements, are mostly occupied by white tenants.

The Grass Is Not Always Greener: Congressional Dysfunction, Executive Action, And Climate Change In Comparative Perspective, Hari Osofsky, Jacqueline Peel Jan 2016

The Grass Is Not Always Greener: Congressional Dysfunction, Executive Action, And Climate Change In Comparative Perspective, Hari Osofsky, Jacqueline Peel

Articles

Partisan climate change politics, paired with a legislative branch that is often deeply divided between two parties, has led to congressional gridlock in the United States. Numerous efforts at passing comprehensive climate change legislation have failed, and little prospect exists for such legislation in the foreseeable future. As a result, executive action under existing federal environmental statutes--often in interaction with litigation--has become the primary mechanism for national-level regulation of greenhouse gas emissions from motor vehicles and power plants. Although many observers critique this state of affairs and wish for a legislature more able to act. this essay argues that more …

Distribution Of Uranium And Other Radionuclides In Coal And Coal Combustion Products, With Discussion Of Occurrences Of Combustion Products In Kentucky Power Plants, James C. Hower, Shifeng Dai, Greta Eskenazy

Coal Combustion and Gasification Products Journal Archive

Uranium and thorium are part of the mineral assemblages within coals. Uranium can also occur in organic associations, particularly in low-rank coals. While the average U concentration in coals is 2.9 ppm for low-rank coals and 1.9 ppm for bituminous and higher rank coals, high concentrations are known from certain low-rank and thin coals and from coals in areas associated with U mineralization. No high-U coals are mined for power production in the United States. Uranium and Th in coal combustion products are found in amounts more or less in proportion to their concentrations in the feed coal. Not being …

Group Contingency Interventions For Classroom Behavior Management: A Systematic Review Of The Literature 2011-2016, Danielle M. Crawford Duff

Theses and Dissertations--Early Childhood, Special Education, and Counselor Education

The purpose of this review was to evaluate the current literature base on the use of group contingency interventions to determine whether there is sufficient empirical evidence to recommend the practice for behavior management in K-12 classrooms. Studies were evaluated based on standards proposed by the What Works Clearinghouse. The results of the review indicate support for group contingencies as an evidence-based practice and highlight a need for increased experimental rigor and more detailed reporting to determine whether the interventions are effective and for which populations or settings they are most appropriate.

To Be Magic: The Art Of Ana Mendieta Through An Ecofeminist Lens, Elizabeth Ann Baker Jan 2016

To Be Magic: The Art Of Ana Mendieta Through An Ecofeminist Lens, Elizabeth Ann Baker

Honors Undergraduate Theses

Ana Mendieta was a Cuban-born American artist whose unique body of work incorporated performance, activism, Earth art, installation, and the Afro-Cuban practices of Santería. She began her career at the University of Iowa, were she initially received her degree in painting in 1969. It was not until 1972 that Mendieta shifted radically to performance art.

Though she was raised Catholic, she developed an interest in the rituals involved with Santería, a culturally predominant Cuban religion, and it deeply influenced her work in her choice of materials and settings. Santería is one of the major faith-based lifestyles of Cuba …

Two Terms Of The Cuban Counterpoint: Transculturation In The Poetry Of Nicolás Guillén, Alanna L. Fulk

Honors Undergraduate Theses

The history of Latin America and the Caribbean was irreversibly altered by the arrival of the conquistadors, destruction of native civilizations and implementation of colonialism for hundreds of years. However, Spain also introduced the high culture of the baroque to Latin America and the Caribbean, which mixed with the cultures of native and African peoples, creating new, distinct forms of literary expression. Subsequent post-colonial cultural movements attempted to explore and reaffirm the variety of cultures that shaped both regions, including the movement of Afrocubanismo in Cuba, which occurred from 1910-1940. Afrocubanismo was a movement intended to incorporate African folklore and …

Characteristics Of United States Seafood Consumers, Suliman Almojel Jan 2016

Characteristics Of United States Seafood Consumers, Suliman Almojel

Theses and Dissertations--Agricultural Economics

In this thesis, I conducted an analysis of the consumption patterns associated with demographic and socio-economic characteristics, using Tobit and double-hurdle models. Data were collected for 11,574 households from the US Bureau of Labor Statistics for the year of 2014. Specific determinants included household size, age, income, gender, education, race, region, marital status, and whether the household lived in a coastal state. The results reveal that seafood expenditures are sequential decisions. Asian racial groups, households headed by married couples, a large number of members in households, higher income households, and households residing in the Atlantic and Gulf Coasts were variables …

Arctic Energy Cooperation, Hari M. Osofsky, Jessica Shadian, Sara L. Fechtelkotter Jan 2016

Arctic Energy Cooperation, Hari M. Osofsky, Jessica Shadian, Sara L. Fechtelkotter

Articles

The Arctic – with almost a third of the world’s remaining natural gas and thirteen percent of its oil – is one of the globe’s last frontiers for competition over unexplored natural resources. The rapid pace of Arctic melting due to climate change has created opportunities to extract the region’s previously inaccessible offshore oil and gas. The 2015 controversy over the Obama Administration’s approval of Shell Oil’s drilling in the Chukchi Sea followed by the company’s decision to pull out highlighted the need for clear and effective regulation of Arctic drilling. Offshore oil spills are difficult to prevent and clean …

A Compilation Of Global Bio-Optical In Situ Data For Ocean-Colour Satellite Applications, Frank E. Muller-Karger

Marine Science Faculty Publications

A compiled set of in situ data is important to evaluate the quality of ocean-colour satellite-data records. Here we describe the data compiled for the validation of the ocean-colour products from the ESA Ocean Colour Climate Change Initiative (OC-CCI). The data were acquired from several sources (MOBY, BOUSSOLE, AERONET-OC, SeaBASS, NOMAD, MERMAID, AMT, ICES, HOT, GePandCO), span between 1997 and 2012, and have a global distribution. Observations of the following variables were compiled: spectral remote-sensing reflectances, concentrations of chlorophyll α, spectral inherent optical properties and spectral diffuse attenuation coefficients. The data were from multi-project archives acquired via the open internet …

An Analysis Of The Migration Policies Of The European Union And Their Effectiveness In Managing The Current Migration Crisis, Michael Blair

MA IDS Thesis Projects

The current migration of individuals into the European Union is creating an unparalleled and unprecedented crisis that has completely overwhelmed the EU Member States. Migrants entering the European Union have done so via dangerous and deadly sea and land routes, resulting in a devastating humanitarian crisis throughout Europe. As conflicts and instability around the world continue to evolve and escalate, larger flows of migrants continue to pour into the European Union causing the irregular migration of people across Europe’s borders. To counter this, European Union officials have attempted to create migration policies based on border management and security ideals. However, …
