Overlapping Financial Investor Ownership, Market Power, And Antitrust Enforcement: My Qualified Agreement With Professor Elhauge, Jonathan Baker

Scholarly Articles in Law Reviews & Journals

As is well known among financial economists but not previously recognized within the antitrust community, large and diversified institutional investors such as BlackRock, Fidelity, State Street, and Vanguard collectively own roughly two-thirds of the shares of publicly traded U.S. firms overall, up from about one-third in 1980. Recent economic research involving airlines and banking raises the possibility that overlapping ownership of horizontal rivals by diversified financial institutions facilitates anticompetitive conduct throughout the economy, and that the problem has been growing for decades, unnoticed until now. This response to an article by Professor Einer Elhauge, explains why it may be more …

Nonhuman Mind-Reading Ability, Marthe Kiley-Worthington Jan 2016

Nonhuman Mind-Reading Ability, Marthe Kiley-Worthington

Animal Sentience

Harnad (2016) is mistaken that humans are better at mind-reading than other species. Humans have context-independent language, but nonhuman species, especially mammals, have context-dependent nonverbal skills – perceptual, communicative and social -- that can be much keener than our own.

Modulation Of Behavior In Communicating Emotion, Martin Gardiner Jan 2016

Modulation Of Behavior In Communicating Emotion, Martin Gardiner

Animal Sentience

King discusses many examples where two animals, as they bond, behave in ways we interpret as expressing love for one another. If one of the bonded animals then dies, signs of loving are replaced by signs we interpret as expressing grief by the animal who remains. I propose a pathway for emotional communication between an animal and an observer that can have a central role in these and other observations by King and in our overall ability to interpret observed behavior in relation to emotion. This pathway provides evidence of emotion in an observed animal by communicating evidence of emotion’s …

Chemically-Mediated Prey Responses: Invasive Brook Stickleback Induced Changes In Behavior And Life History Of Larval Long-Toed Salamanders, Renae K. Reed Jan 2016

Chemically-Mediated Prey Responses: Invasive Brook Stickleback Induced Changes In Behavior And Life History Of Larval Long-Toed Salamanders, Renae K. Reed

EWU Masters Thesis Collection

"The purpose of this research was to assess the predator-induced responses of a larval amphibian to its natural predators and to an unfamiliar fish. Amphibians express chemically-mediated antipredator defenses in behavior, morphology and life history, and are currently threatened with predation by invasive fish. To investigate this issue, we first initiated a behavioral assay to test the null hypotheses that predator type and diet have no effect on long-toed salamander (Ambystoma macrodactylum) behavior. We exposed individual replicate A. macrodactylum to chemical cues (kairomones) from garter snakes (Thamnophis elegans), tiger salamanders (A. tigrinum) and brook stickleback (Culaea inconstans), which had been …

Reviewing Critical Pedagogy's Criticisms And Providing A Pragmatic Heuristic, Dominick S. Giguere

EWU Masters Thesis Collection

"This article reviews scholarly literature about problems in critical pedagogy, pragmatic examples of implementing critical pedagogy, professional learning communities, and critical pedagogy-based curricula in new media toward proposing part of a broad solution to some of critical pedagogy's criticisms in reaching out to educators: the use of a heuristic that critical pedagogues could use to determine the accessibility in tone of curricula that they could reference to colleagues whom may not know about or otherwise avoid critical pedagogy. Under this initiative, a heuristic is developed based on a review of literature defining and characterizing critical pedagogy. This heuristic is then …

Invertebrate Drift In The Upper Columbia River With Implications For Young-Of-The-Year White Sturgeon, Ryan W. Reihart Jan 2016

Invertebrate Drift In The Upper Columbia River With Implications For Young-Of-The-Year White Sturgeon, Ryan W. Reihart

EWU Masters Thesis Collection

"White sturgeon (Acipenser transmontanus) in the upper Columbia River have been in decline for over 60 years and are listed as critically endangered by the International Union for Conservation of Nature. Annual spawning produces dispersing larvae; however, recruitment into the juvenile age class has not occurred since the early 1970s. One hypothesis to explain this failure in recruitment is that larvae may not find adequate prey. Little is known about diet and prey availability for white sturgeon larvae, especially in Lake Roosevelt, a reservoir of the Columbia River. The Spokane Tribe of Indians collected littoral and mid-channel benthic drift samples …

Synchronization Techniques In Multilingual Fiction: Voiced-Over Films In Poland, Katarzyna Sepielak Jan 2016

Synchronization Techniques In Multilingual Fiction: Voiced-Over Films In Poland, Katarzyna Sepielak

Sociology Faculty Publications

This descriptive analysis of four multilingual fiction films voiced-over into Polish—Nine, Avatar, Vicky Cristina Barcelona, and Inglourious Basterds—provides insight into the application of different types of synchrony and their function in multilingual movies as well as the relation between synchronization and translation techniques. The results raise important questions about the main assumptions of voice-over translation, such as the illusion of authenticity, voice-over isochrony, and the reasoning behind literal synchrony.

Four Days That Transformed Spain 11-M Impact On Memory Recovery Examined Through The Lens Of Duality, Thomas J. Divins

Graduate Theses, Dissertations, and Problem Reports (ETD)

This thesis studies the controversial aftermath of the Madrid terrorist attack of March 11, 2004 and how it impacted the history of memory and silence in Spain since the Spanish Civil War. The terrorist attack had surprising and significant short-term political impacts, which have been well documented by historians, political scientists, and journalists. However, surveying the attack aftermath through the lens of the history of duality in Spain has been less studied. The "lens of duality" is the viewpoint that Spain's history in the twentieth and twenty-first centuries can be explained as a clash between deeply-divided sectors within society which …

Graduate Theses, Dissertations, and Problem Reports (ETD)

This written thesis is the supporting documentation for A Case of the Mundanes, my Master of Fine Arts thesis exhibition. The exhibition seeks to give a visual presence to the seemingly trivial and overlooked moments of everyday life. It contains six individual sculptures made of handmade ceramic forms, fabricated mixed media elements, and modified found objects. The intention of A Case of the Mundanes is to combine nuances of humor to bring lightheartedness to the foibles and anxieties found in everyday life. The exhibition combines familiar and surreal representations to explore the way in which an artwork's meaning can shift, …

Development Of A Cobinamide-Based Optical Sensor For Hydrogen Cyanide And Hydrogen Sulfide, Lee Ann Greenawald

Graduate Theses, Dissertations, and Problem Reports (ETD)

In an occupational or military environment, a personal air-purifying respirator must be provided when breathing-air is contaminated by harmful dust, fumes, gases, aerosols, or vapors. Too often, a respirator user does not have enough information to know when to change his/her cartridge/canister and thus is potentially exposed to toxic gases. Currently, there is no definitive way to determine when respirators' carbon beds have begun to fail. When an end-of-service-life indicator (ESLI) is incorporated into the carbon bed, it informs one, in real-time, when imminent breakthrough is occurring and to replace the cartridge/canister. ESLIs are a more reliable and safer way …

The Court And The Cannonball: An Inside Look, Stephen Wermiel, Lee Levine Jan 2016

The Court And The Cannonball: An Inside Look, Stephen Wermiel, Lee Levine

Scholarly Articles in Law Reviews & Journals

As lawsuits over the right of publicity proliferate among athletes and other celebrities, there is renewed interest, by litigants and judges alike, in the one decision by the U.S. Supreme Court that addresses a tort action arising from a "publicity" related claim, Zacchini v. Scripps-Howard Broadcasting Co. Although the 1977 ruling is often cited as holding that the right of publicity tort survives constitutional scrutiny under the First Amendment, an examination of the case and of the Supreme Court justices' available papers shows that the Court did not view the case as presenting the type of claim that has become …

Platform Gratifications: Tinder Vs. Match.Com, Cassandra Lang

Graduate Theses, Dissertations, and Problem Reports (ETD)

This thesis examined user's experiences using dating applications by applying a uses and gratifications lens to investigate the gratifications of two different dating platforms. Specifically, this study drew upon past computer-mediated research to compare the gratifications obtained from a Tinder-like platform and a Match.com-like platform. The experiment found no significant differences between the gratifications levels of the two platforms types. However, female participants reported significantly lower levels of the "relaxation" gratification levels then males. The study also found identical ordinal gratification levels for the two platforms explored. The findings expand the study of mobile dating applications.

The Role Of Women’S Friendships In Later Life: Implications For Married And Widowed Women, Simóne Dorsey Jan 2016

The Role Of Women’S Friendships In Later Life: Implications For Married And Widowed Women, Simóne Dorsey

Human Development and Family Science

Increasingly, aging research demonstrates the importance of social support for well-being in later life, particularly among women. Women often rely on their spouse as a source of social support; however, it is unclear how older women’s support, particularly friendships, adapts when their spouses die. The current study selected a sample of 253 women from the Social Integration and Aging Study (Fuller-Iglesias & Rajbhandari, 2015) with the goal of examining whether friendship characteristics differ between married and widowed older women and determining the implications for well-being. Results revealed married and widowed women did not differ in friendship number, frequency of contact, …

Interleukin-15 Overexpression Attenuates Muscle Fatigue Associated With Murine Eo771 Mammary Tumors, Joseph F. Bohlen Jan 2016

Interleukin-15 Overexpression Attenuates Muscle Fatigue Associated With Murine Eo771 Mammary Tumors, Joseph F. Bohlen

Graduate Theses, Dissertations, and Problem Reports (ETD)

Severe muscle wasting and muscle dysfunction (cachexia) are considered incurable complications associated with a wide variety of chronic diseases. This loss of function and severe wasting causes an increase in fatigue in cancer patients, leading to reduced motivation for daily activities, further reducing prognosis for recovery in these patients leading to a severe increase in morbidity. Recent work from our lab suggests Interleukin-15 (IL-15) induces a pro-oxidative state in the muscle, reducing fatigue and promoting a more oxidative phenotype. One proposed mechanism behind this is the observation that IL-15 promotes mitochondrial biogenesis, lending more mitochondria for oxidative metabolic processes. Therefore, …

Cerebrovascular Dysfunction In Metabolic Syndrome And Depression: Mechanisms And Implications For Neurovascular Disease, Steven David Brooks Jan 2016

Cerebrovascular Dysfunction In Metabolic Syndrome And Depression: Mechanisms And Implications For Neurovascular Disease, Steven David Brooks

Graduate Theses, Dissertations, and Problem Reports (ETD)

Cerebrovascular diseases are any pathological conditions that are caused by disruptions or alterations in the blood supply to the brain. The brain, which is only 2% of body mass, constantly requires a minimum of 20% of cardiac output to meet its unique metabolic demands. Cerebral tissue relies on aerobic respiration and therefore requires a constant, steady supply of blood to provide oxygen and glucose to make ATP. Insufficient perfusion of the brain, which occurs as a result of reduced or obstructed blood flow, results in cerebral ischemia; ischemic neurons quickly deplete their available ATP and die if blood flow is …
