A Tri-Partite Classification Scheme To Clarify Conceptual Separability In The Context Of Clothing Design, Giovanna Marchese
A Tri-Partite Classification Scheme To Clarify Conceptual Separability In The Context Of Clothing Design, Giovanna Marchese
Cardozo Law Review
The article examines the complexities of copyright protection for clothing designs under the 1976 Copyright Act, focusing on the challenges of applying the conceptual separability doctrine to determine when artistic elements of useful articles, like clothing, qualify for protection. It critiques the inconsistent judicial application of this doctrine and proposes a tripartite classification scheme—fabric pattern design, fabric graphic design, and garment design—to clarify and simplify the analysis of copyrightability. By addressing the ambiguity in current jurisprudence, the scheme aims to enhance predictability for the fashion industry and reduce judicial confusion.

If Maher Kara, the Citigroup analyst at the center of the Salman case now before the Supreme Court, was forbidden under SEC Rule 10b-5 from trading securities for his own account while in possession of the valuable secrets to which his job gave him access, should he instead be able to give that information to family members simply in order to enrich them? I suspect that to anyone unfamiliar with the fine line drawing of federal insider trading law, the answer is clearly no. There is probably no more common form of corruption than generously shoveling the fruits of power …

Patients with tricho-dento-osseous (TDO) syndrome, an ectodermal dysplasia caused by mutations in the homeodomain transcription factor DLX3, exhibit enamel hypoplasia and hypomineralization. Here we used a conditional knockout mouse model to investigate the developmental and molecular consequences of Dlx3 deletion in the dental epithelium in vivo. Dlx3 deletion in the dental epithelium resulted in the formation of chalky hypomineralized enamel in all teeth. Interestingly, transcriptomic analysis revealed that major enamel matrix proteins and proteases known to be involved in enamel secretion and maturation were not affected significantly by Dlx3 deletion in the enamel organ. In contrast, expression of several ion …

What’S Wrong With Sentencing Equality?, Richard A. Bierschbach, Stephanos Bibas
What’S Wrong With Sentencing Equality?, Richard A. Bierschbach, Stephanos Bibas
Articles
Equality in criminal sentencing often translates into equalizing outcomes and stamping out variations, whether race-based, geographic, or random. This approach conflates the concept of equality with one contestable conception focused on outputs and numbers, not inputs and processes. Racial equality is crucial, but a concern with eliminating racism has hypertrophied well beyond race. Equalizing outcomes seems appealing as a neutral way to dodge contentious substantive policy debates about the purposes of punishment. But it actually privileges deterrence and incapacitation over rehabilitation, subjective elements of retribution, and procedural justice, and it provides little normative guidance for punishment. It also has unintended …

Costs Of Pastured Broiler Operations Based On Data From Small-Scale Farms, Siddhartha Dasgupta, Richard Bryant
Costs Of Pastured Broiler Operations Based On Data From Small-Scale Farms, Siddhartha Dasgupta, Richard Bryant
Journal of Extension
Many small-scale and limited-resource farmers use "hobby scale" technologies to produce food for home consumption and as a source of supplementary income. However, the economic potential of many of these technologies has not been investigated. Raising poultry on pasture is a relatively common small-scale technology for which there is sparse production and economics information based on actual-farm data. This article provides such information, based on data from farms in Kentucky. Analysis indicated that live broiler sales might be marginally profitable but that greater profit can be realized through sales of processed broilers at farmers' markets.

Enhancing Extension And Research Activities Through The Use Of Web Gis, Noel M. Estwick, Richard W. Griffin, Annette A. James, Samuel G. Roberson
Journal of Extension
There have been numerous efforts aimed at improving geographic literacy in order to address societal challenges. Extension educators can use geographic information system (GIS) technology to help their clients cultivate spatial thinking skills and solve problems. Researchers can use it to model relationships and better answer questions. A program at Prairie View A&M University involves the use of virtual, field, and story map activities associated with Web GIS (online mapping) to expose participants to plant species identification and engage them in spatial thinking. We describe that program and demonstrate the utility of Web GIS as a tool for integrating experiential …

Photoaging Photography: Mothers' Attitudes Toward Adopting Skin-Protective Measures Pre- And Post-Viewing Photoaged Images Of Their And Their Child's Facial Sun Damage, Matthew Welch, Paul Chang, Myra F. Taylor
Research outputs 2014 to 2021
One of the major sources for children to gain knowledge of skin-protective measures is from their parents. Therefore, an imperative exists for parents to model and reinforce the sun-safety practices they want their children to adopt. Although Australian mothers have been the recipients of two extensive sun-safety public health campaigns, little is known about their attitudes, behaviors, and application of health promotion knowledge toward their and their child’s ultraviolet (UV) sun exposure. Ten mothers with children aged 4 to 12 years were asked a series of questions about their sun-safety practices, both pre- and post-viewing an UV photoaged photograph of …
Identification And Characterization Of The Anticancer Potential Of Indigenous Medicinal Plants Of The Arabian Peninsula, Sameera Omar Mohammed Saeed Balhamar
Identification And Characterization Of The Anticancer Potential Of Indigenous Medicinal Plants Of The Arabian Peninsula, Sameera Omar Mohammed Saeed Balhamar
Theses
Indigenous plant species historically used for their medicinal properties are a tremendous source for bringing newer and safer drugs to the market. A concerted effort is needed to characterize their medicinal potential and identify new molecules that could be exploited in modern medicine. The current study was undertaken to study the anticancer properties of several indigenous plants that are used by the local population of the Arabian Peninsula and beyond for various medicinal purposes. Towards this end, we acquired different plant extracts from five plants, namely Boswellia sacra (BS), Cleome droserifolia (CD), Teucrium muscatensis (TM), Orchadenus arabicus (OA), and Acredocarpus …
Prejudice Toward Atheists In The United States As Related To Perceived Prevalence, Wanda D. Brooks
Prejudice Toward Atheists In The United States As Related To Perceived Prevalence, Wanda D. Brooks
Psychology Theses & Dissertations
By manipulating mortality salience (MS) in place of life-threatening events to stimulate death-related thoughts, the current research contributes to the body of research supporting Terror Management Theory. It was hypothesized that religious participants should exhibit cultural worldview defense by scoring higher in anti-atheist prejudice following the MS manipulation than would those in the control condition. Further, this research extends the current research into Terror Management Theory as a cause for conflict among out-groups and explores its effects on cultural worldviews in the area of prejudice toward atheists. This includes examining how the perception of an increasing prevalence of atheists contributes …
Analysis Of Interference Between Electromagnetic Articulography And Electroglottograph Systems, Kelly Vonderhaar
Analysis Of Interference Between Electromagnetic Articulography And Electroglottograph Systems, Kelly Vonderhaar
Master's Theses (2009 -)
Electromagnetic Articulography (EMA) has become an integral tool for researchers and clinicians who seek to characterize speech kinematics. The position and orientation of the articulators – which include the jaw, lips, and tongue – are recorded by attaching sensors to the articulators and tracking the movement of the sensors through an electromagnetic field. This has been used by researchers and clinicians to better understand dysarthria and synthesize speech, among other applications. Another speech tool, electroglottography (EGG), is used to analyze the movement of the vocal folds during speech production. This is achieved by measuring the time variation of the contact …
Self-Regulation And Cognitive Load As Mediating Factors For Tailored Interactive Multimedia Instruction, Tammy Ann Bankus
Self-Regulation And Cognitive Load As Mediating Factors For Tailored Interactive Multimedia Instruction, Tammy Ann Bankus
Teaching & Learning Theses & Dissertations
The primary purpose of this dissertation was to explore whether self-regulation or cognitive load have mediating effects on both learning experiences and learning effectiveness in tailored versus non-tailored interactive multimedia instructional (IMI) training. Although, there is a plethora of literature looking at the impact of cognitive load in IMI (Clark, 2008; Mayer, 2005; Mayer, 2008; Mayer, Griffith, Jurkowitz, & Rothman, 2008; Sweller, 2011) or looking at self-regulation (Pintrich, 2000a, 2000b; Schunk, Meece, & Pintrich, 2012; Zimmerman et al., 2000) separately, there is limited literature that looks at self-regulation and cognitive load in tailored IMI instruction, and even less literature examining …

Online Adaptive Passive-Aggressive Methods For Non-Negative Matrix Factorization And Its Applications, Chenghao Liu, Hoi, Steven C. H., Peilin Zhao, Jianling Sun, Ee-Peng Lim
Research Collection School Of Computing and Information Systems
This paper aims to investigate efficient and scalable machine learning algorithms for resolving Non-negative Matrix Factorization (NMF), which is important for many real-world applications, particularly for collaborative filtering and recommender systems. Unlike traditional batch learning methods, a recently proposed online learning technique named "NN-PA" tackles NMF by applying the popular Passive-Aggressive (PA) online learning, and found promising results. Despite its simplicity and high efficiency, NN-PA falls short in at least two critical limitations: (i) it only exploits the first-order information and thus may converge slowly especially at the beginning of online learning tasks; (ii) it is sensitive to some key …

Determining Quality- And Energy-Aware Multiple Contexts In Pervasive Computing Environments, Nirmalya Roy, Archan Misra, Sajal K. Das, Christine Julien
Research Collection School Of Computing and Information Systems
In pervasive computing environments, understanding the context of an entity is essential for adapting the application behavior to changing situations. In our view, context is a high-level representation of a user or entity's state and can capture location, activities, social relationships, capabilities, etc. Inherently, however, these high-level context metrics are difficult to capture using uni-modal sensors only and must therefore be inferred using multi-modal sensors. A key challenge in supporting context-aware pervasive computing is how to determine multiple high-level context metrics simultaneously and energy-efficiently using low-level sensor data streams collected from the environment and the entities present therein. A key …

his essay, part of a symposium celebrating the sixtieth anniversary of the Villanova Law Review, reflects on a 1971 article authored by Ferdinand Fernandez, who later would become a federal district court and then court of appeals judge. Fernandez’s article argued that the Due Process Clause of the Fourteenth Amendment creates a substantive individual right to state protection from pollution. Contrary to Fernandez’s prescriptions in 1971 at the advent of modern environmental law, legislation and regulation rather that constitutional litigation have come to dominate the environmental law landscape. In retrospect, this is not surprising. Legislatures and administrative agencies seem to …
Multifactoral Free Speech, Alexander Tsesis
Multifactoral Free Speech, Alexander Tsesis
Northwestern University Law Review
This Article presents a multifactoral approach to free speech analysis. Difficult cases present a variety of challenges that require judges to weigh concerns for the protection of robust dialogue, especially about public issues, against concerns that sound in common law (such as reputation), statutory law (such as repose against harassment), and in constitutional law (such as copyright). Even when speech is implicated, the Court should aim to resolve other relevant individual and social issues arising from litigation. Focusing only on free speech categories is likely to discount substantial, and sometimes compelling, social concerns warranting reflection, analysis, and application. Examining the …

The Government Brand, Mary-Rose Papandrea
Northwestern University Law Review
In Walker v. Texas Division, Sons of Confederate Veterans, Inc., the U.S. Supreme Court held that Texas could deny the Sons of Confederate Veterans a specialty license plate because the public found the group’s Confederate flag logo offensive. The Court did not reach this conclusion because it deemed the Confederate flag to fall within a category of unprotected speech, such as true threats, incitement, or fighting words; because it revisited its determination in R.A.V. v. City of St. Paul that restrictions on hate speech are unconstitutional; because travelers who see the license plates are a “captive audience”; or because …

Siri-Ously? Free Speech Rights And Artificial Intelligence, Toni M. Massaro, Helen Norton
Northwestern University Law Review
Computers with communicative artificial intelligence (AI) are pushing First Amendment theory and doctrine in profound and novel ways. They are becoming increasingly self-directed and corporal in ways that may one day make it difficult to call the communication ours versus theirs. This, in turn, invites questions about whether the First Amendment ever will (or ever should) cover AI speech or speakers even absent a locatable and accountable human creator. In this Article, we explain why current free speech theory and doctrine pose surprisingly few barriers to this counterintuitive result; their elasticity suggests that speaker humanness no longer may be …
Defining The Doratopsis: Investigating The Endpoint Of The Paralarval Stage In Chiroteuthis Calyx, Alicia Bitondo
Defining The Doratopsis: Investigating The Endpoint Of The Paralarval Stage In Chiroteuthis Calyx, Alicia Bitondo
Capstone Projects and Master's Theses
The life histories of open ocean squid are often poorly understood, due to the difficulty of collecting and observing them in the wild. In order to understand life histories fully, species must be identifiable at all life stages. In cephalopods there is uncertainty surrounding the endpoint of the paralarval stage, and this boundary must consequently be determined on a species by species basis. Some common morphological events used as markers of this life stage change are the loss of paralarval characters, and rapid changes in the relative size and growth of certain key structures. Alternatively, the end of the paralarval …

Patterns Of Fecal Progestagens, Estrogens, And Androgens Associated With Reproduction In Blue-Throated Piping Guans (Pipile Cumanensis), Leslie Ann Sterling, Helen Clawitter, Corinne P. Kozlowski, Michael Macek, Anne Tieber
Undergraduate Research Symposium Posters
While fecal hormone analyses are routinely employed to monitor reproduction in mammals, few studies have used these techniques for monitoring reproductive events in birds. This study describes the endocrine patterns associated with reproduction in the blue-throated piping guan (Pipile cumanensis), a less threatened relative of the critically endangered Trinidad piping guan (P. pipile). Fecal samples were collected approximately once a week for 3 years from seven female guans and six male guans at the Saint Louis Zoo. Concentrations of fecal progestagens, estrogens, and androgens were quantified using commercially available enzyme immunoassays. Baseline progestagen concentrations for females …

The Second Circuit And Social Justice, Matthew Diller, Alexander A. Reinert
Articles
The Second Circuit is renowned for its landmark rulings in fields such as white collar crime and securities law — bread and butter issues growing out of Wall Street’s preeminence in the financial landscape of the nation. At the same time, the Second Circuit has a long tradition of breaking new ground on issues of social justice. Unlike some circuit courts which have reputations in the area of social justice built around one or two fields, such as the Fifth Circuit’s pioneering role in civil rights litigation or the Ninth Circuit’s focus on immigration, there is no one area of …

Optimization Of Fuel Consumption For Municipal Solid Waste Collection In Al Ain City, Uae, Elkhalifa Mohamed Zeyada Swar Aldahab
Theses
Collection and transportation of municipal solid waste (MSW) often account for a significant amount of the total budget allocated for waste management. A major portion of that is attributed to fuel consumption. Meanwhile, vehicles involved with waste collection can emit significant levels of atmospheric pollutants. Hence, optimization of waste collection yields both financial and environmental benefits. No work has been done to optimize fuel consumption during MSW collection in Al Ain city. In this study, several cases were developed using ArcGIS Network Analyst tool in order to establish optimum conditions for MSW collection in Um Gafa district in Al Ain …
