Conservation Triage: Debating Which Species To Save And Why, Loren B. Byrne
Conservation Triage: Debating Which Species To Save And Why, Loren B. Byrne
Arts & Sciences Faculty Publications
Because of human impacts on the biosphere, so many species are now threatened with extinction that it may not be possible to save them all. Akin to triage in a medical emergency situation, this challenge has brought forth the idea of conservation triage: having to make difficult choices and justifications about which species should be saved and which might not be savable. The goal of the learning activity described in this chapter is to engage students in this debate so they can gain insights into real-world conservation challenges and practice critical thinking and decision making skills in an authentic context. …
The Magna Carta And The Beginning Of Modern Legal Thought, Vincent R. Johnson
The Magna Carta And The Beginning Of Modern Legal Thought, Vincent R. Johnson
Faculty Articles
As the Magna Carta, England's Great Charter of Liberties, marks its eighth centennial, it is appropriate to ask what's in it. The answer, it turns out, lives up to the legend. What's in the Magna Carta is the beginning of modern legal thought. The Great Charter set the expectations that for 800 years have shaped the development of the law in England, America, and around the globe. Like a blazing light piercing the medieval darkness, the Magna Carta illuminated the importance of legal principles, fair procedures, proportional punishment, official accountability, and respect for human dignity. It was unlike any legal …

Integrity Under Fire: The Wisdom Of General U.S. Grant And Advice For The Neophyte Lawyer, John W. Teeter Jr.
Faculty Articles
Law is not war. Indeed, litigation serves as a peaceful alternative to trial by battle, and our legal doctrines and procedures are designed to prevent society from disintegrating into a feral, sanguinary struggle of each against all. Furthermore, lawyers simply do not deserve to be likened to warriors, for we neither physically defend our nation from foreign aggression nor sacrifice our lives to preserve our principles and freedoms. Any attorney who engages in excessive battlefield rhetoric should be sentenced to bedpan duty at the local Veterans Administration hospital.
At the same time, however, anyone who has tried a case, negotiated …
Ethics Pertaining To The Legalities Of Male Routine Infant Circumcision And Surrogate Consent To Non-Therapeutic Surgery, Jason A. Domashevskiy, Artem V. Domashevskiy
Ethics Pertaining To The Legalities Of Male Routine Infant Circumcision And Surrogate Consent To Non-Therapeutic Surgery, Jason A. Domashevskiy, Artem V. Domashevskiy
Publications and Research
Circumcision is the most contentious surgery performed in the world today. Approximately 38% of the world male population has been circumcised, mostly during the neonatal and prepubescent periods. Circumcision in regularly practiced ubiquitously throughout the Islamic countries, Israel, and the United States; the US is only country who regularly circumcises its boys for a non-religious reason. No world health body advocates circumcision prior to adulthood. Routine Infant Circumcision (RIC) violates the United Nations Policy on Genital Integrity, the Hippocratic Oath taken by doctors, and the rules for surrogate consent to surgery. Studies have shown no benefits to circumcision during the …

El Murciano's "Rondeña" And Early Flamenco Guitar Music: New Findings And Perspectives, Mª Luisa Martínez Martínez, Peter L. Manuel
Publications and Research
The "Rondeña" of guitarist Francisco Rodríguez Murciano (El Murciano, 1795-1848) of Granada--as documented in a notation made by his son--has been a subject of considerable interest among scholars interested in the evolution of flamenco guitar playing (toque). Such authors as Eusebio Rioja (2008, 2013), Javier Suárez Pajares (2003), Guillermo Castro Buendía (2014), and Norberto Torres Cortés (2010) have recognized the importance of this piece in the attempted reconstruction, however hypothetical, of the development of the art of flamenco guitar. These authors have raised various questions about the piece, involving the date and circumstances of its preparation and the …
Investigating The Effects Of Nucleosome Remodeling Factor Knockdown On Anti-Tumor Immunity, Mark G. Roberts
Investigating The Effects Of Nucleosome Remodeling Factor Knockdown On Anti-Tumor Immunity, Mark G. Roberts
Theses and Dissertations
The nucleosome remodeling factor (NURF) is a chromatin remodeling complex involved in early animal development and is implicated in a number of cancers. In previous work, knockdown of NURF’s largest subunit, BPTF, resulted in diminished tumor growth in mouse cancer cell lines. Other studies in our lab demonstrated increased activation of T-lymphocytes into BPTF KD tumors. In order to examine if this approach has any therapeutic potential, this work investigates the effects of BPTF knockdown in established tumors by using recombinant adenoviruses (rAd), as well as observe the way the immune system interacts with BPTF knockdown cells, both in vivo …
Music Therapy With Adolescents In Crisis In America And Korea : A Cross-Cultural Analysis, Seulgi Kim
Music Therapy With Adolescents In Crisis In America And Korea : A Cross-Cultural Analysis, Seulgi Kim
Theses & Dissertations
The purpose of this study was to explore music therapy with adolescents in crisis in both America and Korea. Qualitative methods were employed in this study and the data were collected through semi-structured interviews with two music therapists —one American music therapist practicing in the United States and one Korean practicing in Korea — who have experience working with adolescents in crisis. The participants openly shared their experiences during an hour video-recorded on-line interviews. After the interviews, all content of the interviews was transcribed and analyzed. Three essential categories emerged: (a) the role of music, (b) the role of therapist, …

Beyond The Black Box, Or, When Shrouded Clauses Are Pro-Consumer, Luke Herrine

This article compares two clauses in credit card contracts providing for alternative dispute resolution (ADR). Arbitration clauses use ADR to cut off consumer remedies, while reversal clauses use ADR to expand them. Holding constant the possibility of earning extra money by exploiting consumer biases, it is argued that the coexistence of these two clauses must be explained in terms of which aspects of a firm's institutional structure leads it to instantiate this possibility. Viewing a firm as a forum to mediate the interests of the constituencies that either own or contract with it, one can ask how the aggregate interests …

The Trouble With Tacking: A Reconsideration Of Trademark Priority, Alan L. Durham
The Trouble With Tacking: A Reconsideration Of Trademark Priority, Alan L. Durham
Articles
When trademarks cannot co-exist because they are confusingly similar, priority generally depends upon first use. However, through the practice known as “tacking,” the junior user can sometimes prevail based on its earlier adoption of a similar, but technically distinct trademark. The Supreme Court recently determined that tacking is a question of fact to be resolved by a jury, under the guidance of “careful jury instructions that make [the] standard clear.” Courts say the standard for tacking is “exceedingly strict,” and that tacking is allowed only when the earlier mark and the revised mark are so similar that they convey the …

Lack Of Data For Predicting Storm Water Pollutant Removal By Post-Construction Best Management Practices, Andrew J. Whelton, Jeffrey Gill, Li Song, Bryce Froderman, Mahboobeh Teimouri, Hua Cai
JTRP Technical Reports
The project objective was to conduct a detailed literature review of storm water pollutants and mitigation technologies and synthesize the information so that INDOT can implement project results into standards. Because it is a municipal separate storm sewer system (MS4), INDOT is required to minimize storm water pollution. A literature review was carried-out to gauge pollutants examined by other transportation agencies, the pollutant’s relevance to Indiana roadways, and the effectiveness of storm water pollution minimization best management practices (BMP). A cost benefit analysis was also conducted for a few BMP devices used in Indiana. Results showed that a variety of …

Social buffering, a phenomenon in which the presence of a social partner can reduce stress responses, is often most effective between strongly attached partners. Our laboratory previously found a surprising buffering effect of the hypothalamic-pituitary-adrenal (HPA) response in preweaning guinea pigs by unfamiliar adult males. It was hypothesized that this HPA-buffering effect was driven by social interactions between the two partners and may involve an activation of the prelimbic cortex. Therefore, the current study examined these potential associations. To limit social interactions, the adult male was anesthetized in one condition compared to another condition where the adult male remained conscious. …
Comparison Of Vascular Pulsatility In The Native Beating Heart Versus Direct Mechanical Ventricular Actuation Support Of The Fibrillating Heart, Nathan Victor Wright
Comparison Of Vascular Pulsatility In The Native Beating Heart Versus Direct Mechanical Ventricular Actuation Support Of The Fibrillating Heart, Nathan Victor Wright
Browse all Theses and Dissertations
Most conventional cardiac assist devices today employ continuous flow blood pumps to supplement function in the dysfunctional heart. Continuous flow pumps are predominantly preferred to the original pulsatile pumps due to the smaller size (greater implantability) and higher efficiency they achieve. However, interest in the impact of vascular pulsatility on human health has arisen from the growing evidence of higher complications with nonpulsatile devices compared to pulsatile devices. Direct cardiac compression (DCC) offers a unique solution to the pulsatility issue through the application of force directly to the heart's surface. It is believed that employing the existing pump architecture of …
The Frequency Of The Passive Voice In Freshman Academic Books, Basma Moreb
The Frequency Of The Passive Voice In Freshman Academic Books, Basma Moreb
Electronic Theses and Dissertations
The use of passive voice has long been an area of difficulty for English learners. Celce-Murcia & Larsen-Freeman (2015) noted that it is learning when to use the English passive that presents the greatest long-term challenge to ESL/EFL students (p. 352). Because textbooks are a source of language input for English learners, this study investigated the frequency of passive voice verbs in samples from four academic textbooks in courses commonly taken by freshmen. The study also examined whether there are significant differences between the frequencies by textbook. The data was collected from four General Education Plan (GEP) subject textbooks used …
Spatial Variation In Tooth Shape Of Miocene Populations Of Carcharocles Megalodon Across Ocean Basins, Maxwell John Bertsos
Spatial Variation In Tooth Shape Of Miocene Populations Of Carcharocles Megalodon Across Ocean Basins, Maxwell John Bertsos
Browse all Theses and Dissertations
The extinct Lamniform species, Carcharocles megalodon, were some of the most geographically widespread apex predators in the fossil record. However, whether this cosmopolitan distribution was related to population level differences is unknown. The objective of this study is to assess whether variation in tooth morphology coincided with geographic dispersal. The underlying hypothesis is that variation in an aspect of functional morphology, such as tooth shape, suggests some level of population structuring. Detecting this relationship could potentially provide a mechanism that links population to functional relationships inherent in tooth morphology that may reflect period differences in ocean basins. This would offer …

Plasmalogens are glycerophospholipids abundant in brain and heart tissues. Evidence suggests that they have antioxidant properties. Studies from our laboratory showed that rats treated with myo-inositol plus ethanolamine (ME) have elevated ethanolamine plasmalogens (PE-Pls) in brain and are protected against phosphine-induced oxidative stress. We hypothesized that ME elevates PE-Pls levels and protects against oxidative stress through oxidation of its vinyl ether bond. We tested this hypothesis in Neuro-2A cell culture and assessed the effects of treatments with myo-inositol (M), ethanolamine (Etn), or a combination (ME) on the: (1) effects on phospholipid (PL) classes, especially Etn PLs; (2) effects on cell …

A myriad of factors have been shown to affect the morphology of freshwater fish. Despite the growing base of ecomorphology literature there is little information available exploring how these factors relate to body morphology of Centrarchidae, specifically in the Lepomis genera. Therefore, the objective of this study was to describe variation in body morphology of Bluegill (Lepomis macrochirus) across Grand Lake St. Mary’s watershed area and test for covariation of morphology with size, sex, and habitat. Geometric morphometric methods were used to assess variation among individuals and general linear models were used to test for covariation of morphology with size, …

High-Fidelity Multidisciplinary Sensitivity Analysis For Coupled Fluid-Solid Interaction Design, Koorosh Gobal
Browse all Theses and Dissertations
In many engineering disciplines such as aerospace, marine, automotive, and biomedical engineering, the consideration of the coupling between the fluid and structural systems is necessary for quality engineering analysis. Therefore, the need for such analysis in the design is continuously increasing. The primary motivation for this work is to develop a sensitivity analysis tool that is capable of calculating accurate sensitivities without significant modification of the source codes for simulations based on non-body conformal grids. The majority of work done on the coupled fluid-solid simulations are based on computational grids that conform to solid boundaries. This becomes a restriction for …

Ischemic strokes account for 87% of all strokes and can have debilitating effects on language, sensory, and motor skills. Currently, tPA is the only medication approved by the FDA for the treatment of ischemic stroke, but the window of time to administer the drug is very small. In this thesis, we investigate the use of a simvastatin and fluoxetine drug combination (FS) as a possible treatment for ischemic stroke victims. To analyze the effects of FS on neurogenesis and functional recovery, we utilize the Montoya Staircase and quantify the amount of neurogenesis using doublecortin. Although the results of this study …

Species Differences In The Effects Of Tcdd On A Transcriptional Regulatory Region Within The Ig Heavy Chain Gene, Zahra J. Alfaheeda
Browse all Theses and Dissertations
The immunoglobulin heavy chain gene (Igh) is regulated by numerous regulatory elements including the 3'Igh regulatory region (3'IghRR). Several transcription factors are involved in modulating the 3'IghRR including NF-B, AP-1, and the aryl hydrocarbon receptor (AhR). The AhR is a ligand-activated transcription factor that mediates the transcription of genes involved in the metabolism of environmental toxicants such as TCDD. TCDD binds AhR and regulates immunoglobulin (Ig) expression in B cells of animal models. This modulation appears to be directly mediated by binding of the AhR to dioxin response elements (DRE) within the 3'IghRR. Structural differences have been found between the …

The ability to disperse over long distances can result in a high propensity for colonizing new geographic regions and lead to lineage diversification via allopatric speciation. However, high vagility can also result in gene flow between otherwise allopatric populations, and in some cases, parapatric or divergence-with-gene-flow models of speciation might be more applicable to widely distributed lineages. Here, I used five nuclear introns and the mitochondrial control region to examine divergence, gene flow, and phylogenetic relationships within a cosmopolitan lineage comprising six species, the blue-winged ducks (genus Anas), which inhabit all continents except Antarctica. I found two primary sub-lineages, the …

In diseases like AIDS, Multiple Myeloma, Multiple Sclerosis (MS), Type 1 Diabetes, and Systemic Lupus Erythromatosus the detection of major histocompatibility complex type 1 molecules (MHC 1) can be a helpful component of disease diagnosis and prognosis. Most somatic mammalian cells display to varying degrees major histocompatibility complex (MHC) class 1 antigen on the cell surface. MHC1 molecules consist of a polymorphic alpha a chain and a monomorphic beta chain, beta 2 microglubulin (ß2m). The ß2M composition is fairly constant within a species whereas the alpha chain is not. The polymorphic alpha chain is encoded by an MHC complex gene …

This thesis examines the excoriating pamphlet literature of both Dutch and English origin during the three Anglo-Dutch Wars of the seventeenth century. The Dutch Republic of this time was in the midst of its Golden Age, while England was on its ascent to eventual predominance in world affairs. By looking at concepts such as staartmannen [tail-men], Duivelskind [Devil's child], or "Hollandophobia," themes of mockery, religion, and xenophobia in popular printed works - including the engraved illustrations which accompanied the texts - are observed. Ultimately the thesis argues that the pamphlet literature bolstered the regional identity of Hollander in the Dutch …
