Chipping Away At The Rock: Perez V. Mortgage Bankers Association And The Seminole Rock Deference Doctrine, Kevin O. Leske Jan 2016

Chipping Away At The Rock: Perez V. Mortgage Bankers Association And The Seminole Rock Deference Doctrine, Kevin O. Leske

Loyola of Los Angeles Law Review

Largely escaping judicial and scholarly examination for close to seventy years, the Seminole Rock deference doctrine directs federal courts to defer to an administrative agency’s interpretation of its own regulation unless such interpretation “is plainly erroneous or inconsistent with the regulation.” But at long last the United States Supreme Court is poised to re-evaluate the doctrine.

In March 2015, in Perez v. Mortgage Bankers Association, the Court addressed whether a federal agency was required to follow the notice-and-comment procedures of the Administrative Procedure Act after it changed a prior interpretation of its regulation under the “Paralyzed Veterans doctrine.” Although …

Human Reason And Biblical Hermeneutics: An Introduction, Angel Manuel Rodriguez Jan 2016

Human Reason And Biblical Hermeneutics: An Introduction, Angel Manuel Rodriguez

Journal of the Adventist Theological Society

"It is our intention to explore some of the issues involved in the use of reason in a hermeneutics that seeks to properly interpret the Scripture. This is necessary in an intellectual context where reason, in spite of postmodernism, remains the omnipotent ruler of knowledge. I will approach the assignment as a Christian who believes that God is the Creator and Redeemer and that He has revealed to us the fundamental elements and concepts necessary to find meaning in life and in the world in which live. The content of this revelation, preserved for us in the Holy Scripture, should …

How New York City Invented The Holiday Season: The Rise And Fall Of The World’S First Global Holiday, Ronald J. Brown Jan 2016

How New York City Invented The Holiday Season: The Rise And Fall Of The World’S First Global Holiday, Ronald J. Brown

New York School for Career and Applied Studies (NYSCAS) Publications and Research

Jesus may have been born in Bethlehem, but it was the city of New York that transformed the traditional day of his birth, December 25, into a national and eventually global holiday season. The evolution of the Christian religious holiday of Jesus’ birth into a secular global holiday that embraces all religions, cultures, and traditions is a unique example of the emergence of a global culture. Little did Clement Clarke Moore realize when he transferred the holiday of St. Nicholas from December 6 to the 25th, nor Macy’s Department Store when it organized its first Thanksgiving Day Parade, that they …

Don't Be Cruel (Anymore): A Look At The Animal Cruelty Regimes Of The United States And Brazil With A Call For A New Animal Welfare Agency, David N. Cassuto Jan 2016

Don't Be Cruel (Anymore): A Look At The Animal Cruelty Regimes Of The United States And Brazil With A Call For A New Animal Welfare Agency, David N. Cassuto

Elisabeth Haub School of Law Faculty Publications

In the United States and around the world, animals exploited for human use suffer cruel and needless harm. The group bearing the brunt of this exploitation--agricultural animals--is routinely exempted from the largely ineffective and rarely enforced animal welfare and anti-cruelty regulations that exist today. This Article offers a comparative analysis of the agricultural animal welfare regimes of two countries with globally significant presence in the agriculture industry: the United States and Brazil. Even though the two countries approach agricultural animal welfare differently, they arrive at the same outcome: institutionalized indifference to animal suffering. To remedy the current regulatory structure, this …

Ppap2b Expression Limits Lesion Formation In Murine Models Of Atherosclerosis, Paul A. Mueller Jan 2016

Ppap2b Expression Limits Lesion Formation In Murine Models Of Atherosclerosis, Paul A. Mueller

Theses and Dissertations--Physiology

Coronary artery disease (CAD) is the leading cause of death in both men and women worldwide and is defined as a narrowing of the coronary arteries due to accumulation of atherosclerotic plaques. Genome-wide association studies have identified risk loci within the gene PPAP2B that confers increased risk of developing CAD. Evidence suggests these aforementioned SNPs are regulating PPAP2B expression in a cis-manner through the interruption of transcription factor binding sites. PPAP2B encodes the lipid phosphate phosphatase 3 enzyme that plays a key role in degrading bioactive lysophosphatidic acid (LPA). LPA has a plethora of effects on vascular tissue and is …

Cell Ray 3d Bioprinter, John Bocinsky, Eric Mason, Nevada Weaver, Kristin Wood Jan 2016

Cell Ray 3d Bioprinter, John Bocinsky, Eric Mason, Nevada Weaver, Kristin Wood

Biomedical Engineering and Sciences Student Publications

For research of cancer and other diseases,it has become increasingly more important to have accurate 3D culture models that more closely mimic in vivo tissues and the surrounding extracellular matrix (ECM). The current and past two-dimensional (2D) cell culture models fail to provide a complex ECM environment that is necessary to understand the cellular reactions that occur in response to different drugs and therapeutics, while animal models are time consuming, expensive, and constantly fail to reflect human tumor biology. 3D bioprinting has recently emerged as a viable solution to this problem offering increased efficiency and reproducibility, however, these options are …

Impacts Of Wood Energy On Timber Markets In New England And New York, Iuliia Drach Jan 2016

Impacts Of Wood Energy On Timber Markets In New England And New York, Iuliia Drach

Master's Theses and Capstones

Renewable energy has a number of environmental and socioeconomic advantages over the energy derived from finite fossil fuels, which is why it has been increasingly promoted on the state and federal levels. Growing interest in renewable energy calls for detailed analysis of the effects the potential increase in production of such energy might have on the existing markets.

The obvious choice for the source of renewable energy in New England and New York is wood biomass due to the region’s abundant forest resources and extensive wood harvesting and processing infrastructure. To analyze the impacts of increased wood biomass consumption for …

Relating Shell Morphometrics And Heterozygosity To Byssogenesis, Byssal Thread Attachment Strength And Motility In The Blue Mussel, Ellie Daniels Jan 2016

Relating Shell Morphometrics And Heterozygosity To Byssogenesis, Byssal Thread Attachment Strength And Motility In The Blue Mussel, Ellie Daniels

Master's Theses and Capstones

Heterozygote deficiencies have been noted in both wild and farmed populations of Mytilus edulis Linnaeus 1758, yet the underlying causes for this deficit remain unclear. This is especially surprising considering that advantageous fitness traits (i.e., increased fecundity, reduced basal metabolism, higher growth rate in farmed mussels) as well as decreased mortality under environmental stressors (i.e., air exposure, increased water temperature) are positively correlated with heterozygosity in these mussels. The dislodgement hypothesis states that more heterozygous mussels are migrating to the periphery of a rope culture or mussel bed to gain an energetic advantage where they become more susceptible to drop-off. …

Elderly individuals can greatly benefit from the use of computer applications, which can assist in monitoring health conditions, staying in contact with friends and family, and even learning new things. However, developing accessible applications for an elderly user can be a daunting task for developers. Since the advent of the personal computer, the benefits and challenges of developing applications for older adults have been a hot topic of discussion. In this chapter, the authors discuss the various challenges developers who wish to create applications for the elderly computer user face, including age-related impairments, generational differences in computer use, and the …

Crisis Across The Dog-Starred Verse: Tales Of Heroism, Horror, And Apocalypse, David Arroyo Jan 2016

Crisis Across The Dog-Starred Verse: Tales Of Heroism, Horror, And Apocalypse, David Arroyo

Stonecoast MFA Theses and Capstones

Crisis Across the Dog-Starred Verse: Tales of Heroism, Horror, and Apocalypse is a collection of formal and free-verse poems. Although a few pieces are confessional in nature, many of the poems borrow from the genres of speculative fiction: horror and science fiction specifically. The thesis is not divided into sections, rather it alternates visions of a confessional real world and fantasy space. Many poems cover the death of my dog and our adventures in the multiverse, while others like “Together We Are Monsters” are meditations on monsters and pornography. Two longer pieces, however, “Campus of the 21st Century,” and “The …

Graphic And Digital Keats: “La Belle Dame Sans Merci” In Poetry Comics, Brian Bates Jan 2016

Graphic And Digital Keats: “La Belle Dame Sans Merci” In Poetry Comics, Brian Bates

Reconstruction: Studies in Contemporary Culture

[First paragraph]

In the twenty-first century, John Keats's canonical poem "La Belle Dame sans Merci" has been given new lives through visual adaptations. [i] Hidetoshi Oneda's fifteen-minute film (2005), which adds a ship-wreck frame narrative that doubles the poem's existing frame narrative, was the first of several short movie versions of "La Belle Dame."[ii] Amidst these cinematic adaptations, in 2013 PM Buchanan and Karen Yumi Lusted began publishing a serialized graphic narrative anime version that, according to one reviewer, "drags The Beautiful Lady out of the forest and screaming into the modern world."[iii] Buchanan and Lusted's adaptation has received considerable …

Affordances And Possibilities Around The Personal Portable Library In Art And Research, Henry Warwick Jan 2016

Affordances And Possibilities Around The Personal Portable Library In Art And Research, Henry Warwick

Reconstruction: Studies in Contemporary Culture

[First paragraph]

The Personal Portable Library is basically a very simple device. It is a hard drive or USB memory stick filled with files. What kinds of files depends on curator or librarian's interests. Many people have hard drives filled with music, and they share drives, USB sticks, CDRs and DVDRs filled with music. In fact, according to the RIAA, Offline File Sharing exceeds online file sharing of music. [1] Music files, like font files, are small and easily transferred from one machine to another. Video files are another issue. A film can be 2 or more gigabytes in size …

Nature & Spirit: A Digital Lens Of Gay-Male Culture, Brandon S. Gellis Jan 2016

Nature & Spirit: A Digital Lens Of Gay-Male Culture, Brandon S. Gellis

Reconstruction: Studies in Contemporary Culture

History is fraught with critical reactions toward homosexuality. Within the United States, response by the culture-at-large (mainstream culture) towards this sexual orientation underwent a radical transformation within the last one hundred years. Toward the beginning of the 20th century, homosexuality was deemed immoral and punishable by law, necessitating that most homosexuals remained closeted and forcing gay communities to evolve separately from, yet in parallel to, the culture-at-large. However, by the 1960s gay political organizations began publicly protesting the mistreatment of gay communities, and arguing for equal treatment and the decriminalization of homosexuality. Burdened by the mid-20th century art world's homophobic …

Making The Posters Dance: Victor Moscoso’S Four-Dimensional Posters And Adventures In Exhibition Concept, Design, And Archiving, Scott B. Montgomery Jan 2016

Making The Posters Dance: Victor Moscoso’S Four-Dimensional Posters And Adventures In Exhibition Concept, Design, And Archiving, Scott B. Montgomery

Reconstruction: Studies in Contemporary Culture

[First paragraph]

Generally, posters do not move, let alone dance, wave, wink, or fly. They tend to stay still, affixed to walls. In keeping with the advertising mandate originally inherent in the medium, clarity in delivering a message is frequently a guiding principle in poster design. Artistry is employed in the service of communicating the idea, whether political, social, or commercial. But art's role has tended to be subservient - to attract the viewer's eye toward the advertising message. Transcending this, the poster reached its first artistic apotheosis in the late 19th/early 20th century work of Art Nouveau masters such …

The Perpetual Archive: Mapping Living Archive As Inventory, Jenny Filipetti Jan 2016

The Perpetual Archive: Mapping Living Archive As Inventory, Jenny Filipetti

Reconstruction: Studies in Contemporary Culture

[First paragraph]

Inventory is the new archive. It is strange that no one has said it before. Inventory: apprehending the records of the past in order to understand the present and prepare for the future. Today's inventories are entire living ecosystems of products, control systems, consumers, barcode scanners, warehouse shipments, Internet shopping carts. Inventory has ceased to track, merely: inventory does. And who would ever stop with inventory? Inventory is only always an invitation to access, a means to a (never-)end(ing).

English And Latin Lexical Innovations In Reginald Pecock’S Corpus, J. A. T. Smith Jan 2016

English And Latin Lexical Innovations In Reginald Pecock’S Corpus, J. A. T. Smith

All Faculty Open Access Publications

This article examines the Middle English and Latin word formations of Bishop Reginald Pecock (d. 1459). In particular, it addresses the false assumption that Pecock was intentionally writing in an English that was primarily Germanic in etymology. The article concludes that Pecock’s lexical innovations were primarily Latinate, that he was unlikely to be concerned with the “purity” of his word formation, and that it was highly unlikely that he was trying to eschew Latinate vocabulary. These conclusions were ascertained through a comprehensive assessment of Pecock’s vocabulary which shows that Pecock created 715 new words out of a total estimated vocabulary …

The Lived Experience Of Facilitating The Violet Oaklander Model Of Psychotherapy For Children And Adolescents, Blake Brisbois Jan 2016

The Lived Experience Of Facilitating The Violet Oaklander Model Of Psychotherapy For Children And Adolescents, Blake Brisbois

Antioch University Dissertations & Theses

The purpose of this phenomenological study was to describe the experience of facilitating the Oaklander Model of Gestalt Play Therapy when treating children or adolescents in psychotherapy. Interviews were conducted with clinicians who have received training and use the Oaklander method in their practice of psychotherapy. Transcriptions of the interviews were coded and analyzed, revealing a consistent experience along various themes. Participants reported that this Gestalt method allows a non-linear method of helping clients to unfold according to the needs and challenges of each session. Participants also reported that the end goal of the Oaklander Gestalt model helped young clients …

New Kids On The Blockchain: How Bitcoin’S Technology Could Reinvent The Stock Market, Larissa Lee

UC Law Business Journal

Bitcoin is the first and most successful digital currency in the world. It polarizes the news almost daily, with either glowing reviews of the many benefits of an alternative and international currency, or doomsday predictions of anarchy, deflation, and another tulip bubble.

This article focuses on the truly innovative aspect of Bitcoin - and that which has gone mostly unnoticed since its inception - the technological platform used to transfer Bitcoin from one party to another. This technology is called the Blockchain. The Blockchain eschews a bank or other intermediary and allows parties to transfer funds directly to one another, …

Think Of The Children: Using Iied To Reformulate Disturbing Speech Restrictions, Richard Lorren Jolly Jan 2016

Think Of The Children: Using Iied To Reformulate Disturbing Speech Restrictions, Richard Lorren Jolly

University of Michigan Journal of Law Reform

The Colorado State Court of Appeals recently upheld an injunction restricting public displays of aborted fetuses. The court held that the restriction passed strict scrutiny because the state had a compelling interest in protecting children from the psychological harm of “disturbing images” and the injunction was narrowly tailored. This marked the first time an injunction had been upheld on this rationale. This Note critiques that holding and others. It contends that while some federal and state courts have recognized the interest in protecting the psychological wellbeing of children from disturbing speech as compelling, the interest is not supported by precedent. …

The Incremental Retributive Impact Of A Death Sentence Over Life Without Parole, Michael L. Radelet Jan 2016

The Incremental Retributive Impact Of A Death Sentence Over Life Without Parole, Michael L. Radelet

University of Michigan Journal of Law Reform

In this paper, the author takes a closer look at retribution, which is the primary justification for the death penalty today in the United States and the main component of the additional punishment imposed by the death penalty over and above life imprisonment without parole (LWOP). While all criminal punishments, to varying degrees, punish both the inmate and his or her family, this paper argues that the death penalty’s added punishment over LWOP often punishes the family just as much as the inmate, and after the execution the full brunt of the punishment falls on the family. This added impact …

Retention And Reform In Japanese Capital Punishment, David T. Johnson Jan 2016

Retention And Reform In Japanese Capital Punishment, David T. Johnson

University of Michigan Journal of Law Reform

This Article focuses on the failure of abolition and of death penalty reform in Japan in order to illustrate contingencies in the trajectory of capital punishment in the modern world. Part I describes three facts about postwar Japan that help explain why it retains capital punishment today: a missed opportunity for abolition during the American occupation of the country after World War II; the long-term rule of a conservative political party; and economic and geopolitical power that has enabled the country to resist the influence of international norms. Part II describes a few ways in which Japanese capital punishment has …
