With some apologies for a vast degree of oversimplification, let us stipulate that there are two main forms of originalism. One is known as “semantic” or “public meaning” originalism. Its leading advocates include Lawrence Solum, Keith Whittington, and Randy Barnett (professional friends, all). The leading premise of semantic originalism is that the meaning of the constitutional text—or, more specifically, of its individual clauses—was fixed at the moment of its adoption. Under this view, the goal of constitutional interpretation is to recover that original meaning, and the best way to do that pivots on reconstructing how an informed reader, whether a …

To reduce readmission rates and prevent adverse outcomes after discharge, hospitals have begun implementing "transitional care" initiatives. This systematic review identifies research on the particular set of services now reimbursable by Medicare (transitional care management [TCM]) and evaluates the studies for program effectiveness. Results of 3 databases were screened for peer-reviewed journal articles published between January 2004 and 2015 that report on readmissions of adults in the US health care system under the Medicare TCM bundle. ClinicalTrials.gov was queried for funded studies. Of 969 identified studies, 77 met inclusion criteria for relevance to transitional care and appropriateness of population and …

BACKGROUND: Longer nephrology care before end-stage renal disease (ESRD) has been linked with better outcomes.
METHODS: We investigated whether longer pre-end-stage renal disease (ESRD) nephrology care was associated with lower mortality at both the patient and state levels among 443 761 incident ESRD patients identified in the USA between 2006 and 2010.
RESULTS: Overall, 33% of new ESRD patients had received no prior nephrology care, while 28% had received care for >12 months. At the patient level, predictors of >12 months of nephrology care included having health insurance, white race, younger age, diabetes, hypertension and US region. Longer pre-ESRD nephrology …

This Note examines the split among the federal circuit courts regarding the application of agency principles to claims of foreign sovereign immunity. Specifically, a minority of courts have applied the doctrine of apparent authority in determining whether a sovereign is bound by the acts of its agents. The majority of courts have, however, declined to apply the doctrine, holding that only actual authority is sufficient to bind sovereigns to their agents’ acts. This Note examines the policy ramifications of the minority view through the lens of sovereign debt litigation, especially those conducted by so-called vulture funds, and ultimately concludes that …

This study aims to illuminate interaction between leucine supplementation and mitochondrial proteins concerned with synthesis and biogenesis. We hypothesized that supplementation with leucine will attenuate the weight gain of the high fat diet in comparison with the normal chow group, by enhancing mitochondrial biogenesis and content. We conducted a laboratory experiment using Western Blotting techniques to determine protein expression. Proteins of interest in this study include PGC-1α, COX-IV, TUFM, TFAM, and mtIF2. The findings from the research show a main effect of an increase in the expression of PGC-1 α in high fat diets. There was no difference in the …

Purpose: The growing amount of clinical resistance observed in current antifungal drugs and in anti-HIV pharmaceuticals is a concern in the medical community. The purpose of this study is to develop a mild synthetic process for biomedically relevant thiazolyl aryl ketones that can be used to develop antifungal and anti-HIV drugs. We hypothesized that the proposed synthetic technique would be more efficient, produce fewer unwanted byproducts, and be more tolerant of functional groups than existing methods.

Many mothers are unaware of the benefits of breastfeeding. This lack of knowledge leads to an inability to weigh the advantages and disadvantages of the potential source of nutrition their infant will receive during his or her first months of life. Many mothers never even attempt to breastfeed their infant. Even among the mothers who do initially choose to breastfeed, the majority deviate to other forms of feeding early in the postpartum period. Introduction: Childhood obesity is a problem that leads to many serious health effects including early maturation, decreased quality of life and increased risk for cardiovascular disease. In 2012, over one third of children were considered obese (Childhood Obesity Facts 2015). Converging my various identities as artist, educator, firefighter and city employee I delved into the City of Boise’s LIV campaign. LIV’s intent is the reimagining of municipal government and its engagement with employees, residents, and business. I pursued three different projects: interning in Human Resources, sitting on the Vista revitalization committee, and coordinating art students with the Boise Farmers Market “Mobile Market” project. I found myself in a very Boise story. This project has several more years until it reaches a maturation point where the final outcomes are known.

For the purpose of this dissertation, the term communication partner described any individual in a position to provide or support opportunities for communication. Communication partners have been discussed in current literature in the areas of augmentative and alternative communication (AAC), severe disabilities, aphasia, and autism spectrum disorder (ASD). The role, characteristics, and responsibilities of a communication partner are most comprehensively described in the aphasia literature.
It is likely that individuals with ASD would have more opportunities for social interaction and engagement if supported by skilled and informed communication partners. The communicative success of individuals with ASD may depend on the …

Analysis of the human proteome has identified thousands of unique protein sequences that contain acetylated lysine residues in vivo. These modifications regulate a variety of biological processes and are reversed by the lysine deacetylase (KDAC) family of enzymes. Despite the known prevalence and importance of acetylation, the details of KDAC substrate recognition are not well understood. While several methods have been developed to monitor protein deacetylation, none are particularly suited for identifying enzyme-substrate pairs of label-free substrates across the entire family of lysine deacetylases. Greek mythology never strays very far from Western imagination. Though every few years literature involving the infamous Gods tapers off into the back of our collective minds, a resurgence soon follows. The late Romantic literary movement (as popularized by Lord Byron, Percy Bysshe Shelly, and John Keats) depended heavily upon Greco- Roman mythology to help illustrate characters that existed somewhere between the shadow of imagination and the truth of humanity. Non-Traditional Stable Isotope Behaviors In Immiscible Silica-Melts In A Mafic Magma Chamber, Dan Zhu, Huiming Bao, Yun Liu

Non-traditional stable isotopes have increasingly been applied to studies of igneous processes including planetary differentiation. Equilibrium isotope fractionation of these elements in silicates is expected to be negligible at magmatic temperatures (δ57 Fe difference often less than 0.2 per mil). However, an increasing number of data has revealed a puzzling observation, e.g., the δ57 Fe for silicic magmas ranges from 0‰ up to 0.6‰, with the most positive δ57 Fe almost exclusively found in A-type granitoids. Several interpretations have been proposed by different research groups, but these have so far failed to explain some aspects of the observations. Here we …

Coupled Onshore Erosion And Offshore Sediment Loading As Causes Of Lower Crust Flow On The Margins Of South China Sea, Peter D. Clift

© 2015, Clift. Hot, thick continental crust is susceptible to ductile flow within the middle and lower crust where quartz controls mechanical behavior. Reconstruction of subsidence in several sedimentary basins around the South China Sea, most notably the Baiyun Sag, suggests that accelerated phases of basement subsidence are associated with phases of fast erosion onshore and deposition of thick sediments offshore. Working together these two processes induce pressure gradients that drive flow of the ductile crust from offshore towards the continental interior after the end of active extension, partly reversing the flow that occurs during continental breakup. © 2015 The Wilson Ornithological Society. The Military Macaw (Ara militaris) and the Great Green Macaw (A. ambiguus) are species whose close relationship is reflected in their morphological similarity as well as their geographic ranges. Military Macaws have a disjunct distribution, found in Mexico as well as several areas in South America, while Great Green Macaws have two or more disjunct populations from Honduras to eastern Ecuador. We used mitochondrial sequence data to examine the phylogenetic relationships between these two species, and also among representative samples across their ranges.
