There were seventeen international investment agreements (“IIAs”) signed around the world in 2012, and each one of them contained some provision relating to the protection of the environment. In comparison, no investment treaty signed before 1985, and fewer than ten percent of treaties signed between 1985 and 2001, contained any reference to the environment at all. Environmental language has become increasingly common in bilateral investment treaties (“BITs”), and to an even greater degree in other IIAs, such as free trade agreements (“FTAs”). The legal implications of the integration of environmental law and norms into investment law treaties have yet to …

Picturing Moral Arguments In A Fraught Legal Arena: Fetuses, Photographic Phantoms And Ultrasounds, Jessica Silbey

This article investigates the movement in the U.S. that seeks to regulate the abortion decision by mandating ultrasounds prior to the procedure. The article argues that this reform effort is misguided not only because it is ineffective, but also because ultrasounds provide misleading information and are part of shaming practices that degrade the dignity of women. Both of these problems violate the main tenets of Planned Parenthood of Southern Pennsylvania v. Casey (1992). Central to the article’s argument and novelty is that the pro-ultrasound movement’s mistake is both legal and cultural. It misunderstands the nature of visual technology by failing …

When copyright lawyers gather to discuss fair use, the most common refrain is its alarming expansion. Their distress about fair use’s enlarged footprint seems completely untethered from any appreciation of the remarkable increase in exclusive copyright rights. In the nearly forty years since Congress enacted the 1976 copyright act, the rights of copyright owners have expanded markedly. Copyright owners’ demands for further expansion continue unabated. Meanwhile, they raise strident objections to proposals to add new privileges and exceptions to the statute to shelter non-infringing uses that might be implicated by their expanded rights. Main conclusion We have evaluated the endogenous expression and molecular properties of selected Group 3 LEA proteins from Artemia franciscana , and the capacity of selected Groups 1 and 3 proteins transfected into various desiccation-sensitive cell lines to improve tolerance to drying. Organisms inhabiting both aquatic and terrestrial ecosystems frequently are confronted with the problem of water loss for multiple reasons—exposure to hypersalinity, evaporative water loss, and restriction of intracellular water due to freezing of extracellular fluids. Seasonal desiccation can become severe and lead to the production of tolerant propagules and entry into the state of anhydrobiosis at various stages …

This pilot investigated the promise of positive outcomes in literacy, science, and social behavior on K– 2 English learner (﴾EL)﴿ students after two months of implementation of the Science Inquiry Centered Argumentation Model (﴾ScICAM)﴿—a systematic teaching approach to science learning that integrates literacy instruction and argument-‐based inquiry. The sample included 17 teachers and 31 EL students. Results indicated that teacher practices (﴾proximal outcomes)﴿ aligned well with the ScICAM approach and resulted in increases in EL student learning (﴾distal outcomes)﴿. Depression and hopelessness predict myocardial infarction (MI), but it is unclear whether depression and hopelessness are independent predictors of MI incidents. Hopelessness, depression, and MI incidence rate 18 years later were measured in 2005 men. Cox regressions were conducted with hopelessness and depression serving as individual predictors of MI. Another Cox model examined whether the two predictors predict MI when adjusting for each other. Depression and hopelessness predicted MI in independent regressions but when adjusting for each other, hopelessness, but not depression, predicted MI incidents. Thus, these results suggest that depression and hopelessness are not independent predictors of MI.

Depression becomes more prevalent as individuals progress from childhood to adulthood. Thus, empirically supported and popular cognitive vulnerability theories to explain depression in adulthood have begun to be tested in younger age groups, particularly adolescence, a time of significant cognitive development. Beck’s cognitive theory and the response style theory are well known, empirically supported theories of depression. The current, two-wave longitudinal study (N = 462; mean age = 16.01 years; SD = 0.69; 63.9 % female) tested various proposed integrative models of Beck’s cognitive theory and the response style theory, as well as the original theories themselves, to determine if …

The purpose of this investigation was to examine the effects of combined aerobic and resistance exercise training among self-reported mood disturbances, perceived stress, frequency of self-reported symptoms, and symptom distress in a sample of HIV+ adults. For this purpose, 49 participants were randomly assigned into an exercise (EX) or control (CON) group. Those in the EX group completed 50 min of supervised aerobic and resistance training at a moderate intensity twice a week for 6 weeks. The CON group reported to the university and engaged in sedentary activities. Data were collected at baseline before randomization and 6 weeks post intervention. …

IN October of 1863, two years into the Civil War, a short editorial titled "Empty Sleeves" appeared on the front page of the Staunton Spectator.1 It addressed a question that had become familiar in the wake of the war's unprecedented violence; namely, how to encounter, or how to look at (in both the literal and figurative senses), the quickly growing population of veterans whose injuries marked them as "disabled:' This question could be cause for considerable anxiety in able-bodied Americans whose beliefs were shaped by Victorian and muscular Christian values.

The Socialist Federal Republic of Yugoslavia was a multi-national state, consisting of six republics and two autonomous regions. However in 1991, the country descended into a tragic and bloody civil war, causing over two hundred thousand deaths and the migration of thousands. The disintegration of Yugoslavia produced seven independent countries: Serbia, Croatia, Slovenia, Bosnia and Herzegovina, Macedonia, Montenegro and Kosovo.

The Danish were the largest immigrant group in Cedar Falls. They immigrated to Cedar Falls and the nearby rural village of Fredsville in large numbers between 1870 and 1900. There they formed an immigrant community. The lived near each other, worshipped together, spoke the same language, and carried on Danish traditions. They farmed, found jobs in Cedar Falls businesses, and opened businesses of their own. By the 1930s, as the first generation of Danish immigrants grew old, the younger generations began to identify more as Americans than as Danes. The elements that characterized the Danish immigrant community began to disappear. …

Nearly half of adults in the United States do not meet the recommended guidelines for both aerobic and strengthening activities despite the benefits of regular physical activity (National Center for Health Statistics, 2014; US Department of Health and Human Services, 2008). The purpose of the current study was to test whether normative feedback (i.e., descriptive and descriptive plus injunctive norms) affects levels of physical activity. Participants wore a Fitbit Zip pedometer to record exercise behavior and received normative feedback messages sent to their mobile phones. A career as a collegiate outdoor recreation professional is both a challenging and rewarding occupation. It is a position that consists of inconsistent hours as well as extended periods away from home. This qualitative study identified how changes in family status affect an individual’s perception of the position as a collegiate outdoor recreation coordinator. More specifically, the perceived benefits or challenges that occur throughout the family status changes, and what effect, if any, these perceptions had on the individual’s work performance, job satisfaction and career longevity.

As an introduction to a special issue on intellectual property philosophy, this article focuses on insights from Asian thought. Such a focus is needed not only to provide balance within this special issue, which includes articles focusing primarily on Western philosophy, but also to highlight the compatibility between Asian philosophy and the notion of intellectual property rights. More importantly, this article aims to demonstrate that Asian philosophy may suggest new ways to address the ongoing and highly complex intellectual property challenges confronting emerging economies and the digital environment.

Alon Harel argues that the acts of a public official acting with "fidelity of deference," are "necessary," "non-contingent," "intrinsic," "constitutive," integrative," "expressive," or "inherent" features of legal punishment. Accordingly, he calls his argument "noninstrumental." This can be taken as an argument for logical necessity, definition, extension, or modest or immodest conceptual necessity. Only the last interpretation fits Harel's text, but such an argument fails because instrumentality is necessarily present in any event in the natural world, including punishment. Harel does not say which aspects of natural instrumentality he means to exclude from his argument, or how, or why.

In 1973, the feminist newsmagazine Off Our Backs featured a segment on women in jail awaiting trial in Washington, D.C. Many of the women faced minor charges, such as soliciting prostitution, but remained in detention because they could not afford to pay even very low amounts of monetary bail. The magazine interviewed Myrna Raeder, then a fellow at Georgetown, and other attorneys involved in a class action suit against D.C. corrections, who argued that low-income women were unjustly subjected to the punitive effects of pretrial detention, in violation of their due process rights. No previous scientific investigation has studied the influence of either increasing or decreasing levels of body weight (BW) support on oxygen consumption (VO2) while running in reduced BW conditions via a differential air pressure (DAP) treadmill. Moran et al. found rate of perceived exertion to be higher at the same BW conditions when moving from high BW support to low BW support but did not quantify the findings with VO2. Temporomandibular joint (TMJ) internal derangement (ID) is one of the most common form of temporomandibular disorders. There is evidence showing the increased expression of matrix metalloproteinases (MMPs) in the cells from degenerated TMJ disc. ADAMTS are a large family of metalloproteases which are responsible for proteoglycans degradation. The present study aimed to evaluate ADAMTS-4 and ADAMTS-5 immunohistochemical expression in human TMJ discs from patients affected by ID, and to find out if there is any correlation with the degree of histopathological changes.
