The purpose of this article is to explore and analyze the crucial inter- relationship and the present tension existing between various life settlement alternatives and the insurable interest requirement for life insurance. Does the 240-year-old insurable interest doctrine adequately meet the needs of a modern society in recognizing a secondary market for life in- surance? If so, what additional remedies, if any, are available to both the insured and the insurer to legally protect the contractual rights and reasonable expectations of the parties?

This brief Article proceeds in four parts. Part I discusses the Supreme Court's recent cases that address employer free exercise rights. Part II notes problems that accompany providing free exercise rights to employers. Part III explores the expansion of employer prerogative in the context of providing employers additional free exercise rights. Part IV considers problems that arise when employee rights are not deemed central to litigation regarding employer free exercise rights. The Article concludes by proposing a refraining of the free exercise issue that will consider how to account for the interests of the employer, its stakeholders, and its employees …

Amici curiae are law professors who have significant research and teaching experience in the field of energy law, with a particular focus on electric power markets. They are listed in the Appendix to this brief. They are submitting this brief because they believe that the U.S. Court of Appeals for the District of Columbia Circuit made serious errors when it held that the Federal Energy Regulatory Commission (FERC) lacked authority to regulate operators’ rules for demand response (DR) in the wholesale electricity markets. ในปัจจุบันธุรกิจเครือข่ายขยายตัวอย่างต่อเนื่องไปทั่วโลกรวมทั้งในประเทศไทยด้วยทั้งในเรื่องของยอดขายและจำนวนคนที่เข้าสู่ธุรกิจเครือข่าย แต่อย่างไรก็ตามบุคคลที่เข้าสู่ธุรกิจนี้และประสบความสำเร็จนั้นมีจำนวนน้อยมาก ซึ่งสาเหตุหนึ่งของความล้มเหลว ส่วนหนึ่งเป็นผลมาจากการที่นักธุรกิจเครือข่ายไม่สามารถสรรหาบุคคลที่มีศักยภาพที่จะประสบความสำเร็จเข้าสู่เครือข่ายของตนได้ ดังนั้นเพื่อช่วยให้นักธุรกิจเครือข่ายและบริษัทที่ทำธุรกิจเครือข่ายสามารถสรรหาบุคคลเข้าสู่ธุรกิจได้อย่างมีประสิทธิภาพมากยิ่งขึ้น งานศึกษานี้จึงมุ่งที่จะพัฒนาเครื่องมือคัดกรองบุคคลที่มีศักยภาพประสบความสำเร็จในการทำธุรกิจเครือข่าย โดยแบบจำลองสมการเชิงโครงสร้างถูกพัฒนาขึ้นเพื่อศึกษาและยืนยันเกณฑ์หลักและเกณฑ์รองที่จะนำไปใช้การคัดกรอง จากนั้นกระบวนการวิเคราะห์เชิงลำดับชั้นแบบฟัซซี่ถูกนำมาใช้ในการวิเคราะห์เพื่อคัดกรองผู้มุ่งหวังบนฐานเกณฑ์หลักและเกณฑ์รองที่พัฒนาขึ้น ผลการวิเคราะห์จากแบบจำลองสมการเชิงโครงสร้าง พบว่า แบบจำลองที่พัฒนาขึ้นสอดคล้องกับข้อมูลเชิงประจักษ์ โดยในแบบจำลองประกอบด้วยตัวแปรแฝงจำนวน 3 ตัวแปร คือ 1) การไม่ยอมรับช่องว่างระหว่างสิ่งที่มีกับสิ่งที่ปรารถนา และ ความไม่มีประสิทธิภาพของทางเลือกที่เป็นไปได้ทั้งหมดในการลดช่องว่างระหว่างสิ่งที่มีกับสิ่งที่ปรารถนา 2) พลานุภาพ และ 3) การยืนหยัดในการตัดสินใจแม้บุคคลสำคัญรอบข้างเป็นอุปสรรค จากนั้นนำเกณฑ์ที่ได้ไปวิเคราะห์ต่อโดยใช้กระบวนการวิเคราะห์เชิงลำดับชั้นแบบฟัซซี่ ซึ่งจากการทดสอบจะเห็นว่ากระบวนการวิเคราะห์เชิงลำดับชั้นแบบฟัซซี่นั้นสามารถนำมาประยุกต์ใช้ได้เป็นอย่างดี

The main aim of the research is to enhance the safety management system through the introduction and tracking of safety performance indicator “non-compliance per flight hour”. All the non-compliances related to the main operational departments were gathered from the data base of the case study company for the year 2014. It was found that the non-compliances per flight hour were highest from the Aircraft Maintenance Department with the exact number being 3.30 non-compliances per flight hour. The objective of this research is to improve the manufacturing process of a concrete roof tile manufacturing company to solve its problems of low labour productivity, rising labour costs and scarcity of labour. Initial analysis established that press forming was a bottleneck in the overall process and used the most manpower. Process activity mapping and Work study were used as tools to analyse the problems to identify non-value-added activities. Railroad transportation is very important for economic growth and effective maintenance is one critical factor for its economic sustainability. The high repetitive forces from a moving railcar induce cyclic stresses that lead to rail bending and potential deterioration due to fatigue crack initiation and propagation. Previous research for prediction of fatigue life has been done under the assumptions of a uniform track bed and a homogeneous rail. This study employs geometric morphometric methods to investigate the morphology and shape change of the frontal bone for Pan troglodytes and Pan paniscus. Unlike previous work on the topic, this research analyzed morphology and ontogenetic shape change in a single bone of the cranium, namely the frontal bone. Frontal bone shape was compared between juvenile Pan troglodytes and Pan paniscus and the ontogeny of the bone was assessed in Pan paniscus infants and juveniles. This study is informed by funds of knowledge and culturally responsive teaching studies that aim to explore and legitimize the cultural knowledge immigrant children bring to their communities and schools. Consequently, this paper specifically addresses issues related to the educational experiences of Karen children and their parents from one American teacher/researcher who has worked with the Karen for the past four years. There have been very few measurements of the total cross section for n-p scattering below 500 keV. In order to differentiate among NN potential models, improved cross section data between 20 and 600 keV are required. We measured the n-p and n-C total cross sections in this energy region by transmission; a collimated neutron beam was passed through CH2 and C samples and transmitted neutrons were detected by a BC-501A deuterated liquid scintillator. Cross sections were obtained by taking the ratios of normalized neutron yields with the samples in the beam and with no sample in the beam. Both …

A Measurement Of The Prompt Fission Neutron Energy Spectrum For 235U(N,F) And The Neutron-Induced Fission Cross Section For 238U(N,F), Zachariah W. Miller

Two measurements have been made, addressing gaps in knowledge for 235U(n,f) and 238U(n,f). The energy distribution for prompt fission neutrons is not well-understood below 1 MeV in 235U(n,f). To measure the 235U(n,f) prompt fission neutron distribution, a pulsed neutron beam at the WNR facility in Los Alamos National Laboratory was directed onto a 235U target with neutron detectors placed 1 m from the target. These neutron detectors were designed specifically for this experiment and employed a unique geometry of scintillating plastic material that was designed to reject backgrounds. Characterizing The Nearest Young Moving Groups, Kyle Mccarthy

Moving groups are associations of stars which originated from the same star forming region. These groups are typically young (< 200 Myr) since they have not dissipated into the galactic field population. Over the last 15 years, roughly 10 such moving groups have been found with distances < 150 pc (7 with distances < 100 pc), each with a unique velocity and position.
This work first investigates the likelihood to resolve star from two moving groups (AB Doradus and Beta Pictoris) using high spacial resolution optical interferrometry and found 5 AB Doradus stars and 1 Beta Pictoris star with declinations > -30 could be spacially resolved.
To more deeply characterize individual groups, we used the 2.7m telescope at the McDonald Observatory to observe 10 proposed AB Doradus stars and 5 proposed Octans-Near stars (3 probable members, 2 possible) with high resolution (R ~60,000) optical …

The NPDGamma Experiment is used to study the n + p to d + g reaction for the purpose of examining the hadronic weak interaction. The nucleon-nucleon interaction is overwhelmingly mediated by the strong force, however, the weak part can be extracted by a study of its parity violating manifestations. When neutrons are incident on protons, deuterons and 2.2 MeV gamma rays are produced. If the incoming neutrons are polarized, the parity violating weak interaction gives rise to a measured spatial asymmetry, Ag, in the outgoing gamma rays, as sn · kg is parity odd.

A thesis presented on the characterization of oral microbiota in xerostomic versus non-xerostomic volunteers and in daily samples following standard oral hygiene practices. Xerostomia is a difficult and burdensome disease that can be very difficult to diagnose. Understanding the oral microbiota between these diseased and healthy (non-xerostomic) can give us great insight on new treatments and/or prevention. Goals of the study included determining whether there substantial differences in oral microbial populations between the two groups, and whether varying nightly oral hygiene practices had an impact on next-morning oral microbiota titers or composition. Bound By Law: A Roadmap For The Practical Legalization Of Bdsm, Daniel Haley

The note argues that the criminalization of BDSM practices, due to the lack of legal recognition of consent as a defense in BDSM-related injuries, is unconstitutional and harmful. It advocates for legal reform, specifically the creation of a BDSM exception in the Model Penal Code, to protect practitioners' rights and reduce stigma.
