Classroom Management Practices For Male African American Students With Behavioral Disorders, Jamie Helton Hubbard

Walden Dissertations and Doctoral Studies

Male African American students with disabilities in a South Carolina school district have received a greater proportion of discipline referrals and exclusionary consequences than have other demographic groups. The purpose of this sequential mixed methods study was to explore classroom management strategies that may reduce this disproportionality. The conceptual framework was Skinner's applied behavior theory, which states that to change behavior, the environment must be changed. The qualitative guiding question investigated teacher beliefs about best classroom management practices. The quantitative research questions were intended to provide a description of discipline preferences. Quantitative data were collected through the Behavior and Instructional …

An Evidence-Based Determination Of Whether Effective Leadership Competencies Are Universal And Transferable., John Michael Slade Jan 2015

An Evidence-Based Determination Of Whether Effective Leadership Competencies Are Universal And Transferable., John Michael Slade

Walden Dissertations and Doctoral Studies

Poor executive leadership of organizations over the last 20 years has resulted in the destruction of stakeholder value, loss of jobs, and in some cases, risk to the entire enterprise. An executive search firm database, encompassing 16,000 leaders from 300 organizations, was analyzed to determine if the commonality and transferability of leadership competences could be used to improve executive assessment. Implicit leadership theory, where leaders are gauged by the individuals that surround them, served as the theoretical foundation. The study also relies on a leadership competency model used by the executive search firm that constructed the database and is based …

Women's Perspectives On Adequacy Of Screening And Treatment For Postpartum Depression, Gloria Marcia Watson Jan 2015

Women's Perspectives On Adequacy Of Screening And Treatment For Postpartum Depression, Gloria Marcia Watson

Walden Dissertations and Doctoral Studies

Postpartum depression affects some 10% to 20% of mothers. Its impact on the health and well-being of mothers and their infants is well documented. If not identified and addressed early, it can result in emotional burden, costly hospitalization and treatment, and, at worst, suicide and or infanticide. Empowerment theory was the conceptual framework for this hermeneutic phenomenological study. The purpose was to understand the lived experiences of the screening and treatment processes of 10 women from New York City experiencing postpartum depression and their perceived adequacy of the treatment received. In-depth interviews were used to investigate participants' lived experiences of …

Accidentally On Purpose: Intent In Disability Discrimination Law, Mark Weber Jan 2015

Accidentally On Purpose: Intent In Disability Discrimination Law, Mark Weber

College of Law Faculty

American disability discrimination laws contain few intent requirements. Yet courts frequently demand showings of intent in disability discrimination lawsuits. Intent requirements arose almost by accident: through a false statutory analogy; by repetition of obsolete judicial language; and by doctrine developed to avoid a nonexistent conflict with another law. Demanding that section 504 and Americans with Disabilities Act (“ADA”) claimants show intent imposes a burden not found in those statutes or their interpretive regulations. This Article provides reasons not to impose intent requirements for liability or monetary relief in section 504 and ADA cases concerning reasonable accommodations. It demonstrates that no …

Comparison In Personality Profiles Between Child Abusers Versus Child Neglectors, Jodi R. Cuneo Jan 2015

Comparison In Personality Profiles Between Child Abusers Versus Child Neglectors, Jodi R. Cuneo

Walden Dissertations and Doctoral Studies

Children who suffered parental abuse or neglect can be returned home if their safety can be ensured following offender treatment. However, some caregivers will continue to abuse or neglect their children upon return home, leading to additional treatment, state involvement, and harm to the child. This study assessed personality differences between child abusers and neglectors who were caregivers by applying a binary logistical regression analysis to the Minnesota Multiphasic Personality Inventory, Second Edition (MMPI-2) scores sampled from archival data for 215 caregivers. Analysis showed that the abusers had statistically significant higher scores on the F Scale ('Faking Bad'), but significantly …

The Effect Of Nationality Differences On The Emotional Intelligence Of Leaders, Hossein Reza Nikoui Jan 2015

The Effect Of Nationality Differences On The Emotional Intelligence Of Leaders, Hossein Reza Nikoui

Walden Dissertations and Doctoral Studies

Previous studies related to manager effectiveness and organizational culture have determined that emotional intelligence (EI) is a critical predictor of intercultural adjustment and business success. However, few investigators have examined the relationship between EI and nationality differences. In today's globalized business environment, such understanding is crucial to the development of more effective leadership programs for international workers. This quantitative study explored the degrees to which the EI of organizational managers varied across nationalities. A theoretical framework, provided by several theories related to personality, leadership, and types of intelligence, created a lens through which to analyze study results. The Trait Emotional …

Due Process For Cash Civil Forfeitures In Structuring Cases, Timothy J. Ford Jan 2015

Due Process For Cash Civil Forfeitures In Structuring Cases, Timothy J. Ford

Michigan Law Review

On January 22, 2013, Tarik “Terry” Dehko sat down to pay the bills for his small Michigan grocery store when a federal agent entered his office. The agent told Dehko that the Internal Revenue Service (IRS) had executed a seizure warrant and taken the market’s entire bank account—more than $35,000. When Dehko asked how he could run his business without its bank account, the agent replied, “I don’t care.” The government did not charge Dehko with a crime that day. In fact, Dehko had never been charged with any crime in his life. Instead, the government waited until July 19 …

Emergency Takings, Brian Angelo Lee Jan 2015

Emergency Takings, Brian Angelo Lee

Michigan Law Review

Takings law has long contained a puzzle. The Fifth Amendment to the U.S. Constitution requires the government to pay “just compensation” to owners of private property that the government “takes.” In ordinary circumstances, this requirement applies equally whether the property is confiscated or destroyed, and it also applies to property confiscated in emergencies. Remarkably, however, courts have repeatedly held that if the government destroys property to address an emergency, then a “necessity exception” relieves the government of any obligation to compensate the owner of the property that was sacrificed for the public good. Although the roots of this startling principle …

Ethnic Disparities In The Reproductive And Sexual Health Screening Practices Of Ecuadorian Women, Ruth Castillo Jan 2015

Ethnic Disparities In The Reproductive And Sexual Health Screening Practices Of Ecuadorian Women, Ruth Castillo

Open Access Theses & Dissertations

Background: Evidence suggests that reproductive and other health disparities disproportionately affect Indigenous and Afro-Hispanic ethnic minority groups throughout the Latin American and Caribbean (LAC) region. Factors associated with reproductive health disparities in LAC countries include low social economic status (SES), poor health care access, racial and gender discrimination, machismo, health beliefs and low perceived risk for breast cancer, cervical cancer, sexual transmitted infections (STIs) and other conditions. Preventive measures such as health education and early screening is vital for disease prevention and detection. However, screening rates for breast cancer, cervical cancer, and STIs are lower in most LAC countries compared …

Towards Analytical Techniques For Optimizing Knowledge Acquisition, Processing, Propagation, And Use In Cyberinfrastructure, Leonardo Octavio Lerma

Open Access Theses & Dissertations

For many decades, there has been a continuous progress in science and engineering applications.

A large part of this progress comes from the new knowledge that researchers acquire, propagate, and use. This new knowledge has revolutionized many aspects of our life, from driving to communications to shopping.

Somewhat surprisingly, there is one area of human activity which is the least impacted by the modern technological progress: the very processes of acquiring, processing, and propagating information. When we decide where to place sensors, which algorithm to use for processing the data – we rely mostly on our own intuition and on …
