A Mindfulness-Based Stress Reduction Psychoeducational Program In Postpartum Support Groups, Marina Pesserl
A Mindfulness-Based Stress Reduction Psychoeducational Program In Postpartum Support Groups, Marina Pesserl
Walden Dissertations and Doctoral Studies
Postpartum Depression (PPD) affects 15% of women after childbirth. Its etiology includes psychoneuroimmunologic factors with long-lasting postpartum stressors that lead to allostatic overload. Using mindfulness-based stress reduction (MBSR) for PPD has not yet been studied. Addressing this literature gap, the potential benefits of including an 8-week MBSR component based on Beck's theory of PPD at support groups were examined in this phenomenological study based on a sample of 10 women and 2 group facilitators. Purposes of the study included describing the experience of PPD and the MBSR program, identifying the stage of behavioral change of the participants, and describing the …
English Language Learners And High School Transition Experiences, Kimberly Watkins
English Language Learners And High School Transition Experiences, Kimberly Watkins
Walden Dissertations and Doctoral Studies
Spanish speaking English language learning (ELL) students in U.S. public schools are among those most likely to drop out of high school. However, there is a research gap concerning Spanish speaking ELL student success and their experiences in transitioning from supported English as a second language (ESL) classes into mainstream, general education classes in high school. Guided by the framework of transitional bilingual education, the purpose of this study was to present the phenomenological experiences of former ESL students as they transitioned from ESL to English-only classes. Participants included 7 adults who transitioned from Spanish speaking ESL during their high …
Learned Helplessness And Depression: Comparison Of Skilled Nursing And Assisted Living Facilities, Paul Lynn Susic
Learned Helplessness And Depression: Comparison Of Skilled Nursing And Assisted Living Facilities, Paul Lynn Susic
Walden Dissertations and Doctoral Studies
Research with geriatric populations suggests high levels of clinical depression and greater financial and psychological costs of treatment in long-term care facilities with more restrictive care. Research on learned helplessness, a construct separate from depression, suggests learned helplessness and perceived control are useful theories for the study of elder depression, but the relationship between depression and learned helplessness in this population is not clear. This cross-sectional quantitative study examined the relationship between depression and learned helplessness by comparing residents over age 65 in less restrictive assisted living (n =42) versus those in more restrictive skilled nursing facilities (n =63). Data …

Journal of Educational and Psychological Studies
The present study aimed to assess the effectiveness of using social communication networks in teaching geography to develop academic achievement and self-efficacy of college of education students. For achieving that, the researcher prepared a teaching guide, a test in academic achievement and a scale of self-efficacy in teaching. The study sample was (86) students, divided into two groups; the experimental group was (42) students and the control group was (44) students. The pre – test was conducted on both groups; experimental and control. The experimental group studied the course using social networks (Facebook) where the control group studied the course …
2014 State Legislative Review, Aaron C. Johnson
2014 State Legislative Review, Aaron C. Johnson
Animal Law Review
Several state legislatures addressed animal welfare issues in 2014. A young fifth-grader, motivated by a documentary, inspired her community and state legislature to attempt to pass legislation protecting orcas. Two states decided to blaze a new trail when they determined that the federal government was not going far enough to stop the ivory and rhino horn trade. The battle between freedom of speech and property rights reared its ugly head as several states took on the polemical issue of 'ag-gag.' Lastly, we witnessed breed-specific legislation become illegal in three more states, with science trumping the availability heuristic.
Barking Up The Wrong Tree: Regulating Fear, Not Risk, Ann L. Schiavone
Barking Up The Wrong Tree: Regulating Fear, Not Risk, Ann L. Schiavone
Animal Law Review
Beginning in the 1980s, the curious phenomenon of breed-specific legislation (BSL) began to spread across the U.S. and abroad. The phenomenon can be traced to sensationalistic media portrayals of the pit bull at that time. This kind of sensationalism was nothing new; throughout American history, various breeds have served as scapegoats, each taking a turn as the most ‘dangerous.’ While it was not new to seek to contain fears by isolating a particular ‘problem’ breed, the legislation itself was unprecedented. Today, in light of mounting evidence that factors other than breed are more determinative of aggression in domestic dogs and …
Mitigating Foul Blows, Mary N. Bowman
Mitigating Foul Blows, Mary N. Bowman
Georgia Law Review
For nearly eighty years, courts have offered stirring rhetoric about how prosecutors must not strike foul blows in pursuit of convictions. Yet while appellate courts are often quick to condemn prosecutorial trial misconduct, they rarely provide any meaningful remedy. Instead, courts routinely affirm convictions, relying on defense counsel's failure to object or concluding that the misconduct was merely harmless error. Jerome Frank summed up the consequences of this dichotomy best when he noted that the courts' attitude of helpless piety in prosecutorial misconduct cases breeds a deplorably cynical attitude toward the judiciary. Cognitive bias research illuminates the reasons for, and …
Modifying Unjust Sentences, E. Lea Johnston
Modifying Unjust Sentences, E. Lea Johnston
Georgia Law Review
Judicial sentence modification offers a means to address the phenomenon of over-incarcerationas well as the harsh prison conditions that threaten unjust punishment. Indeed, some legislatures have framed states' early release provisions as fulfilling goals of proportionality and just punishment. This Article explores whether the tools available to judges at sentence modification hearings are adequate to respond to the unjust punishment experienced by prisoners. In examining this question, the Article focuses on one population particularly likely to experience disproportionate or inhumane punishment: inmates with serious mental disorders. A deep literature suggests that individuals with serious mental illnesses are especially likely to …
Structural Tax Exceptionalism, James M. Puckett
Structural Tax Exceptionalism, James M. Puckett
Georgia Law Review
Following the Supreme Court's landmark decision in Mayo Foundation for Medical Education and Research v. United States, many scholars of tax law have declared that Mayo marks the death of tax exceptionalism. The tax exceptionalist view holds that because tax is different or special, generally applicable administrative law procedural rules and doctrines do not apply in the tax context. In Mayo, however, the Supreme Court held that generally applicable administrative law rules and doctrines do apply to the Treasury Department and the IRS. Contrary to the prevailing narrative that proclaims the death of tax exceptionalism, this Article posits that the …
From Fedspeak To Forward Guidance: Regulatory Dimensions Of Central Bank Communications, Robert B. Ahdieh
From Fedspeak To Forward Guidance: Regulatory Dimensions Of Central Bank Communications, Robert B. Ahdieh
Georgia Law Review
Let's pause here and note what this moment represented. For the first time, the [Federal Open Market] Committee was using communication-mere words-as its primary monetary policy tool. Until then, it was probably common to think of communication about future policy as something that supplemented the setting of the federal funds rate. In this case, communication was an independent and effective tool for influencing the economy. The FOMC had journeyed from "never explain" to a point where sometimes the explanation is the policy. - Janet L. Yellen'

Post-Crisis Reform Of The Supervisory System And High Reliability Theory, Robert F. Weber
Post-Crisis Reform Of The Supervisory System And High Reliability Theory, Robert F. Weber
Georgia Law Review
Post-crisis reforms of the financial supervisory system have focused on improving the resilience of individual firms and promoting containment of problems in the event that an individual firm does fail. Both resilience and containment are hallmarks of "high reliability organizations" (HROs), a class of organizations distinguished by their ability to maintain reliable performance in dynamic operating conditions.' In the organizational context, resilience is about making organizations more robust to unexpected problems and stresses, and able to maintain performance across a wide range of unanticipated stressed outcomes. Containment is about isolating organizational failures so that when they occur, they do not …
The Evolving Role Of Economic Analysis In Sec Rulemaking, Joshua T. White
The Evolving Role Of Economic Analysis In Sec Rulemaking, Joshua T. White
Georgia Law Review
Recently, the SEC has come under great scrutiny for how it conducts economic analysis around rulemakings, especially those associated with the Dodd-Frank Wall Street Reform and Consumer Protection Act (Dodd-Frank or the Dodd-Frank Act) Dodd-Frank tasked the SEC with more than 100 rulemaking provisions. Perhaps no criticism had a more profound effect than the D.C. Circuit's decision in Business Roundtable v. SEC, which struck down the SEC's proxy access rule due to inadequate economic analysis.
Regulations are imperfect. They cannot be costlessly executed or enforced. Regulators also lack full information on the actual costs and benefits of proposed policies. For …
A Critique Of Hobby Lobby And The Supreme Court's Hands-Off Approach To Religion, Samuel J. Levine
A Critique Of Hobby Lobby And The Supreme Court's Hands-Off Approach To Religion, Samuel J. Levine
Scholarly Works
Over the past several decades, the United States Supreme Court has demonstrated an increasing refusal to engage in a close evaluation of the religious nature of Free Exercise and Establishment Clause claims, instead deferring to adherents’ characterizations of the substance and significance of a religious practice or belief. The Supreme Court’s hands-off approach, which it has justified on both constitutional and practical grounds, has attracted considerable scholarly attention, producing a substantial and growing body of literature assessing and, at times, critiquing the Court’s approach.
Part I of this Essay provides a brief overview for analyzing the Supreme Court’s hands-off approach …
The Effect Of A Drama On Young Adults' Attitudes About Domestic Violence, Regina Watson
The Effect Of A Drama On Young Adults' Attitudes About Domestic Violence, Regina Watson
Walden Dissertations and Doctoral Studies
Intimate partner abuse has been and remains a pervasive problem that has been documented in every race, religion, class, and level of education. This study presented the rationale for achieving positive social change by examining the problem through prevention rather than reaction and intervention. Although many theories of causation have been presented at various times, none has been proven or offers a complete explanation. Social ecological theory examines the interaction of individual, community, relational, and societal influences on the development of attitudes and behavior acceptance. This pre and post-survey group, quasi-experimental study examined the effects of an intervention on attitudes …
Health Care Seeking Behavior And Provider Responses For Hcv-Positive African Americans, Kathleen Susanna Bailey
Health Care Seeking Behavior And Provider Responses For Hcv-Positive African Americans, Kathleen Susanna Bailey
Walden Dissertations and Doctoral Studies
Of the 3.5 million persons infected with chronic HCV in the United States, the African American population is the largest racial group with chronic HCV. Disparities in access to care and treatment involve a complex set of individual, interpersonal, socioeconomic, and environmental factors that influence the course of HCV infection in the African American population, resulting in poorer outcomes and survival. Drawing upon both the theory of reasoned action and the theory of planned behavior, this study was conducted to determine whether the seeking of health care by HCV-positive African Americans and the responses of health care providers to HCV-positive …
Social Skills Comparison Of Online And Traditional High School Students, Jo Shaw
Social Skills Comparison Of Online And Traditional High School Students, Jo Shaw
Walden Dissertations and Doctoral Studies
Online education has evolved over the last 18 years as technology continues to advance. Starting at age 5, children are able to forego traditional classrooms and begin attending school from a computer in their homes. Research has not identified significant academic differences between traditional and online schools; however, there is limited research on differences in social competency in these settings. Bandura's social learning theory was used as a framework to compare social competency skills in traditional (n = 113) and online (n = 28) high school students living in Pennsylvania using the Social Skills Inventory (SSI). Participants were recruited using …
Ventilator-Associated Pneumonia Prevention Bundle, Patricia Cal
Ventilator-Associated Pneumonia Prevention Bundle, Patricia Cal
Walden Dissertations and Doctoral Studies
Ventilator-associated pneumonia (VAP) is a serious complication in critically ill patients; it can prolong intubation, increase intensive care unit and hospital length of stay, and increase mortality to twice the level of patients who do not develop VAP. The purpose of this project was to determine the effect of an evidence-based educational program to prevent VAP on ICU nurses' actual and documented practices for preventing VAP. The research questions addressed whether an educational program focused on VAP prevention will affect critical care nurses' compliance with a VAP prevention bundle, and whether the education will result in maintenance of a rate …
The Impact Of Peer-Mediated Video Modeling On The Mathematics Achievement Of High School Students, Keriann Currlin
The Impact Of Peer-Mediated Video Modeling On The Mathematics Achievement Of High School Students, Keriann Currlin
Walden Dissertations and Doctoral Studies
A significant percentage of US students are not reaching expected proficiency on mathematics content. As a response, educators have been urged to use more evidence-based practices; however, due to the lack of readily available strategies, these efforts have been thwarted. In related fields, video modeling (VM) has been successful in teaching behavioral skills through edited video clips that allow target populations to observe models successfully performing featured tasks. Stemming from Bandura's social learning theory, the intent of VM is to increase the frequency of the modeled behavior through observational learning. Despite the many studies that have shown success with VM, …

Uterine Fibroid Symptom Severity And Impact On Health-Related Quality Of Life Among African American Women, Ilisher Ford
Walden Dissertations and Doctoral Studies
A disproportionate number of African American women are at increased risk for uterine fibroid tumors (UF) compared to their Caucasian, Asian, and Hispanic counterparts. Researchers have indicated that women diagnosed with UF can have a poorer health-related quality of life (HRQOL) when compared to women who do not have a diagnosis of UF. The overall aim of this study was to explore the impact of UF symptoms on the HRQOL of African American women. A quantitative, cross-sectional design was employed utilizing the revised version of Wilson and Cleary's model of HRQOL. A sample was gathered of 80 participants who were …
An Examination Of The Differential Impact Of University/College Research Emphasis On Levels Of Counselors' Resilience, Erica Ann Handon
An Examination Of The Differential Impact Of University/College Research Emphasis On Levels Of Counselors' Resilience, Erica Ann Handon
Walden Dissertations and Doctoral Studies
Counselor resilience is the ability to transform adversity into growth opportunities that become part of the professional's identity and the core values of a counselor. However, researchers have yet to identify why some counselors exhibit higher levels of resilience while others exhibit less. Counselor resilience can be learned and nurtured at any point of an individual's development. The purpose of this study was to examine how differences within the foundational edification of a research-embedded curriculum impact a counselor's level of resilience. Participants included practicing counselors who received their counseling degrees from a 2014 U.S News and World Report (USNWR) Nationally …

The Influence Of Demographics And Cultural Attitudes On Sexual Orientation Attitudes In African American Adults., Bernadette Dawn Harrell
Walden Dissertations and Doctoral Studies
African Americans who identify as gay, lesbian, bisexual, and transgender (GLBT) are discriminated against in the African American community. Sociodemographics such as income, education, age, and religion/spirituality have been shown to be associated with sexual prejudice. There is limited research on how African American cultural attitudes influence attitudes towards sexual orientation. The purpose of this study was to examine the extent to which demographic variables and African American cultural attitudes (measured by the African American Acculturation Scale-Revised; AAAS-R) predict attitudes toward sexual orientation in African American adults (measured by the Attitudes towards Lesbians and Gay Men Scale; ATLG). Social identity …

This qualitative study was designed to understand the experiences of General Educational Development (GED) graduates enrolling into a community college. Research had not been conducted to explore the experiences of GED graduates completing the 2014 version of the exam and transitioning to college. Guided by Schlossberg's college transition theory and Bandura's theory of self-efficacy, this phenomenological study included 11 participants who described their experiences through written narratives and interviews. Participants described their experiences of being an adult education student while preparing for the exam, the steps within the GED test preparation they considered important to matriculation toward college enrollment, and …
Impact Of Pretreatment Self-Perceived Quality Of Life On Chronic Pain Patients, Michelle Laird
Impact Of Pretreatment Self-Perceived Quality Of Life On Chronic Pain Patients, Michelle Laird
Walden Dissertations and Doctoral Studies
Researchers and practitioners have developed new treatment options for chronic pain management based on biopsychosocial models of pain known as interdisciplinary pain management programs (IPMP), which involve interdisciplinary care that integrates physical treatment with emotional, environmental, behavioral, and cognitive interventions. Despite literature documenting the effectiveness of IPMPs, patients find it difficult to obtain authorization for these programs from third party insurance payers. The purpose of this quantitative causal comparative study was to explore whether a patient's perceived quality of life after injury but prior to treatment will affect his or her success in an IPMP. This study was based in …
Perceptions Of Empty Nest Mothers From Diverse Socioeconomic Backgrounds With Boomerang Kids, Banning Kent Lary
Perceptions Of Empty Nest Mothers From Diverse Socioeconomic Backgrounds With Boomerang Kids, Banning Kent Lary
Walden Dissertations and Doctoral Studies
In the United States, a growing number of young people are failing to launch into self-sufficiency, a characteristic of adulthood recognized by most cultural groups. These "boomerang children" return home and interrupt the life course development of their "empty nest" mothers who must suspend plans for self-development. How mothers from different socioeconomic backgrounds cope with this countertransitional phenomenon while preparing their children for successful relaunch is not well known. Elder's life course paradigm provided the theoretical framework for this phenomenological study. Perceptions were collected from an ethnically diverse group of 23 empty nest mothers with 30 boomerang children and seven …

Implementing Change: How, Why, And When Teachers Change Their Classroom Practices, Diane Beth Van Bodegraven
Walden Dissertations and Doctoral Studies
Teacher implementation of school reforms varies widely and often results in inconsistent student outcomes. Teachers adopt or resist change for complex reasons that are not fully understood. This qualitative study explored how veteran teachers described their experiences with school reform and changes in classroom practices that occurred over the course of their careers; it also examined factors that teachers identified as having positive and negative influences on their adoptions of change. The conceptual framework was based on Senge's systems theory as applied to learning organizations and Goleman's emotional intelligence theory. The research questions focused on: (a) How veteran teachers described …

The Role Of Teacher Perceptions In Parental Involvement, Crecenra Boyd
Walden Dissertations and Doctoral Studies
In the changing field of education, there is awareness of the benefits of parental involvement on student achievement and the impact teachers have on the success of parental involvement programs. However, teachers may rely significantly on their personal experiences as a source of reference for parental involvement and subsequently impact student achievement. There is a gap in the research about the lived experiences of teachers regarding their perspectives and support of parental involvement in the classroom. The purpose of this phenomenological study was to explore teachers' lived experiences and attitudes concerning parental involvement and student achievement. The conceptual framework for …
