A Lawyer Looks At Civil Disobedience: Why Lewis F. Powell Jr. Divorced Diversity From Affirmative Action, Anders Walker

This Article reconstructs Lewis F. Powell Jr.'s thoughts on the civil rights movement by focusing on a series of littleknown speeches that he delivered in the 1960s lamenting the practice of civil disobedience endorsed by Martin Luther King Jr. Convinced that the law had done all it could for blacks, Powell took issue with King's "Letter from Birmingham Jail," impugning its invocation of civil disobedience and rejecting its calls for compensatory justice to make up for slavery and Jim Crow. Dismissive of reparations, Powell developed a separate basis for supporting diversity that hinged on distinguishing American pluralism from Soviet totalitarianism. …

The pretext when approaching this subject is to present new elements that show the otomí world vision based in field data and the revision of what has been written. Mythology and the language itself contributed elements to demonstrate the otomíes are guided by a trinity notion which is present within their universe; it is a new way to approach the indigenous world (above all the otomí tribes) in a scientific manner. Robots are increasingly becoming key players in human-robot teams. To become effective teammates, robots must possess profound understanding of an environment, be able to reason about the desired commands and goals within a specific context, and be able to communicate with human teammates in a clear and natural way. Online portfolio selection (PS) has been extensively studied in artificial intelligence and machine learning communities in recent years. An important practical issue of online PS is transaction cost, which is unavoidable and nontrivial in real financial trading markets. Most existing strategies, such as universal portfolio (UP) based strategies, often rebalance their target portfolio vectors at every investment period, and thus the total transaction cost increases rapidly and the final cumulative wealth degrades severely. This study examines the potential for intra-Africa trade and the prospects of advancing regional economic integration through such trade. A variety of empirical models are deployed for the purpose. The analysis and model simulation results reveal the existence of significant potential for intra-Africa trade. However, realizing this potential and hence the effort to advance regional integration through intra-Africa trade is challenged by lack of complementarities of exports and imports as well as the relative competitive position of African potential export suppliers. Samuel Richardson And The "Jew Bill" Of 1753: A New Political Context For Sir Charles Grandison, B Latimer

Analysis of the religious politics of Samuel Richardson’s The History of Sir Charles Grandison (1753-4) focuses on the text’s Catholic and post-Jacobite aspects. This essay argues that there is a more immediate political context for understanding religious tolerance in the novel: the Jewish Naturalisation Act of 1753. Grandison was printed during 1753, when this controversial legislation was passed and repealed. The novel contains Richardson’s only Jewish character, Solomon Merceda, and an exploration of debate over the Act reveals similarities between the assumptions and language of the pamphlet literature, and those found in the novel. Evaluation Of The Geochemical Stability Of The Sandia Canyon Wetland, Brian M. Iacona

The Sandia Canyon Wetland is an effluent supported wetland sustained by three National Pollutant Discharge Elimination System (NPDES) permitted outfalls. The wetland sediments contain an inventory of chromium released from historic operations. Maintaining physical and geochemical stability in the wetland is intended to keep the chromium inventory in its reduced trivalent state to minimize mobility and subsequent offsite migration. Upgrades to the Sanitary Effluent Reclamation Facility (SERF) decreased the amount of water used in nearby cooling towers, and therefore reduced the volume of effluent discharged into the wetland. SERF provides tertiary treatment to treated sanitary effluent creating water of improved …

This article presents the major impact of implemented U.S. Indian policies on the lives of American Indian children. First, the article discusses U.S. policies aimed to re-socializing American Indians through imposition of external language, culture, and beliefs through a system of government-mandated education. In the late 1700s through the 1800s, the U.S. government set a course for military control over American Indian peoples. Re-socialization as an assimilation policy forced profound lifestyle and culture changes. These policies were aimed directly at American Indian children through mandatory Indian residential boarding schools. After decades of resistance, many tribal communities achieved educational reform. The catalytic methane decomposition to produce carbon oxides–free hydrogen and carbon nanomaterial is a promising method feasible for larger production at a moderate cheap price. The produced hydrogen is refined and can be employed straight in fuel cell and in petrochemical industries to produce ammonia and methanol. Auto-thermal reforming of natural gas, partial oxidation, steam reforming are the conventional techniques for hydrogen production in industry, though these processes incur excessive costs for the purification of hydrogen from producing carbon oxides. Since 2001, Colorado has recognized a special type of water right for whitewater parks, which are constructed within a river channel to provide play features for kayakers and other boaters. These water rights, called "recreational in-channel diversions, " are unique to Colorado, even though whitewater parks exist in several western states. This Article addresses some of the underlying reasons that recreational in-channel diversions were established in Colorado, and traces the controversy surrounding their recognition by that state's courts and legislature. Over the last decade, however, the controversy has largely died away, and whitewater park rights have now become an accepted …

This article explores how the designation of critical habitat under the Endangered Species Act provides an opportunity for landscape-level planning to conserve species. The Act’s requirement to designate critical habitat has generated considerable controversy. Some question its utility, including even those who aggressively pursue species conservation. Other industry and local communities challenge the economic analyses accompanying designations. For many years, designating critical habitat only occurred after litigation, well after the Act suggests designation. The general malaise surrounding the program, therefore, is well documented. Yet policy-makers and scholars shy away from crafting innovative proposals for resolving the principal issues hovering around …

New water development projects in China threaten the environment of international rivers. Chinese law, however, does not require developers to assess the effects of proposed projects on the environment outside China’s borders. Nevertheless, examples of transboundary cooperation and international agreements provide a basic legal foundation that allows China to implement transboundary environmental impact assessments (TEIA) as a standard practice. This article explores China’s customary law obligation to conduct TEIA by examining relevant treaties and instances of joint action. Water markets form differently across the western United States, depending on the relative importance of water supply uncertainty and impediments to water transfers. In many locations, trades take the form of short-term leases of water, allowing the underlying property rights to remain unaffected. In other regions, water right transfers predominate. We quantify the relative effects of economic, hydrologic, and state-level institutional variables on a water agency’s decision whether to lease or purchase water rights. Econometric analysis of 3,806 transactions reported in the Water Strategist over 1990 supports the conclusion that market structure varies across states in accordance with local hydrologic …

After reaching water rights settlements, a number of Native American tribes find themselves with rights to more water than their reservations or pueblo communities presently need. As climate change exacerbates drought conditions in the western United States and demand for water increases, some tribes have leased these surplus water rights to public and private, non-Indian, users. Theoretically, this could be a boon for tribes, although the extent of the economic impact of water leasing is difficult to assess without an examination of each individual water lease. The United States Department of Justice released a Findings Letter in connection with its investigation of the use of force by the Albuquerque Police Department from 2009 to early 2013. It found that APD had engaged in a pattern or practice of using excessive force, both lethal and non-lethal. The parties reached an agreement on October 31, 2014 and the Complaint and Settlement Agreement were filed in the United States District Court for the District of New Mexico for approval. Planning For Digitization Of University Libraries In Ghana: Challenges And Prospects, Perpetua Sekyiwa Dadzie, Thomas Van Der Walt

The study investigates the availability of strategic plans or policies for the development of digital libraries in selected universities in Ghana. A case study approach was adopted and interviews were held with three university librarians to determine their views on planning and budgeting for digitization. The findings reveal that all three university libraries have strategic plans, though some are outdated and therefore, rely on policies to ensure that digitization activities are enhanced. Budgetary support for digitization activities range from 16.6% - 50% of the total library budget. The study recommends that the libraries should have an up-to-date strategic plan which …

This study investigated the extent to which demographic variables and ICT access predict ICT use among science teachers in FUS in Nigeria. Out of the Four hundred and sixty four (464) copies of questionnaire administered on science teachers in 25 FGUSs only 353 copies were returned with useful responses. The findings of the study revealed ICT accessibility (B = .431), educational qualification (B = -.187), teaching experience (B = -.154), ICT use experience (B = .152), and location of ICT access (B = .144) as best predictors of ICT use among science teachers in FUSs in Nigeria.
