Free, But Still Behind Bars: Reading The Illinois Post-Conviction Hearing Act To Allow Any Person Convicted Of A Crime To Raise A Claim Of Actual Innocence, 35 B.C. J. L. & Soc. Just. 1 (2015), Hugh Mundy Jan 2015

Free, But Still Behind Bars: Reading The Illinois Post-Conviction Hearing Act To Allow Any Person Convicted Of A Crime To Raise A Claim Of Actual Innocence, 35 B.C. J. L. & Soc. Just. 1 (2015), Hugh Mundy

UIC Law Open Access Faculty Scholarship

As the number of wrongfully convicted prisoners who are subsequently exonerated continues to rise, the importance of access to post-conviction relief also increases. Under the Illinois Post-Conviction Hearing Act, this access is restricted to petitioners who are currently imprisoned or otherwise facing a restraint on their liberty. Persons convicted of a crime who have completed their sentence are barred from pursuing post-conviction relief under the Act, regardless of the existence of exculpatory evidence that supports their innocence. Removing this procedural roadblock and interpreting the Act broadly to allow any person convicted of a crime to raise a claim of actual …

Ending Bacha Bazi: Boy Sex Slavery And The Responsibility To Protect Doctrine, 25 Ind. Int'l. & Comp. L. Rev. 63 (2015), Samuel Vincent Jones

UIC Law Open Access Faculty Scholarship

This essay challenges the conventional wisdom that prohibitions against government-condoned child-sex slavery have attained non- derogable, peremptory status under international law. Much to the utter shock of field investigators and human rights experts, boy sex slavery has evolved into a constitutive and central feature of the Islamic Republic of Afghanistan (Afghanistan) because of a customary practice commonly referred to as bacha bazi.

The International Criminal Court: An Analysis Of The Prevention And Deterrence Of Atrocity Crimes, Shanay M. Murdock

Honors Capstones

This work examines the International Criminal Court (ICC) and its capacity for preventing and deterring atrocity crimes (genocide, crimes against humanity, and war crimes) in relation to its historical development and current standing. Prevention and deterrence at the international level are very difficult to measure empirically, so this work focuses on the perceived successes and challenges of the ICC’s deterrent capacity as a “Court of last resort," in light of international legal and institutional norms. The Court, now in its thirteenth year, is the first of its kind, leaving it vulnerable to (sometimes) unrealistic criticisms and expectations as it builds …

Closed Circuit Television (CCTV) systems are found in a variety of environments and used for a multitude of purposes, leading to differing views of CCTV within an organisation. In accordance to management theory, organisations contain a stratum of work where each level requires specific skills set. The Prevalence Of Sexual Assault On College Campuses, Brenna Hill Jan 2015

The Prevalence Of Sexual Assault On College Campuses, Brenna Hill

The Expositor: A Journal of Undergraduate Research in the Humanities

Sexual assault is a social problem that disproportionately affects college students. Sexual assault perpetrated by men against women is a common occurrence on college campuses. Although situations involving alcohol and drug use often play a role in sexual assault cases, the root cause of the problem is the general perception of violence against women that is perpetuated in society and is implicitly tolerated as an aspect of the status quo. The impact of sexual assault on the survivor is far-reaching. Not only does the survivor experience physical and mental suffering from the assault, the experience jeopardizes the survivor’s college education. …
