Trends In Intellectual Disability Identification In West Virginia, Margaret M. Stephens

Theses, Dissertations and Capstones

The purpose of this study was to examine the prevalence of Intellectual Disability (ID) in each of West Virginia’s Local Educational Agencies (LEAs). Publicly available enrollment and disability counts were aggregated and used to calculate an administrative prevalence rate for each LEA annually, from 2004 to 2013. Prevalence was examined within and between LEAs, as well as between regions. The results indicate a decrease in the administrative prevalence of ID in 50 of 55 LEAs over the 10 years examined. Rates within LEAs varied between years. Additionally, school-based prevalence varied between RESAs, with RESA I and RESA VIII exhibiting the …

Theses, Dissertations and Capstones

The purpose of this descriptive, mixed-method study was to explore the role that research evidence plays in policy-related decision-making within West Virginia’s higher education system, policymakers’ perceptions on the reliability and usefulness of various sources of information, and their insights related to factors that facilitate and/or impede the use of research evidence. Using data obtained through an internet-based questionnaire administered to more than 100 higher education policymakers, the study resulted in several notable findings, many of which reinforced similar findings uncovered in the review of the literature.

Evaluating Chain-Of-Command Self-Efficacy Through High Fidelity, Student-Directed, Obstetrical Simulation, Michelle Mcewen-Campbell Jan 2015

Evaluating Chain-Of-Command Self-Efficacy Through High Fidelity, Student-Directed, Obstetrical Simulation, Michelle Mcewen-Campbell

Nursing Theses and Capstone Projects

The purpose of this quasi-experimental capstone project was to evaluate the impact of high fidelity, student-directed, obstetrical simulation upon chain-of-command self-efficacy of baccalaureate nursing students. The convenience sample, composed of 48 junior nursing students, was randomly divided into four simulation groups, and then further randomly divided into active or observational status. Active participants planned interventions and participated in high fidelity obstetrical simulations related to patient safety and chain-of-command initiation. Active and observational students participated in a combined debriefing session. A pretest posttest design utilizing the General Self-Efficacy Scale (GSES) was utilized to measure chain-of-command self-efficacy in relation to both active …

Overcriminalizing Speech, Michal Buchhandler-Raphael Jan 2015

Overcriminalizing Speech, Michal Buchhandler-Raphael

Scholarly Articles

Recent years have seen a significant expansion in the criminal justice system’s use of various preemptive measures, aimed to prevent harm before it occurs. This development consists of adopting a myriad of prophylactic statutes, including endangerment crimes, which target behaviors that merely pose a risk of future harm but are not in themselves harmful at the time they are committed.

This Article demonstrates that a significant portion of these endangerment crimes criminalize various forms of speech and expression. Examples include conspiracies, attempts, verbal harassment, instructional speech on how to commit crimes, and possession crimes. The Article argues that in contrast …

Justice Scalia's Fourth Amendment: Text, Context, Clarity, And Occasional Faint-Hearted Originalism, Timothy C. Macdonnell

Scholarly Articles

Since joining the United States Supreme Court in 1986, Justice Scalia has been a prominent voice on the Fourth Amendment, having written twenty majority opinions, twelve concurrences, and six dissents on the topic. Under his pen, the Court has altered its test for determining when the Fourth Amendment should apply; provided a vision to address technology's encroachment on privacy; and articulated the standard for determining whether government officials are entitled to qualified immunity in civil suits involving alleged Fourth Amendment violations. In most of Justice Scalia's opinions, he has championed an originalist/textualist theory of constitutional interpretation. Based on that theory, …

The Assessment Of Capable Guardianship Measures Against Bullying: Victimization In The School Environment, Heather Correia Jan 2015

The Assessment Of Capable Guardianship Measures Against Bullying: Victimization In The School Environment, Heather Correia

Master’s Theses and Projects

It has been shown that increased security alone has not had a positive effect on the rate of bullying in schools. This study will empirically test the effectiveness of school resource officers as a variable of capable guardianship and its correlation with the rate and quality of bullying in schools. This research will determine if having capable guardianship, formal or informal, in the school system will have an effect on the deterrence of physical and nonphysical bullying in grade schools and high schools. This research suggests an increase in guardianship roles, will reduce the amount of bullying offenses in grade …

Sex, Gender, And Culture: The Emergence Of Structural Violence While Seeking A Sexual Health Transformation In Uganda, Leah Pauline

MA IDS Thesis Projects

With the 2nd highest fertility rate in the world and the 5th highest population growth rate, Uganda’s ever increasing number of inhabitants is becoming a hindrance to the nation’s ability to develop socially and economically. Despite the push for increased family planning services and sexual health services by the international community and national government, translating words into effective action has been met with cultural beliefs and behaviors blocking the road to changing sex practices within Uganda. Through conversations with the employees of Musana Community Development Organization in Iganga, Uganda, this research explores the complexity of the barriers standing in the …

Digital Forensics In Law Enforcement: A Needs Based Analysis Of Indiana Agencies, Teri A. Flory Jan 2015

Digital Forensics In Law Enforcement: A Needs Based Analysis Of Indiana Agencies, Teri A. Flory

Open Access Theses

Cyber crime is a growing problem, with the impact to both businesses and individuals increasing exponentially, but the ability of law enforcement agencies to investigate and successfully prosecute criminals for these crimes is unclear. Many national needs assessments were conducted in the late 1990’s and early 2000’s by the Department of Justice (DOJ) and the National Institute of Justice (NIJ), which all indicated that state and local law enforcement did not have the training, tools, or staff to effectively conduct digital investigations (Institute for Security and Technology Studies [ISTS], 2002; NIJ, 2004). Additionally, there have been some studies conducted at …

Variable Classification Of Drug-Intoxication Suicides Across Us States: A Partial Artifact Of Forensics?, Ian R H Rockett, Gerald R. Hobbs, Dan Wu, Haomiao Jia, Kurt B. Nolte, Gordon S. Smith, Sandra L. Putnam, Eric D. Caine

Faculty & Staff Scholarship

Background

The 21st-century epidemic of pharmaceutical and other drug-intoxication deaths in the United States (US) has likely precipitated an increase in misclassified, undercounted suicides. Drug-intoxication suicides are highly prone to be misclassified as accident or undetermined. Misclassification adversely impacts suicide and other injury mortality surveillance, etiologic understanding, prevention, and hence clinical and public health policy formation and practice.

Objective

To evaluate whether observed variation in the relative magnitude of drug-intoxication suicides across US states is a partial artifact of the scope and quality of toxicological testing and type of medicolegal death investigation system.

Methods

This was a national, state-based, ecological …
