Education And Educational Attainment In Southern Nevada, Jennifer Pharr, Courtney Coughenour, Shawn Gerstenberger
Education And Educational Attainment In Southern Nevada, Jennifer Pharr, Courtney Coughenour, Shawn Gerstenberger
Nevada Journal of Public Health
Failure to complete high school has a direct impact on a person’s earning potential and quality of life. Higher levels of education are associated with better health. Because of this association, it is important for children and adults to have access to quality education. The percentage of adults who have successfully pursued higher education in Southern Nevada is lower than the peer Mountain West metropolitan areas and the national average. Nevada high school graduation rates are the lowest in the nation. High school graduation rates and dropout rates vary by race/ethnicity in the Clark County School District. High school graduation …
Pardons And The Theory Of The “Second-Best”, Chad Flanders
Pardons And The Theory Of The “Second-Best”, Chad Flanders
Florida Law Review
This Article explains and defends a “second-best” theory of pardons. Pardons are second-best in two ways. First, pardons are second-best because they represent, in part, a response to a failure of justice: the person convicted was not actually guilty, or he or she was punished too harshly, or the punishment no longer fits the crime. In the familiar analogy, pardons act as a “safety valve” on a criminal justice system that doesn’t work as it ideally should. Pardons, in the nonideal world we live in, are sometimes necessary.
But pardons are also second-best because they can represent deviations from other …
The Rostrum Principle: Why The Boundaries Of The Public Forum Matter To Statutory Interpretation, Amy Widman
The Rostrum Principle: Why The Boundaries Of The Public Forum Matter To Statutory Interpretation, Amy Widman
Florida Law Review
This Article explores a normative proposal for statutory interpretation in light of this media-saturated age. The proposal, referred to in this Article as the Rostrum Principle, encourages the Court to interpret ambiguous terms in legislation with a presumption toward the way the legislation was “sold” to the public. This Article further explores the shifting public forum—away from the Congressional Record and formal legal frameworks to include cable news television, newspaper op-eds, and even Twitter. The explosion of popular and social media and politicians’ increasingly sophisticated use of these forms of communication goes far toward setting the debate regarding pending legislation. …

Does The Harm Principle Justify Criminal Drug Statutes Against Drug Use?, Kyle J. Lucas Mr.
The Hilltop Review
The debate over the legal status of drugs is a significant issue in our society due to the number of people fined and imprisoned each year for possessing these substances as well as the resources spent by law enforcement enforcing drug laws. However, what are the legal justifications for the current proscriptions? Looking specifically at the drug user, I will examine what I believe is the most powerful category of arguments in favor of laws against drugs: harm to others. I then adopt the Harm Principle articulated by John Stuart Mill in his work On Liberty as an account to …

Cancer Clusters In Delaware? How One Newspaper Turned Official Statistics Into News, Victor W. Perez, Joel Best, Rachel J. Bacon
Numeracy
The flagship newspaper for the state of Delaware, the News Journal, has been instrumental in disseminating information from state-generated reports of cancer clusters to its readers over the past 7 years. The stories provide colorful maps of census tracts designated as clusters, often on the front page, and detail the types of elevated cancers found in these tracts and the purported relationship of elevated cancer rates to local industry pollution. Though the News Journal also provided its readers with advice about interpreting these data with caution, it uncritically presented these data. Using the state’s unusual definition and measurement of …

Publications and Research
In this presentation, given at the 2015 MLA Convention, I examine the status of online digital humanities projects 10 years after they were presented.
Just over half of the 60 projects presented at DH2005 are still online. Of all the projects, about one-third are ongoing; one-third have been clearly completed; and one-third have unknown statuses. Of the 23 projects that were considered to be complete, three-quarters are still online; one quarter is no longer accessible.

Integrating The Principles Of Effective Intervention Into Batterer Intervention Programming: The Case For Moving Toward More Evidence-Based Programming, Dana L. Radatz, Emily M. Wright
Integrating The Principles Of Effective Intervention Into Batterer Intervention Programming: The Case For Moving Toward More Evidence-Based Programming, Dana L. Radatz, Emily M. Wright
Criminology and Criminal Justice Faculty Publications
The majority of batterer intervention program (BIP) evaluations have indicated they are marginally effective in reducing domestic violence recidivism. Meanwhile, correctional programs used to treat a variety of offenders (e.g., substance users, violent offenders, and so forth) that adhere to the “principles of effective intervention” (PEI) have reported significant reductions in recidivism. This article introduces the PEI—the principles on which evidence-based practices in correctional rehabilitation are based—and identifies the degree to which they are currently integrated into BIPs. The case is made that batterer programs could be more effective if they incorporate the PEI. Recommendations for further integration of the …

Montgomery County's Veterans Treatment Court Offers Opportunity For A Second Chance, Allison M. Loy, Will Davis
Montgomery County's Veterans Treatment Court Offers Opportunity For A Second Chance, Allison M. Loy, Will Davis
Veterans' Voices on WYSO
For veterans, reintegration back into civilian life after military service can be traumatic. Many vets make this transition successfully, but for others it’s very difficult, and some even commit crimes as a result of service-related trauma. Rather than let these men and women get lost in the criminal justice system, the Veterans Treatment Court was created – and courts like these are happening more around the country.
Are Cybercrime Laws Keeping Up With The Triple Convergence Of Information, Innovation And Technology?, Ramesh Subramanian, Steven Sedita
Are Cybercrime Laws Keeping Up With The Triple Convergence Of Information, Innovation And Technology?, Ramesh Subramanian, Steven Sedita
Communications of the IIMA
This paper analyzes the emergence and development of cyberlaws. In many coimtries aroxmd the world, cyberlaws are being enacted in order to curb or prosecute cybercriminals. Cybercriminals have very rapidly adlapted to developments in technology, specifically Internet technology, and use its characteristics of transience, anonymity, speed and vast spread to perpetrate various types of crimes. Thus the triple convergence of information, innovation and technology has also aided criminals to practice their nefarious "trade." The paper analyzes how various countries are taking counter measures by enacting cyberlaws. These actions are often slow and reactive rather than proactive. In addition, the laws …

21st Century Tattoo Identification And Information Sharing Thesis, Christina Smith
21st Century Tattoo Identification And Information Sharing Thesis, Christina Smith
Master’s Theses and Projects
Currently existing is minimal research on the concepts: tattoo identification procedures and information sharing challenges among law enforcement. This research contributes to the literature by examining: how Massachusetts police officers feel about tattoo identification, how they catalog tattoos, and the effectiveness of their technology to share information among departments about suspect’s tattoos. This research is unique because it evaluates whether or not tattoo identification procedures affect information sharing challenges.
Tattoos have a history dating back at least 5,000 years, in fact, an archeological find in the 1990s, was a mummy with 57 tattoos (Kent & Graber, 2012). Presently, tattoo popularity …
