The Death Penalty: Should The Judge Or The Jury Decide Who Dies?, Valerie P. Hans, John H. Blume, Theodore Eisenberg, Amelia Courtney Hritz, Sheri L. Johnson, Caisa Elizabeth Royer, Martin T. Wells

Cornell Law Faculty Publications

This article addresses the effect of judge versus jury decision making through analysis of a database of all capital sentencing phase hearing trials in the State of Delaware from 1977– 2007. Over the three decades of the study, Delaware shifted responsibility for death penalty sentencing from the jury to the judge. Currently, Delaware is one of the handful of states that gives the judge the final decision-making authority in capital trials. Controlling for a number of legally relevant and other predictor variables, we find that the shift to judge sentencing significantly increased the number of death sentences. Statutory aggravating factors, …

The Role Of Parenting In The Prediction Of Criminal Involvement: Findings From A Nationally Representative Sample Of Youth And A Sample Of Adopted Youth, Kevin M. Beaver, Joesph A. Schwartz, Eric J. Connolly, Mohammed Said Al-Ghamdi, Ahmed Nezar Kobeisy

Criminology and Criminal Justice Faculty Publications

The role of parenting in the development of criminal behavior has been the source of a vast amount of research, with the majority of studies detecting statistically significant associations between dimensions of parenting and measures of criminal involvement. An emerging group of scholars, however, has drawn attention to the methodological limitations—mainly genetic confounding—of the parental socialization literature. The current study addressed this limitation by analyzing a sample of adoptees to assess the association between 8 parenting measures and 4 criminal justice outcome measures. The results revealed very little evidence of parental socialization effects on criminal behavior before controlling for genetic …

The Relationship Between Age Of Onset Of Drug Use, Drug Dependence, Mental Disorders, And Offense Type And Severity, Kimberly Diane Gallo

Electronic Theses, Projects, and Dissertations

This study examines the relationship between age of onset of drug use and later drug dependence, and that of age of onset of drug use and current offense type/severity. In addition, it investigates the relationship between mental disorders, drug dependence, and current offense type/severity. Data from years 2007 to 2010 of the Arrestee Drug Abuse Monitoring Program II (ADAM II) were used. The analyses included cross tabulation and chi square. The results indicated that early onset marijuana users (those who began using at age fourteen or younger) were more likely to develop drug dependence than late onset users of marijuana. …

Perceptions Of Individuals With Disabilities In The Justice Systemabout Their Transition Preparation, Justine Nicole Howarth Mar 2015

Perceptions Of Individuals With Disabilities In The Justice Systemabout Their Transition Preparation, Justine Nicole Howarth

Theses and Dissertations

This study gathered information about adults with disabilities who were served with special education services during high school and incarcerated after high school, on their job preparation plan and explored the effects of that preparation on the individual's perception of successful transition after high school. It also investigated what, if anything, could have been done in high school to prevent their entrance or continuation in the criminal justice system. Due to the difficulty in accessing this population, only three individuals were interviewed. However, the rich information provided from this study indicated that to help them live independently and successfully transition …

Experimental Execution, Seema K. Shah Mar 2015

Experimental Execution, Seema K. Shah

Washington Law Review

On July 23, 2014, an execution in Arizona lasted nearly two hours, with the inmate struggling to breathe and gasping over 600 times, according to a local reporter witnessing the execution. This was the third example of a botched execution in seven months. The Supreme Court last evaluated the constitutionality of execution by lethal injection in 2008, but did not provide a clear standard for evaluating risks. Since that time, the lethal injection landscape has transformed. States are using entirely new drugs and drug combinations, and sometimes obtain these drugs from questionable sources, making it hard to predict what will …

The Moral Value Of Envy, Krista Karbowski Thomason Mar 2015

The Moral Value Of Envy, Krista Karbowski Thomason

Philosophy Faculty Works

It is common to think that we would be morally better people if we never felt envy. Recently, some philosophers have rejected this conclusion by arguing that envy can often be directed toward unfairness or inequality. As such, they conclude that we should not suppress our feelings of envy. I argue, however, that these defenses only show that envy is sometimes morally permissible. In order to show that we would not be better off without envy, we must show how envy is not merely morally permissible, but morally valuable. Here I provide a defense of envy's moral value. I argue …

Criminal Infliction Of Emotional Distress, Avlana K. Eisenberg Mar 2015

Criminal Infliction Of Emotional Distress, Avlana K. Eisenberg

Michigan Law Review

This Article identifies and critiques a trend to criminalize the infliction of emotional harm independent of any physical injury or threat. The Article defines a new category of criminal infliction of emotional distress (“CIED”) statutes, which include laws designed to combat behaviors such as harassing, stalking, and bullying. In contrast to tort liability for emotional harm, which is cabined by statutes and the common law, CIED statutes allow states to regulate and punish the infliction of emotional harm in an increasingly expansive way. In assessing harm and devising punishment, the law has always taken nonphysical harm seriously, but traditionally it …

Universal Jurisdiction, The Alien Tort Statute, And Transnational Public-Law Litigation After Kiobel, Ernest A. Young Mar 2015

Universal Jurisdiction, The Alien Tort Statute, And Transnational Public-Law Litigation After Kiobel, Ernest A. Young

Duke Law Journal

The Alien Tort Statute (ATS), enacted in 1789 as part of the first Judiciary Act, provides that “[t]he district courts shall have original jurisdiction of any civil action by an alien for a tort only, committed in violation of the law of nations . . . .” Although the statute lay dormant until the 1980s, the ATS has since become the font of transnational public-law litigation in American courts. This litigation, frequently involving largely foreign parties and events, is a form of civil-side universal jurisdiction. Like more traditional forms of universal jurisdiction, the ATS allows American courts to hear human-rights …

Sarah, a new attorney at a public defender’s office, is assigned to the appeals bureau. Ordinarily, Sarah spends her days researching and writing briefs, talking with clients, and brainstorming legal issues with colleagues. Today, however, she opened the mail to find a notice from the court setting a date for her first oral argument. She suffers the first of several anxiety attacks: rapid heart rate, racing thoughts, shortness of breath, sweaty palms, nausea, and feelings of panic and tension. As she reads the form letter, her hands tremble. This is the day she has dreaded. She loves to write and …

Bullycide: An Exploration Of The Prevalence Of Potential Indicators Comparing Lgbtiq And Heterosexual Adults, Isai Valdez

Electronic Theses, Projects, and Dissertations

This investigative study explores bullycide. Bullycide is the act of committing suicide because of bullying. The primary objective of this research was to compare Lesbian, Gay, Bisexual, Transgender, Intersex, Queer (LGBTIQ) (n = 41) and heterosexual (n = 20) respondents and the prevalence of potential bullycide indicators. By surveying (N = 61) adults, a comparison was made among respondents and their coping mechanisms to bullying. The study found that both sub-groups face an equally high tendency of coping with anger over discomfort (.017). The study also found that both sub-groups demonstrate a high likelihood of responding to bullying by withdrawing …
