Etsu Today - Spring 2015, University Marketing And Communication, East Tennessee State University
ETSU Today [magazine]
Graduation begins today on the campus of East Tennessee State University. In fact it begins every day at this institution. Each time a student enters a classroom, each time a faculty member holds a study session, each time a staff member meets with a student to discuss financial aid options, each time the lights are turned on in a research lab, each time a student completes an internship or an hour of community service, or boards a plane for a study abroad trip, we move one step closer to realizing the dream of a college degree for our more than …

The Criminalization Of Revenge Porn In Japan, Shigenori Matsui
The Criminalization Of Revenge Porn In Japan, Shigenori Matsui
Washington International Law Journal
Revenge porn is the practice of posting and distributing sexually explicit images of an ex-partner on the Internet to seek revenge after a breakup. Because it brings serious damages to the victims, it has become a significant social issue in Japan, the United States, and around the world. An increasing number of U.S. states and other countries are now enacting statutes criminalizing revenge porn. Recently, Japan joined these jurisdictions in criminalizing revenge porn when the Diet, the Japanese national legislature, passed the Revenge Porn Victimization Prevention Act. This article compares the Act with legislation in the United States and critically …
The Incitement Of Terrorism On The Internet: Legal Standards, Enforcement, And The Role Of The European Union, Ezekiel Rediker
The Incitement Of Terrorism On The Internet: Legal Standards, Enforcement, And The Role Of The European Union, Ezekiel Rediker
Michigan Journal of International Law
Consider this sentence: “The Shining Path is a heroic organization.” Over the past thirty years, the Shining Path has waged a violent guerilla war against the Peruvian government, prompting the European Union to designate the group as a terrorist organization. In certain European countries, speech inciting or glorifying terrorist organizations is criminalized. As a result, citizens risk prosecution if they do not carefully limit what they say about the Shining Path, or other terrorist organizations. But where does free speech end and incitement to terrorism begin? The debate over free speech and incitement to terrorism is actively being played out …
Patching Old Wineskins: Heightened Deference Towards Saiban-In Findings Of Fact On Koso Appeals Is Not Enough, Caleb Jon F. Vandenbos
Patching Old Wineskins: Heightened Deference Towards Saiban-In Findings Of Fact On Koso Appeals Is Not Enough, Caleb Jon F. Vandenbos
Washington International Law Journal
The successful introduction of the saiban-in seido—the Japanese lay assessor system—was a tremendous step towards creating meaningful exchange between the public and the judiciary and democratizing the criminal justice system in Japan. To preserve the quality of this exchange, judges must conscientiously solicit and respect lay assessor input during deliberations, and saiban-in decisions must retain their force on appeal. Under current appellate procedure, however, saiban-in findings of fact may be replaced on koso appeal. Koso appeals threaten to eviscerate lay participants’ contributions in the individual case being reviewed and, in the long term, will discourage judges from taking lay …
Challenges In Implementing Restorative Justice Practices In The United States, Erin Roaza
Challenges In Implementing Restorative Justice Practices In The United States, Erin Roaza
Capstone Collection
The purpose of this study was to research the challenges that restorative justice practices come across in their institutional and implementation phases within the United States. The modern concept or philosophy of Restorative Justice has been around for about four decades since the 1970s or 80s. There have been multiple studies made to prove that restorative justice practices might reduce recidivism incarceration costs, while also creating a more fulfilling experience for all parties involved, including minimizing feelings of revenge from the victim. So why has the United States criminal justice system not made more advancements to incorporate more restorative justice …

Improving Police Officer Responses To Persons With Mental Illnesses: A Review Of The Literature, Portland State University. Criminology And Criminal Justice Senior Capstone
Criminology and Criminal Justice Senior Capstone Project
Addressing mental illness in the American criminal justice system is necessary in order to ensure both citizens and officers are safe. According to Centers for Disease Control and Prevention (2011), published studies show approximately 25 percent of all adults in the U.S. have a mental illness and nearly 50 percent of adults in the U.S. will develop at least one mental illness during their lifetimes. The U.S. Department of Justice’s Bureau of Justice Statistics also indicates nearly 25 percent of state prisoners and jail inmates with a mental health problem have three or more prior incarcerations (as cited in Glaze …

From Prosecutorial To Reparatory: A Valuable Post-Conflict Change Of Focus, Nancy A. Combs
Michigan Journal of International Law
The ICC is well known in international legal circles. Indeed, everyone who knows anything about international law knows that the ICC is the acronym for the International Criminal Court, the body charged with prosecuting international crimes around the globe. Created in 2002, the ICC was intended to “put an end to impunity” for the perpetrators of international crimes” and to affirm “that the most serious crimes of concern to the international community as a whole must not go unpunished.”1 Imagine, however, a world where the “ICC” instead was an acronym for the International Compensation Court. That is, what if the …

Sexual Violence In India: The History Of Indian Women’S Resistance, Renae Sullivan
McNair Scholars Research Journal
This research seeks to recontextualize the understanding of the ways women resist sexual violence and agitate for change of socio-cultural and political practices in India. Modern Indian women’s social movements were revitalized in the 1970s with the Mathura rape case in Maharastra. The historical context of this impactful activism is framed through analysis of four pivotal rape cases—Mathura, Bhanwari Devi, Imrana and “Nirbhaya,” otherwise known as the Delhi gang rape case. The assertive and innovative resistance of women includes such tactics as sit-down protests, marches, rallies, candle light vigils, street theatre, presentations, ad campaigns, freeze mobs, and social media. The …

Hate Crime Laws: What Are They And Who Do They Protect?, Maya Pedersen
Hate Crime Laws: What Are They And Who Do They Protect?, Maya Pedersen
Honors Theses
Perhaps due to media attention, especially to recent high-profile cases, awareness of hate crime laws has increased. When people think of the groups protected by such legislation, factors such as race/ethnicity, religion, and sexual orientation often come to mind. People victimized because of their affiliation with any designated group should be protected under these laws and perpetrators of such crimes should receive enhanced penalties. More specifically, the Hate Crime Protection Act (2009) made it a federal offense to assault someone because of sexual orientation. Relatively little research has been conducted on hate crime legislation, but it is important to understand …
