Standing In The Intersection : Using Photovoice To Understand The Lived Experience Of Black Gay College Students Attending Predominantly White Postsecondary Institutions., Erica Caton
Electronic Theses and Dissertations
The intersection of multiple oppressed identities is characterized by the compounded effects of victimization, intimidation and continued marginalization by dominant culture groups in society. Despite a growing body of knowledge about the individual experiences of racial and sexual minorities, there remains a lack of understanding of the unique life experiences of individuals with intersecting oppressed identities, specifically Black gay youth. Failure or inability to recognize, understand and take action in response to the needs of Black gay youth in college, perpetuates a culture of oppression that compromises the physical and mental well-being, and the academic success of these students. Engaging …
Behind Enemy Phone Lines: Insider Trading, Parallel Enforcement, And Sharing The Fruits Of Wiretaps, Alexandra N. Mogul
Behind Enemy Phone Lines: Insider Trading, Parallel Enforcement, And Sharing The Fruits Of Wiretaps, Alexandra N. Mogul
Fordham Law Review
Two key trends were present in the successful prosecution of Raj Rajaratnam and his coconspirators in one of the largest insider-trading conspiracies in history: the use of wiretaps to investigate and prosecute insider trading and a joint effort between the Department of Justice (DOJ) and the Securities & Exchange Commission (SEC) to conduct the investigation. Despite the close working relationship between the DOJ and the SEC, the DOJ never disclosed the fruits of the wiretaps to the SEC, presumably due to its belief that Title III of the Omnibus Crime Control and Safe Streets Act of 1968 (as amended, the …

Perceptions Of Crime Prevention Through Environmental Design (Cpted) At Australian Railway Stations, Paul Cozens, Tiffany Van Der Linde
Perceptions Of Crime Prevention Through Environmental Design (Cpted) At Australian Railway Stations, Paul Cozens, Tiffany Van Der Linde
Journal of Public Transportation
Personal safety and security are essential criteria for measuring the quality of public transport, and research has consistently demonstrated that crime and fear of crime affect levels of patronage. Although authorities throughout the world are implementing Crime Prevention Through Environmental Design (CPTED), research and practice commonly focus on the elements of surveillance, territoriality, and controlling access. Few studies have investigated the CPTED concepts of “image management” or “geographical juxtaposition” (the surrounding environment). This research compares and contrasts the perceptions of rail users and security experts in relation to two railway stations in Perth, Western Australia. One station was designed in …

A Review Of 'Body Farm' Research Facilities Across America With A Focus On Policy And The Impacts When Dealing With Decompositional Changes In Human Remains, Brittany M. Wolff
Criminology & Criminal Justice Theses - Archive
In the current research study, the use of content analysis and secondary data analysis provided the exploratory research on the “body farm” research facilities across the United States. Open-ended survey questions were also utilized and sent to the six research facilities across the country. The use of open-ended survey questions in combination with a small sample size, resulted in only one institution participating in the survey and one facility actively declining to participate. To resolve this limitation, the use of secondary data and content analysis from facility publications and websites were utilized to complete some of the gaps resulting from …

Green Criminological Concerns & Philosophical Beliefs, Alexander Allen Anderson
Criminology & Criminal Justice Theses - Archive
The purpose of this research project was to test the philosophical argument that people who maintained a dualistic mindset or sustained a belief in the existence of the soul would be less concerned with environmental crime. A survey was collected from a sample of 332 individuals at the University of Texas at Arlington in Arlington, Texas. The survey asked individuals to select on a likert scale how concerned they were with environmental harm. Preceding these, individuals were asked to answer either yes, no, or I don’t know on questions concerning their philosophical beliefs, looking for indicators of dualistic thinking and …

The Role Of Entertainment Media In Perceptions Of Police Use Of Force, Kathleen Donovan, Charles Klahm Iv
The Role Of Entertainment Media In Perceptions Of Police Use Of Force, Kathleen Donovan, Charles Klahm Iv
Political Science Faculty/Staff Publications
Scholars have long noted the importance of the media in shaping citizens’ attitudes about crime and justice. Most studies have focused on the impact of news and particularly local TV news, yet Americans spend far more time watching entertainment media. We examine the portrayal of police misconduct in crime dramas, and how exposure to these portrayals affects perceptions of the police. We find that viewers of crime dramas are more likely to believe the police are successful at lowering crime, use force only when necessary, and that misconduct does not typically lead to false confessions. In contrast, perceptions regarding the …
The Brutal Truth About Police Brutality, Markhel D. Hargrove
The Brutal Truth About Police Brutality, Markhel D. Hargrove
Honors Theses
Police brutality is a very timely issue as a new case has seemed to pop up every couple of weeks or so; however, police brutality is not a recent phenomenon, but for some reason, it is getting a lot of media attention today. This is perhaps due to the pattern that is occurring in these instances: black victims and white cops. In order to prevent police brutality from happening, several steps must be made to improve the way that police officers act and think in certain situations. First, it is important to teach officers how to properly handle the mentally …

The Eleanor Mann School of Nursing Undergraduate Honors Theses
Context: According to Alaska’s former governor the sexual violence issue in the state has become an epidemic. Four out of ten women in Alaska have been victims of sexual assault. The purpose of this research was to determine the existence of health care disparities in the treatment of Alaska Native women victims of sexual violence compared to white women victims and address the need for sexual assault nurse examiners (SANEs) to provide culturally competent nursing care. Objective: The specific research questions addressed in this study compared multiple variables between Alaska Native and white women victims of sexual violence: behaviors during …

Databasing Delinquency, Kevin Lapp
Databasing Delinquency, Kevin Lapp
UC Law Journal
Technological advances in recent decades have enabled an unprecedented level of surveillance by the government and permitted law enforcement to gather, store, and retrieve in real time enormous amounts of data. After nearly a century of limited record-making and enhanced confidentiality regarding juveniles, these data collection practices have quickly expanded to include youth. This Article uncovers the vast extent of modern data collection and distribution about juveniles by the criminal justice system from juvenile sex offender registration and their inclusion in gang and DNA databases, to schools turned into mandated law enforcement informants, to police and courts increasingly sharing juvenile …
The Commander In Chief's Authority To Combat Climate Change, Mark P. Nevitt
The Commander In Chief's Authority To Combat Climate Change, Mark P. Nevitt
Cardozo Law Review
Climate change is the world's greatest environmental threat. It is also increasingly understood as a threat to domestic and international peace and security. In recognition of this threat, the President has taken the initiative to prepare for climate change's impact - in some cases drawing sharp objections from Congress. While both the President and Congress have certain constitutional authorities to address the national security threat posed by climate change, the precise contours of their overlapping powers are unclear. As Commander in Chief, the President has the constitutional authority to repel sudden attacks and take care that the laws are faithfully …
Threshold Liberty, Dawinder S. Sidhu
Threshold Liberty, Dawinder S. Sidhu
Cardozo Law Review
The Supreme Court's Thirteenth Amendment precedent is no longer sustainable. For starters, that precedent - which holds that the Amendment prohibits the "badges and incidents" of slavery, and that Congress has the power to "rationally" determine what constitutes a "badge or incident" of slavery - raises serious federalism and separation of powers concerns. To make matters worse, the Court itself has recently restricted the enforcement provisions of the Fourteenth Amendment (in City of Boerne v. Flores) and Fifteenth Amendment (in Shelby County v. Holder), rendering the generous bounds of the Thirteenth Amendment enforcement power an outlier among the …

Foreword: Legal Malpractice Is No Longer The Profession's Dirty Little Secret, Susan Saab Fortney
Faculty Scholarship
In 1994, Professor Manuel R. Ramos published a law review article called, Legal Malpractice: The Profession's Dirty Little Secret. As suggested by the title, Professor Ramos argued that legal malpractice was a "taboo subject" that has been "ignored by the legal profession, law schools, mandatory continuing legal education ("CLE") programs, and even by scholarly and lay publications." Thirty years later, legal malpractice is an ever-present threat that lawyers cannot afford to ignore.
“We Stick Out Like A Sore Thumb . . .”: Underground White Rappers’ Hegemonic Masculinity And Racial Evasion, Matthew Oware
“We Stick Out Like A Sore Thumb . . .”: Underground White Rappers’ Hegemonic Masculinity And Racial Evasion, Matthew Oware
Sociology and Anthropology Faculty Publications
Employing the concept of racial evasion—a derivation of Bonilla-Silva’s colorblind ideology theory—the author analyzes 237 songs of underground white and nonwhite rappers from 2006 to 2010. Performing a content analysis on their lyrics, the author finds that white artists make fewer references to racially political and social themes (e.g., racial profiling, police brutality, racist policies) than nonwhite artists—what the author terms racial evasion. The author speculates that white rappers, understanding that they operate in a specifically racialized black and brown cultural art form, deemphasize or mask their racial identity in their lyrics. This tactic is achieved through lyrically referencing hypermasculine …
