Dangerous Diagnoses, Risky Assumptions, And The Failed Experiment Of "Sexually Violent Predator" Commitment, Deirdre M. Smith Jul 2015

Dangerous Diagnoses, Risky Assumptions, And The Failed Experiment Of "Sexually Violent Predator" Commitment, Deirdre M. Smith

Faculty Publications

In its 1997 opinion, Kansas v. Hendricks, the U.S. Supreme Court upheld a law that reflected a new model of civil commitment. The targets of this new commitment law were dubbed “Sexually Violent Predators” (SVPs), and the Court upheld indefinite detention of these individuals on the assumption that there is a psychiatrically distinct class of individuals who, unlike typical recidivists, have a mental condition that impairs their ability to refrain from violent sexual behavior. And, more specifically, the Court assumed that the justice system could reliably identify the true “predators,” those for whom this unusual and extraordinary deprivation of liberty …

New Orleans Revisited: Notes Of A Native Daughter, Lynnell L. Thomas

American Studies Faculty Publication Series

“Best Culinary Destination.” “Best City for Night Owls.” “Best NFL City to Party In.“ “Best City for Girlfriend Getaways.” “Top National Halloween Destination.” “Best Destination in the US and World for Nightlife.” “America's Favorite City.” And on. And on. The list of tourist destination rankings and accolades have mounted in the 10 years since Hurricane Katrina threatened to decimate New Orleans's tourism industry and, quite possibly—as some predicted and others hoped for—New Orleans itself. Things are different now. Recently, the New York Times proclaimed that New Orleans was “resilient and renewed, a decade after Katrina.” Listing New Orleans as one …

Genetic Influences On Peer And Family Relationships Across Adolescent Development: Introduction To The Special Issue, Lisabeth Fisher Dilalla, Paula Y. Mullineaux

Articles

Nearly all aspects of human development are influenced by genetic and environmental factors, which conjointly shape development through several gene-environment interplay mechanisms. More recently, researchers have begun to examine the influence of genetic factors on peer and family relationships across the pre-adolescent and adolescent time periods. This article introduces the special issue by providing a critical overview of behavior genetic methodology and existing research demonstrating gene-environment processes operating on the link between peer and family relationships and adolescent adjustment. The overview is followed by a summary of new research studies, which use genetically informed samples to examine how peer and …

Governing New Jersey: Reflections On The Publication Of A Revised And Expanded Edition Of 'The Governors Of New Jersey', Michael J. Birkner Jul 2015

Governing New Jersey: Reflections On The Publication Of A Revised And Expanded Edition Of 'The Governors Of New Jersey', Michael J. Birkner

History Faculty Publications

New Jersey’s chief executive enjoys more authority than any but a handful of governors in the United States. Historically speaking, however, New Jersey’s governors exercised less influence than met the eye. In the colonial period few proprietary or royal governors were able to make policy in the face of combative assemblies. The Revolutionary generation’s hostility to executive power contributed to a weak governor system that carried over into the 19th and 20th centuries, until the Constitution was thoroughly revised in 1947. Before that date a handful of governors, by dint of their ideas and personalities, affected the polity in meaningful …

Indiana Law Journal

This Note evaluates the transformation of Indiana’s expungement law. Part I addresses the socioeconomic impacts of a criminal record. Part II presents normative arguments both for and against expungement, concluding that the balance tips in favor of forgiveness. Parts III–IV discuss Indiana’s original expungement provisions, the 2013 statute, and the 2014 amendments. Part V explores the reaction to the new law. Finally, Part VI offers recommendations to improve the statute so that its second-chance promise is equitable, accessible, and robust.

The Right To Defense Discovery In Plea Bargaining Fifty Years After Brady V. Maryland, Cynthia Alkon Jul 2015

The Right To Defense Discovery In Plea Bargaining Fifty Years After Brady V. Maryland, Cynthia Alkon

Faculty Scholarship

Fifty years after Brady v. Maryland, defense attorneys around the United States continue to struggle to get basic information from prosecutors. This is even more of an issue in the ninety-four to ninety-seven percent of criminal cases that are resolved by guilty pleas. As the quote above illustrates, prosecutors can use discovery as leverage in the plea negotiation process. Unfortunately, the rule the Supreme Court established in Brady does little to prevent this kind of gamesmanship.

In Brady, the Court required the prosecution to turn over "evidence favorable to an accused . . . where the evidence is …

Engaging U.N. Special Procedures To Advance Human Rights At Home: A Guide For U.S. Advocates, Human Rights Institute

Human Rights Institute

Social justice advocates in the United States are increasingly using the human rights mechanisms of the United Nations to advance their domestic advocacy on issues ranging from criminal justice to access to health care. These mechanisms offer unique opportunities for U.S. advocates to mobilize grassroots communities, raise public awareness, exert international pressure, and engage with local, state, and national government officials around local human rights concerns. The U.N. special procedures are among the more versatile of the U.N. human rights mechanisms.

This report explores ways in which U.S. advocates are making effective use of the U.N. special procedures. Based on …

Socially Constructing Drug Addicts From The Poor: A Critical Discourse Analysis, Kalynn Susan Amundson Jul 2015

Socially Constructing Drug Addicts From The Poor: A Critical Discourse Analysis, Kalynn Susan Amundson

Graduate Theses and Dissertations

Welfare drug testing was authorized by the Personal Responsibility and Work Opportunity Reconciliation Act (PRWORA) of 1996, and has subsequently garnered extensive legislative interest in numerous states. This policy raises several questions, which are the subjects of the two journal articles and one manuscript included in this dissertation.

The first article addresses the question of a possible confluence of War on Drugs and Welfare Reform policies as evidenced through welfare drug testing policy, and indicated by continuity in policymakers’ rhetoric. This study examines federal-level policymakers’ debate discourse in these two policy streams. The analysis finds themes of the Social pathology, …

Experiences And Perceptions Of Community: The Fayetteville High School Community Photography Project, Stephanie Collier Jul 2015

Experiences And Perceptions Of Community: The Fayetteville High School Community Photography Project, Stephanie Collier

Graduate Theses and Dissertations

The Fayetteville High School Community Photography Project was conducted with 10th-12th grade students in Spring 2014 as part of a participatory art project through their Sociology class. This study uses participant photographs and surveys to better understand student variation in community perceptions and connections. Participant photographs serve as a way to “see” how high school students perceive community. Survey data gathered on the same sample are used to measure individual-level characteristics such as perceived neighborhood deterioration, neighborhood satisfaction, and Social capital to better understand how they impact feelings of community connectedness in youth. Results indicate that Social capital plays an …

Redefining Access To Public Space: Community Relations In A New Immigrant Setting, Aaron Isaac Arredondo Jul 2015

Redefining Access To Public Space: Community Relations In A New Immigrant Setting, Aaron Isaac Arredondo

Graduate Theses and Dissertations

This article examines how and to what extent charging an entrance fee at a public recreational space in a new immigrant setting affects the participation of Latino and migrant population groups at The Jones Center for Families (JCF) in Springdale, Arkansas. This study also documents how participants respond to the entrance fee system by looking at their available options to spend leisure time when living in an area with limited financial resources and recreational facilities. Using qualitative data collected in Northwest Arkansas (NWA), this study looks at how the transformation of JCF from a public to quasi-public space redefines relations …

Understanding The Experiences Of African-American Relatives Who Serve As Care Providers To Custodial Children In Arkansas: An Intersectional Case Study, Carmen Johnson-Hardin Jul 2015

Understanding The Experiences Of African-American Relatives Who Serve As Care Providers To Custodial Children In Arkansas: An Intersectional Case Study, Carmen Johnson-Hardin

Graduate Theses and Dissertations

An increase in the provision of long-term care by relative caregivers to custodial children has brought attention to the physical, emotional, and Social challenges of this complex caregiving experience. Prior studies have examined separate structural identities that focus on comparing the quality of life, educational status, Social status, and income of grandparent custodial caregivers. To extend this research, it is important to explore the gaps in service provisions to relative caregivers; comparative viewpoints of relative caregivers and service providers regarding policies and practices; and heterogeneity among Black relative caregivers utilizing an intersectional framework. Face-to-face or telephone interviews were conducted with …

A Comparison Between Telehealth And Face-To-Face Brief Alcohol Interventions For College Students, Sarah Christine King Jul 2015

A Comparison Between Telehealth And Face-To-Face Brief Alcohol Interventions For College Students, Sarah Christine King

Department of Psychology: Dissertations, Theses, and Student Research

Problematic alcohol use is a common occurrence among college students. While empirically supported interventions exist, their access is typically limited to those who attend large universities. In the health care field there has been an expansion of services provided via telehealth to increase client access to treatment. However, the evidence is mixed regarding the effectiveness of face-to-face versus telehealth interventions and there is a gap in the literature regarding the use of telehealth interventions for brief alcohol interventions in college students. As such, the purpose of this study was to test the effectiveness of a well-validated brief alcohol screening and …

The Idea Of The Casebook: Pedagogy, Prestige, And Trusty Platforms, Joseph Scott Miller, Lydia Pallas Loren

Washington Journal of Law, Technology & Arts

Independently published, electronically delivered books have been the future of the law school casebook for some time now. Are they destined to remain so? We sketch an e-casebook typology then highlight some features of law professor culture which suggest that, although e-casebook offerings will surely expand, the trust credential that the traditional publishers provide plays a durable, central role in the market for course materials that law professors create.

The Temporary Permanence Of Syrian Refugees In Jordan, Charles Edward Davidson Jul 2015

The Temporary Permanence Of Syrian Refugees In Jordan, Charles Edward Davidson

Graduate Theses and Dissertations

In the wake of the 2011 Syrian Civil War, hundreds of thousands of refugees fled to neighboring Jordan. The government of Jordan received them and along with NGOs from around the world, provided for some of their most basic needs including food, education and healthcare. In the summer of 2014 I travelled to Amman and Mafraq, Jordan in order to learn more about the work being done among the Syrians by non-governmental organizations (NGOs). What I found was a variety of short-term aid projects designed by the NGOs to meet the various needs of the refugees. I learned of no …
