Unique And Combined Contributions Of Callous-Unemotional Traits And Parental Incarceration On Juvenile Delinquency In An At-Risk Sample, Lacey Loy Herrington
Unique And Combined Contributions Of Callous-Unemotional Traits And Parental Incarceration On Juvenile Delinquency In An At-Risk Sample, Lacey Loy Herrington
Dissertations
The current study examined the interrelations among callous-unemotional (CU) traits, a history of parental incarceration, and juvenile delinquency. More specifically, although research suggests that both CU traits and parental incarceration are predictors of juvenile delinquent behaviors, their interaction in influencing such behaviors had yet to be investigated. Two-hundred thirteen (213) adolescents (201 males, 12 females) who were enlisted in a residential program designed for adolescents that dropped out of school participated in this study. Participants ranged in age from 16 to 19 (M = 16.92; SD = .77). Higher levels of overall CU traits reported by the adolescent significantly …

Adolescent Street Literacy: The Art Of The Hustle, Regina L. Welch
Adolescent Street Literacy: The Art Of The Hustle, Regina L. Welch
Theses and Dissertations - UTB/UTPA
This thesis is an ethnographic analysis of street youths, runaways and foster children. It focuses on the rhetorical and literacy practices that serve as a foundation for an underground community. Very little research, within the English field or from a literacy perspective, has been done on this demographic. This study includes data from interviews conducted with eight individuals who were “homeless” between the ages of 12 and 18 years old. Homeless is being defined as any duration spent absent of a stable living situation, including, but not limited to, foster homes, sleeping on the streets or in temporary settings, with …
An Empirical Test For Overrepresentation Of Black Youth Arrests In Mississippi, Ashley R. Mcknight
An Empirical Test For Overrepresentation Of Black Youth Arrests In Mississippi, Ashley R. Mcknight
Honors Theses
The objective of this study is to empirically test for black youth overrepresentation at the initial contact (arrest) stage of the juvenile justice system. In 2002, an amendment was made to the Juvenile Justice and Delinquency Prevention Act of 1974 which called for states to monitor disproportionate minority contact at all levels of the juvenile justice system. Arrest data from the Bureau of Justice Statistics has been gathered to determine the rate and percentage at which black youth are arrested compared to white youth. More so, youth population statistics are acquired from the U.S. Census and are converted to percentages. …
Primary Prevention And Risk Reduction Programming For College-Level Sexual Assault Prevention: Illustrating The Benefits Of A Combined Approach, Mellisa Holtzman, Chadwick L. Menning
Primary Prevention And Risk Reduction Programming For College-Level Sexual Assault Prevention: Illustrating The Benefits Of A Combined Approach, Mellisa Holtzman, Chadwick L. Menning
eJournal of Public Affairs
Primary prevention and risk reduction strategies for reducing sexual assault on college campuses have generally been treated as distinct categories of programming, with greater emphasis placed on primary prevention in recent years. The authors propose that there is both theoretical justification and measurable benefit to synthesizing or coordinating carefully constructed primary prevention and risk reduction programming. They provide as support a summary of assessment findings from an exemplary program and discuss implications and future directions for program development and testing.

First Amendment; Freedom Of The Press; Access Of News Media To County Jail; Houchins V. Kqed, Inc., Thomas W. Renwand
Akron Law Review
"Although United States history is replete with struggles over the rights and prerogatives of the press, until recently these disputes rarely made their way to the nation's highest court.' In the last several years the Supreme Court has been confronted with a number of important, complex questions dealing with the role of a free press in a free society.'"

Resistancy To The Law Enforcement Of (Asean) Regional Human Rights Mechanism, What Next?, Chloryne Trie Isana Dewi
Indonesian Journal of International Law
Regional mechanism on the protection of human rights in ASEAN formally has been developed since 2007 through the adoption of the ASEAN Charter in 2007 and the establishment of the ASEAN Intergovernmental Commission on Human Rights (AICHR) in 2009. Nevertheless, efforts on the law enforcement for human rights violations committed by ASEAN citizens and/or within ASEAN territory by establishing ASEAN human rights court is hardly to achieve due to national interest of each member states. Accordingly, for the objective of achieving justice and certainty of law, cooperation among ASEAN member states should be developed through other mechanism. This article tries …

Criminal Justice Act Of 1964; State Malpractice Suit Against Appointed Counsel; Ferri V. Ackerman, Sandra J. Branda
Criminal Justice Act Of 1964; State Malpractice Suit Against Appointed Counsel; Ferri V. Ackerman, Sandra J. Branda
Akron Law Review
The United States Supreme Court in Ferri v. Ackerman reversed the Pennsylvania Supreme Court and held that an attorney appointed by a federal judge to represent an indigent defendant in a federal criminal trial is not, as a matter of federal law, entitled to absolute immunity in a state malpractice suit brought against him by his former client. In a unanimous opinion, the Court decided that the function of appointed counsel is more closely analogous to that of private retained counsel, who enjoy no immunity from malpractice prosecution than to that of judges and prosecutors who have traditionally been accorded …
The Grand Jury: A Critical Evaluation, Ovio C. Lewis
The Grand Jury: A Critical Evaluation, Ovio C. Lewis
Akron Law Review
It seems in retrospect that our grand jury was a microcosm of grand juries generally in that many of the problems noted in the literature were manifest throughout our term. This supports the proposition that the weaknesses and defects of grand juries are not reflective of lack of zeal or devotion to duty on the part of individual members of the juries, but rather are indicative of systemic and institutional dysfunctionalities that are inherent in the grand jury system as it is presently constituted and organized. Thus, the critical comments that appear herein ought not to be taken as an …

Book Review: To Set The Record Straight By Judge John J. Sirica, Richard L. Aynes
Akron Law Review
One of the recent and more worthy accounts is that presented by Washington D.C. District Court Judge John Sirica in his To Set the Record Straight. Judge Sirica's sixteen chapters generally cover five topics: 1) a prologue outlining his early experiences and how he attained his position of federal district judge; 2) the first Watergate break-in trial; 3) Judge Sirica's attempt to "break" the silence of the cover-up following the initial proceeding; 4) the controversy over the production of the Presidential tapes; and, 5) the ultimate trials of Nixon administration officials for conspiracy to obstruct justice.
The Role Of Courts In Government Today, James L. Oakes
The Role Of Courts In Government Today, James L. Oakes
Akron Law Review
It is elementary constitutional law that American courts have the power of judicial review. While a case can be made (and is still sometimes made by critics of too much judicial intervention) against the courts' power to review federal actions against the Constitution or state actions contrary to the Federal Constitution or statutes, the principle of judicial review is so well ingrained in the American system that it need not be reargued here. Rather I shall examine the principal arguments counseling caution and restraint in the exercise of the power, even though some of these arguments seem to run against …

Extraterritorial Abductions: A Newly Developing International Standard, Martin Feinrider
Extraterritorial Abductions: A Newly Developing International Standard, Martin Feinrider
Akron Law Review
It is these extra-legal extraterritorial apprehensions, and their status under international law, that will be the subject of this study. Here, the focus will be on the question of protection against acts of outright abduction. The conclusions reached in this study, however, would be applicable to any extra-legal extraterritorial abduction in which the apprehending State could be considered to be guilty of complicity. It is the problem of the extraterritorial violation of human rights that is to be addressed.

Emerging Cultural Conflicts In Italy: A Challenge For Criminal Law, Raffaele Muzzica, Tracy Tamborra, Giuseppe Amarelli
Criminal Justice Faculty Publications
Because of recent and rapid increases in immigration rates, Italy has been confronted with new forms of cultural conflicts. Cultural conflicts have resulted in cultural offenses; these are acts committed and promoted by people belonging to a minority culture that are considered to be offenses by the majority controlled legal system. In addition to defining cultural offenses and presenting defenses that are presented when cultural offenses are tried, this paper highlights pros, cons and potential pitfalls of considering culture under Italian law. Finally, suggestions to improve legal considerations of cultural diversity in Italy are presented; specifically the creation of laws …

Do The Police Believe That Legitimacy Promotes Cooperation From The Public?, Justin Nix
Do The Police Believe That Legitimacy Promotes Cooperation From The Public?, Justin Nix
Criminology and Criminal Justice Faculty Publications
Tyler’s process-based model of regulation suggests that when citizens perceive the police as a legitimate authority, they are more likely to cooperate in the form of reporting crimes and providing information to the police. Yet most studies have considered citizens’ perceptions of police legitimacy—few studies have asked the police what they feel makes them legitimate in the eyes of the public. Likewise, no studies have considered whether the police believe legitimacy is associated with cooperation from the public. The present study addresses this gap using data from a stratified sample of U.S. police executives. Findings suggest police believe performance, rather …

Polygraph Admission Through Compulsory Process, Timothy J. Walsh
Polygraph Admission Through Compulsory Process, Timothy J. Walsh
Akron Law Review
Polygraph evidence is included within the broad category of expert testimony, yet it is treated quite differently from other forms of expert testimony. If admissible at all for the defense, polygraph evidence almost always requires the stipulation of the prosecution for it to be admitted into court. Such a requirement vests solely, within the hands of a prosecutor, the ability to eliminate that proof which may be necessary for the defendant to effectively prove his innocence. Furthermore, in some jurisdictions a defendant cannot even place his faith in the sympathy of a prosecutor. Instead, a rule bars him from proving …
The Business Papers Rule: Personal Privacy And White Collar Crime, John S. Applegate
The Business Papers Rule: Personal Privacy And White Collar Crime, John S. Applegate
Akron Law Review
The first step in this endeavor will be the development of a definition of white collar crime which adequately accounts for the difficulty in combatting it. The next step will be to examine individually the two competing goals law enforcement and privacy - to try to get a sense of the requirements of each. This will lead into a discussion of the conflict between the goals. The article will then move on to consider several unsatisfactory resolutions of the conflict, making that the basis for sketching out the necessary specifications of a good solution. Finally, the "business papers rule" will …
Maintaining The Integrity Of The Ohio Appellate System, Richard L. Aynes
Maintaining The Integrity Of The Ohio Appellate System, Richard L. Aynes
Akron Law Review
Appellate courts have traditionally played an important role in maintaining the integrity of the judicial system. They not only serve to correct errors which may occur at trial but also provide a reflective forum for the refinement of established principles of law and the development of new ones. Equally as important, they maintain the boundaries of various departments of government. If operating properly, they ensure that the humblest citizen shall be placed on an equal footing with one who occupies the highest position and that for every illegal wrong there is an adequate remedy. These functions become all the more …
