Ohio's New Rape Law: Does It Protect Complainant At The Expense Of The Rights Of The Accused?, Barbara Child
Ohio's New Rape Law: Does It Protect Complainant At The Expense Of The Rights Of The Accused?, Barbara Child
Akron Law Review
WITH THE ENACTMENT of Am. Sub. S.B. 144,1 Ohio has now joined the small group of states' that are revising their rape laws in measures significant enough to indicate that a trend may be underway. Ohio's new law is designed to protect victims of sex offenses: it contains major provisions affecting (1) the definition of rape itself; (2) new services for victims; (3) record suppression; (4) evidence rules; and (5) sentencing for certain offenders. The new law attempts to secure complainants' rights to privacy and equal protection together with defendants' rights to a fair trial and due process; however, the …

Respondent-Driven Sampling: Evaluating The Effects Of The Cure Violence Model With Neighborhood Surveys, Kwan Lamar Blount-Hill, Jeffrey A. Butts
Publications and Research
This report gives insight into how researchers at the John Jay Research and Evaluation Center used Respondent-Driven Sampling (RDS) to measures changes in violence-related attitudes and values of young men (age 18-30) in at-risk neighborhoods and compares areas with and without Cure Violence programs. The RDS method allows researchers to reach difficult-to-recruit populations and helps to increase the credibility of the study.
Shifting The Burden Of Proving Self-Defense - With Analysis Of Related Ohio Law, Randy R. Koenders
Shifting The Burden Of Proving Self-Defense - With Analysis Of Related Ohio Law, Randy R. Koenders
Akron Law Review
Senate Bill Number 42 was introduced into the Ohio General Assembly on February 1, 1977. The bill provides that while the burden of proof for all elements of the criminal offense with which an individual is charged rests upon the prosecution, the burden of proof for affirmative defenses rests upon the defendant, and he must prove his affirmative defense by a preponderance of the evidence. Because the bill raises serious questions concerning placing the burden of persuasion with respect to affirmative defenses generally, and self-defense in particular, on the defendant, a study of the law and policy involved in shifting …

Separation Of Powers; Bill Of Attainder; Presidential Papers; Chief Executive's Right To Privacy; Nixon V. Administrator Of General Services, Patricia L. Spencer
Akron Law Review
In addressing itself to the constitutionality of the "Presidential Recording and Materials Preservation Act," the United States Supreme Court in Nixon v. Administrator of General Services (Nixon II) ruled for the first time on the permissible extent of congressional authority to regulate the disposition of official records and papers of a former chief executive. By its action, the Court undertook to reverse two hundred years of practice by past presidents.

The office of lieutenant governor in Illinois has often been the subject of debate, particularly during budget preparation time. This essay examines the history of the office of lieutenant governor in other states and in Illinois. The Association Between Stalking And Violence In A Sample Of Spanish Partner Violence Cases, Rosa Viñas-Racionero, Chitra Raghavan, Miguel Ángel Soria-Verde, Remei Prat-Santaolaria
Department of Psychology: Faculty Publications
The present descriptive study analyzes stalking in a sample of 278 Spanish court cases involving partner violence and contrasts the benefits of the new bill article 172ter, which criminalizes stalking, compared with the Organic Law 1/2004 on partner violence. Thirty-seven percent (37%) of the total sample included stalking behaviors, which manifested in intimidatory (60%) and controlling (45%) unwanted verbal communications (62%) and physical approaches (42%) that ended violently in a third of the cases (35%). Cases involving violent stalking, non-violent stalking, and physical violence without stalking were compared. A closer look at violent stalking cases uncovered that intimacy-seeking stalking behavior …

Judicial Rhetoric And Lawyers' Roles, Samuel J. Levine
Judicial Rhetoric And Lawyers' Roles, Samuel J. Levine
Notre Dame Law Review
This Essay considers the rhetoric some judges have used to characterize the respective duties of prosecutors and criminal defense attorneys. The Essay suggests that, although this rhetoric often expresses admirable aspirations and ideals, it improperly blurs the lines between the roles different lawyers play within the adversarial system. Specifically, these judges have used language that would seem to place additional limitations on both the methods prosecutors employ in seeking to obtain just convictions and the tactics criminal defense attorneys employ in zealous advocacy of their clients’ interests. This Essay concludes that judges should avoid such rhetoric, which has the potential …

Federal Sentencing In The States: Some Thoughts On Federal Grants And State Imprisonment, John F. Pfaff
Federal Sentencing In The States: Some Thoughts On Federal Grants And State Imprisonment, John F. Pfaff
UC Law Journal
As the movement to reduce the outsized scale of U.S. incarceration rates gains momentum, there has been increased attention on what federal sentencing reform can accomplish. Since nearly ninety percent of prisoners are held in state, not federal, institutions, an important aspect of federal reform should be trying to alter how the states behave. Criminal justice, however, is a distinctly state and local job over which the federal government has next to no direct control. In this Article, I examine one way in which the federal government might be driving up state incarceration rates, and thus one way it can …
