A Warmer Welcome Home: The Need For Incorporating Therapeutic Jurisprudence In Reentry Courts, Kelsey Geary Jan 2015

A Warmer Welcome Home: The Need For Incorporating Therapeutic Jurisprudence In Reentry Courts, Kelsey Geary

St. Thomas Law Review

This comment will focus on one of the first established reentry courts-the Harlem Reentry Court ("HRC")-by evaluating its effectiveness with the basic principles of therapeutic jurisprudence. Section II provides general background on all the relevant topics: therapeutic jurisprudence, problem-solving courts, and reentry courts. Section III specifically focuses on the background, formation, and strategies of the HRC. Section IV gives an in-depth analysis of HRC's process, and how recognizing and further incorporating therapeutic practices could increase its success. Finally, Section V will conclude the argument by advocating for nationwide exposure and implementation of reentry courts for parolees around the country with …

The Last Mile Of The Way: Soul Music And The Civil Rights Movement, Christopher Smith Jan 2015

The Last Mile Of The Way: Soul Music And The Civil Rights Movement, Christopher Smith

AUCTUS: The Journal of Undergraduate Research and Creative Scholarship

In the summer of 1960, a group of Soul performers was scheduled to perform at a segregated dance in Little Rock, Arkansas. Jesse Belvin, Jackie Wil-son and Arthur Prysock were to play two shows that evening—one for a black audience and a second show for a white audience. These segregated shows were essentially the norm in the majority of the country. However, that night, Jackie Wilson decided he was not going to perform the second show for a white audi-ence and encouraged the others to follow suit. They were all subsequently run out of town at gun point and somewhere …

Is Black Motherhood A Marker Of Oppression Or Empowerment? Hip-Hop And R&B Lessons About "Mama", Cassandra Chaney, Arielle Brown Jan 2015

Is Black Motherhood A Marker Of Oppression Or Empowerment? Hip-Hop And R&B Lessons About "Mama", Cassandra Chaney, Arielle Brown

Journal of Hip Hop Studies

A qualitative content analysis was conducted on the lyrics of 59 songs (40 Hip Hop songs; 17 R&B songs; 2 songs that represented the Hip Hop and R&B genre) from 1961-2013 to identify the ways that Black male and Black female artists described motherhood. The songs were determined by Billboard Chart Research Services, and Black Feminist Theory provided the theoretical foundation on which the themes were identified. Qualitative analysis of the lyrics revealed Black motherhood in R&B and Hip Hop to be based on the following four typologies: (1) Motherhood as Source of Emotional Comfort and Support; (2) Motherhood as …

Immigrant Lawyers And The Changing Face Of The U.S. Legal Profession, Ethan Michelson Jan 2015

Immigrant Lawyers And The Changing Face Of The U.S. Legal Profession, Ethan Michelson

Indiana Journal of Global Legal Studies

In this Comment, I extend Lazarus-Black and Globokar's analysis further downstream to consider the stakes for the U.S. legal profession as a whole. Gatekeepers to LL.M. programs are doing far more than determining individual fates and collectively shaping the future of U.S. legal education. I will demonstrate in this Comment that their work helps shape-in concrete, measurable ways-the demographic composition of the U.S. legal profession. In so doing, I will contribute to the emerging field of legal demography, which refers to the study of lawyers through the analysis of data not collected for this specific purpose.

Notes Toward An Understanding Of The U.S. Market In Foreign Ll.M. Students: From The British Empire And The Inns Of Court To The U.S. Ll.M., Bryant G. Garth

Indiana Journal of Global Legal Studies

Mindie Lazarus-Black and Julie Globokar's article on "Foreign Attorneys in U.S. LL.M. Programs: Who's In, Who's Out, and Who They Are" uses interviews, LL.M. student observations, and actual admissions committee documents from one Midwest and one East Coast law school to confirm the tremendous growth of those programs over the past two decades in the United States and indicate who makes the journey to the United States; how foreign LL.M. candidates pitch themselves to admissions committees; how those admissions committees evaluate candidates; and what candidates expect from LL.M. programs. The voices that come through are quite compelling. We now know …

Foreign Attorneys In U.S. Ll.M. Programs: Who's In, Who's Out, And Who They Are, Mindie Lazarus-Black, Julie L. Globokar

Indiana Journal of Global Legal Studies

In recent decades, there has been a remarkable growth in the number of foreign attorneys enrolled at U.S. law schools and particularly in LL.M. programs. To learn more about these students and how they fare, we conducted research in two law schools, one in the Midwest and the second on the East Coast. We examine the admissions process for foreign attorneys from the perspectives and experiences of both the administrators who make admissions decisions and the students who seek admission. We consider the layered international, national, state, and local laws that complicate the selection process, as well as the standards …

Motivating The Solicited And Unsolicited Sharing Of Tacit Knowledge Through The Process Of Externalization, Sheila Yvonne Sorensen Jan 2015

Motivating The Solicited And Unsolicited Sharing Of Tacit Knowledge Through The Process Of Externalization, Sheila Yvonne Sorensen

CCAC Theses and Dissertations

While several U. S. firms have invested in Knowledge Management (KM) tools and software, it has become apparent that investments must be made in additional facets of KM, such as knowledge sharing (KS), thought by many researchers to be the most important component of KM. Of the two types of KS, explicit and tacit, the sharing of tacit knowledge has been shown to contribute the most to an organization’s performance. However, since tacit knowledge is difficult to both convey and acquire, this unshared tacit knowledge may ultimately harm an organization when, without the appropriate knowledge, individuals cannot effectively perform their …

An Investigation Of The Factors Contributing To The Development Of Poorly Defined Is Strategies For Firms In The United States, Karen B. Lacaden Jan 2015

An Investigation Of The Factors Contributing To The Development Of Poorly Defined Is Strategies For Firms In The United States, Karen B. Lacaden

CCAC Theses and Dissertations

Although empirical research has shown that a clearly defined information system (IS) strategy has a positive impact to a firm’s performance and a poorly defined IS strategy has a negative impact to a firms’ performance, firms still develop poorly defined IS strategies. Further compounding the problem, research has revealed that 87% of the business executives believe information systems are a critical enabler to their firms' strategic realization, yet only 33% of business executives involve the Chief Information Officer (CIO) in their firm’s business strategy development. The main goal of this research study is to empirically identify factors which impact development …

Determinants Of Intention To Use New Technology: An Investigation Of Students In Higher Education, Yolanda Dupree Jan 2015

Determinants Of Intention To Use New Technology: An Investigation Of Students In Higher Education, Yolanda Dupree

CCAC Theses and Dissertations

The federal government continues to monitor the cost of paper texts as an essential component of postsecondary education expenses. The Higher Education Act (HEA), which was initially passed in 1965, was created to buttress the educational resources of colleges and universities. Along with addressing the benefits of financial aid in postsecondary and higher education, the act referenced the projected financial burdens of paper texts. The last 2008 reauthorization suggested that colleges and universities develop plans to reduce the costs of college. Congress is currently working to reauthorize the legislation. Based on this information, the problem identified in this study explored …

The Road To Undermatch: Understanding The Differences Between White And Latino Student Predictors Of Undermatch, Awilda Rodriguez Jan 2015

The Road To Undermatch: Understanding The Differences Between White And Latino Student Predictors Of Undermatch, Awilda Rodriguez

Journal of Latino/Latin American Studies (JOLLAS)

Recent headline-grabbing statistics that Latino high school graduates enroll in college at higher rates than their White peers might lead many to conclude that disparities in college access may be a thing of the past. However, disparities in enrollment persist across institution types as Latino students are overrepresented in the two-year sector, and many who are qualified to attend four-year selective institutions undermatch to less selective institutions at higher rates than their similarly qualified White peers. While past research has shown that Latino students have disparate college choice processes than White students, this study advances the literature on college choice …

Military Service And College: An Exploratory Examination Of Military-Connected Latina/O Undergraduates And Access To Higher Education, José Luis Santos, Monica Christina Esqueda, Dani Molina Jan 2015

Military Service And College: An Exploratory Examination Of Military-Connected Latina/O Undergraduates And Access To Higher Education, José Luis Santos, Monica Christina Esqueda, Dani Molina

Journal of Latino/Latin American Studies (JOLLAS)

Approximately 4.2% of undergraduates, or 872,000 students, reported that they had served or were currently serving in the U.S. military during the 2007-08 academic year. Of these students, 13% identified as Hispanic/Latino. Despite a history of college participation, only a handful of studies have examined the postsecondary experiences of students with military service backgrounds. Further, no studies have focused specifically on the experiences of Latina/o undergraduates who have served or are currently serving in the U.S. Armed Forces. We address this gap in the research literature. We briefly summarize current research and data on military-connected undergraduates and then explore how …

The Role Of Social Trust In Low-Income Latino College Financing Decisions, Patricia Mcdonough, Shannon Calderone, Kristan Venegas

Journal of Latino/Latin American Studies (JOLLAS)

We consider the role of social trust in mediating student loan decision-making among Latino students and their parents. Using interview and focus group data from 112 Latino students and 48 parents, we examined how the historical interactions of Latino families with bureaucratic entities shaped perceptions around student loans.

Where Are All The Women? The Decline Of Female Coaches Post Title Ix, Madeline Amon

Master of Education in Applied Human Development Graduate Projects

This paper helps illustrate the decline of female coaches in the NCAA post Title IX. Before Title IX was passed female coaches coached over 90% of female athletes and currently, while female sport participation is at an all-time high, female’s coaching female athletes is not. This drop in females coaching is a serious issue that demands change. This paper calls for change within the current NCAA administrative structure. This paper looks at recent literature surrounding the issue and replicates a study conducted by Dr. Nicole LaVoi from the University of Minnesota that illustrates the issue at the Division I level. …

Factors Influencing Depression In Men: A Qualitative Investigation, Lori A. Mutiso Jan 2015

Factors Influencing Depression In Men: A Qualitative Investigation, Lori A. Mutiso

Theses and Dissertations--Nursing

The purpose of this qualitative descriptive study is to describe men’s experiences of depression in order to provide direction for future research of the screening, diagnosing, and treatment of men's depression. Previous research indicates that men experience different depressive symptoms than women, and there is a possibility that men's depression is not being adequately captured by current screening standards, which would theoretically lead to a large number of men with unrecognized, undiagnosed, and untreated depression. If this is the case, this may explain the disproportionately low number of men diagnosed with depression compared to women, in contrast to the disproportionately …

The Construction And Validation Of An M-Learning Framework For Online And Blended Learning Environments, Dick T. Hamann Jan 2015

The Construction And Validation Of An M-Learning Framework For Online And Blended Learning Environments, Dick T. Hamann

CCAC Theses and Dissertations

With the wide adoption of mobile technologies, new opportunities exist with regard to how these technologies can be used to support teaching and learning. However, there is limited empirical evidence on the use of mobile learning (m-learning) frameworks that support adult students in online and blended learning environments and consider ways to support administrators, faculty, and students in the adoption of mobile technologies for teaching and learning.

The goal was to develop and validate an m-learning framework capturing the administrative, communication, and instructional elements that must be considered when integrating m-learning technologies to support adult community college students. Using design …

In a technologically overloaded world, is it possible to use technology to support well-being activities and enhance human flourishing? Proponents of positive technology and positive computing are striving to answer yes to that question. However, the impact of technology on well-being remains unresolved. Positive technology combines technology and positive psychology. Positive psychology focuses on well-being and the science of human flourishing. Positive computing includes an emphasis on designing with well-being in mind as a way to support human potential. User experience (UX) is critical to positive technology and positive computing. UX researchers and practitioners are advocating for experience-driven design and …

An Empirical Investigation Into The Role That Boredom, Relationships, Anxiety, And Gratification (Brag) Play In A Driver’S Decision To Text, Nathan White Jan 2015

An Empirical Investigation Into The Role That Boredom, Relationships, Anxiety, And Gratification (Brag) Play In A Driver’S Decision To Text, Nathan White

CCAC Theses and Dissertations

Texting while driving is a growing problem that has serious, and sometimes fatal, consequences. Despite laws enacted to curb this behavior, the problem continues to grow. Discovering factors that can reduce such risky behavior can significantly contribute to research, as well as save lives and reduce property damage. This study developed a model to explore the motivations that cause a driver to send messages. The model evaluates the effects that boredom, social relationships, social anxiety, and social gratification (BRAG) have upon a driver’s frequency of typing text messages. In addition, the perceived severity of the consequences and the presence of …

A Case For Weakening Patent Rights, Lucas S. Osborn, Joshua M. Pearce, Amberlee Haselhuhn Jan 2015

A Case For Weakening Patent Rights, Lucas S. Osborn, Joshua M. Pearce, Amberlee Haselhuhn

Scholarly Works

This Article contributes to the patent debate by observing that new and emerging technologies are radically altering the relative costs and benefits of the patent system. Although analysts cannot measure the patent system's numerous absolute costs and benefits, this Article demonstrates that new and emerging technologies are significantly reducing the research, development, and commercialization costs ("innovation costs") that are used by adherents to the incentive and prospect theories to justify the patent system's existence. All things being equal, if significantly, the relative need for the patent system has decreased and will continue to decrease. Thus, this Article argues that patents …
