Interpreting Force Authorization, Scott Sullivan Oct 2015

Interpreting Force Authorization, Scott Sullivan

Journal Articles

This Article presents a theory of authorizations for the use of military force (AUMFs) that reconciles separation of power failures in the current interpretive model. Existing doctrine applies the same text-driven models of statutory interpretation to AUMFs that are utilized with all other legal instruments. However, the conditions at birth, objectives, and expected impacts underlying military force authorizations differ dramatically from typical legislation. AUMFs are focused but temporary corrective interventions intended to change the underlying facts that prompted their passage. This Article examines historical practice and utilizes institutionalist principles to develop a theory of AUMF decay that eschews text in …

An Investigation Of The Effectiveness Of Persuasive Mechanics In Social Network Registrations, Nathan Cook Oct 2015

An Investigation Of The Effectiveness Of Persuasive Mechanics In Social Network Registrations, Nathan Cook

Master's Projects

This study involved 40 participants from the community of varying ages and genders filling out various versions of a social network registration that utilized no persuasive mechanics, a praise persuasive mechanic, a social-pressure persuasive mechanic, and both mechanics combined in an effort to determine the effectiveness of each by measuring the amount of data supplied during registration, as well as self-reported scores on a persuasiveness scale. Attitudes towards risk as well as gender were factors also considered. The results were not statistically significant with the exception of the final, self-reported, most-persuasive design. Participants felt overall that no-mechanics was the most …

Regulatory Exit, J.B. Ruhl, James Salzman

Vanderbilt Law School Faculty Publications

Exit is a ubiquitous feature of life, whether breaking up in a marriage, dropping a college course, or pulling out of a venture capital investment. In fact, our exit options often determine whether and how we enter in the first place. While legal scholarship is replete with studies of exit strategies for businesses and individuals, the topic of exit has barely been touched in administrative law scholarship. Yet exit plays just as central a role in the regulatory state as elsewhere welfare support ends; government steps out of rate-setting. In this article, we argue that exit is a fundamental feature …

Coitus And Consequences In The Legal System: An Experimental Study, Joni Hersch, Beverly Moran Oct 2015

Coitus And Consequences In The Legal System: An Experimental Study, Joni Hersch, Beverly Moran

Vanderbilt Law School Faculty Publications

Scholars have found that men who physically harm their intimate partners receive less punishment than men who harm strangers. In other words, in the criminal setting, coitus has consequences. In particular, for female victims, the consequence is often a legal system that offers little or no protection. Until the experimental study presented here, no one has asked whether the same is true in civil actions. This original experimental survey, fielded on eight hundred participants, provides the first-ever evidence on whether legal decision makers hold sexual activity against females in civil settings. Participants received four scenarios- a homicide, a workplace sexual …

Clear-Cut And Clearly Drawn: Analyzing Portrayals Of The Gdr In Modern German Comics, Elena Souris Oct 2015

Clear-Cut And Clearly Drawn: Analyzing Portrayals Of The Gdr In Modern German Comics, Elena Souris

Undergraduate Student Research Awards

Asking Americans to play a word association game with “Germany” usually results in Nazis or the Holocaust being a first answer; the Berlin Wall is often second. Though not as prolific in international memory as World War II, the impact of Germany’s division into a Western capitalist country and an Eastern socialist state is difficult to overemphasize. The twenty-eight year separation was a defining moment in German culture. From 1961 to 1989, the wall interrupted lives, running through cities, between buildings, and across families. With such a dramatic political and personal impact, it’s no surprise that the time period has …

Being Chinese Again: Learning Mandarin In Post-Suharto Indonesia, Charlotte Setijadi Oct 2015

Being Chinese Again: Learning Mandarin In Post-Suharto Indonesia, Charlotte Setijadi

Research Collection School of Social Sciences

For thirty-two years under former President Suharto’s New Order regime (from 1966-1998), the teaching of Chinese languages in schools was banned in Indonesia. During this period of total assimilation, public displays of Chinese characters were prohibited along with other forms of Chinese cultural expressions, allegedly for the sake of national unity. From 1966-69, hundreds of Chinese medium schools and Chinese language press were closed in Chinese settlements throughout the archipelago and the formal teaching of Chinese languages in Indonesia effectively ceased. As a result, the majority of contemporary Chinese Indonesians no longer have the ability to speak, let alone write …

Men’S Perinatal Mental Health In The Transition To Fatherhood, Daniel B. Singley, Lisa M. Edwards Oct 2015

Men’S Perinatal Mental Health In The Transition To Fatherhood, Daniel B. Singley, Lisa M. Edwards

College of Education Faculty Research and Publications

While fathers have come to be more involved with their partners and infants throughout the perinatal period, recent research has shown that roughly 10% of new dads experience mental health difficulties including depression and anxiety. Unfortunately, few psychologists receive focused training regarding conceptualizing, assessing, or treating common men’s issues in the period spanning from conception through a year post-partum. Because men tend not to seek mental health services during this period, the lack of scholarly attention to this vulnerable group reflects a commonly overlooked public mental health disparity. This article provides an overview of the key factors which research and …

A Sense Of Belonging Among College Students With Disabilities: An Emergent Theoretical Model, Annemarie Vaccaro, Meada Daly-Cano, Barbara M. Newman Oct 2015

A Sense Of Belonging Among College Students With Disabilities: An Emergent Theoretical Model, Annemarie Vaccaro, Meada Daly-Cano, Barbara M. Newman

Human Development and Family Science Faculty Publications

Higher education research suggests that the development of a sense of belonging is key to academic success and persistence, yet we know little about how first-year students with disabilities develop a sense of belonging as they transition into and through their first year in postsecondary environments. Themes from a grounded theory study of 8 college students, most of whom had invisible disabilities, provided the foundation for an emerging model of belonging. Student narratives suggest there are interconnections between the development of a sense of belonging, self-advocacy, social relationships, and mastery of the student role for first-year students with disabilities.

Theravada Buddhism, Identity, And Cultural Continuity In Jinghong, Xishuangbanna, James H. Granderson

Student Publications

This ethnographic field study focuses upon the relationship between the urban Jinghong and surrounding rural Dai population of lay people, as well as a few individuals from other ethnic groups, and Theravada Buddhism. Specifically, I observed how Theravada Buddhism and Dai ethnic culture are continued through the monastic system and the lay community that supports that system. I also observed how individuals balance living modern and urban lifestyles while also incorporating Theravada Buddhism into their daily lives. Both of these involved observing the relationship between Theravada monastics in city and rural temples and common people in daily life, as well …

The Environment And Civil War: Exploring The Relationship Between The Environmental Performance Index And Incidence Of Internal Armed Conflict, Katerina N. Krohn Oct 2015

The Environment And Civil War: Exploring The Relationship Between The Environmental Performance Index And Incidence Of Internal Armed Conflict, Katerina N. Krohn

Student Publications

The state of the environment is receiving increasing attention. Environmental quality’s possible relationship to violent conflict attracts both popular and academic interest. Prior research has found support for the idea that environmental scarcity is related to higher occurrences of civil war. There have been few comprehensive quantitative studies regarding this relationship. This study tests a more general argument that higher environmental quality can lead to fewer occurrences of internal armed conflict. The study utilizes an environmental performance index found in the Quality of Government Standard Dataset to test its hypothesis. The study finds that the higher the environmental performance index …

The "Unfinished Work:" The Civil War Centennial And The Civil Rights Movement, Megan A. Sutter Oct 2015

The "Unfinished Work:" The Civil War Centennial And The Civil Rights Movement, Megan A. Sutter

Student Publications

The Civil War Centennial celebrations fell short of a great opportunity in which Americans could reflect on the legacy of the Civil War through the racial crisis erupting in their nation. Different groups exploited the Centennial for their own purposes, but only the African Americans and civil rights activists tried to emphasize the importance of emancipation and slavery to the memory of the war. Southerners asserted states’ rights in resistance to what they saw as a black rebellion in their area. Northerners reflected back on the theme of reconciliation, prevalent in the seventy-fifth anniversary of the war. Unfortunately, those who …

Two-Spirit Indigenous Americans: Fact Not Fiction, Casey S. O'Higgins Oct 2015

Two-Spirit Indigenous Americans: Fact Not Fiction, Casey S. O'Higgins

Student Publications

This paper examines the narratives of Two-Spirit Indigenous Americans who have been oppressed by heteropatriarchal norms of colonization. Two-spirit creation stories are explored to show the prevalence and importance of their identities prior to contact with Euro-American settlers and the evolution of violence, exclusion, and marginalization due to colonization. The term "Two-Spirit" is examined as a cultural identity of the Indigenous Americans. Finally, the paper looks at how Two-Spirit scholars are looking to combine Queer Theory with Indigenous Studies to deconstruct colonial heteropatriarchal America.

In this paper, I give an account of my capstone for the Religious Studies major. I tell about the research project-turned-applied-learning, and how my research as a Mellon Summer Scholar ’15 led me to start a prison ministry between Gettysburg students and the Adams County Adult Correctional Complex. I reflect on what I have done, how God has worked, and what I have learned. This is far from a typical research paper; then again, this was far from a typical research project.

Youth Participatory Democracy And Political Choices: Views From Ethekweni, Anthony L. Wagner Oct 2015

Youth Participatory Democracy And Political Choices: Views From Ethekweni, Anthony L. Wagner

Student Publications

In this research project I am seeking to gauge youth participation in and attitudes towards the South African democratic process. As in many democratic societies, there is a perception by some that the youth of South Africa are apathetic to issues related to politics and government. In this study I seek to evaluate youth perspectives of democracy based on what they have been taught in school and at home, levels of youth political participation, attitudes towards the African National Congress’s (ANC) dominance of South African politics, perceptions of political alternatives to the ANC, young people’s engagement with nongovernmental organizations in …

The New Road To Serfdom: The Curse Of Bigness And The Failure Of Antitrust, Carl Bogus Oct 2015

The New Road To Serfdom: The Curse Of Bigness And The Failure Of Antitrust, Carl Bogus

Law Faculty Scholarship

This Article argues for a paradigm shift in modern antitrust policy. Rather than being concerned exclusively with consumer welfare, antitrust law should also be concerned with consolidated corporate power. Regulators and courts should consider the social and political, as well as the economic, consequences of corporate mergers. The vision that antitrust must be a key tool for limiting consolidated corporate power has a venerable legacy, extending back to the origins of antitrust law in early seventeenth century England, running throughout American history, and influencing the enactment of U.S. antitrust laws. However, the Chicago School's view that antitrust law should be …

Trafficked? Aids, Criminal Law And The Politics Of Measurement, Aziza Ahmed Oct 2015

Trafficked? Aids, Criminal Law And The Politics Of Measurement, Aziza Ahmed

University of Miami Law Review

Since early in the HIV epidemic, epidemiologists identified individuals who transact sex as a high-risk group for contracting HIV. Where the issue of transacting sex has been framed as sex work, harm-reduction advocates and scholars call for decriminalization as a primary legal solution to address HIV. Where the issue is defined as trafficking, advocates known as abolitionists argue instead for the criminalization of the purchase of sex.

Global health governance institutions are porous to these competing ideas and ideologies. This article first historicizes the contestation between harm-reduction and abolition in global governance on health. The paper then turns to a …
