Different Levels Of Negative Emotions And Their Impact On Prosocial Behavior, Tsamchoe Dolma
Different Levels Of Negative Emotions And Their Impact On Prosocial Behavior, Tsamchoe Dolma
Dissertations and Theses @ UNI
In this fast and competitive world, people are becoming less likely to help others. According to the Bureau of Labor Statistics (2014), the volunteerism rate reached the lowest point in 2013 since 2002. This decrease in prosocial behavior makes the study of prosocial behavior important, especially with the increasing numbers of charitable organizations and their competition to attract more donors and volunteers. Public service advertisements (PSA) are used as a common medium to garner help and support, and many of them use emotional appeals to enhance persuasion. The literature on persuasion shows that emotions have persuasive power to change people's …

An American's Paris: Tourism And The American Consumer, 1947-1961, Margaret Nervig
Dissertations and Theses @ UNI
In 1947, a group of twenty-two Iowa farmers traveled to Europe for a month-long trip around the continent’s top destinations. Their primary mission, as outlined in Life Magazine, was to investigate European farming practices, particularly agricultural methods and food needs in the postwar period. The article included photos of the Iowans visiting French farms and speaking with farmers, but it also included a full-page photo of the group at a Parisian nightclub, complete with scantily clad women. Despite their agriculturally-based intentions, these Midwestern farmers could not resist a taste of Parisian culture.
This type of imagery is only one example …
Identification Of Sluggish Cognitive Tempo By Pre-Service Teachers, Rachel Elizabeth Meisinger
Identification Of Sluggish Cognitive Tempo By Pre-Service Teachers, Rachel Elizabeth Meisinger
Dissertations and Theses @ UNI
Current research suggests that Sluggish Cognitive Tempo (SCT) is a distinct attentional disorder from Attention-Deficit/Hyperactivity Disorder (ADHD) that is characterized by a hypoactive, sluggish behavior pattern (Barkley, 2014). Further, unlike ADHD, SCT represents a more passive form of inattention that does not overly disrupt classroom learning goals. Thus children with SCT may be ‘falling through the cracks’ in schools. If children with SCT are going unrecognized in the classroom, they are likely not getting referred for treatment and additional educational services. SCT is related to many internalizing, academic, and social difficulties (Becker & Langberg, 2013, 2014) and early identification and …
The Variation Of Center Of Mass Excursion Within And Between Innings And Its Relationship To Pitched Ball Velocity In Collegiate Softball Players, Leah Renee Embrey
The Variation Of Center Of Mass Excursion Within And Between Innings And Its Relationship To Pitched Ball Velocity In Collegiate Softball Players, Leah Renee Embrey
Dissertations and Theses @ UNI
The purpose of this study was to measure the changes to excursions of the COM with pitch count and innings pitched in a collegiate softball game. Additionally, the effect of excursion on pitched ball velocity was investigated.
Twenty-six collegiate pitchers were recorded using a high speed video camera. The first three fastballs and the last three fastballs in each inning were used to determine the COM position during the stride foot takeoff, the lead foot touchdown, and the release. Ball velocity was also calculated from the digitization of each video. MatLab and Excel were used to calculate the excursions between …

De Novo Identification Of Differentially Methylated Regions In The Human Genome, Timothy J. Peters, Michael J. Buckley, Aaron L. Statham, Ruth Pidsley, Katherine Samaras, Reginald V. Lord, Susan J. Clark, Peter L. Molloy
Medical Papers and Journal Articles
Background: The identification and characterisation of differentially methylated regions (DMRs) between phenotypes in the human genome is of prime interest in epigenetics. We present a novel method, DMRcate, that fits replicated methylation measurements from the Illumina HM450K BeadChip (or 450K array) spatially across the genome using a Gaussian kernel. DMRcate identifies and ranks the most differentially methylated regions across the genome based on tunable kernel smoothing of the differential methylation (DM) signal. The method is agnostic to both genomic annotation and local change in the direction of the DM signal, removes the bias incurred from irregularly spaced methylation sites, and …
Adopting Online Lecturing For Improved Learning: A Case Study From Teacher Education, Marie Quinn, Shannon Kennedy-Clark
Adopting Online Lecturing For Improved Learning: A Case Study From Teacher Education, Marie Quinn, Shannon Kennedy-Clark
Education Papers and Journal Articles
This paper presents the results of a study that examined the integration of video lectures into a pre-service teacher unit of study. The aim of the research was to ascertain how students used the pre-recorded videos to complement their learning. The focus was on the pedagogy, and explored three factors: convenience, self-regulation of learning and design to aid learning. A mixed method approach to the data collection was used. Data sources included reflective journals, surveys and semi-structured interviews. An analysis of the data indicates that the pre-service teachers viewed the use of pre-recorded lectures positively and that they were a …

Active Avoidance: The Modern Supreme Court And Legal Change, Neal Kumar Katyal, Thomas P. Schmidt

The Supreme Court in the last few years has resolved some of the most divisive and consequential cases before it by employing the same maneuver: construing statutes to avoid constitutional difficulty. Although the Court generally justifies the avoidance canon as a form of judicial restraint, these recent decisions have used the canon to camouflage acts of judicial aggression in both the statutory and constitutional spheres. In particular, the Court has adopted dubious readings of federal statutes that would have been unthinkable in the canon’s absence. We call this move the “rewriting power.” The canon has also been used to articulate …
The New Permanency, Joshua Gupta-Kagan
The New Permanency, Joshua Gupta-Kagan

Permanency is a pillar of child welfare law; children generally do better with legally permanent caretakers than in temporary foster care. Historically, when foster children cannot reunify with their parents, states have sought to terminate parental rights and find adoptive families. But recent legal reforms have created a continuum of permanency options, many of which permit ongoing legal relationships with biological parents and do not require termination of biological parents’ rights. Research has demonstrated that such options are as lasting as adoption, and can help more children leave foster care to legally permanent caretakers. This continuum promises to empower families …
Non-Exclusive Adoption And Child Welfare, Joshua Gupta-Kagan
Non-Exclusive Adoption And Child Welfare, Joshua Gupta-Kagan
Faculty Scholarship
This Article proposes that child welfare law permit the non-exclusive adoption of foster children who cannot reunify with their parents — that is, adoption by foster parents without severing children’s legal relationships with their biological parents. Present law imposes a choice: extended family members or other foster parents may adopt foster children exclusively — and terminate the legal relationship between the child and biological parents — or they may become guardians — which preserves parent–child relationships but denies foster parents the legal title of “parent,” even when they are long-term primary caretakers.
Non-exclusive adoption would respect the lived reality of …

On September 22, 2014, a U.S.-led coalition began airstrikes against the so-called Islamic State in Syria. At the same time, the United States started targeting the Khorasan group in Syria. These two operations raise (again) the question of when States may use defensive force against non-State actors in other States. The text of the United Nations Charter does not resolve the question. Article 2(4) prohibits States from using force “against the territorial integrity or political independence of any State, or in any other manner inconsistent with the Purposes of the United Nations.” Article 51 then recognizes “the inherent right to …

Say Her Name sheds light on Black women’s experiences of police violence in an effort to support a gender-inclusive approach to racial justice that centers all Black lives equally. It is our hope that this document will serve as a tool for the resurgent racial justice movement to mobilize around the stories of Black women who have lost their lives to police violence ...Our goal is not to offer a comprehensive catalog of police violence against Black women – indeed, it would be impossible to do so as there is currently no accurate data collection on police killings nationwide, no …

For girls, as with boys, the failure to receive a high school diploma often places individuals on a pathway to low-wage work, unemployment, and incarceration. The imposition of harsh disciplinary policies in public schools is a well-known risk factor for stunted educational opportunities for Black and Latino boys. Such punishments also negatively affect their female counterparts, as do other conditions in zero-tolerance schools. Yet, the existing research, data, and public policy debates often fail to address the degree to which girls face risks that are both similar to and different from those faced by boys.
This silence about at-risk girls …

When I was an upper-year student at Yale Law School in the late 1960s, I was sometimes as undermotivated as contemporary upper-year law students regularly appear to be. But there was then an appropriate role model for us: a graduate student, brimming with efficiency and self-discipline, who occupied a carrel in the law library, seemingly working day and night on a special research project. He had piled law review articles and cases a foot or more about his carrel, and anyone walking by could see that he seemed obsessed with something called Rule 10b-5. I had dimly heard of this …

How stocks are traded in the United States has been totally transformed. Gone are the dealers on NASDAQ and the specialists at the NYSE. Instead, a company’s stock can now be traded on up to sixty competing venues where a computer matches incoming orders. High-frequency traders (HFTs) post the majority of quotes and are the preponderant source of liquidity in the new market.
Many practices associated with the new stock market are highly controversial, as illustrated by the public furor following the publication of Michael Lewis’s book Flash Boys. Critics say that HFTs use their speed in discovering changes in …

During the Cold War the United States detonated sixty-seven nuclear weapons over the atolls of Bikini and Enewetak in the Marshall Islands. In the late 1970s the United States addressed the massive amount of residual contamination by abandoning Bikini as permanently uninhabitable and pushing much of the waste at Enewetak into the open lagoon. Much of the plutonium was dumped into the crater that had been left by an atomic bomb explosion, and then covered with a thin shell of cement. The resultant “Runit dome” sits unmarked and unguarded in a small island and one day will be submerged by …

Equity's Unstated Domain: The Role Of Equity In Shaping Copyright Law, Shyamkrishna Balganesh, Gideon Parchomovsky
Faculty Scholarship
As used today, the term “equity” connotes a variety of related, but nonetheless distinct, ideas. In most contexts, equity refers to the body of rules and doctrines that emerged in parallel with the common law, and which merged with the common law by the late nineteenth century. At a purely conceptual level, some trace the term back to Aristotle’s notion of epieikeia, or the process of infusing the law with sufficient flexibility to avoid injustice. Lastly, at a largely practical level, a few treat equity as synonymous with a set of remedies that courts can authorize, all of which …

As the dominant approach to legal analysis in the United States today, Legal Realism is firmly ensconced in the way scholars discuss and debate legal issues and problems. The phrase “we are all realists now” is treated as cliché precisely because it is in some ways taken to state an obvious reality about the mindset of American legal scholars. While Legal Realism came to represent a variety of different views, all of these views embodied a common theme, namely, the belief that legal doctrine is “more malleable, less determinate, and less causal of judicial outcomes” than is traditionally presumed. Judges …

Vulnerable, Not Voiceless: Outsider Narrative In Advocacy Against Discriminatory Policing, Nicole Smith Futrell

Despite significant declines in the reported use of stop and frisk and the hope for post-litigation policing reform, it is evident that there are a number of ways in which aggressive, discriminatory policing remains a concern in New York City and in other cities around the nation. This Article suggests that legal advocates must understand and promote the role of narrative in their efforts to address the criminalization of vulnerable communities. Specifically, the transformative nature of outsider narratives from the anti-¬stop and frisk context provides valuable insights for mobilization lawyering against racialized policing.

Good morning, everyone, and thank you all for coming. It is great to have this conversation, particularly with so many people who are already helpfully contributing to this project. As Bill said, I just wanted to say a little bit about the treaty prong of the project that was approved for consideration by the ALI a couple of years ago.
First of all, I should note we get a lot of questions about whether or not we are addressing executive agreements and congressional executive agreements, in addition to Article II treaties. And the current answer is that we are not. …

School of Dentistry Faculty Research and Publications
Purpose
Matrix metalloproteases (MMPs) are tissue-remodeling enzymes that function during the remodeling process, such as in immune-inflammatory diseases. Metalloprotease-2 (MMP-2) and metalloprotease-9 (MMP-9) are gelatinases that degrade several types of extracellular matrix collagen. It is hypothesized that in temporomandibular joint (TMJ) dysfunction, MMP-2 and MMP-9 expression levels may be elevated. Therefore, the objective of this study is to determine the association of MMP-2 and MMP-9 expression with temporomandibular joint dysfunction using an immunohistochemical approach to evaluate the joint disk.
Material and Methods
A total of 45 human temporomandibular joint samples were collected, with 36 samples in the test group (patients …

Temporomandibular joint (TMJ) internal derangement (ID) is one of the most common form of temporomandibular disorders. There is evidence showing the increased expression of matrix metalloproteinases (MMPs) in the cells from degenerated TMJ disc. ADAMTS are a large family of metalloproteases which are responsible for proteoglycans degradation. The present study aimed to evaluate ADAMTS-4 and ADAMTS-5 immunohistochemical expression in human TMJ discs from patients affected by ID, and to find out if there is any correlation with the degree of histopathological changes. Eighteen temporomandibular displaced disc specimens and sixteen TMJ disc control were used for the present study. Specimens were …

In 1973, the feminist newsmagazine Off Our Backs featured a segment on women in jail awaiting trial in Washington, D.C. Many of the women faced minor charges, such as soliciting prostitution, but remained in detention because they could not afford to pay even very low amounts of monetary bail. The magazine interviewed Myrna Raeder, then a fellow at Georgetown, and other attorneys involved in a class action suit against D.C. corrections, who argued that low-income women were unjustly subjected to the punitive effects of pretrial detention, in violation of their due process rights. Raeder reported to the newsmagazine, “as a …

Introduction
Mineral trioxide aggregate (MTA) sets via hydration of calcium silicates to yield calcium silicate hydrates and calcium hydroxide (Ca[OH]2). However, a drawback of MTA is its long setting time. Therefore, many additives have been suggested to reduce the setting time. The effect those additives have on setting reaction product formation has been ignored. The objective was to examine the effect additives have on MTA's setting time and setting reaction using differential scanning calorimetry (DSC).
Methods
MTA powder was prepared with distilled water (control), phosphate buffered saline, 5% calcium chloride (CaCl2), 3% sodium hypochlorite (NaOCl), or …

This chapter examines conflicting norms in the government's licensing of speech and the press on “human-subjects research” through institutional review boards (IRBs). It begins by discussing licensing and why the prohibition of it is so fundamental and prroceeds by providing an overview of the structure of institutional review board licensing. It then highlights the unconstitutionality of IRB laws, arguing that the use of IRBs violates the principles of academic freedom. It asserts that licensing of speech or the press was a method of controlling the press employed by the Inquisition and the Star Chamber, and the First Amendment unequivocally barred …

One of the enduring mysteries about property is why the law protects both ownership and possession. In a pre-modern world, with low rates of literacy and no formal method of registering titles, one can understand why the law would protect possession. In such a world, there may be no concept of property beyond the understanding that persons should respect possessory rights established by others. It is less clear why possession should be protected once property comes to be understood as ownership. Ownership and possession will commonly overlap, and protecting ownership will protect possession. Nevertheless, even in the most sophisticated legal …

To some, the very idea of the constitutional law of the administrative state is an oxymoron. On this view, core features of the national administrative state — broad delegations and the combination of legislative, executive, and judicial power within administrative agencies, particularly agencies that are headed by unelected executive officials only removable on narrow grounds — are fundamentally at odds with both constitutional separation of powers principles and due process. To others, no such conflict between contemporary administrative governance and the Constitution exists, and assertions of the administrative state’s unconstitutionality rest on basic misunderstandings of what separation of powers and …

Introduction: Toward Voice And Reflexivity, Olivier De Schutter, Katharina Pistor
Faculty Scholarship
In their introductory chapter, De Schutter and Pistor argue that in light of increasing absolute and relative scarcity of land and fresh water there is urgent need to improve the governance of these and other essential resources. Emphasizing “essentiality” shifts the debate from allocative efficiency to normative concerns of equity and dignity. Essential resources are indispensable for survival and/or for meaningful participation in a given community. Their allocation therefore cannot be left to the pricing mechanism alone. It requires new parameters for governance. The authors propose Voice and Reflexivity as the key parameters of such a regime. Voice is …
