Reconceptualizing Non-Article Iii Tribunals, Jaime Dodge

The Supreme Court’s Article III doctrine is built upon an explicit assumption that Article III must accommodate non-Article III tribunals in order to allow Congress to “innovate” by creating new procedural structures to further its substantive regulatory goals. In this Article, I challenge that fundamental assumption. I argue that each of the types of non-Article III innovation and the underlying procedural goals cited by the Court can be obtained through our Article III courts. The Article then demonstrates that these are not theoretical or hypothetical solutions, but instead are existing structures already in place within Article III. Demonstrating that the …

IntroductionOnly 30–40% of depressed patients treated with medication achieve full remission. Studies that change medication or augment it by psychotherapy achieve only limited benefits, in part because current treatments are not designed for chronic and complex patients. Previous trials have excluded high-risk patients and those with comorbid personality disorder. Radically Open Dialectical Behaviour Therapy (RO-DBT) is a novel, transdiagnostic treatment for disorders of emotional over-control. The REFRAMED trial aims to evaluate the effectiveness and cost-effectiveness of RO-DBT for patients with treatment-resistant depression.Methods and analysisREFRAMED is a multicentre randomised controlled trial, comparing 7 months of individual and group RO-DBT treatment with …

Police interactions with the mentally ill have been a growing topic as of late in the United States, both in scholarship and in the news. The environment regarding policing is changing, and police agencies are now looking for ways to properly deal with sensitive populations. The information presented will outline and compare Portland Police Bureau’s (PPB) Behavioral Health Unit (BHU) methods for working with the mentally ill, to similar methods around the country, to see what the differences were in police-based interaction with the mentally ill. Introduction: The leading cause of on duty death of firefighters is sudden cardiac events. Current research has shown the effects of fire physical training programs on firefighters, but has not researched fire specific physical training programs for the fire science major population. Purpose: The purpose of this study was to examine the effects of a six-week functional program on fitness and body composition of fire science majors. Emergency management tasks are essentially uncertain. They require information sharing and quick decision making that incorporates coordination across a vast array of individuals and organizations. During an emergency, communication is key during all four phases of the emergency management process; preparedness, response, recovery, mitigation. The purpose of this study was to examine the relationship of formal education and the effect it has on academic performance of the police recruits that attended the Department of Criminal Justice Training (DOCJT) for their basic training academy in Richmond, Ky. This study focused on the academic portion of recruit training only. This study assessed whether education level is a valid predictor of a recruit officers academic performance and will answer if higher education levels give a recruit officer an advantage academically while they are in basic training.

Technology has transformed government surveillance and opened traditionally private information to official scrutiny. The current privacy-based approach to the Fourth Amendment is unable to cope with the changes. This Article offers a solution to the problems that technological surveillance techniques present. Starting with the introduction of the approach in Katz, the Article reviews the development of privacy-based approach. It then looks at three 21st century Supreme Court cases that grappled with applying the Katz test to advanced technological surveillance techniques: Kyllo, Quon, and Jones. The quintessential city park symbolizes a core feature of a democratic polity: the freedom of all citizens to express their views in public spaces free from the constraints of government imposed orthodoxy. The city park finds an unlikely cousin in the federal tax code’s recognition of deductions for contributions made to charitable, religious, and educational organizations. Together, these three categories of tax-exempt organizations encompass a vast array of groups in civil society.

Despite the broad powers wielded by the federal government in security administration, the Supreme Court’s holding in Printz v. United States serves as a substantial check against federal overreach. Hand wringing by legal scholars over the Court’s reasoning in Printz and the rigid rules against commandeering attached to this reasoning have obscured the fact that the case now stands as a bulwark against the expansion of federal authority over state, county, and local police. In 1973, the feminist newsmagazine Off Our Backs featured a segment on women in jail awaiting trial in Washington, D.C. Many of the women faced minor charges, such as soliciting prostitution, but remained in detention because they could not afford to pay even very low amounts of monetary bail. The magazine interviewed Myrna Raeder, then a fellow at Georgetown, and other attorneys involved in a class action suit against D.C. corrections, who argued that low-income women were unjustly subjected to the punitive effects of pretrial detention, in violation of their due process rights. Business leaders venturing in the microbrewing business sector experience long delays due to federal, state, and city requirements unique to this industry. The purpose of this multiple case study was to explore strategies used by microbrewers in cases bounded by the fulfillment of the same licensing requirements to launch a microbrewery in Madison County, Alabama. The dynamic capabilities framework served as the conceptual framework for this study. Crowd-related injuries and deaths are startlingly common both in the United States and worldwide. They occur in a wide range of situations and at a vast array of venues: at music concerts, sporting events, retail holiday sales, in and around airports, subway plaorms, and parking lots, among other locations. These "crowd crush" incidents, however, are extremely underreported and rarely litigated, masking the seriousness of this issue and making it difficult for the few victims who pursue legal recourse to recover damages. In this article, Professor Cecilia M. Bailliet seeks to evaluate UNHCR Guidelines on International Protection in order to examine whether there are discrepancies in the citation of national case law. Part I pursues quantitative analysis of UNHCR's references to national case law and international criminal tribunal case law in its guidelines. Part II presents an alternative view on the importance of transnational judicial dialogues within Refugee Law, juxtaposing the treatment of conscientious objectors seeking asylum in different national jurisdictions with the UNHCR guidelines on military service. Prescription opioid pain reliever utilization has been increasing since the 1990s, due in part to changes in recommendations for the treatment of chronic pain, but also to abuse and diversion. One innovative policy solution to the abuse and diversion of prescription opioids is state prescription drug monitoring programs (PDMPs), which provide prescribers and other selected parties with patient controlled substance dispensation history; thereby, correcting an information asymmetry problem between prescribers and patients.
The widespread implementation of state PDMPs, which vary in program design and requirements, has resulted in a variety of intended and unintended consequences. Previous PDMP evaluations have suggested …

It is broken into two subparts: first, a brief description of the system’s goals and success; and, second, a brief overview of mental health courts’ general structure. As the magnitude, complexity, and urgency of many sustainability problems increase, there is a growing need for universities to contribute more effectively to problem solving. Drawing upon prior research on social-ecological systems, knowledge-action connections, and organizational innovation, we developed an integrated conceptual framework for strengthening the capacity of universities to help society understand and respond to a wide range of sustainability challenges. Stressors stemming from tactical policing such as social isolation and increased work responsibilities often spill over into the home and affect personal relationships. Using attachment theory as the guiding framework, this mixed methods study aimed to obtain a better understanding of the factors involved in maintaining long-term relationships between tactical officers and their romantic partners. Phase I consisted of surveys administered to tactical officers in Kentucky and measured romantic partner attachment, organizational and operational police stressors. The U. S. criminal justice system has used risk assessment tools in an effort to reduce recidivism and risk assessment tools are now commonplace. Correctional organizations, however, have struggled with officers' resistance to these tools in spite of the evidence for their utility. There is limited research that explores the impact of resistance to organizational change within the context of correctional agencies. Investigating The Applicability Of Macro-Level Criminology Theory To Terrorism: A County-Level Analysis, Joshua D. Freilich, Amy Adamczyk, Steven M. Chernak, Katherine A. Boyd, William S. Parkin

This exploratory study examines if causal mechanisms highlighted by criminology theories work in the same way to explain both ideologically motivated violence (i.e., terrorism) and regular (non-political) homicides. We study if macro-level hypotheses drawn from deprivation, backlash, and social disorganization frameworks are associated with the likelihood that a far-right extremist who committed an ideologically motivated homicide inside the contiguous US resides in a particular county. To aid in the assessment of whether criminology theories speak to both terrorism and regular violence we also apply these hypotheses to far-right homicide and regular homicide incident location and compare the results.
