Racial Profiling In The War On Drugs Meets The Immigration Removal Process: The Case Of Moncrieffe V. Holder, Kevin R. Johnson Jan 2015

Racial Profiling In The War On Drugs Meets The Immigration Removal Process: The Case Of Moncrieffe V. Holder, Kevin R. Johnson

University of Michigan Journal of Law Reform

In Moncrieffe v. Holder, the Supreme Court held that the Board of Immigration Appeals could not remove a long-term lawful permanent resident from the United States based on a single misdemeanor conviction for possession of a small amount of marijuana. The decision clarified the meaning of an “aggravated felony” for purposes of removal, an important question under the U.S. immigration laws. In the removal proceedings, Adrian Moncrieffe, a black immigrant from Jamaica, did not challenge his arrest and drug conviction. Consequently, the Supreme Court did not review the facts surrounding, or the lawfulness of, the criminal prosecution. Nonetheless, the traffic …

Utilizing Credit Reports For Employment Purposes: A Legal Bait And Switch Tactic, James D. Phillips, David D. Schein Jan 2015

Utilizing Credit Reports For Employment Purposes: A Legal Bait And Switch Tactic, James D. Phillips, David D. Schein

Richmond Journal of Law and the Public Interest

In our previous article, "Holding Credit Reporting Agencies Accountable: How the Financial Crisis May be Contributing to Improving Accuracy in Credit Reporting" we reviewed the legal history of the Fair Credit Reporting Act (FCRA), its amendments, and the federal case law by circuit. We suggested that the ability of consumers to ensure the accuracy and security of their credit reports might lead to an expansion of the litigation surrounding accurate credit reporting. This article takes the discussion further by exploring the ever-expanding use of credit reports in the employment law arena. We review the state legislation limiting the use of …

No Freedom In A Ship Of Fools: A Democratic Justification For The Common Core State Standards And Federal Involvement In K-12 Education, Neelam Takhar Jan 2015

No Freedom In A Ship Of Fools: A Democratic Justification For The Common Core State Standards And Federal Involvement In K-12 Education, Neelam Takhar

UC Law SF Journal on Gender and Justice

One of the most important functions of the government is the provision of a free public education. While Brown v. Board of Education removed one obvious barrier to equal education opportunities—that of racially segregated education—it left in place another: the obstacle faced by poor school districts that wish to provide an education to their students on equal terms with the education offered by wealthier school districts. The disparities in the quality of education between districts and states are becoming more and more obvious as a growing obstacle to equity. The new Common Core State Standards, which are a single set …

Finding The Middle Ground On A Slippery Slope: Balancing Autonomy And Protection In Mandatory Reporting Of Elder Abuse, Benjamin Pomerance Jan 2015

Finding The Middle Ground On A Slippery Slope: Balancing Autonomy And Protection In Mandatory Reporting Of Elder Abuse, Benjamin Pomerance

Marquette Benefits and Social Welfare Law Review

Millions of older Americans suffer from physical, mental, emotional, or financial abuse. Frequently, their abusers are family members, close friends, or other individuals who occupy positions of trust in their elderly victims’ lives. Unfortunately, due to a variety of factors, elder abuse is a tragically underreported crime. Experts estimate that for every case of elder abuse revealed to law enforcement authorities, five more cases go unreported, allowing the abuse to continue unchecked.

To combat this secrecy surrounding elder abuse, federal and state lawmakers enacted statutes requiring certain people— or, in some jurisdictions, all people—to report instances of suspected elder abuse …

Where Have We Been And Where Are We Going? A Conceptual Framework For Child Advocacy, Michele Cascardi, Cathy Brown, Svetlana Shpiegel, Ariel Alvarez Jan 2015

Where Have We Been And Where Are We Going? A Conceptual Framework For Child Advocacy, Michele Cascardi, Cathy Brown, Svetlana Shpiegel, Ariel Alvarez

Department of Social Work and Child Advocacy Faculty Scholarship and Creative Works

The primary goal of this article is to chart the development of child advocacy as an interdisciplinary field of study and conclude with a conceptual framework for research and higher education in child advocacy. Historically, child advocacy has justifiably focused on protection needs. Values and assumptions about children's best interest have also governed child advocacy, in part because evidence to inform decisions was lacking and in part because of its history as an activist movement. Against this historical backdrop, we describe contemporary trends in child advocacy that reconcile children's protection with their inherent rights to personhood. We rely on the …

Hofstra Law Review

The article discusses several aspects of the efforts to rehabilitate violent youthful offenders in the state of New York as of 2015, and it mentions proposed legislation which would reform New York's juvenile justice system by removing sixteen- and seventeen-year-old non-violent offenders from the state's adult criminal courts and placing them in rehabilitative Adolescent Diversion Parts. Public safety and New York's Family Court Act are examined, as well as the state's criminal laws.

Why The Nsa Data Seizures Are Unconstitutional, Randy E. Barnett Jan 2015

Why The Nsa Data Seizures Are Unconstitutional, Randy E. Barnett

Georgetown Law Faculty Publications and Other Works

Due to the unauthorized leaks of classified information, we have come to learn that the National Security Agency (NSA), an executive branch arm of the U.S. military, has established several data collection programs. In this article, I am not going to get into the details of these programs. Instead, I will limit my focus to what I consider to be the serious constitutional problem with any such program, regardless of the details: the fact that the NSA is demanding that private companies, with which virtually all Americans contract to provide their voice communications, turn over the records of every phone …

Welcome To The Village: An Analysis Of How St. Louis County Occupancy Permit Schemes Perpetuate Segregation And Violate The Constitution, Zachary Schmook, Lauren Verseman

Faculty Articles

In the wake of the shooting of Michael Brown in August 2014 and the events that followed in Ferguson, national attention turned to the several ways St. Louis County’s balkanized municipal governments create policies and conditions that target poor residents and perpetuate racial segregation in the region. One such set of municipal policies involves occupancy permits: many municipalities in St. Louis County require both tenants and owners of residential properties to obtain new occupancy permits upon each change in the individuals occupying the residence. Even as the State of Missouri takes action to address some of the abuses by limiting …

A Guide To Process Optimization, Shannon Leeann Kynerd Jan 2015

A Guide To Process Optimization, Shannon Leeann Kynerd

Honors Theses

Optimization is improving upon an existing process. Generally, the motivation behind optimization is economical. Companies are always looking for ways to improve their process in order to maximize their profit. There are several key steps and strategies that need to be followed in order to guarantee an optimized process and ultimately the maximum profit. An analysis of the base case is essential to optimization. If the starting point is not fully known, then the amount of progress is not known. The top-down and bottom-up strategies determine the overall procedure for optimization. Top-down begins with the big picture while bottom-up starts …

We All Go Home! The Evolution Of Firefighter Accountability Systems, Jeremy Roy Jan 2015

We All Go Home! The Evolution Of Firefighter Accountability Systems, Jeremy Roy

Honors Theses

Accountability is arguably the single most important tool that a fire department has at its disposal. Although accountability systems have been used throughout history, one thing is proven: when there is no accountability system in place, it is only a matter of time before firefighters will get injured, or worse, lose their lives. This work will discuss the history of fire department methodology dealing with the creation of incident management accountability systems. In order to provide historical evidence that lack of an accountability system can cause injury or death, case studies of multiple fire departments that have reported line of …

Personality Factors And Nuclear Power Plant Operators: Initial License Success, Cynthia Catherine Devita-Cochrane Jan 2015

Personality Factors And Nuclear Power Plant Operators: Initial License Success, Cynthia Catherine Devita-Cochrane

Walden Dissertations and Doctoral Studies

Commercial nuclear power utilities are under pressure to effectively recruit and retain licensed reactor operators in light of poor candidate training completion rates and recent candidate failures on the Nuclear Regulatory Commission (NRC) license exam. One candidate failure can cost a utility over $400,000, making the successful licensing of new operators a critical path to operational excellence. This study was designed to discover if the NEO-PI-3, a 5-factor measure of personality, could improve selection in nuclear utilities by identifying personality factors that predict license candidate success. Two large U.S. commercial nuclear power corporations provided potential participant contact information and candidate …

Billy Joel: The Chronicler Of The Suburbanization In New York, Patricia E. Salkin, Irene Crisci Jan 2015

Billy Joel: The Chronicler Of The Suburbanization In New York, Patricia E. Salkin, Irene Crisci

Touro Law Review

Artists often chronicle historical developments through their chosen medium. In the case of Billy Joel, some of his lyrics can be traced to the early sustainability movements as he wrote about the migration of people from the cities and the attendant problems with rapid suburbanization. Described by Tony Bennett as “a poet, a performer, a philosopher and today’s American songbook,” his lyrics address, among other topics, land use, community development, and environmental issues. Following World War II, there was a major shift in population settlement patterns in the United States. As war heroes returned home, not only did the country …

Effectively Implementing Civilian Oversight Boards To Ensure Police Accountability And Strengthen Police-Community Relations, Kevin King Jan 2015

Effectively Implementing Civilian Oversight Boards To Ensure Police Accountability And Strengthen Police-Community Relations, Kevin King

UC Law Journal of Race and Economic Justice

The recent killings of Michael Brown and Eric Garner have reignited the debate over curbing police misconduct. Due to United States Supreme Court jurisprudence and the quality of internal affairs investigations there continues to be a void in police oversight. Local governments are often reactive, instead of proactive, when implementing strategies for overseeing police misconduct. On several occasions civilian oversight boards have only formed in reaction to tragic death. When implemented effectively, civilian oversight boards can both help create just police practices and better the civilian complaint process. Unfortunately, some of these boards fail to develop into more than symbols …

Ferguson To Geneva: Using The Human Rights Framework To Push Forward A Vision For Racial Justice In The United States After Ferguson, Justin Hansford, Meena Jagannath Jan 2015

Ferguson To Geneva: Using The Human Rights Framework To Push Forward A Vision For Racial Justice In The United States After Ferguson, Justin Hansford, Meena Jagannath

UC Law Journal of Race and Economic Justice

As demonstrations under the banner of #BlackLivesMatter continue to erupt around the United States against state-sponsored violence, and as state, local, and federal officials continue to eschew fundamental social change, families and protesters have begun to explore alternative international forums in the search for justice. The Ferguson to Geneva delegation represents a significant event in this internationalist turn. The delegation, consisting of the parents of Mike Brown, Jr. and young Black leaders from Ferguson, chose to air their grievances before the United Nations Committee Against Torture in the fall of 2014. This article reproduces the delegation's "shadow report," which laid …

Exonerated, But Not Free: The Prolonged Struggle For A Second Chance At A Stolen Life, Newton N. Knowles Jan 2015

Exonerated, But Not Free: The Prolonged Struggle For A Second Chance At A Stolen Life, Newton N. Knowles

UC Law Journal of Race and Economic Justice

It is impossible to imagine being accused of a crime you did not commit. Worse, it is even harder to imagine a jury sentencing you to death or to life in prison when you know you are innocent. Since the rise of DNA evidence, the criminal justice system has been stunned by the newly exposed cases of wrongful conviction. Sadly, in most cases innocent exonerees are released with nothing more than an apology, if even that. Postexoneration compensation varies drastically among the several states and reentry resources are even more scarce or unavailable. Each compensation scheme on its own, however, …
