Crash Frequency Analysis Of Left-Side Merging And Diverging Areas On Urban Freeway Segments: A Case Study Of I-75 Through Downtown Dayton, Ohio, Deogratias Eustace, Aline Aylo, Worku Y. Mergia
Civil and Environmental Engineering and Engineering Mechanics Faculty Publications
This paper analyzes the effect of left- and right-side merging and diverging areas and other variables such as light condition, roadway pavement condition, drivers’ age and presence of construction work zones on the occurrence frequency of crashes. A 6.5-mile (10.5-km) section of I-75 that passes through downtown Dayton, Ohio was considered. The area of interest has a high traffic volume and consists of different geometric design challenges including closely spaced merging and diverging ramps. A four-year record of crash data (2005–2008) and a statistical modeling technique that assumes a negative binomial distribution on generalized linear models (GLMs) were used to …
Providing Context To The Clues: Recovery And Reliability Of Location Data From Android Devices, Connie Bell
Providing Context To The Clues: Recovery And Reliability Of Location Data From Android Devices, Connie Bell
Electronic Theses and Dissertations
Mobile device data continues to increase in significance in both civil and criminal investigations. Location data is often of particular interest. To date, research has established that the devices are location aware, incorporate a variety of resources to obtain location information, and cache the information in various ways. However, a review of the existing research suggests varying degrees of reliability of any such recovered location data. In an effort to clarify the issue, this project offers case studies of multiple Android mobile devices utilized in controlled conditions with known settings and applications in documented locations. The study uses data recovered …

Heat In Us Prisons And Jails: Corrections And The Challenge Of Climate Change, Daniel W.E. Holt
Sabin Center for Climate Change Law
This paper addresses two important but largely neglected questions: How will increased temperatures and heat waves caused by climate change affect prisons, jails, and their staff and inmate populations? And what can correctional departments do to prepare for greater heat and minimize the dangers it poses?

Database Infamia: Exit From The Sex Offender Registries, Wayne A. Logan
Scholarly Publications
Since originating in the early-mid 1990s, sex offender registration and community notification laws have swept the country, now affecting the lives of hundreds of thousands of individuals. The laws require that individuals provide, update and at least annually verify personal identifying information, which governments make publicly available via the Internet and other means. Typically retrospective in their reach, and sweeping in their breadth, the laws can target individuals for their lifetimes, imposing multiple hardships. This symposium contribution surveys the extent to which states now afford registrants an opportunity to secure relief from registration and community notification and examines the important …
Recall Me Maybe? The Corrosive Effect Of Recall Elections On State Legislative Politics, Zachary J. Siegel
Recall Me Maybe? The Corrosive Effect Of Recall Elections On State Legislative Politics, Zachary J. Siegel
University of Colorado Law Review
For the first time in Colorado's 137-year history, voters in two districts recalled their state senators from office in September 2013. Although the event prompted significant debate over the controversial gun legislation that sparked the grassroots efforts to trigger the recall elections, discussion generally overlooked the implications of using political recall altogether-implications that concern the very foundation of American democracy: the role of the legislator. This Comment aims to fill that gap, examining politically motivated recalls in the context of state legislatures. Using the recent Colorado examples as a case study, this Comment argues that increased use of the tactic …
Privatization And Its Discontents: The Troubling Record Of Privatized Prison Health Care, Dan Weiss
Privatization And Its Discontents: The Troubling Record Of Privatized Prison Health Care, Dan Weiss
University of Colorado Law Review
As part of a decades-long national trend towards privatization, local governments have turned to private contractors to provide health care in American prisons and jails. Ostensibly, the driving force behind this phenomenon is a desire to cut costs in an era of expanding prison health care expenditures and contracting governmental revenue streams. Local government officials build the cost-cutting incentive directly into their contracts via fixed-rate payment structures and cost-sharing provisions for off-site emergency treatment. While these contracts encourage cost-reduction, they simultaneously discourage proper oversight; their indemnification clauses render local governments largely immune from financial consequences when contractors deny emergency care …
When Apps Pollute: Regulating Transportation Network Companies To Maximize Environmental Benefits, K. Casey Strong
When Apps Pollute: Regulating Transportation Network Companies To Maximize Environmental Benefits, K. Casey Strong
University of Colorado Law Review
"Ridesharing"h as long been touted as a means to reduce the pollution and congestion caused by personal vehicles, but in practice has been relatively unpopular among Americans. That outlook may be changing, however, thanks to new "Transportation Network Companies" (TNCs) that toe the line between ridesharing and for-hire passenger transportation services, such as taxis and limousines. UberX, Lyft, Sidecar, and other similar services have rapidly spread to cities throughout the United States, attracting the attention of investors and ire of incumbent transportation providers. Legal commentary has thus far focused on proposed regulations' implications for liability, public safety, and fairness, but …
The Argument For Moving Away From Residential Placement For Most Juvenile Offenders, Marika Dawkins-Cavazos
The Argument For Moving Away From Residential Placement For Most Juvenile Offenders, Marika Dawkins-Cavazos
Criminal Justice Faculty Publications
This paper examines the theoretical and empirical argument or moving away from residential placement for juvenile offenders. To that end, the use ofres1dential placement for Juvenile offenders and incarceration for adult offenders are compared to shed light on the inconsistencies between rhetoric and actual practices as related to the deterrence theory. While residential placement and incarceration are generally regarded as two separate mechanisms, the literature suggests that residential placement is counterproductive and the U.S. must continue to reassess its approach to juvenile offending.
Supportive Housing Outcomes For Ex-Offenders: Correlations Between Criminal History And Tenancy Success, Emma F. Grochowsky
Supportive Housing Outcomes For Ex-Offenders: Correlations Between Criminal History And Tenancy Success, Emma F. Grochowsky
Master of Arts in Criminal Justice Theses
Ex-offenders face a variety of social, economic, and legal barriers to housing due to their criminal convictions. While many of these barriers exist due to the belief that convicted exoffenders are dangerous tenants, few empirical studies have actually evaluated this relationship. This study examines the relationship between criminal history and housing success for formerly homeless and low-income individuals in a supportive housing environment, both with and without criminal histories. Housing outcomes are measured through length of tenancy, lease violations during tenancy, and reasons for leaving. Implications for future research and housing policies are discussed.
Differences Between For-Profit And Nonprofit Hospitals: Perceived Quality And Access, Michael Ray Eiland
Differences Between For-Profit And Nonprofit Hospitals: Perceived Quality And Access, Michael Ray Eiland
Walden Dissertations and Doctoral Studies
Despite a large body of literature addressing the issue, questions remain about whether nonprofit hospitals provide more community benefit than do for-profit hospitals. This lack of information impacts governments, hospitals, and the healthcare industry, as stakeholders attempt to generate requirements to which hospitals should adhere to maintain nonprofit status, and thus tax exemption. This study addressed this lack of information by examining U.S. hospitals through the lens of stewardship theory to determine whether nonprofits are better stewards of the public good than for-profits, and thus likely to provide higher quality and access. The study applied logistic regression to Centers for …
An Offender's Perspective Of Correctional Education Programs In A Southeastern State, Boderick Bennett
An Offender's Perspective Of Correctional Education Programs In A Southeastern State, Boderick Bennett
Walden Dissertations and Doctoral Studies
Many offenders are incarcerated in U.S prisons with the intent of rehabilitation; however, a majority of these offenders will be released with limited options for employment. Recidivism has been linked to unemployment. The purpose of this multiple case study was to examine the lived experiences of 20 offenders involved in correctional education programs while incarcerated to explore their correctional education experience within the context of postincarceration employment. The theoretical foundation of this study was based on Bandura's self-efficacy theory. Narrative data were elicited pertaining to offenders' perceptions of past education experience, correctional education experience, and their perceived impact of the …
The Investigation Of Okhissa Dam Using A Real-Time Monitoring System, Corey Alexander Hamil
The Investigation Of Okhissa Dam Using A Real-Time Monitoring System, Corey Alexander Hamil
Electronic Theses and Dissertations
According to the National Inventory of Dams (NID), the United States has approximately 87,000 dams. Many of these dams are more than 50 years old and need to be investigated to ensure their safety to the public. A real time monitoring system can obtain a more reliable evaluation of the dam’s performance as well as serve as an early warning system to inform officials of a dam’s condition. Okhissa Dam was selected for investigation using a real-time monitoring system. Okhissa Dam is located in a region that contains both a phreatic aquifer and a confined aquifer. Prior to this investigation …
A Growing Sin-Dustry: The History And Effects Of Cigarette Excise Taxation And Regulation In The United States, Devin A. Rheaume
A Growing Sin-Dustry: The History And Effects Of Cigarette Excise Taxation And Regulation In The United States, Devin A. Rheaume
Honors Theses and Capstones
Originating with the gabelle taxes of France during the close of the Albigensian Crusades, excise taxes and regulations on consumer products have historically been used by local and federal governments to generate revenue during periods of war. Following the enactment of the Internal Revenue Act on June 30, 1864, the United States extended their definition of consumer products to include cigarettes and other tobacco products. The United States Federal government justifies cigarette taxes as a method not only to discourage the habit of smoking but also to recover the costs of the negative externalities associated with the “sinful” behavior. Through …

The Unlikely Meeting Between Dzhokhar Tsarnaev And Benjamin Quarles, Brian Gallini
Case Western Reserve Law Review
Part I explores the Marathon Bombing in more detail alongside the government’s reliance on Quarles to interrogate Tsarnaev. Part II then seeks to place the Tsarnaev interrogation in the context of modern judicial constructions of the public safety exception. Doing so firmly illustrates that the government’s position was unsupported by judicial precedent.
By focusing on the Quarles decision itself, Part III then seeks to provide a proper historic context for the government’s decision not to read Tsarnaev his Miranda warnings. In particular, Part III considers the Justices’ private papers from Quarles to demonstrate that the Court never considered anything beyond …

Legislative Responses To Wrongful Conviction: Do Partisan Principals And Advocacy Efforts Influence State-Level Criminal Justice Policy?, Stephanie L. Kent, Jason T. Carmichael
Legislative Responses To Wrongful Conviction: Do Partisan Principals And Advocacy Efforts Influence State-Level Criminal Justice Policy?, Stephanie L. Kent, Jason T. Carmichael
Criminology, Anthropology, & Sociology Faculty Publications
The number of discovered wrongful criminal convictions (and resulting exonerations) has increased over the past decade. These cases erode public confidence in the criminal justice system and trust in the rule of law. Many states have adopted laws that aim to reduce system errors but no study has examined why some states appear more willing to provide due process protections against wrongful convictions than others. Findings from regression estimates suggest that states with a Republican controlled legislature or more Republican voters are less likely to pass these laws while the presence of advocacy organizations that are part of the 'innocence …
Terrorism Trials In Article Iii Courts, Laura K. Donohue
Terrorism Trials In Article Iii Courts, Laura K. Donohue
Georgetown Law Faculty Publications and Other Works
Some individuals reject Article III courts as a forum for bringing terrorist suspects to justice on the grounds that the ordinary judicial system cannot handle such cases. As an empirical matter, this claim is simply false. Since 2001, myriad terrorism trials have progressed through the criminal system. The U.S. Department of Justice (DOJ) reports that between 2001 and 2010, there were 998 defendants indicted in terrorism prosecutions. Eighty-seven percent of the defendants were convicted on at least one charge. According to the Executive Office for the U.S. Attorneys, from FY 2004 to FY 2009, there were 3,010 terrorism prosecutions. It …
