Smile For The Camera: The Revenge Pornography Dilemma, California's Approach, And Its Constitutionality, Snehal Desai Jan 2015

Smile For The Camera: The Revenge Pornography Dilemma, California's Approach, And Its Constitutionality, Snehal Desai

UC Law Constitutional Quarterly

Revenge pornography is an increasingly prevalent form of cyberharassment, in which embarrassing and sexually explicit pictures and videos are posted on the internet without the consent of the depicted individual. Due to the First Amendment's protection of speech and expression, victims have had little legal recourse against their cyber-harassers. Many states have started to pass laws prohibiting revenge pornography, which have fortunately created some protections for victims. However, the recent passage of such statutes has also led to the debate about their constitutionality.

This Note first examines revenge pornography from various First Amendment perspectives, concluding that courts should carve out …

Airbnb And The Housing Segment Of The Modern Sharing Economy: Are Short-Term Rental Restrictions An Unconstitutional Taking, Jamila Jefferson-Jones Jan 2015

Airbnb And The Housing Segment Of The Modern Sharing Economy: Are Short-Term Rental Restrictions An Unconstitutional Taking, Jamila Jefferson-Jones

UC Law Constitutional Quarterly

The last few years have seen a reinvention of the economy through the growth of the "sharing economy" or the "new economy." The sharing economy has redefined consumption in the housing context in a manner that implicates the exclusivity of the use and enjoyment of real property. However, there is a brewing conflict between this genesis and the realities of economic regulation. Recently, controversy erupted in New York after New York Attorney General Eric Schneiderman subpoenaed Airbnb's records requesting data on its hosts for the previous three years. Schneiderman contended that Airbnb hosts in New York City were violating a …

Blinded By The Light: Addressing The Growing Light Pollution Problem, Andrea L. Johnson

Texas A&M Journal of Property Law

This Article will analyze light pollution that trespasses from one property onto another’s property, and the lack of an amicable way to resolve this issue through existing laws. The growth of oil production in West Texas has led to issues with individual landowners and research organizations regarding light emitted from oil rigging lights. Specifically, the McDonald Observatory is one research facility that has been negatively impacted by the increased nightglow from artificial lighting.

Drone Nation: Policy Considerations For Allowing Commercial Small Unmanned Aircraft Systems Into The National Airspace System, Christopher Chase Poorman Jan 2015

Drone Nation: Policy Considerations For Allowing Commercial Small Unmanned Aircraft Systems Into The National Airspace System, Christopher Chase Poorman

Texas A&M Journal of Property Law

This Comment aims to show that current regulation, or more precisely non-regulation of commercial UAS should be modified, and operators should be allowed to conduct commercial operations without subjecting UAS to the high standards of other “aircraft.” Per Congress’s mandate, the FAA should immediately create and enforce practically sound standards for small-scale, commercial UAS that operate inside the NAS while avoiding unnecessary and costly administrative burdens. Congress should modify the currently voluntary standards, instead of mandating that operators adhere to specific commercial use guidelines without requiring an arduous approval process for commercial flight, such as the current Special Airworthiness Certificate …

The Statement And Account Clause As A National Security Freedom Of Information Act, Lawrence Rosenthal Jan 2015

The Statement And Account Clause As A National Security Freedom Of Information Act, Lawrence Rosenthal

Loyola University Chicago Law Journal

The amount of the aggregate annual appropriations for the civilian and military intelligence programs is the only aspect of intelligence spending that is publicly disclosed. As a consequence, a great deal of information about how public funds are spent remains secret, potentially insulating from ordinary processes of political accountability not only waste, inefficiency, and abuse, but also what the public may regard as unwarranted intrusions on its privacy. This Article offers a constitutional vehicle for greater transparency—the Constitution’s Statement and Account Clause, which provides that “a regular Statement and Account of the Receipts and Expenditures of all public Money shall …

The Lanham Act's Wonderful Complement To The Fdca: Pom Wonderful V.Coca-Cola Enhances Protection Against Misleading Labeling Through Integrated Regulation, Jennifer Thurswell Radis

Loyola University Chicago Law Journal

POM Wonderful sued Coca-Cola under the Lanham Act claiming that it suffered losses due to the misleading label on Coca-Cola’s Minute Maid brand’s Pomegranate Blueberry juice blend. Reversing the Ninth Circuit’s decision in June 2014, the Supreme Court found that POM’s claim was not precluded even though the label was regulated by the FDCA. In fact, the Court acknowledged the complementary nature of private enforcement with FDA regulation, as it did in Wyeth v. Levine in 2009. This Article submits that POM exemplifies the Court’s willingness to strengthen the Lanham Act’s protections against misleading labeling, as it did the same …

Commercialization Of A Small, Lightweight, Low-Cost Seismic Borehole Receiver, Rachel Adams Jan 2015

Commercialization Of A Small, Lightweight, Low-Cost Seismic Borehole Receiver, Rachel Adams

Theses and Dissertations--Civil Engineering

Herein, conceptualization of a recently patented seismic borehole receiver and its components is developed for commercialization. The device is significantly cheaper, lighter, and smaller than existing technologies on the market. Additionally, it has the potential to achieve better seismic readings than its competitors via patented sensor-to-borehole coupling mechanism. It is the hope that the commercialization of this device will not only provide a more affordable alternative to engineers and geophysicists in the existing market, but the significant cost difference may open new seismic measurement opportunities in the developing world. Its compact size and light weight will increase mobility, allowing investigators …

Freedom Of Association And Ngo Law: The Constitutionality Of The 2009 Zambian Ngo Law, Muna Ndulo Jan 2015

Freedom Of Association And Ngo Law: The Constitutionality Of The 2009 Zambian Ngo Law, Muna Ndulo

Southern African Journal of Policy and Development

Freedom of Association is entrenched in the Zambian Constitution and in several International Law instruments to which Zambia is a party. By hindering the independent and effective operations of NGOs, the Non-Governmental Organizations (NGO) Act of 2009 unjustifiably curtails this freedom. This paper examines the NGO Act and documents the various instances in which it imposes an unconstitutional, unjustifiable and disproportionate hindrance on the ability of NGOs to operate effectively. It argues that the Act threatens to roll back the enormous gains that NGOs have made and continue to make in fermenting accountable, democratic and effective governance in Zambia.

Developing Microtargeting In University Marketing Campaigns: Fraser University, Kerri A. Musick Jan 2015

Developing Microtargeting In University Marketing Campaigns: Fraser University, Kerri A. Musick

Senior Honors Theses and Projects

Microtargeting efforts practiced by political parties determine what kind of information sent by what type of messengers should be sent to constituents to increase their likelihood of voting or donating. A similar perspective is used in regard to higher education institutions' marketing tactics. The college experience is malleable and different for each person. Universities are interested in recruiting students. Therefore, the way they recruit students should also be shape-shifters to better match the desired characteristics a prospective student wants out of a school. Microtargeting in university marketing campaigns can allow institutions to distribute recruitment materials at a higher level of …
