This Article challenges the constitutionality of indiscriminately restraining civil immigration detainees during removal proceedings. Not only are immigration detainees routinely placed in handcuffs, leg irons, and belly chains without any individualized determination of the need for restraints, but Immigration and Customs Enforcement (ICE), the prosecuting party, makes the decisions about the use of restraints, rather than the judge. After examining the rationale for the well-established prohibition against the indiscriminate use of restraints during criminal and civil jury trials, and discussing how some courts have extended this rationale to bench trials, this Article contends that ICE’s practice violates substantive and procedural …

College activity courses present an opportunity for physical educators to increase physical activity among young adults. Facilitating motivation in activity courses may lead to increased engagement and future participation in physical activities. The purpose of this study was to examine motivation in college activity courses utilizing a multi-theoretical approach in order to assess changes in physical self-concept and intention for participation in physical activities. It was hypothesized that a task-involved motivational climate would predict need satisfaction, which would in turn predict self-determined motivation. Self-regulation and self-efficacy are both necessary for students to be independent learners. During middle school, students begin to yearn for academic autonomy, but lack the ability to regulate themselves and are unreasonable about their abilities. Goals have been proven to promote the development of these two skills. The purpose of this investigation was to determine which type of performance goal most efficiently promotes the development of self-regulation. The purpose of this study is to investigate the predictors of psychological distress in children following the Gulf Coast hurricanes of 2005. Previous literature has suggested that children that experience natural disasters, such as hurricanes, may face the same psychological dangers as children that experience other types of traumatic experiences. Space is a vantage point from which masculinity can be critiqued and understood. Documentary film-makers employ specific mode(s) to relate space to masculinity by positioning themselves vis-à-vis the interviewees, and the interviewees vis-à- vis the viewers. A financial crisis may threaten the hegemonic masculinity embodied by Wall Street’s lonesome cowboys and provide a chance for film-makers to critique this type of masculinity. This article analyses three documentary films, I.O.U.S.A., Capitalism: A Love Story, and Floored, which were released after the 2008 economic crisis in the United States. The films contain three prototypes: the lonesome cowboy; white, working-class masculinity; and hypermasculinity. …

Martha Fineman proposes a post-identity "vulnerability" approach that focuses on burdens we all share; this article argues that theory needs to incorporate recognition of how invisible privileges exacerbate some people's burdens. Vulnerability theory is based on a recognition that we are all born defenseless, become feeble, must fear natural disasters, and might be failed by social institutions. It thus argues for a strong state that takes affirmative steps to insure substantive equality of opportunity. While vulnerability theory might help explain and remedy situations like Hurricane Katrina, it also might be susceptible to an argument that racial profiling is a necessary …

The research presented in this dissertation assesses the social impacts of the 2010 BP Deepwater Horizon (BP-DH) oil spill in South Louisiana. The coastal region affected by this disaster is made up of rural communities whose residents rely on the Gulf of Mexico and its resources for their livelihoods. Understanding how this disaster has impacted the general quality of life in spill-affected communities, and how community characteristics have influenced vulnerability and resilience to negative outcomes, has important implications for basic and applied research and public policy. The current study investigated the relationship between supervision, job satisfaction, and burnout among live-in and live-on Housing and Residence Life professionals. The literature review consists of empirical research for each construct presented (supervision, job satisfaction, and burnout). The study sample consisted of live-in and live-on Housing and Residence Life professionals employed at colleges and universities across the United States and abroad. Multiple regression and Multivariate analyses were used to answer specific research questions. Results confirmed that there was a statistically significant relationship between supervision, job satisfaction, and burnout. We examine how food-related experiential activities offer different types of intrinsic pleasures, create an alternative path to consumerism, and subsequently affect happiness and well-being. Participant’s perspectives on these activities are compared to those of their favourite material possessions to explore the differences in meaning and motivations. Phenomenological interviews centred on food activities and material possessions revealed that experiential food-related hobbies are valued highly and a source of great life satisfaction because of meeting a variety of psychological needs. In this dissertation, I offer three independent studies that each contribute to the literature on mortgage debt payment. In the first paper, I examine the recent phenomenon of mortgage curtailment (borrowers making voluntary partial prepayments) and link this behavior to consumer deleveraging trends. In the second paper, I use the curtailment measures developed in the first essay to examine heterogeneity in sensitivity to current mortgage leverage in default decisions. Cognitive decline and dementia due to Alzheimer's disease (AD) have been associated with genetic, lifestyle, and environmental factors. A number of potentially modifiable risk factors should be taken into account when preventive or ameliorative interventions targeting dementia and its preclinical stages are investigated. Bone mineral density (BMD) and body composition are two such potentially modifiable risk factors, and their association with cognitive decline was investigated in this study. 164 participants, aged 34–87 years old (62.78 ± 9.27), were recruited for this longitudinal study and underwent cognitive and clinical examinations at baseline and after 3 years. Individual biological differences may contribute to the variability of outcomes, including cognitive effects, observed following electroconvulsive treatment (ECT). A narrative review of the research literature on carriage of the apolipoprotein E ε4 allele (APOE-ε4) and the protein biomarker beta amyloid (Aβ) with ECT cognitive outcome was undertaken. ECT induces repeated brain seizures and there is debate as to whether this causes brain injury and long-term cognitive disruption. The majority of ECT is administered to the elderly (over age 65 years) with drug-resistant depression. Depression in the elderly may be a symptom of the prodromal stage of Alzheimer’s disease …

Background: Various researchers have theorized that bereaved adults who report non-secure attachment are at higher risk of pathological grief. Yet past findings on avoidant attachment representations and grief have yielded limited and contradictory outcomes. Little research has been conducted with older adults to identify the psychological processes that mediate between self-reported attachment representations and the patterns of grief.

The stability of post-traumatic growth overtime and the relationship between post-traumatic growth and traditional distress outcomes remains unclear. We tracked post-traumatic growth in a population-based sample of colorectal cancer patients from soon after diagnosis to five years subsequently to assess the heterogeneity of a post-traumatic growth response to cancer over time and describe the simultaneous and longitudinal relationships between post-traumatic growth and psychological distress. 1966 colorectal patients who were five months post diagnosis were assessed six times over a five year period. Background: Nursing is an emotionally demanding profession and deficiencies in nurses' mental wellbeing, characterised by low vitality and common mental disorders, have been linked to low productivity, absenteeism and presenteeism. Part of a larger study of nurses' health, the aim of this paper was to describe the mental health status and related characteristics of nurses working in two acute metropolitan teaching hospitals. Methods: A cross sectional survey design was used. Results: A total of 1215 surveys were distributed with a usable response rate of 382 (31.4%). Approximately 256,000 cases of malignant brain and nervous system cancer were diagnosed worldwide during 2012 and 189,000 deaths, with this burden falling more heavily in the developed world. Problematically, research describing the psychosocial needs of people with brain tumors and their carers and the development and evaluation of intervention models has lagged behind that of more common cancers. This may relate, at least in part, to poor survival outcomes and high morbidity associated with this illness, and stigma about this disease. Objective: Health-related stigma is associated with negative psychological and quality of life outcomes in lung cancer patients. This study describes the impact of stigma on lung cancer patients' psychological distress and quality of life and explores the role of social constraints and illness appraisal as mediators of effect. Methods: A self-administered cross-sectional survey examined psychological distress and quality of life in 151 people (59% response rate) diagnosed with lung cancer from Queensland and New South Wales. This study proposes a new qualitative typology that can be used to classify learners treading water into different skill-based categories. To establish the typology, 38 participants were videotaped while treading water and their movement patterns were qualitatively analyzed by two experienced biomechanists. 13 sport science students were then asked to classify eight of the original participants after watching a brief tutorial video about how to use the typology. Talent identification tests used at the Australian Football League’s National Draft Combine assess the capacities of ath-letes to compete at a professional level. Tests created for the National Draft Combine are also commonly used for talent identification and athlete development in development path-ways. Physical activity in children and adolescents is on a decline trend. To this end, we conducted a matched-pair randomized controlled trial to examine the effects of a 4-week STAR (School-based; Train-the-trainer; Accessibility of resources; Recreational) skipping programme. 1,386 schoolchildren from 20 primary and secondary schools were recruited. Schools were randomized into the experimental or wait-list control group. Participants self-reported their health-related quality of life using the KIDSCREEN-27. Accelerometers were used to measure the time a subgroup of participants (n = 480) spent in moderate-to-vigorous physical activity during school hours on five consecutive days. High levels of β-amyloid (Aβ) in the brain and carriage of the APOE ε4 allele have each been linked to cognitive impairment in cognitively normal (CN) older adults. The aim of this study was to investigate the relationship between cerebral Aβ level, APOE ε4 carrier status, and cognitive decline over 18 monthes, in 317 cognitively healthy (CN) older adults (47% males, 52.4% females) aged between 60 and 89 years (Mean = 69.9, SC = 6.8).
