Critical Perspectives On Police, Policing, And Mass Incarceration, Richard Delgado, Jean Stefancic Jan 2015

Critical Perspectives On Police, Policing, And Mass Incarceration, Richard Delgado, Jean Stefancic

Articles

Shows that aggressive policing is only one of a number of measures that society uses to control minority groups with whom it is displeased for some reason and that failing to see how the authorities deploy the different measures separately serially or in coordinated fashion is a serious mistake Sketches a new form of policing that is respectful of minority residents and values and provides a framework for reducing excessive incarceration and mitigating some of the cruelties associated with it

Fundamental Rights Of States In International Law And The Right To Peaceful Nuclear Energy Ii. Case Studies, Daniel H. Joyner Jan 2015

Fundamental Rights Of States In International Law And The Right To Peaceful Nuclear Energy Ii. Case Studies, Daniel H. Joyner

Articles

This article first discusses the overall theme of this special issue of the Cambridge Journal of International and Comparative Law from a legal theoretical perspective, namely, the concept of the fundamental rights of states in international law. It concludes that fundamental rights of states exist in international law as autonomous juridical principles. The article then proceeds to discuss one such asserted fundamental right of states: the right to peaceful nuclear energy, as codified in the 1968 Nuclear Non-proliferation Treaty. It argues that the right to peaceful nuclear energy is indeed a fundamental right of states, and that it has juridical …

The Effects Of Abiotic Climate Change Factors On Aphid Life History And Populations, Joseph Vincent Alfonso Jan 2015

The Effects Of Abiotic Climate Change Factors On Aphid Life History And Populations, Joseph Vincent Alfonso

Entomology

While the effects of many abiotic factors associated with climate change have not been extensively studied, work on model organisms is beginning to help predict effects on similar species. Research on climate change has been dominated by temperature effects on organisms, but additional factors are being studied, including changes in atmospheric CO2 concentrations, wind patterns, precipitation patterns, ultra-violet (UV) radiation, night-time temperatures, and daily high temperatures (heat shocks). We review these effects on aphids and present experimental findings on the effects of night-time warming on pea aphid population growth and birth rates. Aphid populations changed when warmed at different times …

Energetic Space: The Affect Of Literature In A Composition Classroom, Heather Marie Steinmann Jan 2015

Energetic Space: The Affect Of Literature In A Composition Classroom, Heather Marie Steinmann

English

Rhetorical and critical theory have both prescribed and proscribed the way scholars view affect. With the exception of Reader Response Theory, literary and rhetorical theory tend to use a more long-term and permanent frame of reference when addressing the emotional relationship between reader and writer. This disquisition explores a framework where the reader and writer find emotional connection in particular and emergent times and spaces. This work extends the import of Kairos, as a rhetorical figure and theory, to contemporary research and theories like Maria Takolander’s “Energetic Space” and Louise Rosenblatt’s “Aesthetic Reading,” theories that link writer to reader. Rather …

Societies Of Control In Young Adult Literature: The Panoptic World Of Veronica Roth’S Trilogy Divergent, Nesreen Abdallah Eldoliefy Jan 2015

Societies Of Control In Young Adult Literature: The Panoptic World Of Veronica Roth’S Trilogy Divergent, Nesreen Abdallah Eldoliefy

English

The didactic impact of Young Adult Literature is a haunting question in the field. Therefore, this paper anchors its analysis of Veronica Roth’s Divergent, Insurgent and Allegiant on Foucault’s concept of panopticism to demonstrate the containing nature of the trilogy. The trilogy engages with identity and potential questions that concern young readers. Seemingly, it proposes radical solutions, while in reality it retains layers of surveillance and control that obliterate any attempts for change. Reading the trilogy from Foucauldian lens demonstrates how no one can escape from the prison-with-prison world it offers. The paper illustrates how the trilogy foregrounds the destructive …

Reorienting Restorative Justice: Initiating A New Dialogue Of Rights Consciousness, Community Empowerment And Politicization, Thalia Gonzalez Jan 2015

Reorienting Restorative Justice: Initiating A New Dialogue Of Rights Consciousness, Community Empowerment And Politicization, Thalia Gonzalez

Faculty Scholarship

For the last three decades scholars have explored the practice of restorative justice as a crime control mechanism in a multitude of settings. Much of the discourse has focused on restorative justice as an alternative to traditional punitive and retributive criminal justice processes. Whether restorative or punitive, criminal justice processes that seek to address harm are not apart, above, or outside social, cultural and political relations. This Article seeks to initiate a new dialogue of justice and argues that the ontology of restorative justice should to be viewed to include a liberatory moment of politicization focused on promoting equality and …

Monitoring Youth: The Collision Of Rights And Rehabilitation, Kate Weisburd Jan 2015

Monitoring Youth: The Collision Of Rights And Rehabilitation, Kate Weisburd

Faculty Scholarship

A monumental shift in juvenile justice is underway, inspired by the wide recognition that incarceration is not the solution to youth crime. In its place, “electronic monitoring” has gained widespread support as a new form of judicial control over youth offenders. Supporters herald it as “jail-togo”: a cost-efficient alternative to incarceration that allows youth to be home while furthering rehabilitative and deterrent goals. But despite electronic monitoring’s intuitive appeal, virtually no empirical evidence suggests its effectiveness. Instead, given the realities of adolescent development, electronic monitoring may lead to more harm than good. This Article is the first to examine the …
