Patching Old Wineskins: Heightened Deference Towards Saiban-In Findings Of Fact On Koso Appeals Is Not Enough, Caleb Jon F. Vandenbos Apr 2015

Patching Old Wineskins: Heightened Deference Towards Saiban-In Findings Of Fact On Koso Appeals Is Not Enough, Caleb Jon F. Vandenbos

Washington International Law Journal

The successful introduction of the saiban-in seido—the Japanese lay assessor system—was a tremendous step towards creating meaningful exchange between the public and the judiciary and democratizing the criminal justice system in Japan. To preserve the quality of this exchange, judges must conscientiously solicit and respect lay assessor input during deliberations, and saiban-in decisions must retain their force on appeal. Under current appellate procedure, however, saiban-in findings of fact may be replaced on koso appeal. Koso appeals threaten to eviscerate lay participants’ contributions in the individual case being reviewed and, in the long term, will discourage judges from taking lay …

Better Call Saul: Is You Want Discoverable Communications: The Misrepresentation Of The Attorney-Client Privilege On Breaking Bad, Armen Adzhemyan, Susan M. Marcella Apr 2015

Better Call Saul: Is You Want Discoverable Communications: The Misrepresentation Of The Attorney-Client Privilege On Breaking Bad, Armen Adzhemyan, Susan M. Marcella

New Mexico Law Review

Initially, this article reviews the law regarding the attorney-client privilege in federal courts and in New Mexico, including a discussion of waiver. Next, this article explores Breaking Bad ’s depiction of the privilege, focusing on the perpetuation of two common myths: the myth of the dollar bill as a prerequisite to the formation of a privileged relationship and the myth that all communications with a lawyer are protected. This article concludes with a discussion of the risks of waiver portrayed on Breaking Bad. In particular, this article examines some of the issues raised by Saul’s joint representation of Walt and …

Foreword: Diversity In The Legal Profession: A Comparative Perspective, Deborah L. Rhode Apr 2015

Foreword: Diversity In The Legal Profession: A Comparative Perspective, Deborah L. Rhode

Fordham Law Review

In principle, the legal profession in the United States and United Kingdom is deeply committed to diversity and inclusion. In practice, it lags behind. This colloquium explores what stands in the way. Leading scholars from both countries look at the gap between aspirations and achievement, and suggest some concrete strategies for change.

Shaping Diversity And Inclusion Policy With Research, Julie Ashdown Apr 2015

Shaping Diversity And Inclusion Policy With Research, Julie Ashdown

Fordham Law Review

The legal profession in England and Wales is perceived as pale, male, and stale (that is, white, male, and older), but is that actually the case? And, if it is, what could or should a representative body like the Law Society do about it? This Article considers the situation from the perspective of solicitors. It reviews the research that the Law Society has commissioned over the last twenty years and how the findings have impacted policymaking. This Article looks at the main initiatives resulting from the research and considers whether they have made a difference and what the continuing challenges …

Busy Doing Nothing: An Exploration Of The Disconnect Between Gender Equity Issues Faced By Large Law Firms In The United Kingdom And The Diversity Management Initiatives Devised To Address Them, Savita Kumra Apr 2015

Busy Doing Nothing: An Exploration Of The Disconnect Between Gender Equity Issues Faced By Large Law Firms In The United Kingdom And The Diversity Management Initiatives Devised To Address Them, Savita Kumra

Fordham Law Review

The Article has three parts: the first reviews the data showing women’s increased participation in the legal sector and assesses why increased participation has not led to inclusion at senior levels. The main barriers are macro and micro processes of social reproduction, poor access to mentors and influential business networks, and gender bias in society at large.

In the second part, the response by large law firms is assessed. This has largely consisted of “business case” approaches to diversity management. The key characteristics of these approaches are presented, as is an overview of key practices adopted by large law firms. …

Going Public: Diversity Disclosures By Large U.K. Law Firms, Steven Vaughan Apr 2015

Going Public: Diversity Disclosures By Large U.K. Law Firms, Steven Vaughan

Fordham Law Review

The Legal Services Board (LSB) has been the parent regulator of legal services in England and Wales since 2009. Born of the wide-ranging reforms introduced by the Legal Services Act 2007 (LSA), the LSB is tasked with promoting the regulatory objectives contained within the LSA, including “encouraging an independent, strong, diverse and effective legal profession.” In July 2011, the LSB introduced a rule requiring the collection of data on workforce diversity and the publication of that data by the legal profession. This was the first—and indeed, is the only—direct regulatory intervention taken with regard to diversity in the legal profession. …

Bicultural Experience In The Legal Profession: A Developmental Network Approach, Jonathan Ashong-Lamptey Apr 2015

Bicultural Experience In The Legal Profession: A Developmental Network Approach, Jonathan Ashong-Lamptey

Fordham Law Review

A developmental network refers to the egocentric network of individuals who take an active interest in and concerted actions toward advancing a protégé’s career. In Part I of this Article, I draw upon the literature to outline the lived experiences of black lawyers, highlighting the need for them to manage their working identity. In Part II, I further develop bicultural experience as a construct for exploring racial minority experience in a professional context with recent developments from the acculturation literature. In Part III, I introduce the developmental network as a vehicle for understanding developmental relationships. Part IV summarizes the methodology …

Incentivizing Lawyers To Play Nice: A National Survey Of Civility Standards And Options For Enforcement, Cheryl B. Preston, Hilary Lawrence Apr 2015

Incentivizing Lawyers To Play Nice: A National Survey Of Civility Standards And Options For Enforcement, Cheryl B. Preston, Hilary Lawrence

University of Michigan Journal of Law Reform

In the last decade, most commentators assume that lawyers’ behavior is now diving to new lows, notwithstanding a flurry of professionalism and civility creeds adopted in the 1980s and 1990s. Proponents of making such creeds enforceable argue that a return to professionalism may improve lawyers’ well-being, restore the public’s confidence in lawyers, and raise the expectations of behavior, not only with respect to civility but also with respect to violations of the Rules of Professional Conduct (hereinafter, as adapted in various jurisdictions, the Rules of Professional Conduct or the Model Rules)

Attitudes Toward A Cancer Coalition: Implications For Coalition Health Communication, Chervin Lam Shih Kian Apr 2015

Attitudes Toward A Cancer Coalition: Implications For Coalition Health Communication, Chervin Lam Shih Kian

Open Access Theses

A cancer coalition is a communication hub for cancer patients that may help address cancer by promoting health and mitigating health issues. Attitudes toward a cancer coalition may be important in determining whether or not patients participate or utilize a coalition. However, little is known about the attitudes of cancer patients toward a cancer coalition, its services, and toward participation. This study addresses this gap by investigating these attitudes. The results encourage the development of a cancer coalition in states that do not yet have a coalition. Effective coalition health communication was found to be a pivotal service that cancer …

When Nurses Are Also Patients: Intimate Partner Violence And The Health System As An Enabler Of Women's Health And Agency In Johannesburg, Courtenay Sprague, Nataly Woollett, Jane Parpart, Abigail M. Hatcher, Theresa Sommers, Shelley Brown, Vivian Black Apr 2015

When Nurses Are Also Patients: Intimate Partner Violence And The Health System As An Enabler Of Women's Health And Agency In Johannesburg, Courtenay Sprague, Nataly Woollett, Jane Parpart, Abigail M. Hatcher, Theresa Sommers, Shelley Brown, Vivian Black

Conflict Resolution, Human Security, and Global Governance Faculty Publication Series

While violence against women is a recognised global health problem, women’s agency in marginalised settings is poorly understood, particularly in relation to health systems. We explored agency as a practical and theoretical construct through qualitative research among 20 nurses with direct or indirect experiences of intimate partner violence (IPV) in Johannesburg. Interviews conducted from August 2013 to March 2014 generated rich descriptions from respondents in five health facilities. Nurses’ self-reported IPV matched national prevalence of 24–31%. Findings revealed the way in which agency is enacted by nurses, allowing them the economic means to leave abusive partnerships, yet disabling them from …

Chevron For Juries, William Ortman Apr 2015

Chevron For Juries, William Ortman

Cardozo Law Review

Chevron U.S.A., Inc. v. Natural Resources Defense Council, Inc. rests on two now-familiar premises. First, for some statutes, the traditional tools of statutory interpretation more readily yield a range of plausible meanings than a single correct reading. Second, judges are not always the officials best positioned to select one interpretation of a statute from among the plausible options. Chevron relied on these premises to decide that when a court finds ambiguity in a statute administered by an agency, it must defer to the agency's interpretation of the statute, so long as it is reasonable. But while administrative law provided a …

Think Like A Businessperson: Using Business School Cases To Create Strategic Corporate Lawyers., Alicia J. Davis

Articles

For the past twenty-five years, my academic and professional pursuits have straddled the line between business and law. I majored in business administration in college and then worked as an analyst in the Corporate Finance department at a bulge bracket Wall Street firm. After completing a JD/MBA, I returned to investment banking with a focus on middle-market mergers and acquisitions (M&A) and subsequently practiced law with a focus on private equity and M&A. Finally, in 2004, I found my current home as a corporate law professor. In my courses, which include Mergers & Acquisitions, Enterprise Organization, and Investor Protection, I …

Transnational Legal Practice [In 2013-2014], Laurel Terry, Carole Silver Apr 2015

Transnational Legal Practice [In 2013-2014], Laurel Terry, Carole Silver

Faculty Scholarly Works

This 2015 Year-in-Review article continues the tradition of collecting and publicizing the developments that occurred during the year related to transnational legal practice (TLP). This year’s article builds on the work set forth in the 2014 Year-in-Review.

The 2014 TLP Year-in-Review provided a departure from the Year-in-Review’s typical method of presentation by identifying two categories of what that article called “TLP-Nets.” One group of TLP-Nets is nationally based and the other is inherently transnational. The 2014 article identified examples of TLP-Nets and highlighted the meeting points and relationships that facilitate border-crossing for the variety of actors involved in TLP policy-making …

The Gospel In Singapore - The Impact Of Civil Religion And Civil Law, Mark Madson Apr 2015

The Gospel In Singapore - The Impact Of Civil Religion And Civil Law, Mark Madson

Doctor of Philosophy Dissertation

Madson, Mark, J. “The Gospel in Singapore: The Impact of Civil Religion and Civil Law.” Ph.D. diss., Concordia Seminary, 2015. 240 pp.

The author explores the development of civil religion in the Republic of Singapore, paying special attention to its sources in English common law, Confucianism, and the Peoples’ Action Party (PAP) ideology of economic pragmatism. Colonial and modern civil religious law, including the Maintenance of Religious Harmony Act of 1990, serve as the basis for analyzing the interaction of the state and traditional religious traditions. The Singapore Story, as told by Lee Kuan Yew and the PAP, provides a …

Self-Represented Litigants, Active Adjudication And The Perception Of Bias: Issues In Administrative Law, Michelle Flaherty Apr 2015

Self-Represented Litigants, Active Adjudication And The Perception Of Bias: Issues In Administrative Law, Michelle Flaherty

Dalhousie Law Journal

This paper advocates for a more active role for adjudicators, one in which they provide direction to parties and actively shape the hearing process. Active adjudication can be an important access to justice tool. Without some direction and assistance from the adjudicator, growing numbers of self-represented litigants cannot meaningfully access administrative justice. Importantly, however, as the role of the adjudicator shifts, so too must our understanding of the notion of impartiality If it is unfair to expect self-represented litigants to navigate the hearing process without adjudicative assistance and direction, it is also unfair to insist on a vision of impartiality …
