Engaging U.N. Special Procedures To Advance Human Rights At Home: A Guide For U.S. Advocates, Human Rights Institute

Human Rights Institute

Social justice advocates in the United States are increasingly using the human rights mechanisms of the United Nations to advance their domestic advocacy on issues ranging from criminal justice to access to health care. These mechanisms offer unique opportunities for U.S. advocates to mobilize grassroots communities, raise public awareness, exert international pressure, and engage with local, state, and national government officials around local human rights concerns. The U.N. special procedures are among the more versatile of the U.N. human rights mechanisms.

This report explores ways in which U.S. advocates are making effective use of the U.N. special procedures. Based on …

Understanding The Experiences Of African-American Relatives Who Serve As Care Providers To Custodial Children In Arkansas: An Intersectional Case Study, Carmen Johnson-Hardin

Graduate Theses and Dissertations

An increase in the provision of long-term care by relative caregivers to custodial children has brought attention to the physical, emotional, and Social challenges of this complex caregiving experience. Prior studies have examined separate structural identities that focus on comparing the quality of life, educational status, Social status, and income of grandparent custodial caregivers. To extend this research, it is important to explore the gaps in service provisions to relative caregivers; comparative viewpoints of relative caregivers and service providers regarding policies and practices; and heterogeneity among Black relative caregivers utilizing an intersectional framework. Face-to-face or telephone interviews were conducted with …

Toward A Synthesis: Law As Organizing, Aaron Samsel Jul 2015

Toward A Synthesis: Law As Organizing, Aaron Samsel

City University of New York Law Review

This paper analyzes tensions within current models of partnership between law and organizing. It draws on the insight developed from recent projects to propose further development of “Law as Organizing” as a new synthesis in which social movement lawyers incorporate organizing principles and techniques into their practice. Part II traces the historical trajectory of public interest lawyering, leading from impact litigation, through rebellious lawyering, and into Law and Organizing. Part III focuses in on “Know Your Rights” trainings as a common site of collaboration between organizers and lawyers, in order to draw out the tension between litigation-oriented and organizing-oriented frameworks …

The Treaty Shopping Practice: Corporate Structuring And Restructuring To Gain Access To Investment Treaties And Arbitration, Julien Chaisse

UC Law Business Journal

This article analyzes the magnitude of the treaty shopping practice and draws relevant theoretical and policy implications for proper rule-making. This fills the gap in the literature, as it is based on a comprehensive survey of tribunal awards to assess the real prevalence of treaty shopping. Also, observing that in all systems of law, whether domestic or international, there are concepts framed in order to avoid misuse of the law; reference may be made in this respect to "good faith" ("bonne foi"), "détournement de pouvoir" (misuse of power) or "abus de droit" (abuse of right), this Article seeks to identify …

The pastor also put Matthew in touch with an acquaintance in Boston, who gave him a place to stay for a short time and encouraged him to apply for asylum. The acquaintance sat down with Matthew and helped him fill out the asylum application form. He told Matthew to be as specific and detailed as possible since that …

Alternative Dispute Resolution For Sustainable Peace: A Pragmatic Proposition, Debasis Poddar Jul 2015

Alternative Dispute Resolution For Sustainable Peace: A Pragmatic Proposition, Debasis Poddar

National Law School Journal

In lieu of formal judicial process under the common law jurisprudence, tools and techniques of alternative dispute resolution (hereafter ADR) - as the same are so called ~ stand way ahead toward peace-building discourse in the contemporary society, as it was earlier. In forthcoming paragraphs. the author strives to articulate with arguments of his own - and corroborate (t)his position that (i) in Its given time and place - the twenty-first century South Asia - ADR, in technical sense of the term, seems a misnomer, because the same stands here in vogue as the mainstream judicious process toward peaceful settlement …

A Case Study Of Irada: Its Impact On The Development And Enhancing The Legitimacy Of Home-Based Businesses In Key Poverty Areas In Jordan, Zaid Hussein Al Attar Jul 2015

A Case Study Of Irada: Its Impact On The Development And Enhancing The Legitimacy Of Home-Based Businesses In Key Poverty Areas In Jordan, Zaid Hussein Al Attar

Theses and Dissertations

Many researchers have investigated the phenomenon of the informal economy and rec-ommended impractical interventions such as controlling the informal economy or formalizing it. However, most research has missed another strategy for helping the informal economy, which involves achieving legitimacy. This study uses unique data from a Jordanian government organi-zation named IRADA designed to help small, home-based businesses. Data on 345 home-based businesses representing a range of poor areas across Jordan provide a case study of IRADA's strategies to help home-based businesses succeed and to contribute to legitimate informal econo-mies in these areas. Logistic regression analysis reveals how marketing and specialized …

Member States Resistance To Eu Foreign Policy Sanctions, Clara Portela Jul 2015

Member States Resistance To Eu Foreign Policy Sanctions, Clara Portela

Research Collection School of Social Sciences

European Union (EU) sanctions are agreed in the Common Foreign and Security Policy (CFSP), a framework where the unanimity rule prevails and where individual Member States have a formal veto. Thus, Member State compliance with sanctions can be expected to be optimal: If Member States have serious objections to the imposition of sanctions, they can veto their adoption in the Council.Yet, while implementation is comparatively satisfactory, Member States have availed of opportunities to undermine the application of EU sanctions regimes at various levels. On the basis of the theoretical framework provided by Saurugger and Terpan, the present article explores various …

Remote Adjudication In Immigration, Ingrid V. Eagly Jul 2015

Remote Adjudication In Immigration, Ingrid V. Eagly

Northwestern University Law Review

This Article reports the findings of the first empirical study of the use of televideo technology to remotely adjudicate the immigration cases of litigants held in detention centers in the United States. Comparing the outcomes of televideo and in-person cases in federal immigration courts, it reveals an outcome paradox: detained televideo litigants were more likely than detained in-person litigants to be deported, but judges did not deny respondents’ claims in televideo cases at higher rates. Instead, these inferior results were associated with the fact that detained litigants assigned to televideo courtrooms exhibited depressed engagement with the adversarial process—they were less …

Panel On Sex Trafficking (Transcript), Cyra Choudhury, Aziza Ahmed, Sienna Baskin, Sandy Skelaney Jul 2015

Panel On Sex Trafficking (Transcript), Cyra Choudhury, Aziza Ahmed, Sienna Baskin, Sandy Skelaney

Faculty Scholarship

AHMED: I am going to speak today about how anti-trafficking efforts are undermining HIV best practices. I hope to explore a series of questions: Why has the anti-trafficking movement become so counterproductive for sex workers? Finally, how do debates on trafficking travel and impact women in countries heavily impacted by HIV?

I thought I would begin by giving a little bit of history and context on the issue of feminism, sex work, and HIV. When HIV was first discovered in the 1980s, the initial response was almost universally coercive and stigmatizing towards the communities that were at high risk for …

Creating New Pathways To Justice Using Simple Artificial Intelligence And Online Dispute Resolution, Darin Thompson Jun 2015

Creating New Pathways To Justice Using Simple Artificial Intelligence And Online Dispute Resolution, Darin Thompson

Osgoode Legal Studies Research Paper Series

Access to justice in can be improved significantly through implementation of simple artificial intelligence (AI) based expert systems deployed within a broader online dispute resolution (ODR) framework. Simple expert systems can bridge the ‘implementation gap’ that continues to impede the adoption of AI in the justice domain. This gap can be narrowed further through the design of multi-disciplinary expert systems that address user needs through simple, non-legalistic user interfaces. This article provides a non-technical conceptual description of an expert system designed to enhance access to justice for non-experts. The system’s knowledge base would be populated with expert knowledge from the …

"His Brain Has Been Mismanaged With Great Skill": How Will Jurors Respond To Neuromimaging Testimony In Insanity Defense Cases?, Michael L. Perlin Jun 2015

"His Brain Has Been Mismanaged With Great Skill": How Will Jurors Respond To Neuromimaging Testimony In Insanity Defense Cases?, Michael L. Perlin

Akron Law Review

A review of the literature on neuroimaging, predictably, reveals a broad array of positions, promises and prophecies. Carter Snead argues that the ambition of cognitive neuroscientists is “to use the claims of their discipline and the new powers conferred by neuroimaging to overthrow retributive justice as a legitimate justification for criminal sanctions.” In this paper, I do not take sides on this debate. Rather, I discuss a related, but distinctly separate issue: which of these positions will jurors think is right, especially in the context of deciding insanity defense cases. The primary and robust debate that has taken place so …
