Citizens, governments and international organizations are beginning to see the vast impacts this issue has not only on the afflicted survivors but also on their families, friends and communities. Part 1 of this series focused on factors influencing payment for patient care services. In Part 2, we review compensation models for nonpatient activity such as medical legal reviews, committee participation, and collaboration with the pharmaceutical industry. Compensation to neurologists in private practice is commonly in the form of guaranteed salary and bonuses. Salary for neurologists in academic medicine has changed considerably over the past 3 decades, from small departments with faculty supported by grants and volunteer faculty, to large departments with faculty split between those with research grant support and those focusing on patient care and teaching. This article reviews what we know about transferring ownership and the right of enforcement of nonnegotiable notes. The focus will be on notes secured by mortgages, since this is likely the context in which most modern nonnegotiable notes are created. There has been a vast amount of litigation about the transfer of negotiable mortgage notes in the past half decade, greatly expanding our understanding, but there has been little development involving nonnegotiable notes. The Admissibility Of Hearsay Evidence In New York State Sex Offender Civil Commitment Hearings After State V. Floyd Y.: Finding A Balance Between Promoting The General Welfare Of Sexual Assault Victims And Providing Due Process Of Law, Brittany K. Dryer

    In twenty states throughout the country, the government may petition for the civil commitment of detained sex offenders after they are released from prison. Although processes differ among the states, the government must generally show at a court proceeding that a detained sex offender both suffers from a mental abnormality and is dangerous and that this combination makes a detained sex offender likely to reoffend. At such court proceedings, both the government and the respondent will present evidence to either the court or the jury on these issues. Law Without Lawyers: Access To Civil Justice And The Cost Of Legal Services, Emery G. Lee Iii

University of Miami Law Review

The high cost of legal services presents a significant access-to-justice problem. In this Article, I argue that this problem is actually two distinct problems—one affecting primarily low- and moderate income persons, and one affecting primarily deep-pocketed corporate defendants. Because the problems are different, they are probably not amenable to a single solution. Most significantly, the Article applies Baumol’s “cost disease” to the rising cost of legal services, thus placing the debate over rising legal costs in a wider economic context

Prisoners’ Rights Lawyers’ Strategies For Preserving The Role Of The Courts, Margo Schlanger

This Article is part of the University of Miami Law Review’s Leading from Below Symposium. It canvasses prisoners’ lawyers’ strategies prompted by the 1996 Prison Litigation Reform Act (“PLRA”). The strategies comply with the statute’s limits yet also allow U.S. district courts to remain a forum for the vindication of the constitutional rights of at least some of the nation’s millions of prisoners. After Part I’s introduction, Part II summarizes in several charts the PLRA’s sharp impact on the prevalence and outcomes of prison litigation, but demonstrates that there are still many cases and situations in which courts continue to …

The Civil Rights Documentation Project (CRDP) vertical file collection was accumulated by Project personnel between 1967 and 1973, the life of the Project. This was part of a two-pronged effort by the CRDP to record oral history interviews with individuals "significantly involved in civil rights activities" and to systematically gather materials such as, handbills, posters,
correspondence, memoranda, minutes of meetings, newsletters, photographs, reports, conference materials, flyers, broadsides, newspaper clippings and journal articles. In 1974 the Project's administrative records, oral history interviews and collection of vertical file materials were donated to the Moorland-Spingarn Research Center of Howard University.

Towards An Institutional Challenge Of Imprisonment For Legal Financial Obligation Nonpayment In Washington State, Devon King

Imprisonment for debt is resurfacing in the United States, primarily in the form of contempt proceedings for failure to pay court judgments. Although Washington’s Constitution prohibits imprisonment for debt, the State repeatedly jails individuals for failing to pay legal financial obligations. This Comment explores the adverse consequences of this de facto debtors’ prison system, describes the strong prohibition on imprisonment for debt found in article I, section 17 of the Washington Constitution, and argues that imprisonment for failing to pay legal financial obligations violates that strong prohibition. Access To Legal Services In Rural Areas Of The Northern Rockies: A Recommendation For Town Legal Centers, Brian L. Lynch

There are two distinct but related issues that affect legal representation in rural areas of the United States: the problem of attracting and keeping private attorneys,1 and the problem of satisfying the immense need for pro bono representation for low-income residents. Although these issues are interrelated—attracting attorneys to rural areas can help satisfy the need for pro bono representation—each state is handling the problems in distinctive ways.
