The Past And Future Of Constitutional Law And Social Justice: Majestic Or Substantive Equality?, David Wiseman

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

This article addresses the past record and future prospects of the relationship between constitutional law and social justice. The exploration of this relationship is framed as a question of the role that constitutional law has played in protecting and advancing a substantive, rather than merely majestic (i.e., formal), conception of equality. After providing an overview of the current state of income deprivation and inequality in Canada, and the implications of this for a constitutional conception of equality, a variety of areas of constitutional law are examined. Immigrants have made outsized contributions to American innovation and entrepreneurship, but the headwinds they face in the U.S. are now driving them to return to their native countries to startup their tech companies.

U.S. immigrants make up only 13% of the country’s overall population, but they have filed over a quarter of the country’s global patent applications, won a third of America’s Nobel prizes in the sciences in the last hundred years and make up over half of all computer science Ph.D. students in U.S. universities. Tanjung Pinang City of the Riau Islands Province (Provinsi Kepulauan Riau) is a transit area for the troubled Indonesian overseas workers from Singapore and Malaysia. The Indonesian National Board for the Placement and Protection of Indonesian Workers (Badan Nasional Penempatan dan Perlindungan Tenaga Kerja Indonesia/BNP2TKI) reported that 15,105 troubled Indonesian overseas workers were deported from January to November 2014 via Tanjung Pinang City. Previous research revealed that citizens of Tanjung Pinang City criticized the treatments given by the local government to the deported workers by reason that they were not the citizens of the Riau Islands Province, yet the local …

Rubicon Programs transformed its programs through recent strategic planning efforts to address the change in their mission that refocuses their goal on the eradication of poverty. The challenge for the design team was reimagining with fresh eyes the organization’s programs and service delivery model by examining what is needed from a holistic approach to move individuals out of poverty; becoming self-sufficient without recidivating back to poverty levels. This focus on moving people out of poverty and increasing sustainable self-sufficiency and not simply finding employment adds a complex level of program design aspects to consider. Hearing Officers' Perceptions Of Their Roles In Welfare Organizations, Karen R. Brown

Little is known about the officials who conduct administrative hearings for aggrieved welfare clients. Hearing officers are charged with ensuring due process for welfare clients, called appellants in the hearing process, who believe that mistakes have been made in their cases and who wish to challenge those decisions. Administrative hearings are one of the few vehicles that afford clients the opportunity to contest welfare policies and procedures. This study explored welfare hearing officers and their perceptions of their roles in conducting hearings.

The government’s lies can be devastating. This is the case, for example, of its lies told to resist legal and political accountability for its misconduct; to inflict economic and reputational harm; or to enable the exercise of its powers to imprison, to deploy lethal force, and to commit precious national resources. On the other hand, the government’s lies can sometimes be helpful: consider lies told to thwart a military adversary or to identify wrongdoing through undercover police work.
