The Reanimation Of The Zombie Genre, William Engel
The Reanimation Of The Zombie Genre, William Engel
Capstones
The following piece is an examination of the evolution of the zombie in popular media. It begins with a brief recap of the zombie’s history, beginning with its roots in 19th century Haitian folklore, followed by its usage in the format of film. The most notable and enduring entries in the zombie film genre served as scathing critiques of contemporary human issues, encapsulating all of the fears and insecurities of its audience. In recent years, however, due to the way the international film market has changed, the zombie film has lost its emotional power and edge. Contemporary zombie filmmakers are …

Kristen Lovell, a black transgender woman and activist, takes precautions everyday as she rides the subway from the Bronx to Manhattan for work. “I know there are people who are intolerant of trans people or have some chip on their shoulder because I exist, and I’m a firm believer in self-defense,” said Lovell, 35, program coordinator at the Metropolitan Community Church of New York. “It could be because I’m black, it could be because I’m trans...they just feel like slicing my face today. I don’t know."

Law, Politics And Legacy Building At The Mclachlin Court In 2014, Jamie Cameron
Law, Politics And Legacy Building At The Mclachlin Court In 2014, Jamie Cameron
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
This article was written for Osgoode Hall Law School’s annual Consti- tutional Cases conference, and provides the keynote overview of the McLachlin Court’s 2014 constitutional jurisprudence. The Court’s 2014 constitutional decisions (Appointment and Senate References; Tsilhqot’in Nation; Trial Lawyers) and restrictions on Mr. Big operations (Hart), in combination with a tsunami of Charter decisions early in 2015 (the 2015 Labour Trilogy; Carter v. Canada; R. v. Nur; and others), made this a legacy-building year. More than an overview, this Article probes the nature of the McLachlin Court’s legacy this year and the relationship between legal and political dynamics, to ask: …
Aboriginal Title And Private Property, John Borrows
Aboriginal Title And Private Property, John Borrows
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
This article explores the relationship between Aboriginal title and private property. In the case of Tsilhqot’in v. British Columbia the Supreme Court of Canada declared that Aboriginal title erased the Crown’s assumed beneficial interest in such lands. The Court was not asked to consider whether private ownership interests were similarly ousted by a declaration of Aboriginal title. This article explores Tsilhqot’in’s unexamined issue and concludes that Aboriginal title could, at times, affect private interests in land and be reconciled with Aboriginal title. This conclusion is based on the Supreme Court’s Constitutional framework which emphasizes proportionality, fairness, reasonableness and reconciliation. Thus, …
Constitutional (Mis)Adventures: Revisiting Quebec’S Proposed Charter Of Values, Dia Dabby
Constitutional (Mis)Adventures: Revisiting Quebec’S Proposed Charter Of Values, Dia Dabby
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
In November 2013, the Parti Québécois introduced the Charter affirming the values of State secularism and religious neutrality and of equality between women and men, and providing a framework for accommodation requests (also known as Bill 60). This proposed piece of legislation would substantially alter how public services are offered and received in Québec. This article argues that this legislative project was much more than a simple law, and rather, as discussed, about reconfiguring the constitutional relationship that Quebecers entertain with the rest of Canada. As such, it engages with the constitutional “misadventures”, as experienced in Quebec in 2013-2014. Drawing …
Safeguarding The Longue Durée: Environmental Rights In The Canadian Constitution, Lynda M. Collins
Safeguarding The Longue Durée: Environmental Rights In The Canadian Constitution, Lynda M. Collins
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
In the modern era, environmental degradation is one of the most significant threats to human well-being and therefore to human rights. Biologically, the right to a viable environment supersedes all other human rights, including the right to life itself. It is not surprising, then, that the vast majority of nations with modern bills of rights have incorporated some form of environmental right or obligation into their constitutions. Respect for the environment is a fundamental value in Canada yet our constitution is silent on environmental rights and obligations. This article will argue that a limited right to environmental protection can nonetheless …
The Damages Directive And Consensual Approach To Antitrust Enforcement, Raimundas Moisejevas
The Damages Directive And Consensual Approach To Antitrust Enforcement, Raimundas Moisejevas
Yearbook of Antitrust and Regulatory Studies
The article focuses on the novelties introduced by the Damages Directive in the field of consensual settlements of disputes concerning private enforcement. The Damages Directive obliges Member States to ensure that the limitation period for bringing an action for damages is suspended for the duration of any consensual dispute resolution process. The Directive also establishes the main principles that govern the effect of consensual settlements on subsequent actions for damages. Since the EU framework for consensual dispute resolution of private enforcement disputes is quite new, many issues must still be solved in Member States’ practice. While analysing consensual dispute resolution …

Modelling And Simulation Of Surface Plasmonic Resonance In Photonic Crystal Fiber / Rifat Ahmmed Aoni, Ahmmed Aoni Rifat
Student Works (2010-2019)
Surface Plasmon Resonance (SPR) refers to the coupling between the electromagnetic wave and the surface plasmonic wave (SPW) on the surface between a metal and a dielectric medium. Since last decade, the SPR behavior is widely applied in prism based SPR sensor, which is bulky and not suitable for remote monitoring applications. To overcome this limitation, photonic crystal fiber (PCF) based SPR sensor had attained great attention with the advantages of easily launching light through the fiber, small-size and design flexibility. To establish the SPR phenomena, metal deposition is necessary. Nowadays, in most of the PCF-SPR sensors, metal is selectively …

How To Throw The Baby Out With The Bath Water. A Few Remarks On The Currently Accepted Scope Of Civil Liability For Antitrust Damages, Agata Jurkowska-Gomułka
Yearbook of Antitrust and Regulatory Studies
The Damages Directive introduces the right to ‘full compensation’ and the principle of ‘joint and several liability’ for antitrust damages (Article 3(1) and Article 11(1) respectively). The Directive does not determine the type of damage that can be awarded in civil proceedings. In theory, there are thus no barriers to establish punitive, multiple or other damages. In practice, it is rather unlikely that such types of damages will be awarded after the implementation of the Directive due to the ban placed on overcompensation in its Article 2(3). This paper will try to decode the concept of ‘full compensation’ and ‘joint …

Georgia’S First Steps In Competition Law Enforcement: The Role And Perspectives Of The Private Enforcement Mechanism, Zurab Gvelesiani
Yearbook of Antitrust and Regulatory Studies
The goal of this article is to assess the role and perspectives of the private enforcement of competition law mechanism in Georgia. The discussion starts with a brief review of a number of major events that have occurred in Georgia in the last two decades, which have shaped its competition law. The paper provides next an assessment of the current stage of the development of Georgian competition legislation, the necessity for a private enforcement model as well as the rules and legal tools offered by existing Georgian law in that regard. Outlined are also a number of challenges that must …

Masae Satouchi is not an average Japanese woman. When she lived in Shiga Prefecture, a country town an hour away from Kyoto, her ex-boyfriends were uncomfortable with her eccentricity. She liked to wear colorful clothes, they didn’t. “I was too colorful to live in Japan,” she says. Japan is, of course, a modern, industrialized nation. The society, however, is famously conservative and does not allow for much unique self-expression. The situation is particularly difficult for Japanese women. Japan ranks 105 out of 136 in global gender gap index. Most women their quit jobs after having their first child.

In April 2015, William Byrd Wilkins or ‘Byrd’, 50, a theatre and television actor, was diagnosed with pancreatic cancer. In August, his friends crowd-funded an all expense paid trip to New York for Byrd who wasundergoing chemotherapy in his rural hometown of Louisburg, North Carolina. Originally described as ‘an opportunity to reconnect’ the trip soon developed into a ‘living funeral’ as Byrd and his friends grappled with Byrd’s terminal prognosis. As he visited his favorite New York haunts and met with friends, Byrd wrestled with the decision to end his chemotherapy upon his return home.

Coyotes have been slowly moving into New York State from Canada since the 1930s. They reached Westchester County and the Bronx decades ago, and their numbers have been slowly rising. Sighting in Manhattan reached an all-time high last spring, and pet attacks in Westchester County have increased slightly in the last several years. But the slight increase in sightings and pet attacks in recent years has been amplified on social media in towns like Chappaqua, New York, where anxiety and fear about coyotes has pitted neighbors against neighbors.

No Sabía Que Tenía Valor”: Uncovering Latina Mothers’ Multiple Literacies, Julia Lopez-Robertson
Journal of Family Strengths
Five Latina mothers were engaged in pláticas literarias/literature discussions about Latino children’s literature at their children’s school. The pláticas served as means to build the links from personal experiences to school learning and to help the mothers recognize that their ways of knowing and making meaning of the world-their multiliteracies-are tools from which their children will and do learn. A community cultural wealth [CCW] framework was employed to identify and make visible the significance of these rich contributions and strengths. Basing the pláticas on texts that interested and were relevant to the mothers and providing them a safe space …
